ADJOURNMENT RESOLUTION 2016-191 DIRECTING THE PAYMENT OF BILLS BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota, that the bills set forth and itemized on Exhibit "A" totaling $549,634.59 are hereby approved for payment, and that checks be issued for the payment thereof. The complete list of bills (Exhibit "A") is on file in the office of the City Clerk and may be inspected upon request. Adopted by the Council this 18th day of October, 2016. Ted Kozlowski, Mayor ATTEST: Diane F. Ward, City Clerk OBJECTION TO ASSESSMENT Pursuant to the provisions of Minn. Stat. 429.061 Subd. 2, Randy L. Patterson and Laura J. Patterson, as fee owners of the real property located at 613 Olive Street W., Stillwater, MN, Property ID No. 28.030.20.34.0095, do hereby object to assessment number 2016-02 LI#409, particularly known as 2016 Street Improvement Project(the "Assessment"). The Assessment is to be voted upon by the City of Stillwater City Council on October 18, 2016. The basis for said objection is as follows: 1. The City failed to comply with provisions of Minn. Stat. Chapter 429 in adopting the Assessment; 2. The Assessment is not uniform upon the same class of property; 3. The Assessment provided no special benefit to the Property; 4. The Assessment exceeded the value of any special benefit to the Property; 5. The City could not lawfully adopt the Assessment because the City's conduct underlying the Assessment violated the Owner's right to equal protection under the Minnesota and United States Constitutions; 6. The improvements for which the Assessment was levied do not result in an increase in fair market value of the Property in an amount equal to or greater than the amount of the Assessment; and 7. The Assessment exceeds the special benefits conferred and effect a taking in violation of the Minnesota Constitution and the Fifth and Fourteenth Amendments to the United States Constitution. NOW THEREFORE BE IT RESOLVED that the City Council of the City of Stillwater hereby denies the demolition of the structure located at 209 Wilkins Street East. Enacts by the City Council of the City of Stillwater Minnesota this 18th day of October, 2016. Ward, Clerk Summary of Proceedings Washington County Board of Commissioners October 4, 2016 Present were Commissioners Fran Miron, District 1; Gary Kriesel, District 3; Commissioner Bigham District 4; and Lisa Weik, District 5. Board Chair Miron presided. Commissioner Reports -Comments -Questions The Commissioners reported on the following items: -Commissioner Weik-reported that she attended a meeting with members of the St. Paul Area Association of Realtors in regards to local policy issues affecting their industry. She attended a League of Women Voters meeting which sponsored a public candidate forum for the open seat for Washington County Commissioner District 2. She met with South Washington Watershed District officials to preview materials that will be presented at today's budget workshop. She taped a candidate statement at the South Washington Telecommunications Commission cable television studios yesterday, October 3rd, in Cottage Grove. She reported on constituent interest in the campus renovation project in Woodbury's Central Park. -Commissioner Kriesel -reported that he attended the Metropolitan Mosquito Control District Executive Committee meeting in regards to the increase of rain and mosquitos this year, and the costs of mosquito treatment. He attended the Solid Waste Management Coordinating Board meeting in regards to comments received about the Solid Waste Management Plan. -Commissioner Bigham-reported that the Friends in Need Food Shelf had its re-grand opening in a new location. She thanked Washington County Assistant Attorney, Irnran Ali, for his presentation at the sex trafficking forum at the Cottage Grove City Hall. She attended the Recycling and Energy Board's Facility Tour, and reported on blue bag organics, and local reinvestment. She reported that Park High School had its homecoming. She attended the St. Paul Park City Council Meeting in regards to the Summit A venue and Highway 61 interchange project. She reported that the Burlington Northern Sante Fe Railway purchased 300 acres in Grey Cloud Island, and that there will be two open houses for public input, one on October 18th and another on November 15th, at the St. Paul Park City Hall. -Commissioner Miron-reported that he attended the Recycling and Energy Board's Facility Tour, and reported on the amount of manual sorting at the facilities. He attended the Metropolitan Mosquito Control District Executive Committee meeting, and reported on the balance of treating mosquitos versus the potential harm to pollinators, and the importance of reporting the location of bee hives to the Department of Agriculture. He attended a Rush Line Corridor Meeting in Forest Lake in regards to bus service from Forest Lake to St. Paul. He attended a bus