RESOLUTION APPROVING A VARIANCE FOR A GARAGE ADDITION
AT 1015 3rd AVENUE SOUTH (CASE NO. 2015-5)
WHEREAS, Kari Garrat requested approval of a variance to allow for the construction of a garage
addition to be located 11.5' into the Front Yard Setback at her residence located at 1015 3`d Avenue South;
and
WHEREAS, the subject property is zoned RB, Two Family Residential and a 30' Front Yard
Setback is required for garages in the RB zoning districts; and
WHEREAS, City Code Chapter 31, Section 31-208 establishes a process for reviewing requests for
variances; and
WHEREAS, according to the established process, the Planning Commission held a public hearing
on March 11, 2015, and denied the variance; and
WHEREAS, City Code Chapter 31, Section 31-217 established a process for reviewing requests for
appeals to decisions of the Planning Commission; and
WHEREAS, on April 7, 2015 the City Council held a public hearing to consider the appeal to the
denial of the variance.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Stillwater finds a
three-car garage is reasonable, that a unique opportunity is presented to remove significant impervious
surface from the right-of-way, and that the garage addition will not significantly alter the essential character
of the neighborhood and hereby approves a 11.5' Front Yard Setback variance for a garage addition to be
located 18.5' from the property line with the following conditions:
i. Plans shall be substantially similar to those on file with the Community Development Department.
ii. A grading plan shall be reviewed and approved by the Engineering Department prior to the issuance of
a building permit or approval of an amendment to an existing building permit.
iii. A building permit or an amendment to an existing building permit shall be reviewed and approved
prior to exterior alterations.
iv. Major exterior modifications to the variance permit request shall be reviewed by the Planning
Commission.
