In the next two weeksisignage will be completed and streets and parking lots marked. In order to enforce the parking regulations, the Parking Ordinance will have to be amended to reflect the parking designations. Attached to this report is the final, signed and marked designations for the Downtown area. (This does not include lots outside of the Downtown Improvement Project area.) The City Council should review these descriptions one final time before the Parking Ordinance is revised. It is suggested that the Council set a workshop for July 14 to meet with the Parking Task Force, SEH, and City Staff to review the parking designations one final time. Glen Van Wormer in the attached memo of June 4, 1992, identified some parking issues that need further consideration; ie loading zones, handicapped spaces, a Parking Commission for parking management and curb marking. These areas, and any other parking concerns, would be considered at the July 14th meeting before the Parking Ordinance is possibly amended July 21. The net result was a considerable amount of signing in place, some of which could have been removed. _A goal of the downtown plan was to reduce the number. of signs. The construction -plans for the downtown improvements were to include replacement of most of the signs which were necessary and removal of many others. Simultaneously with the downtown planning came a change from parking meters to signed time restrictions. The rather quick removal of parking meters necessitated a quick installation of time limit signs, resulting in over -signing in some locations. Part of this was due to installing signs on existing posts or poles, or onto remaining parking meter posts. The subsequent removal of the parking meter posts further modified sign placements. The permanent signing was to be coordinated with revisions to parking. Combinations of two hour, four hour, and 30 -minute zones were to be used for public parking with special areas for permits, handicapped, or loading zones. Signing concepts were reviewed by the Downtown Planning Committee. Later the details were reviewed by the Downtown Action Committee. During this time, a number of physical changes to signs were made through the efforts of some concerned citizens. Unfortunately, records of most of the changes that were made are not available. Subsequently, loading zones, handicapped zones, and 30 -minute spaces were modified from the original approved installations. SHORT ELLIOTT HENDRICKSON INC. ST. CLOUD. The final plans that were part of the contract were reviewed by the Downtown Committees, Parking Committee, City staff, and many individuals. The final layout reflected a group effort towards the best signing. Construction started and removed many of the signs that were in place. Unfortunately, reinstallation or maintenance of some signs was not a. key concern .of the prime contractor,, and a r.:.zpcna:; t: e 3r =aigniig ;; s .: 01 : 1�r:K in pa oducir g permanent signing. With some delays and the early snowfall, many signs were not inpiace in the fall of 1991. ' During the entire process, the City has had numerous requests for actions regarding parking, designations, and especially signing. The City and the contractor have made a number of changes, most of which have been documented. Unfortunately, the signing which is physically in place is not complete compared to plans. This has resulted in criticism of the signing layout_ and request for modifications. Despite the Council's intent to make no more changes to the signing until construction is complete, there is continued pressure to do so. There is also concern that there is no legal Council action for many of the restricted spaces. The changes by plan were to have Council action. The changes that were made by the concerned citizens have no record and therefore, many of the them are probably not legal in terms of their specific restrictions. One of the biggest handicaps in understanding the signing in the downtown area is the 'lack of pavement markings. These were not .to be .instt11 '. is ii the ian aicif bituminous pavement was installed so 'that the markings would be permanent. This has resulted in considerable illegal parking. Requests have been made. for more signing or for larger signs which is contrary to the initial action of the Committees to reduce the number of signs and to minimize their size. The combination of marked parking stalls and signing in the construction contract should result in a system which is clearly understood by most motorists. To help clarify many sof the problems which are occurring in the downtown, we would like to propose the following actions: 1. The Council and City staff continue with the policy they adopted that there be no more changes made to the signing plans until the final pavement markings and signs have been installed. • • Steve Russell June 4, 1992 Page #3 2. The City Council review the attached parking list which identifies two hour, four hour, 30 -minute, handicapped, permit, and loading zones. This is what will be reflected in the signing which is currently part of the plan, modified slightly for modifications made .during the construction process. This does not restrict the Council from taking further action to modify signing, but at least will provide legal action necessary for proper enforcement. 3. The City should develop a definition and a policy for Icadi:.g zones. It is apparent, that many people would like to have loading zones for the convenience of themselves and their customers. The same building owners and occupants would also like to maximize parking for customers in the downtown. There is conflict when loading zones have restricted uses and businesses are complaining about lack of adequate parking. 