HomeMy WebLinkAbout1969-03-25 CPC MIN MINUTES OF PLANNING AND ZONING COMMISSION MEETING DATE: March 25, 1969 Present: Don Carlson Alan Peterson Fred Kalinoff Sid Wihren Ed Simonet John Condon - Chairman and John Lawson-Bldg. Inspector John Condon discussed the request of the City Council that they receive minutes of the Planning & Zoning Commission meeting approximately one week before their meeting so they can be better informed about the commissions ' actions and reasoning. John Condon indicated that the official court reporter (Kirby Kennedy) had offered to do this job for $5.00 per hour. There was discussion that the Planning & Zoning has never used the $100.00 per year that is budgeted for them and that they do bring in some money through fees. Motion by Dr. Kalinoff that the Council be asked to authorize and pay for hiring of a person to take minutes, type them and send them to the Council at a rate not to exceed $5.00 per hour. Seconded by Wihren. Motion passed unanimously. Chairman Condon indicated that he had discussed appointment of Don Carlson to head an Architectural Control Committee. The function of this committee would be to insure that esthetics of the city are preserved as much as possible. When matters are referred to this committee, they will make recommendations to the Planning & Zoning Commission and these recommendations would be included in our recommendations to the Council. These recommendations would then in effect be a part of the building permit and could be enforced by the Building Inspector the same as the building code. (John Condon appointed Don Carlson and Mr. Carlson accepted) . Discussion of our meetings and need to have two meetings to handle many items - one to hear proposal and second to act on proposal after viewing property, etc. -2- Motion by Mr. Simonet to hold two meetings per month for a time at least to determine whether two meetings are necessary. Seconded by Mr. Wihren. Amendment by Dr. Kalinoff to hold meetings on second and fourth Monday each month. Seconded by Mr. Carlson. Amendment passed. Motion passed. Chairman Condon indicated he had asked NSP to donate their pole yard to the City for a park. He stated it would be a good addition to Lowell Park and would eliminate necessity of flood protection for whatever else might be contemplated in the area. Chairman Condon indicated that the Council felt legally obligated to hold public hearings on most matters even though the Planning & Zoning Commission had held a hearing. Since the Planning & Zoning was then not relieving the Council of this burden we were not being as useful as intended. He plans to suggest several changes in the Planning & Zoning law to correct this and other deficiencies and will have the City Attorney work with the Planning & Zoning Commission on these. Chairman Condon discussed a plan to try- to adhere more closely to the spirit of the ordinance in respect to land area requirements but still provide for apartment buildings in all permitted areas. The proposal was that this could be done on a block by block basis through covenants which would guarantee to restrict the density per block to that prescribed by the ordinance. No action was taken. Mr. Laurence Hauge appeared in reference to Case #46, a request for a variance to build a 16 unit apartment house at Third and Linden which had been denied by the Planning & Zoning Commission previously. After discussion a motion by Mr. Simonet that the application would be reconsidered if nine or more additional parking places are provided under the building and would be granted subject to approval of the Architectural Control Committee. In Favor - Carlson, Peterson, Kaninoff, Wihren, Simonet Opposed - Condon -3- Case #47 - Atlas Properties in regard to property at 318 South Brick Street Request for a variance in sideyard of two feet and in land area of 3560 square feet (35.6%) . Motion by Carlson to table action until we can view the property and also to ask Mr. Swanson (Atlas Properties) to appear before the Board. Motion seconded and passed. Meeting adjourned.
