THE HIRTHRLACE OF MINNESOTA DOWNTOWN PARKING COMMISSION MEETING MINUTES November 17, 2016 REGULAR MEETING Chairwoman Pelletier called the meeting to order at 8:34 a.m. Present: Chairwoman Pelletier, Commissioners Glynn, Hopfe, Johnson, Lettner, Council Representative Junker Absent: Commissioner Anderson Staff: Community Development Director Turnblad, Parking Enforcement Officer Pasket, Police Chief Gannaway APPROVAL OF MINUTES Approval of October 20, 2016 meeting minutes The minutes were amended to add the names of commissioners as movers and seconders for action items. NEW BUSINESS Wolf Block Hotel - Construction Parking Community Development Director Turnblad stated that Amcon Construction is beginning work on the boutique hotel in the Joseph Wolf Block. In oder to establish a safe perimeter for the construction site, Amcon is requesting permission to block off the parking on the south side of Nelson Street adjacent to the building, and on the west side of Main Street. This includes three parking spaces on Main Street and five on Nelson Street. The construction period will last about 12 months and would begin in the next two weeks. In addition to blocking off the on -street parking spaces, there will be fencing to close the sidewalk on the south side of Nelson Street. The Main Street sidewalk would remain open to pedestrians. Staff recommends incorporating the five parking spaces on Nelson into the perimeter safety zone but leaving the three parking spaces on Main Street for public use. Dennis Cornelius, Amcon Construction, said the spaces are needed for logistics and moving equipment and materials into the building. If not blocked for the duration of the project, they would like to have those stalls blocked as needed. They are proposing jersey barriers along Main Street with a cyclone fence behind. They want to maintain pedestrian access along Main Street and to the stairs. They also hope to have a pair of gates where Main and Nelson intersect which would allow access beyond the jersey barrier. Downtown Parking Commission November 17, 2016 Community Development Director Turnblad suggested blocking parking in the Main Street spaces as needed (with one day notice), to better accommodate parking demand on Main. Mr. Cornelius replied that due to the overhead power line across Nelson, they have to have access either in front of or behind the site. They can coordinate with the City as long as they know they can have the spaces blocked off for particular days with advance notice. Councilmember Junker said it would be best to keep the construction area as clear as possible from pedestrians. Chief Gannaway pointed out there will be a lot of foot traffic this year throughout the downtown, generated by the Ice Castles. Mr. Turnblad suggested placing a barricade at the top of the hill prohibiting pedestrians from using Nelson. There would still be driving traffic down Nelson. Motion by Commissioner Glynn, seconded by Commissioner Hopfe, to approve 1) blocking off the use of the five requested spaces on Nelson Street; 2) placement of a barricade on the sidewalk just to the east of the entrance to Teddy Bear Park which would direct pedestrians to use the sidewalk on the north side of Nelson; and 3) blocking off the three requested spaces on Main Street as needed. All in favor. There was subsequent discussion of parking for construction crews. Mr. Cornelius said there will not be enough parking on site for all their crews. There could be 25-100 crew members on any given day. They know they will have to deal with parking. Mr. Turnblad suggested getting permits for the crews or directing them to park in the Veterans Memorial lot at Pine and Third/Fourth Streets. Officer Pasket reminded them that on -street parking is limited to three hours and the workers will be subject to parking enforcement. Wanderer Distillery - Parking Mitigation Community Development Director Turnblad reported that the applicants propose to operate a craft distillery and tasting room known as Wanderer Distilling Company in the existing building at 124 Second Street South. The tasting room, with seasonal outdoor seating, will allow patrons to purchase and sample only products produced onsite. The tasting room will be open to the public Thursday through Saturday. Production will occur throughout the week. Approximately 2,300 square feet of the 7,500 square foot structure will be used for the tasting room. They plan to open a 8' x 60' patio sometime after the first year of operation. The remaining 5,200 square feet of building space will be used as office, storage, utility, restrooms, production and warehouse. Though the property has a parking lot, it does not have sufficient parking to meet minimum parking requirements once the seasonal patio is open. Therefore the applicants are requesting the Downtown Parking Commission approve the use of City parking facilities for the balance of the seasonal parking needs. The increased parking demand is calculated to be 16 spaces, 26 seasonally. The parking lot will accommodate 16 spaces, which covers the increased year-round demand. Staff recommends