tour looking at development in the City of Hugo. He attended the Hardwood Creek Library's 50th anniversary celebration in Forest Lake. He will be attending a tour of the Piccadilly Square senior housing on October 4th at 5:30 p.m. General Administration Approval of the following actions: -September 20, 2016, County Board Meeting Minutes. -Molly O'Rourke, County Administrator provided a reminder that the budget workshops following the Board Meeting will be televised. -Ms. O'Rourke also reported that the Health, Safety and Wellness Event for Washington County employees will be at 3:00 p.m. on October 4, 2016, at the Lake Elmo Park Reserve. -Board workshop to discuss the 2017 proposed budget of the watershed management organizations and the Washington Conservation District. -Board workshop to review the results of the 2016 Aquatic Invasive Species (AIS) Prevention Aid Grants. -Board correspondence was received and placed on file. Public Health & Environment -Board workshop to discuss the 201 7 proposed budget of the watershed management organizations and the Washington Conservation District. Public Works Approval of the following actions: -Resolution No. 2016-134, Authorizing final payment for the County State Aid Highway 39 project. -Resolution No. 2016-135, Granting permanent water line easement for purposes ofreceiving city water at 1796 Lake Elmo A venue in the City of Lake Elmo. -Resolution No. 2016-133, Approving of Metropolitan Council Grant Agreement SG-05340 for $1,600,000 in Funding to Assist in the Construction Costs of the Point Douglas Regional Trail and Hastings Bridge Trail System Connection Project. -Board workshop to review proposed 2017 Counties Transit Improvement Board (CTIB) grant requests. Commissioner Reports -Comments -Questions The Commissioners reported on the following items : -Commissioner Bigham -reported that she attended the Red Rock Corridor meeting and reported that the draft implementation plan will be presented for public comment on October 26 1h at the Newport City Hall. She presented with Hally Turner, Washington County Public Works Planner, at the Metropolitan Council Transportation Committee in regards to the draft implementation plan for the Red Rock Corridor. She attended the Counties Transit Improvement Board Meeting. She reported on an event held at the Cottage Grove City Hall on September 26th in regards to the new health advisory for Perfluorinated Chemicals (PFCs) in drinking water. She reported that she attended a meeting with the City of Woodbury about economic development. She reported that on September 29th there will be a sex trafficking forum at the Cottage Grove City Hall from 6:30 p.m. to 8:30 p.m. -Commissioner Weik-reported that she attended the Recycling and Energy Center's Annual Hauler Appreciation Picnic. She attended the Counties Transit Improvement Board Meeting, and reported that two resolutions were passed: 2016 Program of Projects Investment Strategy and the 2016 Grant Solicitation Process. She attended a Gateway Gold Line presentation at the Woodbury Chamber of Commerce Government Affairs Committee. She reported that in- person absentee voting is available through November 7th for the general election, and that she participated in this process at the Woodbury Service Center. She met with the city of Woodbury staff in regards to economic development. She attended the Big Truck day event in Woodbury's Central Park, and thanked Public Works for their efforts. -Commissioner Kriesel -reported that he attended the 125th Anniversary of the Greater Stillwater Chamber of Commerce on the Majestic Star boat. He attended the 38 1h annual Art in the Park in Afton. He attended a Plat Commission meeting. He chaired the Audit Committee Meeting on September 22nd, where new internal auditor, Melanie Greufe, was introduced. He attended the Recycling and Energy Board Meeting in regards to odor mitigation and Biz Recycling website improvements. He attended the Lake Elmo Rotary Club meeting. -Commissioner Miron -reported that he attended the Recycling and Energy Board Meeting. He attended the Community Development Agency (CDA) Meeting, and reported on the CDA authorizing the acceptance of a financing proposal from the First State Bank of Wyoming. He attended the Workforce Development Board Meeting. He reported that there is a Rush Line Corridor meeting tonight, September 2th, from 5:30 p.m. to 7:00 p.m. at the Forest Lake City Center. Community Development Agency -Approval of Resolution No. 2016-132, Granting economic development authority powers to the Washington County Community Development Authority, during public hearing. General Administration Approval of the following actions: -September 13, 2016, County Board Meeting Minutes, with amendments. -Approval of the appointment of Jyneen Thatcher, Hugo, to the Parks and Open Space Commission, District 1 vacancy to a full term ending December 31, 