DATE: August 2, 1976 ®rCB�RS PRESENT: Martin Hansen Jack Shelton Ann Bodlovick Charles Swanson Chris Madsen Jeffrey Zoller Russell Meister APPROVAL OF MINUTES Chairman Martin Hansen called the meeting to order. Ann Bodlovick moved that the minutes of the July 12, ,1976 meeting be approved as submitted. The motion was seconded and passed unanimously. SPECIAL USE PERMITS Case No. 218. Applicant: Deanna Storbakken. Address: 301 Maryknoll Drive. Variance to locate swimming pool in partial side yard. The Commissioners examined a drawing of the placement of the proposed pool. Mrs. Storbakken stated that the neighbors have no objections to the location of the pool. Russell Meister moved that the Stillwater Planning Commission recommend that Mr. and Mrs. Gary Storbakken be granted a variance to locate a swimming pool in their partial side yard at 301 Maryknoll Drive. The motion was seconded and passed unanimously. Case No. 243. Applicant: Robert J. Monahan. Address of Property: 1819 West Pine Street. Variance for construction of new home. Mr. Monahan stated that the tuckunder garage will be off of Pine Street and Pine Street will also be along the front yard. Jeff Zoller asked Jack Shelton if there would be a problem in the future if a street were to be put through on Oakes Street. Jack Shelton stated that the City may need a temporary slope easement from the owner, but there should be no problem. Jeffrey Zoller moved that the Stillwater Planning Commission recommend that a 10' side yard variance be granted to Robert J. Monahan to construct a now home at 1819 West Pine Street. The motion was seconded and passed unanimously. Case No. 245. Applicant: Karl J. Karlson. Address: 1315 S. 4th Street. Variance to put a garage in side yard. Mr. Karlson stated that his garage will be 3' from the property line. The Commissioners examined the sketch showing the location of the proposed garage. Jeffrey Zoller moved that the Stillwater Planning Commission recommend that a variance be granted to Karl J. Karlson, 1315 S. 4th Street, to locate a garage in his side yard.. The motion was seconded and passed unanimously. Stillwater Planning Commission Minutes August 2, 1976 Page Two Case No. 247. Applicant: John Lengyil. Address: 2209 Oak Ridge Road. Variance to build an attached garage on west side of house. Mrs. Lengyil noted that there will be a walkway between the neighbor's carport and the proposed garage. She stated that the neighbor to the west has no objections to the location of the garage. She is asking for a 3' variance. The garage will be 21' wide, which will be 2' from the property line. Charles Swanson moved that the Stillwater Planning Commission recommend that a 3' variance be granted to John .Lengyil, 2209 Oak Ridge Road, to build a 21' attached garage. PETITION TO VACATE A PORTION OF ABBOTT STREET Mr. and Mrs. Steve Marlowe and Mr. and Mrs. Bell were present at the meeting to discuss a petition to vacate a portion of Abbott Street. The Commissioners examined the plat of the property in question. It was pointed out that there will be some opposition to the vacation by the owner of undeveloped lots adjacent to the street. The Commissioners were told of the litter and diseased elms located on the vacant lots. It was noted that the owner of the property could be instructed to clean the property, or the City could clean it and bill the owner. After further discussion, Charles Swanson moved that the Stillwater Planning Commission recommend that the easterly 100' of Abbott Street be vacated. The motion was seconded and passed unanimously. DOWNTOWN PARKING Representatives of the Downtown Retailers Parking Committee, Mr. Jeans and Mr. Thompson, were present at the meeting. Mr. Jeans stated that they had held a meeting that morning and expressed the opinion that they would favor the highway bypass route which would be located on the east side of the railroad tracks between the tracks and the park. He noted that the street would have to be elevated because of the flood plain. Charles Swanson pointed out that the bypass should ideally be a one way going north, so that a signal will not be necessary by the NSP building. A general discussion of the downtown parking problem followed. It was felt that effective parking would have to be one block from Main and Chestnut. Ann Bodlovick noted that there will be a meeting on the highway bypass subject at Holcomb's on September 2 at 11:30, which the members of the Planning Commission could attend. w Stillwater anCommission Minutes August 2, 1976 Page Three PLANNED UNIT DEVELOPMENT M . Art Palmer stated that he felt perhaps it would be advantageous to adopt Planned Unit Development for the Second and Mulberry Street area. Mr. Palmer showed the Commissioners outline f the property in question. A discussion followed to the advisability of a PUD. It was felt it may be of benefit to create a PUD for two blocks--Commercial, Main, Second, Mulberry, west side of Second to Third. It was pointed out that if Dominion does go ahead with its plans for elderly housing, under a PUD Dominion would have to come before the Planning Commission for approval of their plans. Jeffrey Zoller suggested that the Planning Commission consult Harold Kimmel to ascertain if the two blocks in question can come under a PUD, and if they can the Planning Commission will support such an endeavor. He noted that once a PUD is created, a concept plan will have to be developed. Mr. Palmer asked to be included on the September 13 meeting agenda. LONG RANGE COMPREHENSIVE PLANNING Chairman Martin Hansen noted that Bill Schwab will explain to the Council what it must do in regardto comprehensive planning, and the Planning Commission will either accept Mr. Schwab'srevise it. Chairman Hansen noted that there will be a meets 4:30 P.M. in the Council Chambers on Tuesday, August , in this regard. Chairman Hansen noted that the courts have been making some rulings on various items controlling comprehensive planning in differtnt cities. Cities are not allowed to restrict growth, but they can implement procedures which will delay it, such as providingfor a two-year freeze for residential zoning unless the developer contributes to a share of the school costs, or stipulatingthat all zoning matters be approved t a general election. OTHER BUSINESS Chairman Hansen noted that there will be a meeting of the Joint Powers Planning and Zoning Committee August 18 at 7:00 P.M. in the Washington County Board Room, in regardto the Croixgate and Holey developments on Highway 212. He stated that the Stillwater Planning Commission can issue formal or informal statements concerning any business coming beforethe Joint Powers Planning Committee. ADJOURNMENT The meeting was adjourned at 10:45P.M.
