The meeting was called to order by Chairman Arndt. The Chairman stated
that the meeting would be directed to the following matters.,
1. Mulberry Street Vacation
2. Consideration of the revision of Ordinance 383 in respect to
special use pernitz and the petition of Sheldon Snaith .
3. Consideration of approval of preliminary plat 398 regarding
Cochran's Long Lake Addition - A. B. Jackson.
4. Changing regular meeting date.
The Chairman made a motion to approve the minutes of the August 2nd Special
Meeting as printed. Seconded by Friedrich. Unanimously Carried.
Mulberry Street Vacation:
Mr. 1� rshall stated that the Margaret Rivers Foundation contemplates iTakir
a grant or providing construction funds for certain renovation and new con-
str-action at the Public Library® The Lib=y has asked the City of Stillwater
to vacate a certain portion of Mulberry Street between 3rd and 4th Street.
All property owners involved, with the exception of one gentleman on Third
Street, have signed the patition. This gentleman will have access off of
firth Street and the City has Ew-7=,nteed him snowplowing. He could also be
granted an easement through the fArkin.- lot. Additionally, Mulbersnj Street
is sc.)-.,eduled 'for.storzi sower separation which would go into i'l-ho, par.�kin.,, lot.
I'his would be assessed to everybody in the area. Discussion concerned,
cont-acting the gontleman on Thii�d and Mulberry. Felt it would be bel-t-or
if he also OK'd the vacation. It was decided to get n.ore infoyT.iation from
the 1,.ar arot Rlivers Foundation before deciding. A motion was riladc Hohlt,
seconded by Mr. Co-radon to table this matter until the me;tiro; of Augu�t 23rd.

Proposed amondment to the Zoning Ordinance .383, Section 14, Subsection 2,
Section 15, Subsection 2 - Froposal to permit an additional class -be be

industrial uses found not to be objectio-nable in the neighborhood located in.

This is not an allowable use. To rectif_'y this, -the following could be done:
(1) Rezone; (2) Adopt special use permit; or (3) Close down shop. Since a
sheet �,.,ietal shop is now operatin�Z in violation of permit, a motion was mafie
by Condon, seconded by Kalinoff that: We recommend to the City Council that
the City Cc-ordinator ara/or Susiness Inspector be instructed to close down
that ope2nation. Motion Fails. Discussion followed regarding enforcement
of other violations.
Mr. Smith testified that for the past 25 or 30 yearsappzoxi.�,,�a-tely the
type of use has been made of this propel-ty by various companies. A
motion was made by Iuihren, that the proposed amen"Ime-n1c, be adopted. No second.
Motion dies. Chairman Arndt stated t at at this point the following, could
be done: (1) Reconuiend that the ordinance revision be passed-
, (2) Rezone;
(3) Create a special use permit Section F for sheet metal shops. Discussion.
If the Ordinance is revised, some flexibility can be put into the ordinance.
The spacial use category is vory restrictive. Perhaps it cot,Id be broadened
up. The City can always put restrictions on special use permits. In re-
zonin,g, you lose all control. A special use permit can also be given to
an in;ividual with restrictions. A motion to grant a speciial use - r-,1 it

and consideration. It should apply to all use districts, excajt family.
