The event has not changed from last year. This is one of the events under the Event Coordinator's contract. This event was presented to the Parking Commission on March 20, 2014. The Commission comments are as follows: a. Parking Commission recommended approval as requested by the event organizers. b. Parking Commission recommended charging only for the 28 marked on -street spaces that will be reserved by virtue of dedicating the streets to race use. They recommended not charging for the on -street spaces that are being reserved but are not marked. c. Parking Commission recommended a fee of $534 for the two lots they will reserve, and the 28 on -street spaces. The cost for the parking lots and reserved spaces is the same that was approved last year by the Council. The cost of the Teddy Bear Park reservation is $130.00 (2"d floor is used for testing of bicyclists) According to the contract $1000.00 is payable to the City for Police, Public Works & Fire Services. The applicant paid $50.00 for the application fee, however that fee was raised to $100.00 therefore shortfall of $50.00 is included in the total amount due. Total Amount Due for this Event would be $1,714.00. Due date for the insurance and fees would be May 23, 2014. ACTION REQUIRED: Review event and contract. If Council wishes to approve the event and contract they should pass a motion adopting a resolution entitled "Approving 2013 Rivertown Art Festival Special Event and Contract", subject to coordination of the event with the City's Event Coordinator to meet the City's requirements RESOLUTION 2014-073 APPROVING 2014 SPECIAL EVENT AND CONTRACT NORTH STAR GRAND PRIX BE IT RESOLVED, by the City Council of Stillwater, State of Minnesota, that the 2014 North Star Grand Prix Special Event and Contract, between the Minnesota Bicycle Festivals, Inc. and the City of Stillwater is hereby approved, subject to coordination of the event with the City's Event Coordinator to meet the City's requirements, and authorizes the Mayor and City Clerk to sign the contract. Customer and Police to set Deliver to lot across from US Bank on 2nd between Chestnut and Olive: 6- Portable Delineators 40 -Sandbags 2014 NORTH STAR GRAND PRIX STILLWATER BICYCLE RACE THIS AGREEMENT (the "Agreement") is made this day of May 2014 by and between the CITY OF STILLWATER, Washington County, Minnesota (the "City"), and the MINNESOTA BICYCLE FESTIVALS, INC., a Minnesota nonprofit corporation (the "Festival"). WHEREAS, in light of the foregoing, the Festival wishes and the City will permit the Festival to organize and conduct bicycle races in the City on June 15, 2014 (collectively, the "Races") as part of the North Star Grand Prix in order to foster and promote tourism within the City of Stillwater and the St. Croix Valley and encourage commerce within the City that will ultimately increase property values and the quality of life within the City, thereby promoting the welfare of the City; NOW, THEREFORE, in consideration of the promises and the mutual covenants and agreements contained herein, the City and the Festival agree as follows: 1. Authorization. The City will permit the Festival to organize and conduct the Races in the City on June 15, 2014, 2. Race Set-up. The City will permit the Festival to set up for the Races on June 15, 2014. 3. The Races. The Races may consist of up to but no more than four bicycle races: a pro and/or elite amateur men's race, a pro and/or elite amateur women's race, an advanced amateurs' race, and a race for children. Substantial changes in the format and duration of the Races will not be made by the Festival at any time without advanced notice to the City and or Event Coordinator. 4. Course for the Races. The course for the Races (the "Course") will begin at or near the intersection of Chestnut Street West and 2nd Street East in the City (all locations specified in this paragraph are in the City). Participants will travel south on 2nd Street South to Pine Street East, take Pine Street East to Broadway Street South, head south on Broadway Street South to Churchill Street East, they will turn west and continue on Churchill Street East to 1St Street South. Participants will then travel north on 1St Street South to Willard Street East, veer West on Willard Street East to 2" Street South, then go north on 2nd Street South until they reach Pine Street East. Participants will head west on Pine Street East, then turn north on 3r1 Street South. They will go north on 3rd Street South until Chestnut Street East, where they will turn east until they reach 2nd Street East. Minor changes in the location of the start and finish line of the Races on the Course will be determined in the Festival's sole discretion. However, substantial and significant changes may not be made without advanced notice to the City. 5. Closing of the Course. The Festival may, as it deems necessary, place and leave materials used to close the Course (e.g., barricades, traffic cones) on the Course on June 14, 2014, June 15, 2014, and June 16, 2014. The Festival will re -open the Course to traffic as soon after the completion of the Races as it deems safe for participants and spectators. 