OPEN FORUM Roger Tomten, representing the Water Street Inn, provided an update on parking, the trash enclosure, and street width issues along Myrtle Street in conjunction with the proposed hotel addition. Heritage Preservation Commission Meeting PUBLIC HEARINGS May 5, 2014 Case No. DP/2014-16 Request for a Design Permit for exterior modifications to the structure located at 200 Chestnut Street. Merle Sorensen, owner, Scott Kragness, aplicant, Mark Balay, representative. City Planner Wittman explained the request. The applicant is proposing the following exterior modifications. West Elevation: Conversion of metal service entrance to a new aluminum storefront entry; installation of a metal cover over the existing drive-through window; installation of an (approximately) 16' long, 6' tall fence to screen existing mechanical equipment. North Elevation: Conversion of an existing dormer window into a hood exhaust location; and installation of an (approximately) 16' long, 6' tall fence to screen existing mechanical equipment. Additionally, modifications to the site are proposed that include the conversion of the parking lot to head -in parking along the western property line. This would create two-way traffic from Myrtle, abandoning the drive-through and egress on Second Street South. Staff recommends approval with the following conditions: 1) The drive-through window shall be covered with a wood panel, painted white; 2) the new door opening shall be constructed of a similar size and of similar materials as all other door openings on the structure; 3) the hood exhaust shall be routed through the roof of the structure and screened from street view; 4) prior to installation, a fence permit shall be obtained. The permit shall indicate a fence height, from grade, of no greater than 6' and painted or stained a color as determined by the HPC; 5) Design Review permit applications shall be submitted and approved by the HPC for any future outdoor patio, signage and any additional alteration; 6) if alternative provisions are found for the lack of onsite parking by the Downtown Parking Commission, prior to business opening: A curb shall be installed on South Second Street; and the western parking lot shall be painted according to plan. Motion by Commissioner Johnson, seconded by Commissioner Krakowski, to approve Case No. DP/2014-16 with conditions 1-6 noted in the staff report, with modification to Condition 42 requiring white anodized aluminum with dimensions submitted and modification to Condition 44 that the fence be painted white. After discussion, the motion was rescinded. Motion by Commissioner Welty, seconded by Commissioner Krakowski, to approve Case No. DP/2014-16 with conditions noted in the staff report, with modification to Condition 42 and Condition 44 as stated in the original motion, and with modification to Condition 43 indicating the vent would go through the roof, if possible, but that the vent may replace the dormer and painted the color of the roof. All in favor, 6-0. NEW BUSINESS Stillwater Heirloom Homes Program Applications City Planner Wittman provided a draft of the Stillwater Heirloom Homes Program Application for discussion. South Hill Walking Tour Brochure Draft - Dan Hoisington City Planner Wittman introduced a draft of the South Hill Walking Tour Brochure for discussion. Potential Historic Preservation Funding_ProgPrograms Discussion City Planner Wittman reported that at the request of Chairman Larson, staff has started the process of researching state and federal programs for funding assistance to assist private property owners in the rehabilitation of their structures. The City has a facade restoration loan program but it is not funded. The Page 2 of 3 Heritage Preservation Commission Meeting May 5, 2014 program was funded through TIF monies but the state no longer allows the City to utilize funds in this fashion. To date, staff has not been able to find seed monies for this program. Preservation Awards Discussion City Planner Wittman informed the Commission that the Preservation Alliance of Minnesota (PAM) is accepting nominations for the 30th annual awards program. She requested the Commission consider whether there is a project, person or organization that deserves acknowledgement. Additionally, the City has submitted a nomination to the National Alliance of Preservation Commission's (NAPA Commission Excellence award for the HPC's Heirloom and Landmark Sites Program and Walking Tours. The nomination was encouraged and supported by the State Historic Preservation Office. The City is expected to hear from the NAPC in mid-May. FYI SHPO CLG Grant Award: Bergstein Reuse Study City Planner Wittman informed the Commission that the Minnesota Historical Society' s Grants Review Committee reviewed the city's Certified Local Government grant application. Their recommendation was to approve grant of $17, 250 for this project. The Grants Office is in the process of preparing the Certified Local Government Grant Agreement for the project and it will be forwarded to the City within the next few weeks. The sign ordinance further indicates projecting signs must be visible from the sidewalk and not be a hazard to pedestrians. If lighted, the sign must be externally lit. The sign conforms to these standards. The Downtown Design Review Manual indicates: • Materials: Modern sign materials are acceptable provided their design is handled with an understanding of the Victorian spirit. • Color: Choose tones with sufficient contrast to be clearly legible: dark on light or light on dark. The relationship of the colors and tones used on new