A RESOLUTION APPROVING THE SUBDIVISION FOR
CERTAIN LANDS LOCATED AT 1020 OWENS STREET NORTH
CASE NO.2016-45
WHEREAS, Timothy Freeman, of Folz, Freeman, and Erickson, Inc., representing
Lois Kohns, property owner, made application for approval of the subdivision of the
property located at 1020 Owens Street North and legally described on Exhibit A;and
WHEREAS, on December 14, 2016, the Stillwater Planning Commission held a
public hearing and recommended approval of the preliminary and final plat applications;
and
WHEREAS, January 3rd, 2016, the Stillwater City Council held a public hearing and
reviewed the subdivision request and found them to be consistent with City Code Chapter
32, Subdivision Code of the City of Stillwater.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Stillwater hereby approves the subdivision of lands located at 1020 Owens Street North
with the following conditions:
1. Utility service connection plans must be submitted to and approved by the Stillwater
Public Works Director prior to City signing off on the deeds for their recording with the
County.
2. An escrow for utility service connection construction may be required at the Public
Works Director's discretion. The amount would be determined by the Public Works
Director. If an escrow is required, it must be deposited with the City prior to
commencing any utility work within the City's road right of way.
3. The total amount due for all of the development impact fees is $10,432, which shall be
adjusted annually based on the City of Stillwater adopted Fee Schedule in effect at the
time of submittal. This amount must be submitted to the City prior to the release of
executed deeds or plat mylars from City offices.
4. A five foot wide drainage and utility easement along the south side, and a ten foot wide
drainage and utility easement along the east and the west sides, must be created for
Parcel A. A five foot wide drainage and utility easement along the north and south
sides, and a ten foot wide drainage and utility easement along the east and the west
sides,must be created for Parcel B.
a. The easements are to be approved in form and content by the City Attorney prior to
release of the Parcel 2 deed for filing with Washington County. The easements will

need to be filed by the landowner together with the deed. Proof of filing will be
required prior to issuance of a building permit for Parcel B.
5. The design of any new residences on Parcel B shall require design review and approval
by the Heritage Preservation Commission. Review and approval shall conform to the
standards set forth in the Stillwater (a/k/a Neighborhood) Conservation District.
6. The new residence shall comply with the aforementioned City Code Section,in addition
to all infiltration requirements for the Middle St. Croix Watershed Management
Organization (MSCWMO).
