DATE: June 7, 1976 MEMBERS PRESENT: Martin Hansen Russell Meister Ann Bodlovick Charles Swanson Ronald Kiel Jeffrey Zoller APPROVAL OF MINUTES Chairman Martin Hansen called the meeting to order. He noted that the next meeting will be July 12, 1976. Russell Meister moved that the minutes of the May 10, 1976 meeting be approved as submitted. The motion was seconded and passed unanimously. SPECIAL USE PERMITS Case No. 231. Applicant: Patrick Geiger. Address of Property: 324 South Third Street. Permit to add two apartments to lower level. Mr. Geiger stated that most of the work has been completed. The project started out on a small scale basis and developed into major remodeling before he obtained a building permit. The building originally contained six units and was converted to four units on each level. Mr. Geiger stated that there will be room for the parking of four cars when the garage to the rear is torn down. Discussion followed as to the inadequate number of parking spaces. Ordinance dictates two parking spaces per unit. Charles Swanson questioned the fact that Mr. Geiger had not obtained a build- ing permit before completing the addition of the two apartments. Mr. Geiger replied that he had not anticipated the extensive remodeling when he started the project. Jeffrey Zoller moved that the Stillwater Planning Commission grant a Special Use Permit to .Patrick Geiger to add two apartments to the lower level at 324 South Third Street, with the following restrictions: (1) That he must tear down the garage to the rear of the building to provide a minimum of four parking spaces within 45 days from the date of Council approval of the permit= (2) that he obtain a Building Permit and that the Building Inspector inspect the apartment building. The motion was seconded and passed with one negative vote-by Charles Swanson. The Commission objected to the fact that a Building Permit was not obtained prior to remodeling. Case No. 232. Applicant: Dgrward E. Minks. Address: 1105 South 4th Street. Variance to build a 16' x 26' garage in rear yard within 1 foot of southerly property line. Mr. Minks showed the Commissioners drawings of his plans. He stated that he had informed his neighbor of his plans, and the neighbor had no objections. Stillwater Planning Commission Minutes June 7, 1976 Page Two Charles Swanson moved that the Stillwater Planning Commission recommend that a variance be granted to Durward E. Minks to build a 16' x 26' garage in the rear yard one foot from the southerly property line at his address of 1105 South 4th Street. The motion was seconded and passed unanimously. The public hearing date will be June 22, 1976. Case No. 233. Applicant: Norris Danielson. Address: 511 W. Aspen Street. Variance to build a 24' x 24' garage in side yard on east side of dwelling. Mr. Danielson's home is on a corner lot. His driveway will go to Aspen Street. Jeffrey Zoller moved that the Stillwater Planning Commission recommend the granting of a variance to Norris Danielson, 511 W. Aspen Street, to build a 24' x 24' garage in the side yard on the east side of his home. The motion was seconded and passed unanimously. The public hearing date will be June 22, 1976. Case No. 234. Applicant: Randall J. Boyle. Address: 314 North Fourth St. Permit to operate an interior design business from his residence. Mr. Boyle stated that he plans to do the bookkeeping and paper work in his residence. He is establishing his residence as a place of business for tax purposes. It will be a part-time business. Mr. Boyle stated that he will have no signs on his residence. There will be no inventory of goods at the residence. Charles Swanson moved that the Stillwater Planning Commission recommend that f a Special Use Permit be granted to Randall J. Boyle to operate an interior design business from his residence at 314 North Fourth Street, with the following restrictions: (1) If at some future date Mr. Boyle installs an advertising sign at his residence, the sign will be non-illuminated and no larger than 2' x 2' = (2) no inventory of goods for sale will be kept at the residence= and (3) the Permit will expire after one year, at which time it will be considered for renewal. The public hearing date will be June 22, 1976. Case No. 235. Applicant: Mary Erickson. Address of Property: 1020 North Owens Street. Permit to operate an antique shop in garage north of dwelling. This case will be postponed until the next Commission meeting. VACATION OF A PORTION OF OAKES STREET Chairman Martin Hansen briefed the Commission on what had transpired at the last Council meeting in regard to the vacation of a portion of Oakes Street. It was noted that there was 'not sufficient information regarding the properties involved. Stillwater Planning Commission June 7, 1976 Page Three Jeffrey Zoller moved that the Stillwater Planning Commission recommend that a portion of Oakes Street not be vacated due to the fact that there would be inaccessible lots. The motion was seconded and passed unanimously. UNDEVELOPED LOTS WITHOUT SEWER SERVICE The Commissioners reviewed the material from the County Planning Department in regard to ordinances in effect for lots without central sanitary sewer. Charles Swanson noted that the County is in the process of coming up with a new and revised soils map for the entire county. Chairman Martin Hansen suggested that the Commission get information from Jack Shelton as to which areas in Stillwater are unsewered. He stated that perhaps these areas should be classified as unbuildable. Charles Swanson stated that he will contact Bill Schwab for his recommendations in regard to unsewered lots. DOWNTOWN PARKING Jeff Zoller recommended that the Commission obtain a report from the Parking Committee to find out what has transpired in regard to the City's plans to purchase property for parking facilities. AMENDMENTS TO HIGH DENSITY MULTIPLE DWELLING ORDINANCE Jeffrey Zoller noted that he had discussed the amendments with Mr. Kimmel, who suggested giving copies to some of the local architects for their reactions. It was also suggested to Jeffrey Zoller that he contact Carl Dale and the City of White Bear for more ideas. He will do this and report back to the Commission at a later date. OTHER BUSINESS Jeffrey Zoller noted that it was his understanding that the Planning Commission would consider and approve or disapprove of any constr4iction with a value over $500 in the downtown area. He stated that he felt the plans for the Galley at the north end of Hooley's parking lot should have come before the Commission. Mr. Zoller felt that the Commission should recommend passage of an ordinance stating the Planning Commission must consider improvements to existing construction or new construction with a value over $500, if in fact such an ordinance is not in exist€ince. Mr. Zoller will contact Harold Kimmel to determine if such an ordinance is in effect. i Stillwater Planning Commission Minutes June 7, 1976 Page Four Chairman Martin Hansen noted that the applications for special use permits and variances were being submitted to the City within & very short time before the Commission meetings. He stated that a limit should be set as to the number of days an applicant must apply for his permit or variance prior to the Commission meetings. It was decided that a limit of 10 days prior to Planning Commission meetings be set asoa deadline for the submission of permit and variance applica- tions. The Secretary will inform Dorothy Schnell of this, and she will include this information in the monthly newsletter to citizens. ADJOURNMENT The meeting adjourned at 9:15 P.M. i z
