HomeMy WebLinkAbout2014-146 RESOLUTION NO. 2014-146 A RESOLUTION WAIVING AN INTEREST IN WISCONSIN EMINENT DOMAIN ACTION WHEREAS, a Memorandum Of Understanding (MOU) signed by the City and the State of Wisconsin (State), obligates the City to take certain action to mitigate environmental impacts related to the new Interstate Bridge Crossing, and obligates the State to take action to acquire private interests that exist within the boundaries of City owned park property located north of the north right of way line of State Highway 35, and; WHEREAS, the private interests to be acquired by the State include the right of access to an existing private dwelling located within the boundaries of City owned park property as depicted on the map that is attached to this resolution as Exhibit A, and; WHEREAS, part of the improvements associated with the private dwelling consist of a garage and canopy as well as a driveway, drainage area, culvert and parking area located outside of the boundary of the private dwelling and located on City park property, and; WHEREAS, the State has asked whether the City wishes to claim ownership of any of the improvements located on City property or whether the City wishes to disclaim all or part of the proceeds to be paid to the private property owner by the State that is associated with the improvements, and; WHEREAS, a report was prepared by the City Attorney and presented to the Council that described the history of the parcel in question and the Council therefore believes it is fully advised in the premises; NOW, THEREFORE, the City Council resolves as follows: 1. That the City waives and forever discharges any interest in the garage, canopy, driveway, drainage area, parking area, or any other improvements on City property adjacent to the private parcel described as an "exception" on Exhibit "A" and waives any interest in a payment or award that the State pays to the owner of the private parcel. 2. That the City staff is directed to deliver a copy of this resolution to the State officials and representatives associated with this action.