6. Trash Enclosures. Lessee shall furnish trash receptacles in sufficient quantity to contain the accumulation of trash generated by the Festival or obtain trash receptacles from the City at an additional cost. Lessee shall make certain that all trash is picked up during and after each Event. Lessee shall remove any excessive garbage that does not fit within the receptacles and disposed in an off-site trash dumpster. The City reserves the right to require additional receptacles should the Lessee not remove excess garbage from the Festival. 7. Portable Toilets. The Festival will provide portable toilets for participants and spectators to use on June 15, 2014. 8. Traffic Signs, Trash/Trash Receptacles & Portable Toilets Removal. All traffic signs, trash/trash receptacles, portable toilets must be removed by 3:30 p.m. Monday, June 17, 2014. Any remaining after such time will be removed by City and all labor and storage fees will be paid for by the Festival Organization. 9. Use of Parking Lots. The Festival is aware and will inform all vendors and Festival participants that staking into the asphalt for tents, etc. is not allowed (any damage repair will be paid for by the Festival Organization). The Festival is given use of the parking lot at 2nd and Nelson Streets and 2nd & Olive Streets. 10. Team Trailers. Team trailers cannot be parked on any street in Stillwater. 11. Parking Control. To ensure that Downtown businesses retain parking availability for their customers during the Races, the City will close the City parking lot located immediately west of 2nd Street South, north of Olive Street East and south of Chestnut Street East on June 15, 2014 for use by the Race. The City will also post and enforce signs prohibiting parking on all streets that make up the Course between 8:00 am and 4:00 pm, or until the Course re -opens, on June 15, 2014. The Race will promote parking inside the Course by Race participants, volunteers, officials, organizers and anyone traveling to Stillwater for the Races by including a parking map and parking information in its promotional literature for the Races. 12. Traffic Control. The Course, including all intersections on the Course, will be closed to traffic during the Races. Prior to the Races, the Festival will make its best efforts to ensure that the closure of the Course, including all intersections on the Course, poses the least disruption possible under the circumstances to residents who live on or within the Course perimeter. The Festival will also make every effort to minimize the involuntary towing of vehicles because of the Race. The Festival will negotiate a road closure plan with the City's Chief of Police and Event Coordinator. 2 13. Emergency Plan. The Festival will prepare an emergency plan that it will share with the City's Event Coordinator, Police and Fire Departments. 14. Insurance, Hold Harmless, and Indemnity. The Festival agrees to indemnify and hold harmless the City with regard to any claims, causes of action or demands that might be brought against the City arising out of the events authorized by this Agreement, except for those claims, causes of action or demands that arise out of the sole negligence, gross negligence and/or willful misconduct of the City or any of its agents or employees. Festival also agrees to provide to the City evidence of insurance coverage of at least the statutory liability limits for municipalities covering claims that might be brought against the Festival that arise out of the events authorized by this Agreement and to name the City as an additional insured on their policy "as their interest may appear." Insurance Certificate must be received by the City no later than three (3) weeks before the Race. 15. Public Information. The Festival will make every reasonable effort to notify property owners and businesses that are on or within the perimeter of the Course of any restrictions that might be placed upon their movements during the Races, including, but not limited to, distributing notices to each such residence or business no later than two weeks before the race. 16. Police Power. The City reserves the right to shut down the Races in the event the Chief of Police determines that the public safety is threatened, or the health or safety of participants is threatened because of weather, temperatures, or any unforeseen cause that threatens the public health or safety or if closure is directed by the Medical Doctor designated by the Race in the Emergency Plan. 17. City Costs. The Festival will reimburse the City in the amount of $1,000 for costs incurred by the City Police Department, Public Works Department, or Fire Department to safely conduct the Races. Rivertown Art Festival. The City has encouraged Rivertown Art Festival ("Event") in order to foster and promote tourism and encourage commerce that will ultimately increase property values and the quality of life within the City. Substantial changes in the layout/format/duration of the Event will not be made by the Organizer at any time without advanced notice to the City. 2. Dates and Hours of Event. Operations are limited as follows: Setup: Friday, May 30, 2014 — 12:00 p.m. — 7:00 p.m. Event: Saturday, May 31, 2014 — 9:00 a.m. — Midnight Sunday, June 1, 2014 — 9: 00 a.m. — 5:00 p.m. Cleanup: Sunday, June 1, 2014 — 5:00 p.m. — 8:00 p.m. 3. Event/Alcohol. No alcohol will be served during this event and no other Alcohol or Coolers are allowed. 