2019. -Approval of 2015 Consolidated Annual Performance and Evaluation Report for submission to the U.S. Department of Housing and Urban Development. -Approval of projects recommended by the County Administrator for funding through the 2015 Countywide Mission Directed Budget Savings Program. -Molly O'Rourke, County Administrator, reported that the Planning Advisory Commission meeting scheduled for September 27th has just been cancelled due to no new items up for review. -Board correspondence was received and placed on file. Property Records & Taxpayer Services Approval of the following actions: -Resolution No. 2016-128, Approving the public sale of tax forfeited land to be sold at public auction. -1 Day Temporary On-Sale Liquor License for the Minnesota Food Association for October 16, 2016 in May Township. Public Health & Environment Approval of the following actions: -Resolution No. 2016-129, Certifying to the County Auditor unpaid county environmental charges and order the County Auditor to extend the assessments with interest upon the tax rolls of the county. -Agreement with the City of Woodbury for the purchase of exterior waste/recycling bins and related educational materials for the Bielenberg Sports Center not to exceed $70,000. -Board workshop to review the County Yard Waste Management System study. Public Works Approval of the following actions: -Change order# 3 to Contract 9500 with Kendell Doors & Hardware, Inc. for work on the North Shop Renovation Project in the amount of $2,498.92. -Resolution No. 2016-130, Amendment No. 1 to Agreement #01434 with the Minnesota Department of Transportation for the release and conveyance of the south Frontage road, (County State Aid Highway 26) and Beach Road (County State Aid Highway 23). -Contract with Wench Associates, Inc. for 2016-2019 water resource engineering services in an amount to not to exceed $50,000 for each 12-month period of the 3 year contract. -Resolution No. 2016-131, Authorizing final payment in the amount of $36,035.12 to Hardrives Inc., for completion of the County Road 62/63 and Government Center Parking Lot Project. -Approval of donation of $1,500 from the Lake Elmo Rotary Club for archery range improvements at the Lake Elmo Park Reserve. -Board workshop to review the Historic Courthouse operations. He wrote a Mighty Ducks grant and was awarded $58,606 of matching money from the Minnesota Amateur Sports Commission that the City would have to match. Bids came in over budget. He recommended that the Council reject all bids for Items 1, 3 and the alternate items, and award the contract for Item 2 to Corvel Group, the lowest responsible bidder as they are the most familiar with understanding the HVAC needs of the recreation center for their bid amount of $85,260. Motion by Councilmember Menikheim, seconded by Councilmember Junker, to adopt Resolution 2016-188, rejecting certain bid items on all bids for the HVAC system at the St. Croix Recreation Center. Community Development Director Turnblad reported that the concept plan for Aiple Park is progressing and a community meeting will be held November 3. Regarding Stillwater Collision, he stated that fencing, cleaning and shrubbery has been completed, but the October 17 deadline for paint booth work cannot be met, and would need an extension to November 4. The business owner has been diligent in addressing the issues and has hired a group that specializes in retrofitting spray booths. City Administrator McCarty reminded the Council of the regional meeting November 30 with Metro Cities/League of Minnesota Cities. Tony Grove, Stillwater Collision, stated that a consultant was hired who assured him that the new system will take care of the situation. Councilmember Weidner thanked Mr. Grove for cleaning up the property. Since the City has a mortgage against the property and ownership of the property would change, an amendment to the loan agreement would have to be made. Staff is comfortable with the arrangement. City Attorney Magnuson would draft an agreement to be brought back for signature which carries the mortgage forward. These adjustments are mainly due to leaks found during the course of the year, but often stand out more during the readings during the 1st quarter of every year. For residential properties, sanitary sewer billing rates are set during the 2nd quarter of every year using the water consumption ( obtained from the Water Board) from the 1st quarter of the year. This rate is then used for the next 4 billing cycles (quarters) until the rates are reset again the following year. As mentioned before, occasionally there are some properties that have experienced increased water usage during the 1st quarter of the year due to some unforeseen circumstances ( e.g. leaky toilet, water softener issues, pipe issues, etc.). This increased water usage naturally in tum increases their sanitary sewer billing rate for the next 4 billing