CITY OF STILLWATER
August 7, 1972 - Regular Meeting

The meeting was called to order by Chairman Arndt. Mir. Arndt indicated
he had received the resignation of Melvin Friedrich from the Planning and
Zoning Commission. Chairman Arndt declared that a quorum was present in
that over fifty percent of the present membership of the Planning Commission
is present.
Vacation of a portion of Niaryknoll Drive
A motion was made by Balfanz, seconded by Shelton that the Planning
and Zoning Commission recommend granting the vacation, providing the City
have a thirty (30) foot right-of-way easement for future hook-up for the
sewer. Motion Carried.
Case No. 120 - Swager Bros. , Inc. - Special Use Permit and Variance on
North Owen Street
A motion was made by Balfanz, seconded by Condon that this matter be
referred to the building inspector on the ordinance and Swager Bros. can
come in later with site plan. Motion Carried.
Case No. 125 - Swager Bros. , Variance in Lot Area at 815 South Seventh St.
A motion was made by Condon, seconded by Shelton that the Planning and
Zoning Commission recommend approving the variance for severance of a portion
of Lot 25 attaching same to Lot 24 and grant a five hundred (500) square foot
variance from the Zoning Ordinance for purposes of construction of a house
of the diminsions of 24• by 4.0 feet. The house constructed shall comply
with the normal side yard and set back requirements of the Zoning Ordinance.
Motion Carried.
Case No. 122 - Michael W. Dunn, 1214 N. 1st St. - Variance for a garage in
the front yard.
A motion was made by Balfanz, seconded by Condon that the Planning and
Zoning Commission recommend that a variance be granted permitting Mr. Dunn
to construct a garage at such a position on his lot as to permit sane to be
constructed not closer to the existing street than the front line of the
existing dwelling house and not closer than fifteen (15) feet to the South
property line. Motion Carried.
Case No. 123 - Kenneth E. Raschke, Variance request at 1205 West Linden St.
Case stricken. No one appearing.
Case No. 124 - Roger Hilde variance permit for a swimming pool at 705
West Orleans Street
A motion was made by Condon, seconded by Balfanz that the Planning
and Zoning Commission recommend that a variance be granted to construct a
swimming pool in the side yard, providing that adequate chain link fencing
be installed and providing that screening to camouflage and otherwise make
as unobtrusive as possible said necessary fencing be used. Further provided
that said pool be constructed not closer than ten (10) feet from the South
property line and that any filter system be as close to the dwelling house
structure as possible. Motion Carried.
Barbara Charlsen, 1030 Fourth Avenue South - Antique Shop
A motion was made by Condon, seconded by Balfanz that the Planning
and Zoning Commission recommend that a special use permit be granted, subject
to the following:
1. Petitioner be restricted to operating an antique shop.
2. Petitioner be limited to the employment of one person other than
herself as proprietor.
3. Petitioner be required to provide a minimum of six (6) off street
parking spaces for customers.
4. That the hours of operation be restricted to three (3) days per
week and by appointment.
5. That the Petitioner be restricted to the use of one unlit advertising
sign advertising her premises.
Paul Liberty, Sr. , 1807 West Olive Street - Service Station
Found to be operating within the Ordinance.
Juel Mickelson, 1120 North William Street - Automobile repair garage -
Did not appear.
Mr. Marshall was directed to be sure that a warning ticket was issued to
Mr. Peaslee.

A motion was made by Condon, seconded by Balfanz that the meeting adjourn.

In re: Vacation of a portion
of ;,iaryknoll Drive FINDINGS OF FACT
The Planning and Zoning Commission of the City of Stillwater, upon
the petition of T & L, Inc. for a vacation of a portion of Maryknoll Drive
(said petition having been duly filed and upon the calendar, having come on
for final hearing on the 7th of August, 1972) on hearing the evidence and
being duly advised with respect to this petition, makes, the following
Findings:
1. That the platted street will dead end at the point where it
adjoins Wildpines First Addition and that further continuance of the
platted street will serve no public purpose.
2. That Maryknoll Drive as presently in use terminates at the
intersection of Oakridge goad and that no further development is planned
on Maryknoll Drive and that maintenance of that portion of the right-of-way
which is undeveloped would not serve the best interests of the City.
3. That in the future sewer service may be extended down that portion
of Maryknoll Drive to connect with sewer at Wildpines I and that access for
such sewer construction is necessary.
4. That minimum easements for construction purposes are twenty (20)
feet and that frequently such easements are too narrow and because the
sewer at that portion of the City is extremely deep, that maintenance of a
thirty (30) foot easement would serve the best interests of the City.
THEREFORE, the Planning and Zoning Commission of the City of Stillwater
recommends that the vacation be granted subject to the securing by the City
of a permanent easement for sewer construction and maintenance purposes to
a width of thirty (30) feet.