deferring a decision on the parking demand for the seasonal patio until the distillery is ready to open the patio area. The parking lot should still be required to be striped per the plan on file. Page 2 of 3 Downtown Parking Commission November 17, 2016 Councilmember Junker noted it is very hard to back out of parking spaces in the lot as it exists now. Mr. Turnblad said if they shift to a one way entrance and exit to the lot, parking spaces would be gained. Motion by Chairwoman Pelletier, seconded by Commissioner Johnson, to approve the request through use of public parking for the required parking mitigation for the increased seasonal demand, with the conditions recommended by staff, and a recommendation that Domacin and Wanderer work together to create a more efficient and safe one-way circulation through both of their lots. All in favor. Parking Ramp There was general discussion of the need to curtail using the ramp for parking mitigation for new businesses and business expansions because it is filling up. A second parking ramp is needed. One possible location could be Lot 1. Commissioners agreed that a work session with the Council is needed, as part of the comprehensive planning process, to discuss the big issues related to parking such as: need for second parking ramp; solutions to the emergency exiting situation of the ramp; possible moratorium on approving the use of public parking for new and expanding businesses. The Commission discussed a variety of solutions to the problem with the emergency button on the ramp exit equipment. The development would include 64 rooms, a coffee shop, a full service restaurant, several conference rooms, an attached three level parking structure, and a three-story office building. The hotel would be built this coming year and the office building would be built at a future date. The project would include redevelopment of Municipal Parking Lots 13 and 14. The 31 lost public parking spaces would be relocated to the parking structure proposed for the hotel. PROPOSAL DETAILS The specific proposal includes: • Construction of a new hotel with primary entrance off of North Main Street. This would be made possible by demolishing the existing single -story office building to the south of Johnny's TV and combining several vacant parcels. o The 64-unit hotel would have a main -floor coffee shop with patio, which would border the North Main Street sidewalk. O The hotel is proposed to have three stories. O The third story of the hotel would include a full -service restaurant that is open to the public. Outdoor dining would be available on this level. O Small conference and dining space will be available. • A new, 105 space three -level parking deck would be located behind the hotel. North Main Hotel Page 2 O The lowest level would gain access from Mulberry Street East, and would be at the same elevation as North Main Street. o The middle level would also be accessed off of Mulberry, but a bit further to the west, which is to say a little higher elevation. o The upper level would be accessed off of North Second Street. o The project developers are proposing to acquire Municipal Lots 13 and 14 and relocate the 31 spaces in these two public lots to their parking structure. ■ The timing has not been finalized, but a second phase of this property development would be the construction of a three-story office building at the corner of Mulberry and 2nd Street North. PARKING ANALYSIS Staff believes that the amount of parking required by the project is 172 spaces. The calculations are found in the table below. During the off season only 164 spaces are required for the project. As seen in the table, the project includes 632 square feet of conference room space, which would normally generate a need for 21 spaces'. However, the hotel operator has stated that the conference space can only be used by hotel room guests. And if that is always true, the 21 spaces would not be required and a total of only 151 spaces would be required for the project. But, city planning staff is uncomfortable waiving the 21 spaces since a simple hotel policy change could result in the need for those 21 spaces. The submitted plans show the construction of a total of 105 spaces in the parking structure. An email exchange with the architect states that they are redesigning the parking structure and believe that they will be able to provide 117 spaces. The best case scenario for parking shortage unfolds as follows. If the Parking Commission and City Council agree with the developer that the 21 conference parking spaces can be waived, and 117 spaces are ' 1 space per 15 square feet of space. So the 632 sf would need 42 parking spaces if the conference space were stand alone. However, as part of a hotel project a 50% deduction is allowed since half of the folks in the conference space would be expected to be hotel room guests. So, with the deduction the space requires 21 parking spaces. North Main Hotel Page 3 eventually included in revised building plans, then the total required spaces would be 151. That is a seasonal shortage of 34 spaces (26 spaces