4. Signs. Signage will be prominently displayed at each entry/exit point the number and content of which must be approved by the City Police Chief describing the regulations prohibiting liquor as well as the prohibition against participants bringing their own liquor into the park. 5. Noise Control. The Event is responsible to control the noise emanating from the Area at a level that will not interfere with the peace and repose of the residential area on the bluffs on the north, west and south edges of the downtown. 6. Police Power. The City reserves the right to order a shutdown of the Area in the event the Chief of Police determines, in his sole discretion, that the public safety is threatened or any condition of this Agreement is violated. If requested by the Chief of Police, the Organizer will assist the police in the clearing of the Area. 7. Security. Lessee shall confer with the Chief of Police and Event Coordinator as to the advisability of closing the Levee Road (Lowell Park) and shall hire any security personnel the Stillwater Police Chief requires. Should the City have to hire outside agencies, the City will invoice the Organizer for any additional costs. 8. Use of Parking Lots. THE ORGANIZER IS AWARE AND WILL INFORM ALL VENDORS AND EVENT PARTICIPANTS THAT STAKING INTO THE ASPHALT, ETC. IS NOT ALLOWED (ANY DAMAGE REPAIR WILL BE PAID FOR BY THE ORGANIZER). The Event is given use of Lots based upon the actual layout option chosen and approved by the Public Works Superintendent and Event Coordinator. The Organizer agrees to pay the City for the use of the parking lot according to the parking space fees designated by the City Council. City Costs. Organizer will prepay the City for the estimated costs of the City Police Department, Public Works Department, and Fire Department estimated as determined by the City Administrator for city services needed to safely conduct and maintain the Event or any Page 1 of 4 supporting activities. The payment of estimated costs and costs incurred at the time of the billing (i.e. neighborhood meeting expenses and/or city equipment) shall be received by the City no later three (3) weeks before the Event. Failure to make the payment will result in the cancellation of the Event. In the event of a cancellation of this Event after the deposit is made, the City will be entitled to deduct actual out of pocket costs incurred in preparation for the Event, before returning the balance to Organizer. 9. City Improvements. The Organizer understands and acknowledges that the City may be completing grading, parking lot improvements and park improvements in the area of the Event and in order to accommodate this construction and staging activities the City reserves the right to which parking lots may be used by the Organizer for this Event to accommodate any City improvements in the Event area. 10. Park Property. The Organizer shall ensure that no vehicles drive on the City's park property. In the event that damages occur to the City's property, the Organizer shall pay for any restoration of the park as determined by the City. 11. Irrigation System in Park Property. Lowell Park is maintained by a buried irrigation system. This system cannot be damaged by stakes or posts that are driven into the ground or by equipment and vehicles running over irrigation heads. For that reason, stakes or posts longer than 12 inches and more than a quarter inch in diameter may not be used in the park. Further, as insurance against damage, a deposit must be made to the City in the amount of $750.00 and any damage to the system will be deducted from the deposit. The balance of the deposit will be returned with 30 days of the conclusion of the Event. The Event Organizer shall contact the Public Works Superintendent prior to the event for location of the irrigation system. 12. City Services. The type and amount of materials needed for the Event will be determined by the Public Works Superintendent. The Organizer shall be required to provide portable toilets to augment the existing facilities, barricades for street closure, trash removal and electricity for vendors. The Organizer may contact the City to arrange rental of materials and will be charged for use according to the City of Stillwater Event peltnit fee schedule. a. Portable Toilets. The Organization must furnish portable restrooms to facilitate expected crowds in a number required by the Event Coordinator. Additional portable restrooms must be provided by the Association if deemed necessary to protect public health as determined by the Event Coordinator. City Public Restrooms on the Pedestrian Walkway will remain open during the Event and the City will supply and equip the restroom, however, the Association will be responsible for maintaining, cleaning, security and supervision for both restrooms. b. Barricade Placement. The Organizer shall place reflective standard barricades no later than 8:00 a.m. on May 30, 2014 at the parking lot entrances on Mulberry, Myrtle, Chestnut, Sam Bloomer Way and Nelson as designated by the Public Works Department. This will inform users of the parking lot closure for the Event. c. Trash Enclosures. The Organizer shall furnish dumpsters or roll -off boxes and trash receptacles in sufficient quantity to contain the accumulation of trash generated by the Event. The Organizer shall make certain that all trash is picked up during and after Event daily. The Organizer shall remove any excessive garbage that does not fit within Page 2 of 4 the receptacles and dispose in trash dumpsters. The