Chairman, Tom Farrell called the meeting to order at 7:30 owing to the
fact that it was necessary to wait until that time for the quorum of
members to arrive. Owin? the the large number of people waiting for their

Chairman, Tom Farrell stated that there wore a number of queotions which
had to be asked concerning the application: -
Do we want to vary from the subdivision code section S01?
Answer: lot is presently unplatted. Questioned Ron Niska as to
minimum lot square footage for single family home to which the
answer was 7, `'00 square feet.
why do you want an extra lot there?
Answer: we both want to build a house. to live in ourselves.
Is parking available?
Answer: yes, and sewer and water have been petitioned for.
Are any neighbors present who have questions.
No answer.
Amotion was made by Nr. Meister and seconded by Mr. Ranum that the variance
for the sub -division be approved. motion unanimously carried.
Mr. Farrell stated that a Certificate of survey must be provided before
the division was recorded at the County, and stated his concern about the
appearance of discrepancies in the plan.

Chairman Tom warren statel that there was more than one variance in
this instance which v:as required aE, the required amount for a single

family home is 7,500 square feet and this variance would be short 1400
square feet. The applicant stated that when they bought the property
the previous week they were told t}iat the side lot was larger than it
really is. There ;ere sug,;eGtions that applicant state their case to
the realty company concerned for action on their part.
Russ Moister stated that they would have to apply to the council again at
the time they wanted to build. Agin Bodlovick stated that if they cannot
build because the lot is not large enough why would they want to apply
for a variance now? The Chairman then at.ked if the e were any objections
raised by neighbors. The following people made objection-

street corners was very unsatisfactory to her.
Earl Flowers who liver, next door stated that he did not feel the

near and it would be very inconvenient to him.
Dave Ha:k also objected to the removal of the side yard.
Ann Bodlovick. said Lhat she could not see another house on that small lot.
A motion was nae by Nr. Nci iter and seconded by Ann Bodlovick that the
variance be denied, notion unanimously carried.

Applicant stated that he had problems with egress windows which would be
solved. Dick Haas - a glassblower - will be living in the building. Ann
Bodlovick stated that originally applicant had been planning an apartment
building, but his plans had changed.
Tom Farrell asked what type of apartment this would be, and the answer was
that it would be an effeciency, but the main object would be to have someone
to look after the building.
A motion eras made by Al Panum and seconded by Ann Bodlovick that the special
use permit be ;ranted. l,,otion unanimously carried.

A plan of the future building was presented ice the Council. Tom Farrell
asked why the 1+ pi.ex was 80 near to the road w,;en the requirement is a set
back of 35 feet, designer stated that was an accident in his drawing.
Tom Farrell asked wiry there should be a LE olex in a single family neigh-
borhood. Applicant stated that if he lived in the area he probably would
only want a duplex but economically it was preferable to him to erect a
l} plex. He plans to live in one himself, and the cost to build will be
around one hundred and fifty thousand dollars plus the cost of the lot.

Applicant stated that he intended the building to be very nice and attractive.

Tom Farre1iftii there were any neighbors who had objections: -
The neighbors came forward and handed a signed petition to the chairman,
as per copy enclosed herewith. There eras some discussion about the rocks
and trees at present on the property making it look untidy. It was stated
that ,•ir. Johnson had purchaaeU them and they would be removed shortly.
prior to identifying themselves the neighbors asked the applicant why he
would not just build a single family home. The answer was that he would
only live there part of the year and because of the fuel shortage it was
not economical to erect a building when one was not going to live in it.
The following names identify the neighbors who came to the meeting: -
Urs. Palmer who lives opposite.
L1-22 Gedatu ; who lives on the west end.
Raboin of 4tii. and Stillwater Ave. said. there would be no
room for parking, children or recreation.
Ur. Anderson who lives to the south objected to the renters who
:Night be living in a L} plex. There were no duplex's he stated
and the closest one was on Holcombe St.
Ann Bodlovick asked what the size of the lot is and was told it was 100
x 150. She stated that she could see that a 4 plex mightdepreciate the
lots which the neighbors own because of the cars, people and traffic in
what is, essentially, a 1 family area. Applicants answered that they did
not wish to do anything to upset the neighborhood. Ms. i3odlovick asked
whether they planned to rent to older or younger people and the answer
was that they probably would be older but would have no way of knowing
what would be the case in five yearn' time.
Neighbors stated that it was a troubled area and this would make things
worse. The designer/architect atated that this would be a high rental
bloci.e. 350 dollar; per unit.

the children in the area and was told that they would not be linin, at

Ann Bodlovick stated that the building apse red quite attractive being
52x40 and each having 2 bedrooms and tuck -under garages. However, most
homes in that area were 100 years old and the neighbors had a right to
object if they did not v'ant that tyke of building in their area.
A motion was made by Russell Weitz and ;econdcd by Russell Meister that
the special use penmit be denied. Ann Bodlovick abstained from voting.
Motion was carried.

NEW BUSINESS
Ordinance no. 506 $eritage preservation Commission
Tom Farrell stated the need to get this under way. He suggested that
members meet at 6.30 p.m, before the regular Planning Commission
meeting started. It was agreed to do this.
Tom Farrell requested that the Architectural students, mike Marxen & mark
who presented the Stillwater plan at the last meeting of the Master
plan Committee,be paid. Ron Nislia asked why this would be necessary as
students do this as part of their education. Ann Bodlovick stated that
she understood that a decision had already been taken on this. It will
be discussed at the next meeting of the master plan Committee on May 21.
Ann Bodlovick made a motion to adjourn and it was seconded by Russell
Weitz. The meeting adjourned at 3:45 p.m.
