Dear Mr Kimbele,
I would like to provide Carriage Rides to individuals in the City of Stillwater during the months
of May through September on the weekends to begin this year and possibly again for up the
coming year if all goes well with this service. The vehicle I would be using would be a Vis-a-Vis
Carriage (1800 reproduction with hydraulic brakes and electric lights -holds 6 to 8 passengers)
hitched to a Belgian draft horse. The unit.I will use does have a equine waste basket attached to
the vehicle. The horse would be trailered in, I would need the size of 2 to 3 parking spaces
located close to where I will be providing rides. The area I would like to use for travel is along
the river front - open to suggestions. The pick up point I am interested in is close to the river
boats/cave tours and the drop of point is the same or open to discuss. My back ground as it
relates to horses consists of 32 years experience as a professional 3rd generation horse trainer
interested in providing carriage rides as a hobby.
I believe the availability of a horse drawn vehicle would enhance the atmosphere of the City of
Stillwater providing people with an experience of how it was to get around in the 1800's. Horse
drawn Carriages are a large part of American History I am proud to promote.
I would like to present my request to the City of Stillwater at a upcoming board meeting. I can

PARKING EASEMENT
THIS INDENTURE made this--�j!�_day of December, 1996,by and between MAINSTP EAM
DEVELOPMENT PARTNERSHIP, a Minnesota Partnership, ("Grantor"), and the CITY OF
STILLWATER, a Municipal Corporation of the State.of Miflnesota, ("City").
RECITALS
A. Grantor is the owner of land, (the "Property") located in the City of Stillwater, County of
Washington, State of Minnesota, legally described as set forth on Exhibit "A" attached hereto.
B. The City desires to obtain an easement for public parking over a portion surface parking lot
on the part of the Property described in Exhibits "A" and "B" attached hereto, (the "Parldng Area").
NOW,THEREFORE,in consideration of the mutual covenants contained herein,Grantor grants
to the City:
1. Non-Exclusive Possession of parking,Area. City shall have non-exclusive use of the parking
spaces located in the improved, surface parking lot in the "Parking Area" between the hours of 6:00 p.m,
and 5:00 a.m., Monday through Friday,,between the hours of 6:00 p.m. Saturday until 8:00 a.m.
Sunday, after 3:30 p.m. on Sunday until 5:00 a.m. Monday and any National Holiday,
At all other times, exclusive use of the Parking Area is reserved in the Grantor,
2. Use. City is permitted to use the Parking Area, for public parking and for law enforcement
purposes for the benefit of the Grantor and the Public;subject to the following conditions:
A. Signage_. The City must, at its sale expense and subject to the approval of the
Grantor, design and install signage that clearly identifies the Public Use Periods provided for by-this
Easement.
B. Insurance, City must maintain compreh6nsive liability insurance,naming Grantor as
an Additional Insured in an amount equal to at least$600,000.00 per occurrence(combined single limits)
for the use of the Parking Area by the City and the Public,

C. denmi , the City hereby indemnifies, defends and saves Grantor and its
employees, agents, insurers, assigns, and affiliated partnerships and corporations harmless from and
against all claims, actions, costs (including without limitation reasonable attorney's fees and costs and
witnesses' fees and costs) or damages of every kind and description(including without limitation claims
for property damage or personal injury), fees,judgments, expenses, liabilities, liens, and suits, known
or unknown, liquidated or unliquidated, which accrue to or,are suffered by any person or property
resulting from acts or orrtissions of the Public and the City, its employees, agents, and licensees in
connection with the use of the Parking Area.
D. Term. This Easement and the rights and covenants contained herein is perpetual and
shall run with and bind the .land.
3. Notices, Any notices relating to the Easement must be in writing and will be deemed
delivered when personally served or when sent by first class certified mail, return receipt requested,
served or addressed as follows:

RE: Negotiationa with the Main Stream Developr.�ent Partnership with regard to the]Maple
Island Site
NVhen the.City Council approved the transfer of a 20 foot strip of land adjacent to the tyle Island Site
to the Main Stream Development Partnership, Main Stream Partnership agreed in return to grant a
parking casement to the City over the parking lot on the North and of the site, South of Mulberry
between Main and Water.
I began the negotiations with Karl Ranum by proposing an easement that was identical,to the parking 101,
agreement that had been in place between the City and Mapla Island when the City resurfaced the parking
tot several years ago. This language has not been acceptable to Main Stream and Ranum has role]me that
Vern Steffan is asking for different conditions.
The terms of tha prior lease and the easement language that t suggested for City use of the tot is as
follows-
%. Rzclusiyc possession of par int arca. City shat] have exclusive use of the North row of
parking spaces at all times and exclusive use of the remainder of the spaces ("the remainder
area") between the hours of 6:00 p.m. and 5:00 a.m. Monday through Friday and at all tines
on Saturday and Sunday and any National Holiday."
The language that Ranum asks, for is as follows:

Dear Mayor,
On July 9, 2004 a group of 24 seniors from Becketwood Cooperative in Minneapolis
traveled via Becketwood's van to Stillwater. Their purpose was to tour the city on the
Stillwater Trolley and to have lunch at the Dock restaurant. Becketwood's driver
inquired at the Dock as to where it would be appropriate to park the van. He was directed
to the City lot and was told that during weekdays it would be no problem to park there.
When the group returned to the van after the tour and lunch, the driver found that the van
was ticketed. The agent who was then on duty at the lot said that there were no
exceptions to people using the lot without paying for it. He also complained rather
bitterly to our driver about the fact that the van was parked across several spaces, in spite
of the lot still being mostly empty.
I am enclosing our check for the twenty dollars due for the violation—no big deal.
However, I thought you should be aware that this did not sit very well with my driver or
the 24 visitors to your lovely town. The businesses in your community that have
substantial contact with such groups need to know where to direct a driver to park an
obviously over-sized vehicle. I have to think that vans bringing groups to town is a fairly
common occurrence in Stillwater in the summer. I just thought you should know.

I am paying this parking fine as cited; however, I would like to state that I think it is
unjust. I parked in the Public Parking Lot and there was not a sign stating there was a 3
hour limit that was visible from my parking spot. . I do not live in Stillwater, so I'm not
familiar with the restrictions. Maybe the sign was removed for some reason, but it was
not visible at entry.
When I returned to my vehicle and found the ticket, I looked for a sign stating the parking
rules and there was a sign on the other end of the parking lot. It was not something I
could see from my location without first walking to the other end of the lot. When you
spend a day with friends shopping and dining in Stillwater, it takes more than 3 hours.
This ticket ruined a fun day and now when I think of returning to Stillwater I will have a
negative feeling.
You better replace your missing signs, or post the rules for all to see.

RE: South Main Parking Improvement Project
Project 2004-05
DISCUSSION:
Bids for the South Main Parking Improvement Project were opened on Thursday, July 15,
2004. The City received one bid with the low bid of$128,035.00 submitted by Tower
Asphalt (see attached resolution). The engineer's estimate for this project was $154,000.00.
This project will be funded by the Downtown Parking Fund.
RECOMMENDATION
I recommend that the City accept the bids submitted for the South Main Parking
Improvement Project, Project 2004-05 and award the contract to Tower Asphalt with a low
bid of$128,035.00.
ACTION REQUIRED:
If Council concurs with the recommendation,they should pass a motion adopting the
Resolution 2004- ACCEPTING BID AND AWARDING CONTRACT FOR

ACCEPTING BID AND AWARDING CONTRACT FOR
SOUTH MAIN PARKING IMPROVEMENTS
(Project 2004-05)
WHEREAS,pursuant to an advertisement for bids for the South Main Parking Improvement
Project,bids were received, opened and tabulated according to law, and the following bid was received
complying with the advertisement;
BIDDER BID AMOUNT
Tower Asphalt, Lakeland, Minnesota $128,035.00
ENGINEER'S ESTIMATE $154,000.00
And
WHEREAS, it appears that Tower Asphalt of Lakeland,Minnesota is the lowest responsible
bidder.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
STILLWATER,MINNESOTA:
1. The Mayor and Clerk are hereby authorized and directed to enter into a contract with Tower
Asphalt of Lakeland,Minnesota in the name of the City of Stillwater for the rehabilitation of
Main Street Parking Expansion according to the plans and specifications therefore approved by
the City Council and on file in the office of the City Clerk.
Adopted by the City Council this 20th day of July 2004.