short during the off-season). The worst case scenario plays out as follows. If the Parking Commission and City Council do not agree that the 21 conference parking spaces can be waived, and only the current 105 parking spaces are constructed, then there is a seasonal shortage of 67 spaces (59 spaces short during the off-season). MITIGATION REQUEST The developers are requesting that the parking shortage be mitigated by using the Municipal Parking Ramp on the opposite side of Second Street. In years past the Municipal Parking Ramp has been underutilized. Even on weekends it was usually not difficult to find 50 or more vacant spaces. However, since the opening of the JX Event Center the Municipal Parking Ramp no longer has many weekends with more than a few vacant spaces. Moreover, Thursday and Friday evenings can also be difficult to find parking in the city ramp. So, using the city's parking ramp as a mitigation strategy probably will not suffice for the hotel building and its various uses, since they have heavy demand during evenings and weekends when the city's ramp has the fewest number of vacant spaces. However, it may be an acceptable strategy for the office building to use the city ramp, since its peak demand is during weekly office hours when the municipal ramp still has spaces available. Consequently, in the worst case scenario, if the 36 office building parking spaces are mitigated off -site, there would still need to be 23 more spaces in the hotel's parking structure during the off-season, and 31 more needed during the summer -season. Staff believes these spaces should be added to the hotel's parking structure. However, this would require another level of parking, which the developer believes may be cost prohibitive. In the best case scenario, 34 of the office building's parking spaces would need to be mitigated off -site. ALTERNATIVES A. Approve the developer's request to use the public parking ramp to cover the worst case scenario's 67 space peak -season parking deficit (May through October), and the 59 space off-season deficit (November through April), with the following conditions: 1. At least 31 parking spaces must be made available to the general public. 2. The parking mitigation fee for the municipal ramp (currently $12 per space for a bulk rate business hours pass) will be invoiced quarterly by the City. [31 billed during the peak -season and 23 during the off-season until the office building is constructed; after office building construction, then billing would increase to 67 during the peak -season and 59 during the off-season.] 3. The fee is to be paid upon receipt of City invoice. Failure to pay fees within 30 days of invoice will be certified for collection with real estate taxes. The applicant waives any and all procedural and substantive objections to the parking mitigation fee in -lieu of on -site parking requirements, including but not limited to a claim that the City lacks authority to impose and collect the fees. The applicant agrees to reimburse the City for all costs incurred by the City in defense of enforcement of this provision. B. Approve the use of the public parking ramp to cover only the worst case's 36 space deficit for the office building, with the following conditions: 1. The on -site parking structure will have to be enlarged to provide 136 parking spaces, 31 of which must be made available to the general public. 2. The parking mitigation fee for the 36 spaces (currently $12 per space for a bulk rate business hours pass) will be invoiced quarterly by the City. North Main Hotel Page 4 3. The fee is to be paid upon receipt of City invoice. Failure to pay fees within 30 days of invoice will be certified for collection with real estate taxes. The applicant waives any and all procedural and substantive objections to the parking mitigation fee in -lieu of on -site parking requirements, including but not limited to a claim that the City lacks authority to impose and collect the fees. The applicant agrees to reimburse the City for all costs incurred by the City in defense of enforcement of this provision. C. Deny the use of public parking to mitigate the parking deficit. D. Defer a decision on the parking mitigation request until the revised plans are completed by the architect and submitted to city staff for review. STAFF RECOMMENDATION Since the parking ramp will often not have sufficient weekend parking, nor parking on Friday nights and some Thursday nights, staff would recommend Alternative B. I've attached a picture of the street view. Might it be possible to convert the northernmost spot on the west side of the street in front of the brick building to handicap? In the picture it would be to your right. The vehicles face and travel south on 3rd St. here and being able to pull right in to the spot without parallel parking would be great. The development would include 64 rooms, a coffee shop, a full service restaurant, several conference rooms, an attached three level parking structure, and a three-story office building. The hotel would be built this coming year and the office building would be built at a