The Chairman related that the meeting was directed to certain questionsand issues affecting the requests of U. S. Homes Corporation, Orin Thompson Division, for certain changes in the plat of Wild Pines as previously approved by the Planning and Zoning Commission. The Chairman outlined the major issues confronting the Commission in terms of proposed plat. changes as follows: 1 . Relocation of the proposed townhouse site and appropriate zoning to facilitate such relocation of townhouses including the addition of a town— house site which abuts the Fair Meadows addition. 2. The issue resolving itself into the request for a blanket variance to permit the developer to place residences within a certain distance of the property line and adjoining houses on adjoin- ing lots. 3. Certain issues in respect to the park and open space to be dedicated to the City of Stillwater .which abuts the Fair Meadows addition and which abuts property owned by Home Owners Assocation of Fair Meadows addition. Robert Steinforff, on behalf of U. S. Homes Corporation, pro- posed that the green space in the proposed development be treated as an "out lot". He stated that there was to be a meeting of the Home Owners Association on August 3, 1971 to discuss the open space in the Home Owners Association and what the home owners in the Home Owners Association may wish to do in re- spect to the open space and whether they wish to continue to maintain it or whether they wish to have it taken over by the city and joined to the property which the developer pro- poses to dedicate to the city. It was proposed by Ray Marshall that the townhouse area which abuts the Fair Meadows addition specifically those housing sites on Oak Ridge Road should have a minimum of a 50 foot setback from the Oak Ridge Road, Fair Meadow's properties. A discussion ensued in respect to this proposal . The new townhouse sites proposed by the developers was dis- cussed. There seemed to be a general approval of the relocation. There was a discussion as to the manner of development and whether the assurances of the developer in respect to open space in the townhouse site areas would be sufficient without formal control on the part of the city. A discussion ensued in respect to the side yard variances. Discussion of the blanket variance followed. It was proposed that a five foot side yard on the garage side and a 15 percent of the front yard widish of thelot be required on the house side in respect to the new development. Harold Hohlt voiced disagreement with proceeding in the piece meal manner. He voiced the opinion that the entire development should be handled as a planned unit development and that the city should postpone any action onthe proposed changes until such time as. a planned unit development ordinance is in effect. He stated that without a planned unit development ordinance, the city, for most practical purposes, loses control . Ray Marshall indicated that it was his opinion that most of these matters could be covered via a contract which will be entered into between U. S. Homes Corporation and the City in respect to the street development bond, et cetera. The Chair having been informed that several members of the planning Commission were unable to make this special meeting, he postponed until a special meeting to be held August 6, 1971 , at 4:30 P.M. , any final action in respect to these matters. Wihren P 7:30 R. Marshall The meeting was called to order by chairman, Duane Arndt. The chair entertained the motion for approval of last meeting's minutes. Balfanz seconded; all in favor. Petition to make certain modifications on preliminary plot of o Wildpines area was mentioned. This item will be brought up at a special meeting one 'week from tonight, Monday, July 26, at 7:30. Item #1 - Petition for certain portions of East School Street to be vacated. Mr. Dan MacDonald,of 118 East Laurel, and Mr. Wade Green,of 116 East School Street,were present to represent this matter. Balfanz moved that comments of the City Attorney be obtained and reported back at the next regular meeting. Hohlt seconded the motion. Item #2 - Case #104 - Petition for Varience - Mr, James Steele, property owner of the corner of Sherburne and Oak Streets. Chair tabled motion to next meeting. Balfanz seconded; all in favor. There is to be a hearing by the Minnesota Municipal Committee on August 11, 1971. Oak Park property owners have petitioned annexation of the strip of property on highway #212 to Greeley Street extension. Condon moved that Chairman Arndt attend this meeting and discuss with them some of his viewpoints on the subject Wihren seconded. Chair entertained motion to adjourn, Condon seconded; passed.
