A RESOLUTION APPROVING A SPECIAL USE PERMIT
FOR LAKEVIEW HOSPITAL TO OPERATE A SLEEP STUDY CENTER
AT 850 CHURCHILL STREET WEST
PLANNING CASE NO.2016-09
WHEREAS, the Lakeview Hospital made application for approval of a Special
Use Permit to convert the existing office building into a sleep study center, located at
850 Churchill Street West on property legally described as:
See Exhibit A;and
WHEREAS, on February 8, 2016 the Planning Commission held a public hearing
on the requested Special Use Permit, and recommended approval with conditions;and
WHEREAS, on March 8, 2016 the City Council held a public hearing on the
requested Special Use Permit.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Stillwater hereby approves the requested Special Use Permit with the following
conditions:
1. The facility shall not be advertised as a clinic.
2. Sleep study services shall be the only patient care services allowed onsite.
3. Laundry services shall be limited to 7:30 a.m. to 4:30 p.m.
4. Prior to the issuance of a building permit,the two existing lots shall be combined
into one lot.
5. The property owner shall completely enclosure all exterior trash receptacles on all four
sides.
6. The exterior facade of the enclosure,vestibule and retaining wall shall be of the
same or complimentary color and tone as the existing building facade.
7. Lighting fixtures must provide a complete cut-off so the bulb/source of light
cannot be seen off the property, and at the property lines,the illumination must be
engineered to be zero lumens.
8. Onsite parking shall be reserved for the sleep center patients and staff. A sign,in
conformance with City Code Section 31-509, Sign Regulations, shall be installed on
the property designating the parking designation.
9. Sign permits shall be obtained prior to the installation of any required or desired
signage.
10. The property owner shall secure the necessary building (including mechanical and
plumbing) and electrical permits prior to any interior or exterior site alterations.
11. Prior to the release of a Certificate of Occupancy,verification of compliance with
the noise ordinance provisions shall be submitted to the City upon installation of
the exterior mechanical equipment. Equipment not in compliance with the City's
nuisance regulations shall be rectified.
12. The permit is not transferrable to another agency without prior approval by the
City Council.
13. The project shall be completed according to the plans on file with the Community
Development Department.

EXHIBIT A
That part of Lots 4, 5, and 6, Block 6, Holcombe's Addition to Stillwater, lying
South of the North 100 feet thereof, as measured along the Westerly line of said
Lot 6 and the Easterly line of said Lot 4. Also, that part of Lots 7, 8, and 9,
of said Block 6, lying North of the South 100 feet thereof, as measured along the
Westerly line of said Lot 7 and Easterly line of said Lot 9. Also, the South
100 feet of Lots 7, 8, and 9, Block 6, Holcombe's Addition to Stillwater, as
measured along the Westerly line of said Lot 7 and the Easterly line of said Lot 9.
Also, that part of vacated Churchill Street being the North 5 feet of said platted
street thereof which adjoins the South line of said Lots 7, 8, and 9.