City reserves the right to require additional receptacles should the Organizer not remove excess garbage from the Event. d. Electricity and Water. Each electrical box needed for the Event will be opened by the City on May 30, 2014. The Organizer shall be charged for the use of each electrical box according to the permit fee schedule. The City shall provide the Organizer a key for the water shut off valve. The Organizer shall provide a $50 deposit for such key and will be reimbursed upon return of said key. e. Barricades/Trash/Trash Enclosures/Portable Toilet Removal. All barricades, trash, additional trash enclosures and portable toilets will be removed by 3:30 p.m. on the Monday following the event. If the above items are not removed as stated above, the Organizer will reimburse the City for costs incurred in removing the items. 13. Park Fee. The Organizer agrees to submit a user's park fee of $500.00 payable to City at the signing of this contract. 14. Vendors. a. The Organizer agrees that any vendors using cooking facilities will be inspected for safety by the Stillwater Fire Department b. NO CAMPING. The purpose of the meeting was to get an update on the status of the sale of the building, and determine whether the structure is in immediate danger of deterioration or is experiencing "demolition by neglect". Jon indicated that since the price was dropped in the past six months, there have been several groups interested in the building. All of the groups have been looking at relatively modest reconfiguration and remodeling. Some are interested in possible separate or addition building on the site, maintaining the existing primary facades. The peeling paint and weathered siding and windows are unsightly, but with the exception of some missing siding on the east side, the building appears to be weather tight and generally sound. There is a visible bowing of the west and east foundation walls, but it is understood to have been this way since the late 1800's and does not appear to be moving or increasing. The interior presents some challenges, and will need some code updates (including accessible entrance and toilets), but the basement appears to also be generally sound and relatively dry. There is noticeable sewer gas smell, presumably from open plumbing traps. The consensus from our group is that the building's overall exterior condition does not appear to be in immediate danger of significant structural deterioration, or demolition by neglect. Jeff and Amy suggested Owner and seller look into potential Federal and State tax credits. Jon noted the facade loan program (discontinued by the City), would be valuable in offsetting exterior rehab costs for any buyer. The group discussed the need for this or a similar loan program by the City to help owners or buyers update and maintain historical buildings in the downtown area. They noted the cost to the City of such a loan program could be much less than the cost of actually buying and/or repairing historic buildings in danger of neglect and deterioration. The Owner is strongly encouraged to repair the missing siding noted at the SE corner to prevent any damage there, and fill or seal floor & fixture traps with antifreeze to address the sewer gas. APPROVAL OF MINUTES Motion by Councilmember Menikheim, seconded by Councilmember Weidner, to approve the April 1, 2014 regular and recessed meeting minutes. All in favor. PETITIONS, INDIVIDUALS, DELEGATIONS & COMMENDATIONS Possible approval of the Stillwater 1/2 Marathon Special Event & Contract May 24, 2014 - Brian Mastel Brian Mastel, Mastel Event Management, explained he was hired by Run Stillwater, Inc. to manage the marathon which includes a half marathon and a 5K. He reviewed the routes proposed. Councilmember Weidner asked why the run is proposed for Stillwater and how it will benefit the City, and Mr. Mastel responded that Run Stillwater, Inc. wants to bring more runners to the area. The event will showcase the beauty, amenities and hospitality of Stillwater and runners will spend money in town. Councilmember Polehna inquired why the event is not going through the public hearing process for new events, and City Clerk Ward replied that the event was cancelled last year and the proposed routes changed because of construction this year. City Council Meeting April 15, 2015 Mr. Mastel noted the old route required more traffic control and the new route has less impact on traffic. He views it as an existing event that was postponed last year due to the moratorium on special events. Councilmember Weidner commented that if the event was not approved last year due to the moratorium, then he views it as a new event subject to the new event process, and Mr. Mastel stated when he submitted the permit application in January, he was not informed that it would have to go through the approval process as a new event. Councilmember Menikheim noted that he supports the event. Councilmember Polehna agreed that he too supports the event, but it should follow the rules - the task force put a policy together and it is not being followed. City Clerk Ward reported that staff did not consider the marathon to be a new event, because it would have been the same event and route as proposed last year. However, the route changed due to construction. Councilmember Weidner expressed concern about the applicant not attending previous meetings when