4. The Council should also review its present, signing of handicapped spaces on the City streets. We have a concern .relative to the use of a prime parking space for handicap use when all City lots have handicapped spaces which currently are -under utilized. Our biggest concern is that a handicapped stall is generally 12 feet in width in a parking lot compared to the normal 8-1/2 or 9 feet for a regular stall. The 12 feet of width is not available in on -street parking spaces meaning that any extra width needed by the handicapped motorists will come from the through lane. This obviously sets up a safety concern which should be addressed. 5. For the long term, the City should look at setting up a Parking Commission. We have worked in several communities. we are such . a. Commission exists. The Commission would be advisory -to the. Council and would be set up similar to Planning Commissions, Charter Commissions or other specifically authorized groups. Changes in parking and parking signs should have review by this Commission. Membership could be made up from downtown business people, City staff members, citizen members, or a Council person. The benefit of such a organization would be to provide continuity of thought and action and to formalize a process which currently has many very interested and concerned people lobbying many different ways to try to get a specific modification or installation done. The Council would not give up any of its authority, but would receive input from a specific authorized group. July 7, 1992 STILLWATER CBD PARKING ORDINANCES 1. Perro Creek has been identified in the Middle River WMO Surface Water Management Plan as a possible project area. Over the years the creek has overflowed its banks during heavy rainfalls and this has caused some property damage. The Middle River WMO decided that this project affects only the cities of Bayport, Oak Park Heights, Stillwater and Baytown Township. These jurisdictions are being asked to fund a hydrologic study related to the Perro Creek watershed. The cost of the study is about $1,600 and the City of Stillwater's share is $66 (only 4 percent (4%) of the Perro Creek watershed lies within the City of Stillwater). I would request approval to contribute $66 for the study. We have some concerns about this situation and wish to go on record with our position regarding this and other developments. We are asking the City Council to enforce every aspect of our present ordinance which was written to protect the citizens of Stillwater from rows of Bed and Breakfasts giving a residential area a commercial feeling. One license in the 800 block of Pine Street does meet the requirements of the ordinance and this we support. We also support our present ordinance as written,however it seems that most licenses applied for and issued recently are asking for some form of non-compliance or variance. This practice should stop as it develops inequities within the market by requiring some of us to comply and allowing new licenses exceptions to our rules. We would like to see some form of governing of the current ordinance come out of City Hall. Following is a list of possible requirements: 1. Certificate of insurance - Since Homeowner Insurance does not cover B&B operations, proof of proper business insurance should be required by the city. 2. Proof of required off-street parking - Not just a drawing showing proposed parking but a physical inspection to see we are all in compliance. 3. Health Department license number should be on file Prior to opening. 4. Proof of fire inspection on file before opening. 5. Proof of sales and tax I.D. number on file before opening. 6. Proof of a wine license for all Inns which serve wine to their guests. 7. It is our belief that the issuance of licenses to people who do not open within a reasonable length of time (6 months) should be rescinded in order to open that market area to someone who is serious about the business. 2. The complete gutting and reconstruction of our historic homes in order to make them a new structure should remove those buildings from consideration as it places them in violation of the' age requirements of the ordinance as well as encourages the destruction of Stillwater's heritage. 3. B & B licenses should be used to encourage restoration of our larger historic homes and an encouragement to develop sensitive adaptive reuse of the structures. The number of rooms allowed should be determined by the size of the home and the number of original sleeping rooms. We have enclosed for your consideration a copy of an ordinance enacted in Galena, IL which addresses most of our concerns. In conversations this week with their building officials they indicate total satisfaction with the results. The physical and aesthetic impact of off-street parking located on the zoning lot shall not be detrimental to the existing character of the lot and the surrounding neighborhood. It shall be a priority to preserve greenspace. Generally, the capacity of a zoning lot to accommodate off-street parking shall be related to the size and nature of the lot, as stated in subparagraph 8.6.1.3 above. The purpose of this Is so that the special use permit shall contain a record of the Information on which the special use permit is based. (b) The specific period of time for which the special use permit shall be granted. (c) No guest house shall commence doing business until a guest house license has been issued by the City of Galena. (d) Proof of registration with the Illinois Department of Revenue and Jo Daviess County for hotel/motel taxes shall be given to the Zoning Administrator within ninety (90) days after issuance of the guest house license. (e) Records of payments made to the Illinois Department of Revenue and Jo Daviess County for hotet/motel taxes shall be submitted with the application for renewal of the guest house license, for renewal of the special use permit, or upon reasonable request, at any time, by the Zoning Administrator. Property owners granted special use permits for guest houses prior to August 1, 1989, and their heirs and assigns, shall only be required to meet guest house zoning requirements in force at the time said guest house special use permit was initially granted provided said guest houses meet all City licensing requirements, comply with all laws of the State of Illinois, and satisfy Section 8.6.4.