HomeMy WebLinkAboutRules of Procedure adopted 1970-05-26 by City Council ADMINISTRATIVE RULES OF PROCEDURE STILLWATER PLANNING AND ZONING COMMISSION In all matters referrable to the Stillwater Planning and, Zoning Commission, hereafter the Commission, under the Zoning Ordinance , Comprehensive Plan, or other direction of the City Council, the following procedure shall apply except as exempted by resolution of the Commission at a duly called meeting. 1. All petitions for relief from the strict requirements of the Zoning Ordinance shall submit in writing an application setting forth the specific relief requested under the Ordinance. 2. Such petitions shall be filed with the City Clerk by paying the appropriate fee provided by these rules. The City Clerk shall date the filing of said petition. 3. Petitions filed ten days preceding• a regular scheduled meeting of the Commission will be on the calendar of business of the Commission and continued on such calendar until acted upon by the Commission. 4. All petitions for a variance from the strict require- ments of the Ordinance or a special use permit shall also be accompanied by: a. Plans in duplicate, drawn to scale in black p line or blue print showing the actual shape and dimensions of the lot to be built upon or the use of which variance or special use is being petitioned for in whole or in part. b. Statement oftheexact location, size and height of any building or structure to be erected or altered. C. In the case of a proposed new building or structure , or proposed alterations of an existing building or structure, submit a sketch of the structure as it will appear after the work for which the variance per- mit is sought is completed, showing the front, side and rear elevations of the pro- posed structure. d. Statement of the existing and intended use of each building or structure or part thereof. e. Information relative to the number of families or housekeeping units the building is designed to accommodate and the square footage in each such housekeeping unit. Z. it the petition involves alteration, aaai tions or changes to an existing structure a certificate of compliance with applicable state and municipal regulations dealing with fire and public safety. g. Statement of present use of affected property. 5 . All dimensions required to be shown by these rules shall be related to the location and size of the affected lots and shall be actual dimensions. 6. The petitioner in all cases shall have the burden of persuasion; he shall personally appear before the Commission at the time set for the taking of evidence with respect to his petition. 7. The Commission shall, upon the call of a case, receive all evidence relative to the granting of said petition, includ- ing the impact of said variance or special use permit on adjoin- ing property, and the public health, we and safety. The Commission on its own motion shall determine when it has heard sufficient evidence to render a decision. 8. At the closing of a case with respect to receipt of evidence, the Commission shall render findings of fact and recommendation in writing, together with such portions of the record of the hearing with respect to that case, to the City Council. 9. The Commission shall either recommend that the peti- tion be : a. Granted as requested; b. Granted subject to conditions and safeguards; c. Denied. 10. All special use permits or variances granted shall expire if building pursuant to the request set forth in the petition has not been commenced within six months of the granting of same by the City Council. 11. No petition for variance or special use shall be sub- mitted within one year in identical form of one denied by the City Council. Adopted by the City Council on May 26, 1970.
