A RESOLUTION APPROVING THE DEVELOPMENT AGREEMENT FOR
THE PRESERVE OF STILLWATER
CASE NO. 2016-15
WHEREAS, Joseph Klewicki of Tribella Properties - MN, LLC made application for
approval of the final plat known as THE PRESERVE OF STILLWATER; and
WHEREAS, on January 14, 2015 the Stillwater Planning Commission held a public
hearing and recommended approval of the preliminary plat, formerly known as RICHLIND;
and
WHEREAS, on March 3, 2015 the Stillwater City Council held a public hearing on the
preliminary plat;and
WHEREAS, on March 22, 2016 the Stillwater City Council reviewed the final plat and
final plans for THE PRESERVE OF STILLWATER and found them to be consistent with the
preliminary plat and plans they approved on March 3,2015.
NOW,THEREFORE, BE IT RESOLVED,that the City Council of the City of Stillwater
hereby approves the Development Agreement for THE PRESERVE OF STILLWATER with the
following conditions:
1. The site shall be developed in substantial conformance with the following plans on file
with the Community Development Department,except as may be modified by the
conditions herein:
• Existing Conditions Sheet C1.1 dated 12/12/2015
• Tree Survey&Preservation Plan Sheet C1.1.2&L1.1 dated 12/4/2015
• Demolition Plan Sheet C1.2 dated 3/17/2016 by AW
• Site Plan and Wetland Plan Sheet 2.1 dated 3/17/2016 by AW
• Grading Plan&Details Sheet C3.1 &C3.4 dated 3/17/2016 by AW
• Erosion Control Plan Sheet C3.2 dated 3/17/2016 by AW
• Street Plan and Profile Sheet C3.3 dated 3/17/2016 by AW
• Grading Details Sheet C3.4 dated 3/17/2016 by AW
• Sanitary Sewer&Watermain Sheet C4.1 dated 3/17/2016 by AW
• Storm Sewer Plan Sheet C4.2 dated 3/17/2016 by AW
• Utility Details Sheet C4.3 dated 3/17/2016 by AW
2. This development shall be responsible for paying 2016 development impact fees,
including the Transportation Adequacy/Mitigation Fee, the AUAR fee and trunk sewer
and water fees. These fees shall be due prior to release of the final plat for recording
with Washington County.

3. Storm ponds shall be designed to reflect the new rainfall data from National Weather
Service Atlas 14.
4. The Middle St.Croix Watershed Management Organization conditions include:
a) Reduce the maximum ponding depth in the infiltration basin to 21.6" to achieve
drawdown in 48 hours. The infiltration design rate for SM soils is 0.45" per hour.
Provide sufficient area to retain the full 2,445 cubic feet of storage at a maximum
ponding depth of 21.6" within the infiltration areas.
b) Forebays cannot be credited for volume reduction.
c) Provide a cross section of the infiltration basins indicating soil types and elevations
in compliance with design guidance in the most recent version of the Minnesota
Stormwater Manual.
d) Submit a legally binding maintenance agreement for stormwater features.
e) Hydrocad summary submitted does not match the conditions on the plan and must
be corrected and resubmitted.
f) Pipe run OCS#3 to STMH#4 is labeled as a 12" RCP and a 21" RCP.
g) Grate for OCS#5 must have incorrect dimensions.
5. The developer will provide to the City Engineer a storm water maintenance plan
obligating the Developer and future owners to the continued maintenance of the storm
water control features,swales and ditches,infiltration basins and fore bay basin.
6. All civil engineering plans must be found satisfactory to the City Engineer,or revised to
his satisfaction,prior to release of the final plat from City offices for filing with
Washington County.
7. All electrical and communications utility lines shall be buried.
8. Prior to release of the final plat for recording with Washington County,a$20,000 park
and trail dedication fees shall be submitted to the City (minus any credit for pre-
approved trail construction costs). In the alternative,the developer may pay the$20,000
park and trail dedication fees prior to release of the plat,and upon completion of the
trail any credit determined to be applicable by the City Engineer would then be
reimbursed to the developer.
9. Conservation easements for all Lots will be filed with the final plat for all wetlands and
wetland buffer areas.
10. No building shall occur on noncontiguous rear yard areas.
11. Pruning and grading near any of the oak trees to be saved,especially the red oak,shall
not occur between April 15th and July 1st,unless a professional forester has prepared an
oak impact plan that is approved by the City in advance of work on site.