(e) and Section 8.6.5(d) hereof. After May 1, 1988, no person shall operate a guest house or a bed and breakfast establishment (hereinafter called "guest house") as defined under the Galena Zoning Ordinance, without first having obtained a license for the guest house from the City. The license may not be issued until such person has obtained a special use permit for the guest house from the City. Sec. 12-109. Inspection Reports Required to Obtain License. No license shall be issued until the following inspection reports have been filed with the Galena Zoning Administrator: (a) A fire inspection report from the Galena Fire Chief stating that the guest house complies with fire and life safety regulations applicable to guest houses, as provided for in Chapter VII of the Galena Code of Ordinances. Sec. 12-110. Liabltity Insurance. Prior to obtaining a guest house license, the guest house owner shall provide the Zoning Administrator with proof that liability insurance coverage in an amount of not less than five hundred thousand dollars (3500,000.001 per occurrence exits with respect to such guest house. Sec. 12-111. Initial License and Annual License and Fees Therefor. Each applicant for a guest house license shall pay an initial license fee of one hundred fifty dollars (3150.00). Said fee shall be paid prior to the inspections being made pursuant to Section 12-109 hereof. Said fee shall be nonrefundable, even if the guest house license is never issued. Prior to March 1, 1988, each guest house owner shall apply for a guest house license for the fiscal year commencing May 1, 1988, and shall pay an annual license fee of one hundred fifty dollars (3150.001. Prior to February 1 of each year thereafter, any guest house licensee who wishes to renew his license for the next fiscal year beginning May 1, shall pay an annual license fee of one hundred thirty dollars (3130.00). Upon payment of said fee, reports in accordance with Section 12-109 hereof shall again be completed and submitted to the Zoning Administrator prior to May 1 of such year. An annual guest house license shall be issued upon payment of the license fee and upon the filing of said inspection reports. Sec. 12-112. Display and Form of License. The guest house license shall be conspicuously displayed near the registration area within the guest house. Since this area is generally lower than Myrtle Street, it is inundated more frequently in the spring by flood water. In order to increase the use of this City property, it would be more desirable to modify the elevation by filling slightly. This would mean approximately a 4 -foot or 5 -foot raise in elevation along the roadway and onto Mulberry Point. This corresponds to •elevations approximately 200 feet west of the river bank, which are still subject to inundation by the 100 -year flood level. By raising this area to the same elevation as properties adjacent to Myrtle Street just west of the railroad tracks, it would provide use by the City and its citizens for a longer time period during the year; and provide a more efficient means of fire protection for the marina and the cafe. Mitigation could be reviewed as a part of any changes made to the flood configuration and/or additions of retaining walls in the Mulberry Point area. One possible mitigation site would be Kolliner Park, which is property owned by the City on the east side of the river. The slight filling in the 100 -year area and possible mitigation would all have to be reviewed with the Corps of Engineers. We estimate that approximately 1,500 lineal feet of retaining wall would be required in addition to footage in the reports, such as the erosion protection wall inspection dated October 10, 1991 and the feasibility study prepared for the central business district improvements dated June 21, 1990, have indicated as wall rehabilitation and addition. We have roughly estimated this additional 1,500 lineal feet of wall to cost approximately • $1,350,000.00. SHORT ELLIOTT HENDRICKSON INC. ST. This area, as you know, has been protected with riprap which has been unsatisfactory because of the ice shoving conditions in the spring. That is, the riprap is pushed by the ice and literally piled up on the bank in the spring. This is a constant maintenance requirement for the City of Stillwater. We trust this additional review will assist you in your review of the work required along the waterfront to further protect the City of Stillwater and provide use for its citizens. As a resident of the City of Stillwater I and my family have used and enjoyed the park on many occasions. The riverfront setting is spectacular and is a real focal point for the downtown area as well as the entire city. At present the park .has deteriorated and is in need of maintenance and enhancement. One enhancement that would greatly improve the "friendliness" of the park for the public would be the elimination of the roadway