CITY OF STILLWATER
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ADOPTING ASSESSMENT-BROWN'S CREEK COVE
(PROJECT 2016-07) L.I.411
WHEREAS, the council has met and considered the proposed assessment of the
Transportation Adequacy charges as requested by the Developer of Brown's Creek Cove.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of
Stillwater:
1. The proposed assessment, a copy of which is attached hereto as Exhibit A (The
Assessment Roll) and made a part hereof, is hereby accepted and shall constitute the
special assessment against the lands named therein, and each tract of land therein
included is hereby found to be benefited by the proposed improvement in the amount of
the assessment levied against it.
2. The assessment of $2,421.23 per parcel shall be payable in equal annual installments
extending over a period of three (3) years,the first of the installments to be payable on or
before the first Monday in January 2017, and shall bear interest at the rate of five (5)
percent per annum from the date of the adoption of this assessment resolution. To the
first installment shall be added interest on the entire assessment from the date of this
resolution until December 31, 2017. To each subsequent installment shall be added
interest for one year on all unpaid installments.
3. Property owners may at any time prior to certification of the assessment to the county
auditor, pay the entire assessment balance on such property, without any additional interest
to the City of Stillwater. NO INTEREST WILL BE CHARGED IF THE ENTIRE
ASSESSMENT IS PAID BY NOVEMBER 15, 2016. If the assessment is not paid by
November 15, 2016, accrued interest from the date of the adoption of the assessment roll
through December 31, 2017 will be added with the first installment due in 2017. The
yearly installments will be collected with the property taxes that are paid to Washington
County. You may at any time thereafter, prior to November 15th of any year, pay the
remaining principal balance(in whole or part)to the City of Stillwater.
4. The entire assessment will also become immediately due upon the sale of a parcel to an
unrelated third-party.
5. The clerk shall forthwith transmit a certified duplicate of the assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments shall be
collected and paid over in the same manner as other municipal taxes.
Adopted by affirmative vote of the majority of the City Council of the City of Stillwater
the 19th day of July, 2016.
