RESOLUTION GRANTING LICENSE TO STILLWATER AREA SCHOLASTIC
CYCLING ASSOCIATION FOR THE USE OF BROWNS CREEK PARK
WHEREAS,Hank Gray,Stillwater Area Scholastic Cycling Association(SASCA)
Board Secretary,has made a request,attached hereto as Exhibit A,to allow the
Stillwater Area High School Mountain Bike Team(the Team)limited mountain bike use
on existing mown trails in Brown's Creek Park;and
WHEREAS,on January 25,2016,the Parks Commission discussed the request
and determined the City should look into allowing mountain bikes in Brown's Creek
Park;and
WHEREAS,the City Council of the City of Stillwater discussed the request on
June 7,2016 and determined a limited use license for the 2016 year should be allowed
for the City to determine if alterations to the Brown's Creek Park Plan should be made
in the future.
NOW THEREFORE BE IT RESOLVED that the Stillwater City Council hereby
grants license to the Stillwater Area High School Mountain Bike Team to allow for
limited mountain bike use on existing mown trails,identified on the attached Exhibit B,
in the Brown's Creek Park:
1. A license must be applied for annually. The license is valid only for dates
specified in the Operating restrictions and conditions section,below.
2. No license will be issued or renewed without proof of general liability insurance
in the minimum amount of$1,000,000 per occurrence.
3. Operating restrictions and conditions:
a. The use license is valid from August 20 until October 27,2016.
b. The Team is allowed to use designated use license approved trails in
the park,one day per week on either Tuesday,Wednesday of
Thursday,determined by the Team coaches and based on ground
conditions,immediate weather,and other scheduled activities.
c. Limited mountain biking will occur only during the hours of 3:00 PM
and 5:00PM.
d. The Team will be accompanied,at all times,by trained coaches,
assistant coaches and/or specified and designated volunteers covered
under the Teams general liability insurance.
4. During periods of flooding and/or saturated ground conditions,limited
mountain biking use will not be allowed to operate from this location.