the event was on the agenda. Police Chief Gannaway indicated that there were some requirements he had asked the applicant to meet. Councilmember Weidner stated whether it is considered a new event or old event is a big question, because this is not the "Stillwater Marathon" which was an established event. He feels it is unfortunate the applicant was not at previous meetings when this was on the agenda. Mayor Harycki pointed out that the application was turned in January 29, so if there was a mess- up, it was probably internally with different people looking at the application. The Council should discuss what it does and does not consider to be a new event; however he is in favor of approval as time is short. Councilmember Polehna stated he supports approval for this year but he would like to see the applicant go through the new event approval process next year. Motion by Councilmember Menikheim, seconded by Councilmember Polehna, to approve the Stillwater 1/2 Marathon Special Event and Contract, adding a condition that the organizers encourage the use of the parking ramp for race finishers, and that they understand this is not considered an old event. He noted that the DNR has initiated burn restrictions as the fire danger is considered high. He reminded the community of Severe Weather Awareness Week, next week, and that the tornado drill day is Thursday with outdoor warning sirens sounding at 1:45 and 6:55 p.m. City Clerk Ward announced a retirement in the administration department; the position will be advertised. Public Works Director Sanders reported that next week the bridge over Manning Avenue, for the Gateway Trail, will be started with paving of the trail done by the end of 2014. The National Weather Service is predicting the river will crest this Thursday or Friday below previous predictions. Tomorrow there is a public meeting with the Coast Guard about changes in the lift bridge schedule. He has talked to Washington County about replacing some of the dead trees on Manning Avenue. Second Street repairs should be done by the end of the week. Finance Director Harrison informed the council that auditors were here March 31-April4 and all went well. A public hearing to consider a request by ArtReach Alliance, 224 4th Street North for approval to hold outside events in 2014 which is a condition of the Special Use Permit approved on May 29, 2009. City Planner Wittman explained that a condition of the Special Use Permit for ArtReach Alliance dictates that outside assemblies will only be allowed with approval of the City Council after holding a public hearing. The condition was put in place to prevent conflicts with residential uses in the neighborhood. ArtReach has requested approval of 2014 programming events. While some events are specifically designed to be hosted on the front porch, guests may `spill over' onto the front porch or lawn during other events as well. Staff recommends the Council approve the resolution authorizing outdoor assemblies to be held in conjunction with ArtReach Alliance's 2014 programming Heather Rutledge, ArtReach Executive Director, thanked the Council for considering the request. Mayor Harycki opened the public hearing. David Levy, 306 Fourth Street North, stated he would not be in favor of allowing any amplified music. Jane Paskvan, 314 Fourth Street North, agreed that amplified music would not be okay. The neighborhood has dealt with a lot of noise from this and other venues. She does not believe a small venue needs to have amplified music outdoors. Jerry Helmberger, 303 Fourth Street North, expressed appreciation for ArtReach's work, but he feels the music gets a little loud and should not be amplified. Mayor Harycki closed the public hearing. Ms. Rutledge informed the Council that last year there was a guitarist or keyboardist, and singer, with mostly jazz and folk music, not large ensembles. Amplification is only used when needed to hear the instrument. ArtReach is not trying to be a concert venue, but simply adding multi- disciplinary arts to its programming. Timothy Paskvan, 314 Fourth Street North, stated last year, the ArtReach events made so much racket that it could be heard despite closed doors and windows. It was disturbing the peace. Mayor Harycki noted that Stillwater is unique in that sound carries all around the City with the hills, so maybe amplification should be prohibited. Ms. Rutledge replied that restriction would eliminate music altogether. Councilmember Polehna suggested that the amplified events be moved to the new amphitheater downtown. Ms. Rutledge replied that the goal of the events is to bring people into the art gallery. Councilmember Weidner stated he would be in favor of allowing the outdoor events without amplification. Councilmember Menikheim agreed, adding that the arts community needs support. He suggested getting musicians who can be heard without amplification and inviting the neighbors. There are still some outstanding issues which he feels will be resolved. He anticipates having Event Coordinator Mens -Eastman and The Locals at the May 20, 2014 City Council meeting. COUNCIL REQUEST ITEMS Councilmember Polehna informed the Council that the Beyond the Yellow Ribbon group is being revitalized, as some personnel from Stillwater are going to be deployed. Also he met with Friends of Stillwater Area Dog Park about authorization to move ahead with