In re: Swager Bros. , Inc. -
Variance in Lot Area - 815 South FINDINGS OF FACT
Seventh St.
The Planning and Zoning Commission of the City of Stillwater, upon
the petition of Swager Bros. , Inc. for a Variance (said petition having
been duly filed and upon the calendar, having come on for final 'nearing
on the 7th of August, 1972,) on hearing the evidence and being duly advised
with respect to this petition, makes the following Findings:
1. The Petitioner is the owner of Lots Twenty-four (24), Twenty-
five (25) and Twenty-six (26), Block Seven (7), Churchill, Nelson &
Slaughter's Addition to the City of Stillwater.
2. Lot Twenty-five (25) has an existing structure on it, and said
above mentioned lots are Forty (4.0) feet in width.
3. The Zoning Ordinance of this portion of the City of Stillwater
designates this district a two-family district and requires a minimum of
Seven Thousand Five°Hundred (7,500) square feet for building site purposes.
4. The Petitioner desires to acquire an additional building site on
Lots Twenty-four (24), Twenty-five (25) and Twenty-six (26).
5. These platted lots render it difficult to acquire an additional
building site without splitting lots and severance of the South Ten (S. 10)
feet of Lot Twenty-five (25) and attaching same to Lot Twenty-four (24) will
cause a Seven Thousand (7,000) square foot land area to be available.
6. Existing lot sites in the general vicinity of Petitioner's property
are of a similar area and will not be adversely affected-by permitting a
Seven 'Thousand (7,000) square foot building site.
TFDLiREFORE, the Planning and Zoning Commission of the City of Stillwater
recommends that the Petition for severance of a portion of Lot Twenty-five
(25) attaching same to Lot Twenty-four (24) be granted and that the Petitioner
be granted a Five Hundred (500) square foot variance from the Zoning Ordinance
for purposes of construction of a house of the dimensions of Twenty-four (24)
by Forty (4.0) feet, and further providing that the house constructed shall
comply with the normal side yard and set back requirements of the Zoning
Ordinance.

In re: Michael W. Dunn - FINDINGS OF FACT
Variance
The Planning and Zoning Commission of the City of Stillwater, upon
the petition of Michael W. Dunn for a variance (said petition having been
duly filed and upon the calendar, having come on for final hearing on the
7th of August, 1.972,) on hearing the evidence and being duly advised with
respect to this petition, makes the following Findings:
1. The Petitioner owns Lot Two (2), Block Seventeen (17) , Carli and
Schuianberg Addition and desires to construct a garage unattached in
variance from the ordinance requiring same to set behind the rear line
of the dwelling house.
2. Petitioner's property has a rise substantially above the existing
street grade and thereafter falls off toward the rear of the lot rendering
it difficult to construct a garage at the rear of the house.
3. Petitioner desires to construct a garage of masonary type with
a partial excavation of the garage site to avoid the necessity of
constructing a steep driveway.
4. The Planning Commission has discussed the location of the garage
and the fact that the petitioner is desirous of retaining certain trees on
the site in placement of said garage structure.
5. A garage of the type Petitioner desires to construct can be
constructed at the front line of Petitioner's dwelling house and extending
back therefrom without substantial detriment to adjoining property owners.
6. A garage whose front line is that of the existing dwelling will
not cause a traffic hazard to the existing street.
7. Petitioner is agreeable to removing a certain Elm tree to permit
placement of the garage at a line not closer than the front line of the
dwelling house and not closer than fifteen (15) feet to the South property
line.
THEREFORE, the Planning and Zoning Commission of the City of Stillwater
recommends that a variance be granted permitting Petitioner to construct a
garage at such a position on his lot as to permit same to be constructed not
closer to the existing street than the front line of the existing dwelling
house and not closer than fifteen (15) feet to the South property line.

Variance FINDINGS OF FACT
The Planning and Zoning Commissicn of the City of StJ.l.lw,,).ter, upon
the petition of Roger and Dawn Hilde `or a variance (said powition having
been duly filed and upon the calendar, having cor�jo on for final hearing on
the 7th of August, 1972,) on hearing the evidence and being duly advised
with respect to this petition, makes the following Finding:;;
1. Petitioner desires to construct a permanent swimming pool structure
on the side yard of his premises.
2. The slope of Petitioner's property is such that to construct a
swimming pool at the rear of said property would require substantial fill.
3. Petitioner can more adequately screen and use said swimming pool
by constructing same at the side yard.
4. Construction of a swimming pool in the side yard would not
adversely affect the use of the adjoining property and would not cause a
substantial noise factor to the adjoining property owner.
5. The adjoining property owner's garage is on the side of Petitioner's
property where he proposes to construct said swimming pool.
6. Petitioner has agreed to construct and maintain chain link fencing
to prohibit access to said swimming pool area, and Petitioner has agreed
to provide certain screening to camouflage and otherwise make less obtrusive
the chain link fencing.

In re: Barbara Charlsen - FINDINGS OF FACT
Special Use Permit
The Planning and Zoning Commission of the City of Stillwater, upon
the petition of Barbara Charlsen for a special use permit (said petition
having been duly filed and upon the calendar, having ,come on for final
hearing on the 7th of August, 1972) , on hearing the evidence and being
duly advised with respect to this petition, makes the following Findings:
1. Petitioner currently operates an antique shop at 1030 Fourth
Avenue South in an area zoned two family.
2. Petitioner's operation is not of a commercial type which is
obtrussive to the neighborhood.
3. Petitioner desires to continue to operate said business on
the same basis that she has operated same in the past and requires a
special use permit and agrees to operate same under certain conditions
as the City may set forth in the special use permit.
THEREFORE, the Planning and Zoning Commission of the City of Stillwater
recommends that the special use permit be granted, subject to the following:
1. Petitioner be restricted to operating an antique shop.
2. She be limited to the employment of one person other than herself
as proprietor.
3. The Petitioner be required to provide a minimum of six (b) off
street parking spaces for customers.
4. The hours of operation be restricted to three: (3) days per week
and by appointment.