future date. The project would include redevelopment of Municipal Parking Lots 13 and 14. The 31 lost public parking spaces would be relocated to the parking structure proposed for the hotel. PROPOSAL DETAILS The specific proposal includes: • Construction of a new hotel with primary entrance off of North Main Street. This would be made possible by demolishing the existing single -story office building to the south of Johnny's TV and combining several vacant parcels. o The 64-unit hotel would have a main -floor coffee shop with patio, which would border the North Main Street sidewalk. O The hotel is proposed to have three stories. O The third story of the hotel would include a full -service restaurant that is open to the public. Outdoor dining would be available on this level. O Small conference and dining space will be available. • A new, 105 space three -level parking deck would be located behind the hotel. North Main Hotel Page 2 O The lowest level would gain access from Mulberry Street East, and would be at the same elevation as North Main Street. o The middle level would also be accessed off of Mulberry, but a bit further to the west, which is to say a little higher elevation. o The upper level would be accessed off of North Second Street. o The project developers are proposing to acquire Municipal Lots 13 and 14 and relocate the 31 spaces in these two public lots to their parking structure. ■ The timing has not been finalized, but a second phase of this property development would be the construction of a three-story office building at the corner of Mulberry and 2nd Street North. PARKING ANALYSIS The amount of parking required by the project is 172 spaces. The calculations are found in the table below. During the off season only 164 spaces are required for the project. The developers are proposing to construct a total of 105 spaces in their parking structure. That is 67 spaces short during the warm season and 59 spaces short during the off season. MITIGATION REQUEST The developers are requesting that the parking shortage be mitigated by using the Municipal Parking Ramp on the opposite side of Second Street. hi years past the Municipal Parking Ramp has been underutilized. Even on weekends it was usually not difficult to find 50 or more vacant spaces. However, since the opening of the JX Event Center the Municipal Parking Ramp no longer has many weekends with more than a few vacant spaces. Moreover, Thursday and Friday evenings can also be difficult to find parking in the city ramp. So, using the city's parking ramp as a mitigation strategy probably will not suffice for the hotel building and its various uses, since they have heavy demand during evenings and weekends when the city's ramp has the fewest number of vacant spaces. However, it may be an acceptable strategy for the office building to use the city ramp, since its peak demand is during weekly office hours when the municipal ramp still has spaces available. North Main Hotel Page 3 Consequently, if the 36 office building parking spaces are mitigated off -site, there would still need to be 23 more spaces in the hotel's parking structure during the off season, and 31 more needed during the patio season. Staff believes these spaces should be added to the hotel's parking structure. However, this would require another level of parking, which the developer believes may be cost prohibitive. ALTERNATIVES A. Approve the developer's request to use the public parking ramp to cover the 67 space peak - season parking deficit (May through October), and the 59 space off-season deficit (November through April), with the following conditions: 1. At least 31 parking spaces must be made available to the general public. 2. The parking mitigation fee (currently $10 per space) will be invoiced quarterly by the City. [31 billed during the peak -season and 23 during the off-season until the office building is constructed; after office building construction, then billing would increase to 67 during the peak -season and 59 during the off-season.] 3. The fee is to be paid upon receipt of City invoice. Failure to pay fees within 30 days of invoice will be certified for collection with real estate taxes. The applicant waives any and all procedural and substantive objections to the parking mitigation fee in -lieu of on -site parking requirements, including but not limited to a claim that the City lacks authority to impose and collect the fees. The applicant agrees to reimburse the City for all costs incurred by the City in defense of enforcement of this provision. B. Approve the use of the public parking ramp to cover only the 36 space deficit for the office building, with the following conditions: 1. The on -site parking structure will have to be enlarged to provide 136 parking spaces, 31 of which must be made available to the general public. 2. The parking mitigation fee for the 36 spaces (currently $10 per space) will be invoiced quarterly by the City. 3. The fee is to be paid upon receipt of City invoice. Failure to pay fees within 30 days of invoice will be certified for collection with real estate taxes.