the dump site, and suggested having a neighborhood meeting. He also met with fireworks vendors about music for the Fourth of July. He suggested the Council consider adopting a Branding Policy for consistency in marking City vehicles. Councilmember Menikheim asked about TIF allocated for the boutique hotel. City Attorney Magnuson explained that the developers are anxious to move forward and are working on a plan which will be mailed along with a fiscal analysis to the School Board and Washington County for comment next week. It will then be considered for adoption after a public hearing June 3. Motion by Councilmember Menikheim, seconded by Councilmember Polehna, to adopt Resolution 2014-067, Rescinding a Request for Bridge Schedule Deviation, and to direct staff to follow proper channels to look at this next year. Ayes: Councilmembers Menikheim, Weidner, Polehna, Mayor Harycki Nays: None Councilmember Weidner acknowledged problems with the process and asked if there is room for compromise. Councilmember Menikheim replied with the current timeframe, it would be better to start the process all over again next year by having conversations with all the parties involved ahead of time. There are at least 10 organizations involved in this decision. Councilmember Polehna indicated he doesn't have a problem rescinding the request for this year, but he feels next year the City request a schedule change next year and should start the process earlier. City Council Meeting April 23, 2014 Mayor Harycki acknowledged that the process for requesting a change was not initially clear. City Administrator Hansen said that staff can communicate with the Coast Guard to let them know there may be a similar request going forward next year. Corey Buettner, Downtown Revitalization Committee, told the Council the DRC brought this issue up to alleviate vehicle traffic congestion during bridge construction. The downtown business owners have no concerns about the lift bridge schedule after 2017 because vehicle traffic will not be a factor. Retroreflectivity describes how light is reflected from a surface and returned to its original source. Traffic signs are made with retroreflective sign sheeting material that redirects headlamp illumination back toward the vehicle, thereby making the sign visible at nighttime to the vehicle driver. Improvements to nighttime visibility of traffic signs will help drivers better navigate roads at night and thus promote safety and mobility. Improvements in sign visibility will also help older drivers whose visual capabilities may be declining. Compliance dates for replacement of signs that fail to meet minimum standards have been eliminated. However, cities still need to adopt a policy to replace traffic signs when they are worn out. Adopting a sign retroreflectivity policy will significantly reduce tort liability lawsuits involving traffic signs. Regulatory, warning, guide signs and object markers must meet retroreflectivity requirements. Staff has been finalizing a Sign Retroreflectivity Policy based on a model policy developed by the League of Minnesota Cities. We will be utilizing a combination of a Blanket and Life Expectancy methods as its management method. The replacement plan divides the City in ten areas, with signs replaced in a different area in a ten year cycle. The ten year replacement schedule is based on the expected life of the High Intensity Prismatic (HIP) material the city is utilizing for its signs. Estimated cost of replacement of all signs city wide is $180,000 which would be paid through the Signs and Lighting Fund. RECOMMENDATION Staff recommends that Council pass a resolution adopting the Sign Retroreflectivity Policy as presented. RESOLUTION ADOPTING SIGN RETROREFLECTIVITY POLICY WHEREAS, the Minnesota Manual of Uniform Traffic Control Devises (MN MUTCD) requires the City to establish a sign retroreflectivity assessment or management program. WHERAS, a sign retroreflectivity policy was presented to City Council; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, MINNESOTA: hereby adopts the sign retroreflectivity policy to implement an assessment or management method to meet the minimum sign retroreflectivity requirements in the Minnesota Manual on Uniform Traffic Control Devices. Ward, City Clerk CITY OF STILLWATER SIGN RETROREFLECTIVITY POLICY PURPOSE AND GOAL The purpose of this policy is to establish how the City of Stillwater (City) will implement an assessment or management method, or combination of methods to meet the minimum sign retroflectivity requirements in the Minnesota Manual on Uniform Traffic Control Devices (MN MUTCD). Substantial conformance with the MN MUTCD is achieved by having a method in place to maintain minimum retroreflectivity levels. Conformance does not require or guarantee that every individual sign in the City will meet or exceed the minimum retroreflective levels at every point in time. The goal of this policy is to improve public safety on the City's streets and roads and prioritize the city's limited resource to place the signs. APPLICABLE SIGNS This policy applies to all regulatory, warning and guide signs as set forth in the MN MUTCD, excluding the following signs: A. Parking, Standing, and Stopping signs (R7 and R8 series) B. Walking/Hitchhiking/Crossing signs (R9 series, R10-1 through R10 -4b) C. Acknowledgment signs, including Memorial signs