Case No. 342
Swager Bros. Inc.
5898 Omaha
439-7810
This plan for Cooper's Subdivision was presented two years ago as
a preliminary drawing. At that time there were dual family
dwellings. Upon the, complaints from neighbors the original 23
W units were redrawn to 12 lots. This presentation is a Planned Unit
Development concept. The two year delay is due to surveying problems.
This property is zoned for dual family units.
An agreement was made with the neighboring property owners that
µ Lots 1 & 2 would not have duplexes built on them. A total of no
more than 6 duplexes will be built on the tract.
Chick sw4nson made a motion that the following recommendation be
presented to the City Council for approval:
u' The' Planning Commission recommends approval subject
to the following requirements and limitations:
Block 1 shall be single family dwellings.
Blocks 2 & 3 may be duplexes,- not to exceed
p six (6) in number.
All requirements and limitations previously
stated by the Planning Commission approximately
two (2) years ago shall be adhered to.
Any and all new restrictions or covenenats
regarding the property shall be reviewed by

Pauley Realty Co. - A representative of the Pauley Realty Co. was
present making an inquiry regarding property at 1009 Fifth Ave. So.
The property has less square footage than is required by law.
It has 6985 Sq. Ft. when 7500 Sq. Ft. is required.
If this lot was sold would the new property owner be able to obtain
a permit to build a home on this property? Would a Variance be
approved for this property? The commission felt that approval would
be given. A greater problem may be the sewer system. It was
suggested -that a Perk 'Pest be obtained from the County. This could
be a greater problem than the square footage.