or improved structures must be compatible with the color and tone patterns already established by adjacent buildings. The White Chocolate tasteful use of color and accent can introduce variety and charm, whereas the indiscriminate use of colors and color combinations can overload the senses and produce visual conflict and chaos. Exercise caution in the use of colors and tone combinations and their patterns. The goal is to achieve an area -wide complementary blend of background colors combined with selected and limited uses of primary and focal colors. The color of buildings should relate to the adjacent buildings colors to create a harmonious effect. Avoid colors which visually overpower or strongly contrast with adjacent building colors and established downtown color schemes as a whole. RECOMMENDATION Staff recommends approval DP/2014-22 with the following condition: 1. All revisions to the approved plan shall be reviewed and approved by the HPC. The unlit wall sign, proposed to encompass the existing 110 square foot sign area, does not conform with the existing zoning regulations of one square foot per one linear foot of business frontage. While this business had a 110 square foot sign in this location, the sign was illegally installed and never received design approval by the HPC. The applicant is proposing a high-density foam letters to be stud mounted to the board. The area of the lettering is consistent with the zoning regulations. The 3.2 square foot (24" square), circular projecting sign will be hung from a new aluminum bracket. The acrylic sign is proposed to be framed in aluminum. The applicant is requesting the sign be internally lit. APPLICABLE GUIDELINES AND REGULATIONS One hanging sign, no greater than six square feet, is permitted per business in the CBD. The sign ordinance further indicates projecting signs must be visible from the sidewalk and not be a hazard to pedestrians. If lighted, the sign must be externally lit. One wall sign is proposed for each the Main Street and Chestnut Street facades. A 11.6 square foot halo -lit sign is proposed to be located above the Main Street door to the upstairs of the structure. A 16 square foot, unlit sign is proposed for the Chestnut Street facade. This sign, too, would be located above the access to the second story. APPLICABLE GUIDELINES AND REGULATIONS Wall signs are permitted by the sign ordinance at a ratio of one square foot per one linear foot of the structure, parallel to a lot line. Signs located in multi -tenant structures are to be consistent with an HPC -approved sign plan/program. Lighting: Use incandescent indirect lighting and place spotlights discreetly, in such a way as to shield the source from pedestrians and vehicular traffic. • Do not use internally or back -lit signs, either projecting, wall mounted, or hung inside the window. ANALYSIS, DISCUSSION AND FINDINGS While the unlit sign on Chestnut Street meets the requirements set forth in the sign ordinance and is consistent with the Downtown Design Manual guidelines and the multi -tenant sign pian, the Main Street sign may not. Staff has discussed with the applicant the Downtown design guidelines in relationship to whether or not the halo -lit sign may be construed as an internally or back -lit sign. ALTERNATIVES AND RECOMMENDATION The Commission has the following alternatives: 1. Move to approve, with or without conditions, DP/2014-20. 2. Move to deny, without prejudice, DP/2014-20. 3. Move to table DP/2014-20, requesting more information. Staff recommends the Commission review DP/2014-20 with relationship to the Victorian spirit of downtown Stillwater. If the Commission should move to approve, staff would recommend incorporating the following conditions of approval: 1. All major revisions to the approved pian shall be reviewed and approved by the HPC. KLBB Radio is applying for a permit to install a halo -lit reverse channel letter LED sign on Main St. in Stillwater. These type letters are much different than face -lit letters. Many feel these letters have a distinctly classy look over standard lighted signage and are popular in modern indoor shopping malls and downtown areas. Reverse letters do not illuminate on the face (opaque aluminum) but direct the lighting backwards against the wall. This light (blue and white in KLBB's case) floods the surface behind the letter allowing illumination to come behind and around the edges of the letter. This is referred to as a "halo" effect. The footcandle power of a halo -letter is approximately'/ the illumination of a facelit letter using the same amount and intensity LED modules as a light source. They are popular with city Zoning Departments across America because they give a subtle, stylish look to commercial signage and are good for neighborhoods with mixed commercial/residential use because residences are not exposed to garish lighting fortmats popular in suburban strip malls. While the applicant has indicated they would like a mural with historic themes, they would prefer to have a more contemporary mural in this location. The partially existing mural depicts a sheriff holding a bottle, a train with beverage -can cars, a deer/elk and folks dancing amongst cacti. APPLICABLE GUIDELINES AND REGULATIONS The sign ordinance indicates graphic design signs require a special use permit (SUP). Prior to obtaining the SUP, staff has advised the business that a Design Review permit is required from the Heritage Preservation Commission. The Downtown Design Manual indicates "[p]ainted wall signs occasionally appeared on the side of buildings at corner locations, or where a low adjacent roofline exposed an expanse of plain brick wall above. As these signs were high on the building, the message was simple and the lettering was large and bold. In the time period of the 1920's -1950's, there were occasions of painted advertising in these areas. More recently, there have been murals created on walls of "non-contributing" buildings, or on the back of "non-contributing' buildings, or on the back walls of "contributing" buildings. These have been addressed on a case-by-case basis". Guidelines indicate: • Murals on "non-contributing' buildings have been allowed with individual review, provided they have a historic theme, and do not advertise an existing business or company. 