cycles (quarters). These residents/owners will then call the City to explain their individual circumstance. We (Finance) then review consumption rates from prior/current quarters to see if we can determine the duration/termination of the leak based on the information provided to us by the water department and the resident/owner. This information then is used to provide Council with new billing rate recommendations for upcoming billing periods (until the new rates are reset the following year). This practice has been used by the City for many years, and has been proven to be a fair and accurate way for property owners to pay their fair share of the use of the sanitary sewer system. RECOMMENDATION: Attached are staff recommendations for sanitary sewer rate adjustments currently requested by property owners. These adjustments are expressed in gallons ( of consumption), based on the average consumption of the prior 3 years, and converted to the new billing rate using the most current billing rates approved by Council. These adjustments will begin with the next billing cycle (3rd quarter billing). In other words, staff is recommending to Council that the property owner at least pay the increased sanitary sewer rate for the billing period in which the leak occurred. COUNCIL ACTION: If Council agrees with Staffs recommendation, Council needs to approve staff recommendations as listed on the attached Exhibit A. In 2016, the lease was $8, 831.85. Staff is recommending a 2% increase ($9,008.49) on the lease for 2017. ACTION REQUIRED If Council concurs with staff’s recommendation, council needs to adopt a resolution entitled “approval of increase to railroad lease payment” increasing the lease payment to $9,008.49 for 2017. Fourth Street, Willmar, Minnesota, herein referred to as SafeAssure. SafeAssure agrees to abide by all applicable federal and state laws including, but not limited to, OSHA regulations and local/state/national building codes. Additionally, SafeAssure will practice all reasonable and appropriate safety and loss control practices. SafeAssure further agrees that Stillwater will not be held liable for any claims, injuries, or damages of whatever nature due to negligence, alleged negligence, acts or omissions of SafeAssure to third parties. SafeAssure expressly forever releases and discharges Stillwater, its agents, members, officers, employees, heirs and assigns from any such claims, injuries, or damages. SafeAssure will also agree to defend, indemnify and hold harmless Stillwater, its agents, members and heirs from any and all claims, injuries, or damages of whatever nature pursuant to the provisions of this agreement. SafeAssure and its employees is an independent contractor of Stillwater, and nothing in this agreement shall be considered to create the relationship of an employer/employee. The project included these areas: Street reconstruction • Olive Street (William to Holcombe) • 63rd Street North, Osman Avenue, Oxboro Avenue North • Orleans Street (Second Avenue to Fourth Avenue) • 641h Street North and Ozark Avenue North Mill and Overlay • Tower Drive • Benson Boulevard West • Highland Road • Highland Court • Lydia Circle • Gilbert Court Final cost of the project including engineering, construction and administrative costs is estimated to be $1,794,318.64 . This cost includes water main replacement on 63rd Street North and Osman Avenue North and street and utility work on Oak Park Heights streets including portions of 641h Street North, Ozark Ave North, and 65 1h Street. These sections will be paid by the Stillwater Water Board and the City of Oak Park Heights. Less these areas, the cost of 2016 Street project is $1,392,699.05. Five of the six appraisals showed that the benefit from the improvement exceed the cost of the assessment. The exception, was at 702 Olive Street, where the estimated benefit after the improvement is $10,500. But since the assessment rate is lower for Olive Street than the amount used for the appraisal, the assessment would be lower than the benefit. To date there have been no objections submitted to the City. The assessment period would be 10 years at an interest rate of 3 .5%. RECOMMENDATION: Staff recommends that Council hold the assessment hearing, and adopt the attached assessment roll for the 2016 Street Improvement Project. Although there is dedicated easement for drainage, the topography of the land is such that the drainage spreads outside of the existing easement area into the backyards of these properties. Both staffs have concerns that once temporary dewatering activities discontinue spring runoff and rain events, flooding will still occur and conditions and may worsen. There is also the additional concern of future development of the parcels on the eastside of Mary lane would increase the runoff in the area and add to drainage issues that exist today. In working with Watershed District, we