DATE : April 2, 1979 PRESENT: Tom Farrell , Chairman Jack Shelton Dave Hnefelkamp Bud Roepke Ann Bodlovick RUSS Weitz Russ Meister Chuck Swanson Ron Niska CALL TO ORDER The meeting was called to order by Tom Farrell, Chairman. A motion was duly made , seconded and carried to approve the minutes as read. OLD BUSINESS Case No. 347 - Approved by City Council Case No. 348 -- approved by City Council Case No. 344 - Replot and resubmit NEW BUSINESS Case No. 345 Special Use Permit James Menard Convert duplex into 11.08 South First Tri-plex 439-4733 Mr. Menard has met with Ron Niska and City requirements in order to meet code were discussed. Mr. Menard stated that all requirements could be met. Approximately 5 , 000 square feet will remain after garage and parking requirements are completed. Chairman, Tom Farrell asked if neighbors to the property were present . Mr. Chuck Beyer, 1112 S. First Street came forward. Mr. Beyer firmly stated his objections to developing the property as stated by Mr. Menard. He indicated that the proposed garage location would be on his property. Mr. Menard indicated that the recent survey of the property did not agree with this statement. Jack Shelton presented the city map indicating the property lines of these two lots. Mr. Beyer continued with his objections stating the a tri-plex is too much density for the neighborhood. He cited parking, noise and control as potential problems. The problems would be even greater with the landlord not on the property. STILLWATER CITY PLANNING COMMISSION April 2 , 1979 Page Two Additional neighbors came forward and expressed their agreement with Mr. Heyer on these points of objection . They further felt that the proximity to Nelson School and proposed development there would cause additional parking and population density problems. Mr. Menard stated the he could not control where people parked even though off-street parking was provided. lie stated he would still be in control of the property even though he did not live on the premises. He stated that he plans to invest $61 , 000 in the develop- ment of the property and did not plan to lose his investment by renter problems. On the motion of Russ Weitz a request for approval of a Special Use Permit was presented. Motion died for lack of second. Chuck Swanson made a motion to decline the approval for a Special Use Permit due to the objections presented by neighbors i .e. density of population and control of parking. Motion seconded. Ayes - Seven No - One Motion carried. Case No. 349 Special Use Permit Kenneth E. McKenzie Privacy Fence 2419 hidden valley Lane 439-8515 Mr. McKenzie came forward and stated his request. The property has a drop-off of two feet. In order to get the benefits of a 6 ' fence a 8 ' fence must be constructed. Question: Have the neighbors been contacted? Answer : No. Concern was expressed about the neighbors view from their lot. A motion was duly made to approve the Special Use Permit for the construction of the fence. Seconded and carried. Case No. 350 Special Use Permit Jan & Alice Harriman Beauty Shop 61.2 South Fifth St. 439-4275 Jam Harriman came forward and stated her request. All neighbors have been contacted and there are no objections. The shop would have one operator. The hours would be 8-5 , Tuesday through Saturday. There would be no outside sign. STILLWATER CITY PLANKING COMMISSION April 2 , 1979 Page Three Case No. 350 -- Continued Russ Meister made a motion to approve the Special Use Kermit for the Beauty Shop. The Permit is to be renewed in one year. Any complaints by neighbors during the past_ year would be considered at that time. The motion was seconded and unanimously carried. Case No. 351 Special Use Permit George Parker. Convert church into home Fourth & Oak Streets Mr. George Parker was present . He stated that he would like to convert the church into a dwelling unit. Mr. Niska has been contacted and requirement have been discussed in order to bring the building up to code. Neighbors came forward and expressed their approval for the planned home. vandalism, maintenance and occupancy have all been problems . Anyone wanting to occupy the building would be encouraged by them. Mr. Parker stated that he would occupy the building as soon as possible. The basement would be converted into a small apartment at a later time. The area is presently zoned for two-family dwell- ing,. The apartment is needed to help supplement the cost of the improvements on the property. Two living unit, would be the maximum for the property. Parking requirements have also been met. On motion of Chuck Swanson the approval for Conditional Special Use Permit was approved . Seconded and carried . Case No. 3.52 Special Use Permit Catherine Francis Convert house into studio 113 E. Pine Street 774-6775 Catherine Francis was present and explained her request. off street parking would be provided at the back of the property. She does not live at the location of the property. No customers would be coming to the studio. Commercial and large media presentations are the type of business involved. STILLWATER CITY PLANNING COMMISSION April 2 , 1979 Page Four Neighbors have been contacted and there are no objections . The exterior of the building will not be changed to any degree. A small sign will be erected, which will be within the four square foot requirement. There is an easement agreement with the neighbors for parking access . Neighbors stated no objections. Dave Knefelkamp made a motion to approve the Special Use Permit. The motion was seconded and carried. Case No. 353 Variance Edward Mauss Divide Lot 1120 North First St, 439-8018 Mr. Mauss came forward and outlined his plan for the property. The original size of the property was 140 X 150. The intent is to divide the property and then sell one lot. No neighbors came forward to make a statement regarding this lot. A motion was duly made to approve the Variance after a registered survey of the property has been submitted. The survey is to show the location of the house on the property. It is also to state single family dwelling only. The motion was second and carried. on motion duly made the meeting was adjourned at 8 :40.