D. All signs with blue or brown backgrounds E. Bikeway signs that are intended for exclusive use by bicyclists or pedestrians] RESOURCE MATERIALS The city has reviewed and relied on numerous resources in adopting this policy. These resource materials include, but are not limited to the following: • Methods for Maintaining Traffic Sign Retroreflectivity, Publication No. FHWA-HRT-08-026, U.S. Department of Transportation, Federal Highway Administration (November 2007). • Sign Retroreflectivity Guidebook, Publication No. FHWA-CFL/TD-09-005, U.S. Department of Transportation, Federal Highway Administration (September 2009). • Sign Retroreflectivity: A Minnesota Toolkit, Minnesota Department of Transportation, Local Road Research Board (June 2010). • Traffic Sign Maintenance/Management Handbook, Report No. 2010RIC 10, Version 1.1, Minnesota Department of Transportation (October 2010). • LMCIT Sign Retroreflectivity Memo and Model Policy, League of Minnesota Cities (Final Edition, March 2014). SIGN INVENTORY To meet the City's goal of maintaining sign retroreflectivity above certain levels, the City will maintain a sign inventory of all new or replacement signs installed after the effective date of this policy. The inventory shall indicate the type of sign, the location of the sign, the date of installation or replacement, the type of material used on the face of the sign, the expected life of the sign and any maintenance performed on the sign. As to existing signs, the City has performed an inventory of signs covered in this policy. The inventory was completed in 2010. REMOVAL OF SIGNS In recognition of the fact that excess road signs have been shown to reduce the effectiveness of signage, as well as impose an unnecessary financial burden on road authorities. It is the City's policy to remove signs determined to be unnecessary for safety purposes and which are not required to comply with an applicable state or federal statute regulation. The removal of signs shall be based on an engineering study and the MNMUTCD. SIGN EVALUATION METHOD After reviewing the various methods for sign maintenance, the City will use a combination of the Expected Sign Life and the Blanket Replacement to meet the minimum sign retroreflectivity requirements in the MN. The City has been divided into ten areas and with an area replaced each year The City will replace all of the signs each year that has reached the end of its life cycle. The City will install 3M High Intensity Prismatic (HIP). Based on the HIP sheeting, each sign group will be replaced every 10 years. An installation date will be labeled or recorded when a sign is installed , so that the age of any given sign is known. SIGN REPLACMENT After the initial replacement of signs or the installation of new signs, the City shall, for the purpose of complying with the requirements of the MN MUTCD, maintain minimum retroreflectivity standards, as budgetary factors allow, by replacing signs as they reach of their expected life . If a sign is, found to have failed prior to its normal life, damaged, stolen or missing it will be replaced as soon as possible once it has been discovered. MODIFICATION AND DEVIATION FROM POLICY The City reserves the right to modify this Sign Retroreflectivity Policy at any time if deemed to be in the best interests of the City based on safety, social, political and economic considerations. The Director of Public Works , or designee, may authorize a deviation from the implementation of this policy in regard to a particular sign when deemed in the best interests of the City based on safety, social, political, and economic considerations. The one side of this access road bordered property that remained within Stillwater Township, and the Orderly Annexation Agreement prevented the annexation of this Township property or the assessment of it for road improvements. Nevertheless, the developer, Trailhead Development Company was required to build this access road at its own expense, but they believed it was unfair to allow property that remained in the Township to have access to a road at no cost. The City agreed with this position, but was also concerned that only a fair price be charged by Trailhead to these adjacent owners for access to the roadway. This compromise allowed the developer to plat a narrow strip of land between the Township property and the access road that would require an agreement from Trailhead to allow passage across it. The City then obligated Trailhead to charge adjacent owners no more than their fixed cost for the road. Since the development of Creekside Crossing, however, Trailhead has gone out of business, has not paid real estate taxes on these strips, and the parcels are therefore ready to be sold at auction by Washington County. Since the City has first chance at these parcels for roadway purposes, it is proposed that the City buy these strips and make them part of the right- of-way of Creekside Crossing. Striping of grassy area is mainly done by hand. Also, Public Works department has been painting crosswalks and stop bars throughout the city for the past 5 years. On occasion, the City has used the City of Bayport's mechanical striper for both fields and pavement. Discussion With 3 fields to maintain on a weekly basis and cross walks and stop bars, staff is recommending the purchase of a line machine. With the development of airless