felt the easement area should be looked at closer and determine of ways to improve the downstream drainage from Mary lane. We have asked the Watershed District consultant to come up with costs for Marylane Drainage Assessment that would collect data, do hydrologic modeling and look at different scenarios with cost to improve the drainage area. This cost is estimated at $24,127. Since the drainage area is not within City limits it was proposed that the cost of the study be split evenly between the City and Watershed District. At their last meeting Watershed District Board approved half of the amount for the assessment. If approved funds for this city's portion of the assessment would come from the Storm Water Utility Fund. RECOMMENDATION Staff recommends that approve the Mary lane Easement Assessment and share the cost the Browns Creek Watershed District in the amount of $12,060. The District's rules do not require that a permit applicant evaluate interim downstream impacts during construction and the NPDES requirements for temporary erosion and sediment control were met. As shown in Figure 1, the flow from Rutherford Station leaves the site with a newly constructed culvert under Marylane and flows overland across a heavily-wooded drainage easement with little understory / groundcover (bare soil with high erosion potential) from the eastern edge of Mary lane Avenue across parcel number (0006), through the rear lots of the Brown's Creek Preserve Subdivision and onto city owned Outlot A of the Settlers Glen 6th Addition. The water goes to a City owned stormwater pond and outlets to natural wetlands. Flow from this area ultimately ends up at the diversion structure. There are 64.4 acres that make up the drainage area flowing to the Marylane Culvert: Table 1: Drainage A P rea roporuo u Munici12.alit't. Area Percent Grant 35.8 56% Stillwater 28.6 44% Residents living adjacent to the drainage easement have notified the BCWD and the City of Stillwater that the drainage has been flooding yards as a result of the development dewatering activity taking place at Rutherford Station. Temporary dewatering activities have been changed to require the clean water to be piped to the city owned stormwater pond in Settler's 6th Addition, but the unstable nature of the woodlands and undefined flow path through this relatively flat area have been identified by BCWD staff and City staff as potential long-term issues. Staff are concerned about capacity to pass flows during spring snowmelt conditions and future issues when additional undeveloped parcels along Marylane are converted to higher density residential development. After discussing these concerns with the City of Stillwater staff, it was decided that a collaborative evaluation of the drainage easement should be performed. This evaluation would characterize its condition and identify opportunities to stabilize the flow area, restore capacity, and potentially make improvements to provide additional treatment (storage) if needed. If it is determined that improvements need to be made to restore the capacity of the drainage easement, the City of Stillwater is interested in cost-sharing with the BCWD on the implementation of these improvements. Based upon the funding authorization for the project, Wenck’s contract could only be written for the first phase of work. However, now that preliminary approval has been given by the Council for the 2017 City Budget, which includes funding for the second phase of work, the contract needs to be amended accordingly. This contract amendment accomplishes three things: 1. Pre-construction services fee of 2.25% (original fee) extended to cover the new construction cost estimate of $2.25 million instead of the previous $2.1 million estimate. [New estimated total fee of $50,625. Previously with amendment #1 was $47,250.] 2. On-site construction management services fee of 4.5% (original fee) extended to cover both phases of the $2.25 million project instead of just the first phase. [New estimated total fee of $101,250. Previously with original contract was $33,750 for $750,000 of construction.] 3. The reimbursable expenses extended to cover both phases. Reimbursable expenses include such things as construction trailer office, site fencing, toilets, clean-up, snow plowing, construction debris containers and removal, heat and electricity, etc. [New estimated total fee of $175,275. Construction compensation will be adjusted upon project completion to 4.5% of actual construction costs. 3.The maximum reimbursable expenses compensation shall be increased to $175,275 assuming no more than a 9 ½ -month construction period. This increase is due to construction of phase 1 and 2 and an increase of 3 ½months to the construction schedule. We realize this decision will not satisfy all of our trail users but I'm hopeful that it will address most of the concerns we've heard over the last year.
