HomeMy WebLinkAbout2016-070 (The Preserve - Variances) RESOLUTION NO. 2016-070 CITY OF STILLWATER WASHINGTON COUNTY,MINNESOTA A RESOLUTION RECINDING AND REPLACING RESOLUTION NO. 2015-046 AND APPROVING VARIANCES FOR THE PRESERVE OF STILLWATER CASE NO. 2014-39 13310 BOUTWELL ROAD WHEREAS, Thad Rich made application for approval of a rezoning and preliminary plat for RICHLIND encompassing property legally described as: See Exhibit A; and WHEREAS, together with the preliminary plat application, Thad Rich requested variances to the wetland buffer, the wetland buffer structure setback, front yard setback,minimum lot area and the subdivision regulations; and WHEREAS, on February 11, 2015 the Stillwater Planning Commission held a public hearing on the variances associated with a preliminary plat and found the variances were reasonable, due to a uniqueness of the property, and that they would not alter the essential character of the neighborhood, recommending approval of the variances; and WHEREAS, on March 3, 2015 the Stillwater City Council held a public hearing on the variances and approved; and WHEREAS,on March 22,2016 the Stillwater City Council considered a Final Plat approval request for the development, though the name of the plat is now THE PRESERVE OF STILLWATER and lot and block numbers have changed; and WHEREAS,in order for the approved variances to be assigned to the proper lots and blocks, their legal descriptions need to be changed to correspond to the plat of THE PRESERVES OF STILLWATER. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Stillwater hereby rescinds Resolution 2015-046 and re-approves the following variances for the development: Resolution No. Page 2 of 3 1 A 5' variance to the Wetland 1 60' wetland buffer for disturbance associated with the construction of the right-of-way. 2. A 55' variance to the Wetland 1 60' wetland buffer and a 35' variance to the Wetland 4 60' wetland buffer for disturbance associated with the installation of storm sewer improvements. 3_ A 5' variance to the 60' wetland buffer for the preexisting structure on Lot 2, Block 2 to be located 55' from a wetland. 4_ A 20' variance to the 20' wetland buffer setback for the preexisting structure on Lot 2, Block 2 to be located 55' from a wetland. 5. A 5' variance to the 30' front yard setback for Lot 1, Block 2, and Lots 1-5, Block 1 for future structures to be located 25' from the property line. 6. A 557 square foot variance to the minim lot area for Lot 1, Block 2. 7. A 70' variance to the 600' maximum cul-de-sac length. Ward,City Clerk Resolution No. Page 3 of 3 Exhibit A Legal Description All that part of the E 1/2 of NW 1/4 of Section 29,Township 30 North,Range 20 West, Washington County,Minnesota, described as follows: Beginning at a point where the West line of the above described tract intersects the South line of the right-of-way of the Minneapolis-St. Paul and Suburban Railway Co.;thence southeasterly along said right- of-way line, said line being a curved line, a distance as measured on the chord of said curved line,428 feet to a point;thence South on a line parallel to the West line of said 80 acre tract to the center of the public highway running trough said 80 acre tract;thence northwesterly along the centerline of said public highway to a point where the centerline of said public highway intersects the West line of said 80 acre tract; thence North along the West line of said 80 acre tract to the place of beginning.
