It was felt that the Planning Commission needed more information
onland use in the area. Mrs. True offered to put together a program of

In re: Charles J. Salmore - FINDINGS OF FACT
Request for Variance.
The Planning and Zoning Commission of the City of Stillwater, upon
the request of Charles J. Salmorre for a Variance (said request having .
been duly filed and upon the calendar, having come on for hearing on
the 2nd of October, 1972,) on hearing the evidence and being duly advised
with respect to this petition, makes the following Findings:
1. The Petitioner is the owner of a contiguous lot adjoining
other property that the Petitioner occupies as his residence.
2. That the lot in question is forty (40) feet in width and one
hundred thirty-five (135) feet in depth for a total square footage of
5,4.00 feet.
3. Petitioner desires to build a single family dwelling on said
premises. That the proposed dwelling to be constructed would be eighteen
(18) feet from the adjoining house on the one side and nineteen (19) feet
from, the house on the opposite side.'
4. That the Petitioner proposes to construct a tuck-under garage
which, due to the narrowness of the lot, would be physically impossible
to enter without trespassing upon the adjoining property.
5. That the proposed dwelling structure would be unduly close to
other structures in the neighborhood and that construction in the area
in violation of the Zoning Ordinance would merely perpetuate and accentuate
already existing problems in this older district.
6. That the proposed development would not be in keeping with the
surrounding area and in general would be very poor land use planning.
7. That the Petitioner's property is substantially short in respect
to required land area under the Zoning Ordinance and that the -requested
variance is much more than minimal. That granting a variance of the
amount requested would make it very difficult for the Planning and Zoning
Commission at any time in the future to enforce land use requirements of
any type.
THEREFORE, The Planning and Zoning Commission of the City of
Stillwater recommends that the Variance be denied.

for Special Use Permit.

a The Planning and Zoning Commission of the City of Stillwater, upon
the request of Janet Corbo for a Special Use ,Permit (said request having
been duly filed and upon the calendar, having come on for hearing on the
2nd of October, 1972, ) on hearing the evidence and being duly advised with
respect to this petition, makes the following Findings
j 1. That the Petitioner desires the issuance of a Special' Use
Permit for purposes of operating a beauty shop.
2. That th ''Planning and Zoning Commission finds that under the
terms of the present Ordinance no Special Use Permit can be issued for
' a beauty shop within this zoning district.
3. That the Planning and Zoning Commission has been presented
on at least three occasions within the past thirty months with requests
for Special Use Permits to operate beauty shops in residential districts
in the City where same are not presently permitted.
4. That the Planning and Zoning Commission believes that additional
flexibility is desirable in ascertaining placement of business establish-
ments such as a beauty shop or other businesses run out of homes which
do not adversely affect surrounding property or create unusual traffic
situations.

-Stillwater recommends that the Zoning Ordinance be amended to provide
for additional .classes of special use permits in R.B. and R.A. residential
districts.

Request for Variance
The Planning and Zoning Commission sof the City of Stillwater, upon
the request of Richard McKnight for a 'Variance (said request having been
duly filed and upon the calendar, having, come on for hearing on the 2nd
of October,) on hearing the evidence and being duly advised with respect
to this petition, makes the following Findings:
1. That the Petitioner desires to build a duplex in such manner
as to require a variance of twelve (12) feet in respect to the backyard
variance.
2. That the Petitioner's proposed development would be in conformity
with the surrounding area and generally an improvement to the real estate
consistent with the adjoining land uses.

3. That the proposed development provides adequate space for any,
occupied dwelling units.
4. That the placement of the proposed duplex structure is generally
consistent with other properties in the area and that a twelve (12) feet
backyard variance would be compatible with the manner in which the structure
would be placed on the property.
5. That the Petitioner should place the front of the structure
(sideyard) at least twenty-two (22) feet from the property line.
6. That opinions of adjoining property owners should be ascertained
in respect to the proposed development.
THEREFORE," The Planning and Zoning Commission of the City of Stillwater
recommends that the variance be granted subject too
1. That the proposed front entrance to said duplex structure
(facing Martha Street) be not closer than twenty-two (22) feet from the
property line on Martha Street.
2. That there be no objection on the part of adjoining property
owners of a substantial and proprietary nature.

the request of Clarence Johnson for a Variance (said request having been
duly filed and upon the calendar, having come on for hearing on the 2nd
of October, 1972,) on hearing the evidence and being duly advised with
respect to this petition, makes the following Findings
1. That the Petitioner desires to enlarge an existing garage
structure changing same from a single car to a double car garage.
2. That the proposed garage change will be an improvement to the
esthetic appearance of the Petitioner's property and would generally
constitute an improvement to the neighborhood.
3. That along with the construction of the garage, Petitioner
will purchase a four (4) foot strip of additional property from the
adjoining property owner.
4. That the Petitioner has agreed to supply an adequate deed
evidencing purchase of said property and tosubmit a registered land
survey in respect to said, additional property purchased.
THEREFORE, The Planning and Zoning Commission of the City of
Stillwater recommends that the Variance be granted to construct a garage
within less than five (5) feet of the sideyard, subject tot
1. Petitioner supplying evidence satisfactory to the City iby Deed
of the purchase' of additional property of not less than four (4) feet.
2. Submission of a registered land survey in respect to the property
lines after purchase of the property.
