Magnuson DATE: November 18, 2014 RE: Status of Removal of the Zephyr Engines as of 11/18/2014 The move from Lake Elmo to Alamosa Colorado has been approved by the UP as Proposal Number 98408. Cars will be ordered to the Lake Elmo UP siding as soon as a written agreement can be made with the owner of the former Lake Elmo Hardwood parcel. For the UP, I have been in touch with Meghan McClain of the UP in Omaha. I have talked to Tom Edison, the manager of CHEEE LLC, owner of the siding, and Tom has sent a confirming email to the UP and will follow up with the required written agreement. While I was doing this memo, a text message came from Megan in Omaha that approvals have been given to order rail cars. I have talked with Tom Shuman of STS,a heavy hauler out of Comfrey MN. He confirmed that he has been retained to do the haul from Stillwater to Lake Elmo and has given the date of December 15th as the first date that he has available. I have talked with Meghan, with Ken Bitten of Heritage Leasing who is funding this move, with Tom Edison representative of the owner of the siding, and Tom Shuman the heavy hauler under contract for the move. All four have given sincere reports that the approvals have been given and the financial commitments have are in place to make this move a reality. Therefore, I would recommend that the extension deadline for removal be moved forward to December 15th, 2014. IP'< -. • All private/for-profit events held in the city pay at $15 per hour per reserve officer working the event. • The reserve unit completely funds and provides for itself (uniforms, training, equipment, etc) • The reserve unit also assists the parking enforcement division through the issuance of administrative parking citations. Statistics: Total ride-along/patrol hours: 786 in 2014 (compared to 74+ 14 in 2013) Total public events worked: 19 t As well as 7 monthly meetings. In order to continue with the work, the contractor has proposed to shelter the unfinished walls (north and west sides) and provide temporary heating in order to complete the masomy work. This work was not factored into the original project cost, is considered extra work and requires a change order. The amount of the work is estimated at $3000.00. Once the structural walls are completed, the roof would be installed and the building enclosed. Work on the bathroom interior would continue through the winter with some additional heating costs to the project. Next spring the exterior brick would be installed. RECOMMENDATION: In order to continue on with the Lowell Park Bathroom project, it is recommended that council approve change order in the amount $3000 to shelter and heat the unfinished masonry walls of the Lowell Park Bathroom. STAFF REPORTS Police Chief Gannaway stated that extra staff will be available on Halloween and recommended bright clothing, flashlight and leaving lights on for safety Halloween, however in the past it has not been an issue. Community Development Director Turnblad informed the Council that a public information meeting on the Stillwater Barge property will be held at the Library, November 17 from 6-8 p.m. Public Works Director Sanders that the parks will be closed as of Friday, October 31. He also provided an update on the restroom project and parking lot construction. Councilmember Polehna provided an update on the Naming of the Park Contest that six names (Bridgeview Park, Lift Bridge Park, Sawmill Park, Loggers Park, Mill Park and Riverfront Park) were chosen by the Park Board and recommended that a committee be formed consisting of Rob McGarry of the Parks Board and chairs ofHPC & Planning Commission along with a staff member & two members of Council. Council consensus that Councilmember Menikheim and Polehna be Council representatives and have the chairpersons serve or appoint someone for the committee. NEW BUSINESS Summer Tuesdays request for invoice reduction Community Development Director Turnblad reviewed the parking fee reduction request to $624 instead of $936, received from Cory Buettner, Summer Tuesdays. He stated that due to flooding in North Lowell Park during four of the Summer Tuesday event dates, 26 spaces in Lot 2 needed to be used as an alternate location for some of the activities. He stated that Mr. Buettner presented this request to the Downtown Parking Commission and they recommended that Council approve the change. Motion by Councilmember Kozlowski, seconded by Councilmember Polehna to approve the request for the reduction from $936 to $624 for the lot use. All in favor. COUNCIL REQUEST ITEMS Councilmember Kozlowski inquired about the Downtown Parking restrictions. Public Works Director Sanders stated that it would be on the November 18th agenda. Both service providers have indicated their willingness to extend the 2014 contract through December 31, 2014. REQUESTED ACTION Staff requests the Council to approve the attached resolution, extending two contracts: 1) for mowing, snow removal, and clean up services with C. Hassis; and 2) for yard clean up and securing of property to MSP Outdoor Services through December 31, 2014. The reconstruction was part of the City's Downtown Parking Lot Project constructed in 2013 and completed in 2014. According to the development contract, all associated costs of the parking lot was to be assessed to St. Croix Preservation. These costs have been finalized and amount to $103,177.02. This amount is further reduced by $10,305, to account for reimbursements spelled in the contract for lot striping, garbage enclosure and parking lot expansion. For a total assessment of $92,872.02. In the contract St. Croix Preservation consent to the assessment and waived any right to appeal the assessment. A resolution has been prepared for council to adopt the assessment RECOMMENDATION: It is recommended the council approve the resolution to adopt the assessment for St. Croix Preservation ACTION REQUIRED: If Council concurs with the staff recommendation, they should pass resolution 2014- A RESOLUTION ADOPTING ASSESSMENT A RESOLUTION ADOPTING ASSESSMENT WHEREAS, pursuant to a Development Agreement between St. Croix Preservation, a Minnesota limited liability company, and