which runs adjacent and parallel to the river. The presence of cars, trucks, and motorcycles between the green area of the park and the river detracts from the natural setting and enjoyment of the river. Actual flow in 1991 was determined by the metered and/or unmetered flow from your community. The allocation also shows any credits for facilities acquired from your community (current value credit) or for debt service paid by your community. It also shows any credit or debit resulting from the 1989 Final Cost allocation. A debit or credit generally occurs when a community has more or less wastewater volume than estimated, relative to other communities. The 1991 final cost allocation is based on the actual wastewater flow and agency expenditures for the year. This result is then compared to the amount of money your community remitted. Any adjustment, whether a debit or a credit, will be applied to the estimated sewer service charges for 1993. I am forwarding a copy of this statement to your finance officer. DELAY. Upon acceptance of this proposal as a contract, the Company agrees to start the described work at such time as may be agreed to by both parties, provided the site is made available to the Company free of obstructions as indicated in condition 11 above Upon completion, the Company will clean up the premises in the immediate area of the work unless other arrangements are requested in writing by the Purchaser. Purchaser shall have an authorized representative at the site of work for inspection and acceptance at the tiMe of completion of work. 13. WATCHMEN. The Company shall not be responsible for charges for watchmen or for inspection of work or materials, unless otherwise agreed to in writing. 14. RIGHTS-OF-WAY, PERMITS, ETC. MN 55433 1,1 21 7110-6x01 As your Sub -Committee works on the Water Resources Development Act of 1992, I would like to ask your assistance for what I hope you will see as a modest request toward stopping the erosion of a retaining wall system in Stillwater, Minnesota. My office has been working closely with the Army Corps of Engineers - St. Paul District Office and the City of Stillwater to obtain technical assistance through 1946 • Flood Control Act, Section 14 Emergency streambank and shoreline protection (a Continuing Authorities Program). Currently, we are anxiously awaiting the announcement of a feasibility study by the North Central Division US. Army Corps of Engineers. Mr. Chairman, I am writing you today because the problem we are facing is serious enough to warrant action above and beyond the Section 14 program. First of all, Section 14 has a $500,000 statutory Federal cost limitation. Engineers have estimated that it will cost 51.2 million to repair the existing retaining wall system and another $800,000 to extend the wall system which would protect the City of Stiilwater's trunk sewer line and lift stations. Under this funding level the City of Stillwater would be left to finance 75% of the project, a price tag the City can not afford to pick-up. Furthemiore, the river wall, the lift bridge connecting Minnesota and Wisconsin, Lowell Park, and the busy commercial section of downtown Stillwater are all listed on the National Register of Historic Places. Erosion of the wall system threatens each of these historic markers. The wall system and bridge hold up more than just history, more specifically, the Army Corps of Engineers concluded in a preliminary report that, "failure of the wall could lead to temporary loss of the only bridge across the St. Croix River between Hudson and Osceola, Wisconsin a distance of 28 miles." Stillwater medical services provide primary health care for many Wisconsin residents who are dependent on the bridge for access into the Stillwater area. THIS STATIONERY PRINTED. ON PAPER MADE OF RECYCLED FIBERS One final point, the Army Corps of Engineers reported, "(f)ailure is not the result of inadequate maintenance by the city." And so as you can see, time and water have taken their toll on Stillwater's protective wall system and could lead to economic and historical damage at any time in the next two years. Action must be taken now on this retaining wall system, built 55 years ago as a WPA project. In light of the economic and historic importance of the wall system, I request that this year's Water Resources Development Act include authorization for Stillwater's retaining wail system. Mr. Chairman, this project is top priority for myself and my constituents and I thank ycu for your attention. Providing and maintaining jacking pits with minimum dimensions of 8 feet in width, 34 feet long, to a depth of 18 inches below the bottom of the pipe, including sheeting the face and sheeting other sides as may be required. (Said jacking pits shall be provided by the owner or general contractor in a dry condition. Owner and/or general contractor shall be responsible for back -filling, restoration and removal of excavated material piled beside the working pit.) 2. Providing all pumping including dewatering to 6 inches below the flowline of the pipe. 3. Providing access for rubber -tired vehicles within 10 feet of the centerline of the working pits. 4. Furnishing and maintaining any barricades, signs, flares and/or other required safety devices. 5. Your attention is directed to the CONDITIONS attached hereto. By accepting this PROPOSAL, you will be accepting said CONDITIONS and acknowledging that you have received, read and understand same. TERMS: 1. Where rock or shale is encountered, we reserve the right to increase the above price based upon time and material required to remove said obstructions. 