sprayers, prices have become more competitive with this equipment. BEYER ACCESSORY BUILDING - When John Beyer had built his home 25 years ago, the Township had required he put in a road to Township standards which he has maintained at his own expense. Now he wishes to build a new accessory building but would like to retain the older building where he stores the equipment for the road maintenance. The older building is about 600 square feet and the new one he plans to build is about 2800 square feet which would put him over the limit for his approximately 14 acres which would allow a total of 2900 square feet. The consensus of the Board was to get more input from staff and encouraged Mr. Beyer to apply for a variance. The building he proposes is in two 1400 square foot sections and he can go ahead and start with one of the sections and be within the allowed square footage. 5. MCDONALD PARK PROPERTY - Scott McDonald was present and gave an update on the park property his father is proposing to be part of the Washington County Land and Water Legacy Program. They have run into an issue with respect to setbacks on the lake. The homes currently there have a 75 foot setback, but the County is requiring a 200 foot setback for a new lot. Someone from the County will be invited to a future meeting to discuss their thinking. Stillwater Town Board Mtg. — 4/24/14 Page 2 6. WELL WATER TESTING PROGRAM - Washington County offers well water testing services for a nominal fee to all residents. Gravel Surface at Hwy 95 and Co51 - Adam Josephson, MnDOT, was present to discuss this intersection where there had been an issue with dumping. This is in the MnDOT right-of-way. They are willing to work with the Township to re - naturalize the area. He suggested the possibility of a berm to discourage people from driving in there. MnDOT will pay for all work.They could probably begin work in July. They would use some sort of low maintenance grass seed. They will attempt to clean up the area before then. He will communicate with Paul Pearson with respect to a timeline. b. 2014 Road Striping - Paul Pearson had submitted plans to Washington County for our striping needs. The County will include this work with their contract work and submit an invoice to the Township. c. 2014 Trail Maintenance Work - Paul Pearson had a map showing proposed trail work where trees and brush has grown up. He believes the cost that had been budgeted for trail maintenance was $15,000 to $20,000. There will be more information at the next meeting with respect to anticipated real costs and Paul Pearson will work with Marsha Olson on the budget numbers. The Clerk will check with Chief of Police Steve Nelson to see if Sentence to Service may be available to do some work. d. 2014 Seal Coating - Paul Pearson had prepared a memorandum outlining his research on the benefit of seal coating. He would recommend that the Township continue their seal coating program. It may be helpful if we can work with another community. Paul Pearson will solicit bids in April for the 2014 work to see what the cost would be. Stillwater Town Board Mtg. — 4/10/14 Page 2 e. Delay of Some 2017 Overlay Work - There had been some discussion of delaying some work that had been scheduled in 2017 so that the Township's road fund was not completely depleted. Paul Pearson said that it could be done. MFRA will identify the roads this spring that can be delayed and also estimate the related cost that the shift would make when MFRA updates the Asphalt Road Maintenance Cost Summary later this year. f. Affeldt Erosion Inspection Report - Mr. Affeldt has not yet submitted copies of the erosion reports. 5. CHIEF OF POLICE - a. Report given. There were 17 burning permits, 4 for buckthorn. The burning ban will go into effect on Monday, April 14th. No dogs were impounded. b. Park Reservations - There have been four reservations for the park so far. All are paid for. c. CUP Checks - Steve Nelson is work on CUP checks and expects to be done by next month. d. Accident- There had been an accident at Myeron Road and Norell. e. Upcoming Events - • Ironman Bike Ride on April 27 which will include part of the Township. • Cinco de Mayo is coming up. • The Jon Francis race will run as part of the Logjam festivities. f. Dog Licenses - Information will go out next month. g. Documentary - The BBC will be shooting a documentary at the boomsite. h. House on Boutwell - There had been a complaint about a lot of cars parked at a house on Boutwell. Steve Nelson is looking into it and most of the issues have been addressed. 6. TREASURER - a. Communication Committee - Fred Brandt reported that the budget for the communication committee is expected to go over. Brown's Creek Watershed District Projects - Planner Sherri Buss' memorandum dated April 3, 2014 had outlined some projects that the Watershed District had planned. Washington County Public Works Facility - David Johnson reported that they have an issue with wastewater from salt/sand trucks being rinsed off. They are considering putting in a pipe from the facility to the wastewater treatment facility in Stillwater. David Johnson and Fred Brandt will attend their presentation on April 15th. Zoning Permits in the Transition Zone - There was a discussion of what would happen to properties in the Transition Zone that had been issued a CUP by the Township when they are annexed into the City.