the City of Stillwater, Washington County, Minnesota, the City Council met and considered its obligation under the Development Agreement to certify against property assessments for Parking Lot Improvements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Stillwater: 1. The proposed assessment, a copy of which is attached hereto and made a part hereof as Exhibit “A,” is hereby accepted and shall constitute the special assessment against Parcel No. 28.030.20.41.0018 and the Parcel is hereby found to be benefited in the amount of the assessment levied against it. 2. The assessment shall be payable in ten (10) annual installments, the first of which is to be payable on or before the first Monday in January, 2014 and will bear interest at the rate of three (3) and one–quarter (¼) percent per annum from the date of the adoption of this assessment resolution. The timing is also appropriate. Loggers Park Mill Park  The shoddy mill is placed there, and Commander Mill can be seen from the park. It also is the location of other mills in the past.  The park is located on a former site of a mill. Mills were critical component of Stillwater’s rich, river city history. It is a short name that is easily remembered and honors the memory of mills in Stillwater. Riverfront Park  Close to the river Sawmill Park  They all have a connection to the area or a history for that site.  I believe the name should be simple and plan, someone might even say boring! Every city has one of these parks and we should name it something that sounds like it has been around for a long time. Easy to remember, nothing trendy please.  There used to be a sawmill on the property. The rock/brick chimney structure for the sawmill is still standing and can be seen from the park. It is located just to the west of the park on the edge of the bluff above Highway 95.  Original use of property was for Hersey Staples sawmill. Page 2 of 2 Parks Commissioner Rob McGarry and Chairmen Mike Kocon and Brian Larson joined Councilor Polehna and Menikheim in ranking the names, determining which park name was best suited. None of the committee members preferred Lift Bridge Park, determining it would likely be confusing to most visitors as Lowell Park and Kolliner Park are at the foot of the historic lift bridge. Although Commissioner McGarry indicated he best preferred Sawmill Park it, coupled with Mill Park and Loggers Park, fell in the middle of the rankings, unable to garner enough votes to be in the top two choices. Councilor Polehna and Chairman Larson both chose Bridgeview Park as their number one choice, with Chairman Kocon indicating it was ‘just as high in ranking’ as his first choice, Riverfront Park. Councilor Menikheim, too, chose Bridgeview as a second runner up to Riverfront Park. Those committee members who ranked Bridgeview as the name which best represents the park indicated this because the name is simple and non-ostentatious and fitting for a park that will have views of both the historic lift bridge as well as the new river crossing bridge. Additionally, it was indicated that any portion of the shoreline areas could be known as Riverfront Park (a close second to Bridgeview). ATTACHED Resolution A RESOLUTION NAMING THE FORMER BARGE TERMINAL PROPERTY “BRIDGEVIEW PARK” WHEREAS, in March, 2014, the Parks and Recreation Commission learned of the history of the former Aiple/Barge Terminal property from Washington County Historical Society’s Executive Director, Brent Peterson; and WHEREAS, in April, 2014, Council liaison Mike Polehna suggested the Parks and Recreation Commission develop a park naming contest for this 17-acre property south of downtown and the City opened the contest up to the public for name suggestions; and WHEREAS, by the contest ending date of September 17, 2014, the City had collected 245 suggestions for naming the park and on October 27, 2014, the Parks and Recreation Commission recommended to the City Council six suitable names for the park; and WHEREAS, on October 28, 2014, the Council developed a committee for the development of a recommendation of a name for the property; and WHEREAS, on November 18, 2014, the City Council received a committee recommendation for a new name of the former Aiple/Barge Terminal property. Ward, City Clerk MEMORANDUM TO: Mayor and City Council FROM: Shawn Sanders, Director of Public Works DATE: November 14th, 2014 SUBJECT: 2014 Street Improvement Project Final Adoption of Assessment Roll Project 2014-02 DISCUSSION: At the October 7th assessment hearing for the 2014 Street Improvement Project, there were four properties who objected to the assessments. The four properties were: R & S Systems LLC Forekids LLC Soaring Eagle Management LLC AJD Investments LLC 1725 Market Drive 1655 Market Drive 251 0 Curve Crest Boulevard 251 0 Curve Crest Boulevard As a result of the objections at the hearing, these properties were removed from the assessment roll and Council asked staff to review and report back to the council at a later meeting. Since the meeting, staff hired an appraiser to determine if the proposed assessment were justified on all four properties. The appraiser estimated that benefit received from the improvement on all four properties was greater than the proposed assessment. RECOMMENDATION: Based on estimates from the appraiser's reports, it is recommended that the assessments from the four listed above remain unchanged and it recommended that Council adopt the assessments for these four properties for the 2014 Street Improvement Project as previously presented . NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER, MINNESOTA: 1. Such proposed assessments, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable on or before the first Monday in January 2015, and shall bear interest at the rate of 4.5 percent per annum from the date of the adoption of this assessment resolutions. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2014. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. Property owners may at any time prior to certification of the assessment to the county auditor, pay the entire assessment on such property, with interest accrued to the date of payment, to the City of Stillwater Treasurer. NO INTEREST WILL BE CHARGED IF THE ENTIRE ASSESSMENT IS PAID BY NOVEMBER 30, 2014. If the assessment is not paid by November 30, 2014, accrued interest from the date of the adoption of the assessment roll through December 31, 2014 will be added with the first installment due in 2015. If payment is not received by November 30, 2014, the amount listed above will be collected over a 10-year period with interest added at 4.5% per year on the unpaid balance. The yearly installments will be collected with the property taxes that are paid to Washington County. At any time thereafter, prior to November 15th of any year, pay the remaining principal balance (in whole or part) to the City of Stillwater. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. Ward, City Clerk MEMORANDUM To: Mayor and City Council From: Shawn Sanders, Di~~r of Public Works Date: October 17th 2014 RE: Proposed wintertime parking regulation in the Central Business District DISCUSSION At a previous council meeting, staff was asked to look into possible ways to decrease the "buildup" of snow and ice in the parking lanes in the downtown area. Buildup of snow and ice is caused by a number of factors including limited access to clearing snow and ice due to vehicles parking in the street both during and after a snowfall and just the nature of the snow or ice event. In meeting with Chief Gannaway, Captain Meredith, and Public Works Superintendent Moore we first looked at the existing wintertime parking ordinance during the months of November through March. This allows for parking of vehicles on the even numbered address side of the street on even numbered days and to park on the odd numbered address side of the street on odd numbered days. This method of wintertime parking is throughout the city, but does allow for exceptions in certain parts of the city to park on both sides of the street after the snow has been cleared, including the Central Business District. The question that arises is with the statement after the snow has been cleared; what constitutes a snow? a dusting, a one inch snow fall.. When does the odd even parking begin? After the snowfall begins or when we begin plowing. All difficult questions for enforcement under the current ordinance. We discussed a few options to help resolve this issue in the downtown area including; better enforcement of the current ordinances (see above), restrict wintertime parking completely or to restrict parking during certain hours of the day during the winter months. The first two were discussed and eliminated, because of enforcing timing etc. and impacts to business owners. The outcome was to propose to eliminate the odd-even parking restriction and to create an on-street parking restriction from the hours of2:00 a.m. to 6:00a.m. from November to March in the Central Business District and to include all of Third Street from Pine to Mulberry, Fourth Street from Myrtle to Mulberry and Myrtle Street from Third to Fourth Street. ( See map). This option would be clear and concise for the residents, patrons, and merchants , easy for police to enforce and allow for better snow plowing and removal for Public Works , since this is generally the time we are plowing the downtown area. With this change in parking, persons who previously used on-street parking during the winter months would have to use nearby parking lots during the restricted parking hours. RECOMMENDATION It is recommended that council discuss the proposed wintertime parking regulation in the Central Business District and approve the winter parking regulation as proposed. If approved this change would become effective for the upcoming winter season. Letters of support are for MT’s submission of a federal grant application for 2018 funding. While a specific location has not yet been determined, the letter of support indicates the City’s willingness to worth with MT on a potential location along or near the Highway 36 corridor, potentially within the City of Stillwater. This comes before the City as MT has recently released a Draft Service Improvement Plan (http://www.metrotransit.org/sip) which proposed a new route from Stillwater to downtown Minneapolis, eight times daily. With the route anticipated to be implemented by 2020, MT has forecasted an additional 175-200 cars per day may need to be accommodated in a Stillwater-area park and ride. The current St. Croix Valley Park and Ride, located at the Rec Center, is designed to accommodate 100 cars. A public comment period on MT’s Draft Service Improvement Plan is open until November 30, 2014. MT’s grant submission deadline is December 1, 2014. COUNCIL ACTION If the Council would like to send a letter of support for a future park and ride to be located in the Stillwater area, Council should move to authorize Mayor Polehna to sign the letter of support. ATTACHED Letter of Support     November 18, 2014 Dear Transportation Advisory Board, On behalf of the City of Stillwater, I would like to extend our support to Metro Transit in their application for a new park-and-ride facility to be located along or near the Highway 36 corridor in the Stillwater/Oak Parks Heights area with a specific location to be determined. A park-and-ride facility of approximately 300 spaces would help serve current and future need in our community, given the opening of the Saint Croix Crossing in 2016 and the extension of Metro Transit service from this corridor to Downtown Minneapolis. In 1999 the City of Stillwater accepted ownership of the St. Croix Valley Park and Ride, located near the Highway 36 corridor, and has provided maintenance services at this site. We are willing to have another facility located in our jurisdiction given the right opportunity and the land use considerations of the potential site. As the project progresses, we will continue to work with Metro Transit as they begin to identify potential sites for this park-and-ride facility. In conclusion, we support Metro Transit in this application to the 2014 Regional Solicitation. We look forward to working with Metro Transit to provide a facility and service that will help meet the needs of our community.