2. Construction estimates will be invoiced monthly unless other satisfactory arrangements are made prior to beginning work on the project. Materials delivered to the job site in excess of $500 may be billed upon delivery. 3. Our terms are net 30 days from date of invoice (no retentions). It is understood and agreed that this PROPOSAL now constitutes the entire agreement between the parties, and that no oral statements varying the terms thereof shall have any force or effect. (company) (by) (title) Date: EJM PIPE SERVICES, INC. (by) EJM PIPE SERVICES, INC. CONTRACT CONDITIONS 1. PARTIES; ACCEPTANCE OF PROPOSAL. EJM Pipe Services, Inc. is hereinafter called the "Company". The party to whom the within bid proposal is made is hereinafter called the "Purchaser". The proposal together with these conditions shall constitute a short form of contract, which will be binding on both parties, after being signed by legally authorized officials representing the Purchaser and the Company, provided that the Company has delivered its acceptance of this proposal within five (5) days of the expiration date shown on the face of this bid proposal. 2. INSURANCE. Insurance to be furnished by the company to cover work on this proposal shall consist of comprehensive general liability and automobile liability insurance as well as worker's compensation insurance as required by state law. Insurance costs other than the forgoing are not included in this proposal. If other types of coverage are required, They will be charged for at the prevailing rates applicable to the coverage required. Premiums for payment and performance bonds, state or municipal taxes have not been included in the prices on this proposal unless otherwise stated on the face thereof. 3. UNIT PRICING. If the prices quoted herein are iinit prices, it is understood that any quantities or dimensions appearing in this proposal are approximate. Final quantities and dimensions shall be agreed to by both parties, when the work is completed, and the unit prices quoted herein shall be applicable for computing the total amount payable to the Company. 4. DRAWINGS AND SPECIFICATIONS. Purchaser shall supply himself with the latest issue of all drawings and specifications and shall keep a copy thereof at the work site at all times 4Ind in good order so as to be available for inspection by Company. 5. CHANGE IN CREDIT CONDITION OF PURCHASER. Terms of payment are subject to the approval of the Company's Credit Department. If in the Company's sole opinion, the credit condition of the Purchaser has changed between the date hereof and the commencement and/or completion of the work to be performed hereunder, the Company reserves the right to change the terms of payment as a condition to the performance of its obligations. 6. DELAY. The Company shall not be liable for failure or delay in delivery or performance due to Acts of God, subsurface rock or shale, differences with workmen, local labor shortages, Ifire, flood or other casualty, governmental regulations or requirements, shortages or failure of raw materials, supplies, fuel, power or transportation, breakdown of equipment, or any other causes beyond Company's reasonable control whether of similar or dissimalar nature than those enumerated. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY CONSEQUENTIAL DAMAGES OR CLAIMS FOR LABOR RESULTING FROM FAILURE OR DELAY IN DELIVERY OR PERFORMANCE 7. WARRANTIES. The Company warrants title to, and freedom from encumberance on, the products sold hereunder. The parties acknowledge and agree that there are no other understandings, terms, conditions or warranties, either expressed or implied. 8. PURCHASER'S REMEDIES. The Company's liability hereunder shall be limited to its obligation to perform according to the terms of the proposal. 9. TECHNICAL ADVICE. The Company shall not be responsible for the results of any technical advice in connection with the design, installation and use of the products sold hereunder. 10. BACK CHARGES. All back charges are subject to negotiation and must be presented to the Company in writing within thirty (30) days after the Company completes its work. 11. REMOVAL OF OBSTRUCTIONS. All utility lines, sewers, water mains, conduits or other obstructions which may retard the progress of the work, herein described, shall be promptly relocated or removed by others at no expense to the Company unless otherwise specified on the face of this proposal. 12. COMMENCEMENT AND COMPLETION OF WORK. Upon acceptance of this proposal as a contract, the Company agrees to start the described work at such time as may be agreed to by both parties, provided the site is made available to the Company free of obstructions as indicated in condition 11 above. Upon completion, the Company will clean up the premises in the immediate area of the work unless other arrangements are requested ii writing by the Purchaser. Purchaser shall have an authorized representative at the site of work for inspection and acceptance at the time of completion of work. 13. WATCHMEN. The Company shall not be responsible for charges for watchmen or for inspection of work or materials, unless otherwise agreed to in writing. 14. RIGHTS-OF•WAY, PERMITS, ETC. Unless otherwise expressly agreed to in writing, all agreements for right-of-way, permits and other authorizations to permit the work to be done and payment therefor to be made shall be obtained by the Purchaser at the Purchaser's expense and satisfactory evidence thereof furnished to the Company before the Company shall become obligated to furnish materials or perform the work. The setting of line and grade stakes shall be an obligation of the Purchaser, unless otherwise expressly agreed in writing. 15. WAIVER.