305 Water Street South Case No. DP/2014-21 (HPC: June 2, 2014) Page 1 of 2 ANALYSIS, DISCUSSION AND FINDINGS The period of significance in the Downtown Commercial Historic District was 1860 to 1940 with most of the construction occurring prior to 1900. The Freight House was constructed in 1888 with a National Register period of significance from 1875 to 1899. With this in mind, the historic themes should be during the period of significant and relevant to Stillwater. While the contemporary mural includes some historic themes (i.e. a sheriff, trains, deer and folks dancing), the depiction of beverage cans (not introduced until the mid -1930s) is not historic. Furthermore, the depiction of cacti in the mural is not indicative of the vegetation found in eastern Minnesota. ALTERNATIVES AND RECOMMENDATION The Commission has the following alternatives: 1. Move to approve, with or without conditions, DP/2014-21. 2. Move to deny, without prejudice, DP/2014-21. 3. Move to table DP/2014-21, requesting more information. Staff recommends the Commission review DP/2014-21 with relationship to the Victorian spirit of downtown Stillwater. If the Commission should move to approve, staff would recommend incorporating the following conditions of approval: 1. All revisions to the approved pian shall be reviewed and approved by the HPC. The Caboose at Freight House a. The Freight House currently has a historic caboose placed at the north end of the property. b. The Caboose is begging to rust and look very rough and has been a consistent spot for graffiti c. We would like to paint a mural with some historic references with images of the types of activities that take place at the Freight House and the area Dancing, Old Trains, Sheriff, Red Deer/Elk 2. Garden Area The area currently around the caboose has become a very dirty area and a place that trash and debris tend to accumulate. We would like to plant fresh flowers and create a green space around the base of the area. b. We fill this will become a popular area for folks to gather and take photos x HERITAGE PRESERVATION COMMISSION MEETING DATE: June 2, 2014 CASE NO.: DP/2013-38 Amendment APPLICANT: Roger Tomten, representing Chuck Dougherty, applicant REQUEST: Request for a temporary trash enclosure to be located at 101 Water Street South ZONING: Commercial Business District COMP PLAN DISTRICT: Downtown Mixed Use PREPARED BY: Abbi Jo Wittman, City Planner BACKGROUND In the fall of 2013, the property owner requested a design permit for a trash enclosure to be located on a parking lot adjacent to 101 Water Street South. The HPC denied the request as the application was not consistent with a 20 year old design permit. The applicant appealed the HPC's request. The City Council tabled the item to allow for the applicant to work with neighboring property owners on a potential shared facility. The neighboring property owner was not interested in the shared enclosure. So, Water Street Inn proposed a temporary enclosure attached to the west wall of the Water Street Inn. This enclosure is intended to remain in place until the planned Water Street Inn addition is built. Then the trash will be stored inside. The Council approved the proposal with a condition that it must receive a Design Permit from the HPC and the condition that it must be built and in use by July 1, 2014. APPLICABLE GUIDELINES AND REGULATIONS The Commercial Historic District Design Manual guidelines state to "screen exterior trash enclosures and storage areas... from view of nearby streets and adjacent structures in a manner that is compatible with the building and site design". RECOMMENDATION Approval of the amendment to Design Permit 2013-38 with the following conditions: 1. The enclosure shall be temporary and no trash shall be kept outside except within the structure as conditioned by the Special Use Permit approval. 2. The structure shall be completed and used by July 1, 2014. As a condition of approval, the City Council has required that an enclosure be constructed by July 1 st, 2014, with the understanding that it be removed upon completion of the new ad- dition. Since the enclosure is meant to have a limited two-year life span, the enclosure design strives for minimal impact to existing structures and light weight construction materials. The entire enclosure will be constructed of cedar with black strap hinges for the doors. The cedar will be left to gray naturally with no finishes or paints. The enclosure location currently is a landscaped area between the base of the building and the sidewalk. This area would be filled in with a concrete slab and the enclosure structure se- cured to the new slab. This site allows us to utilize an existing curb cut located directly across from the enclosure. We are striving to maintain a 5 foot minimum sidewalk width and will be significantly downsizing the dumpsters in order to accommodate the small area.
