The Heritage Preservation Commission may take action or reply at the time of the statement or may give direction to staff regarding investigation of the concerns expressed. Out of respect for others in attendance, please limit your comments to 5 minutes or less. 5. CONSENT AGENDA (ROLL CALL). All items listed under the consent agenda are considered to be routine by the Heritage Preservation Commission and will be enacted by one motion. APPROVAL OF MINUTES Possible approval of January 6, 2014 meeting minutes Motion by Commissioner Brach, seconded by Commissioner Mino, to approve the minutes of the January 6, 2014 meeting. Request for a Design Permit for a projecting sign to be hung from an existing arm for Atticus Family Law located at 125 Main Street South with entrance at 120 Water Street South in the CBD, Central Business District. NEW BUSINESS Heritage Preservation Commission Meeting February 3, 2014 Case No. DP/2014-3. Request for a Design Permit for a multi-tenant sign plan, and corresponding signage, for the structure located at 233 Main Street South in the CBD, Central Business District. Joe Ehlenz, applicant. City Planner Wittman explained that the applicant is requesting approval of a Design Permit for a multi- tenant sign plan, and corresponding signage on the front and rear fa<;:ades, to be located at 233 Main Street South. The front fa<;:ade is proposed to have one 19 square foot (9'6" wide by 2' tall) brushed metal sign to read LOLO (the name of the restaurant that is located on the main floor) and one four square foot (2'X2') metal projecting sign to read "HAF Group." The projecting sign will be hung from a 1" steel tube support suspended from the structure. All fa<;:ade signs will be lit with a 60 watt directional wall sconce ("goose neck" light) finished in matte black. The rear fa<;:ade is proposed to have one 11.67 square foot (3'5" X 3'5") metal sign with white lettering to read "HAF Group" noting the primary services offered. The sign is proposed to be backlit with LED lighting, which is not permitted in the CBD. In addition, one 9.54 square foot (3'5" wide by 2'9-1/2" tall) black, gray and green sign with white lettering will read "LOLO." The sign is proposed to be backlit with white LED lighting. Signs will all be boxed in on the sides. Staff recommends approval with conditions including provisions for changing the internally-lit signs to have gooseneck lighting on the signs in the rear facade. Kurt Kohl, representing the applicant, presented a sign sample illustrating the lettering style and lighting scheme that is proposed. Light is to be directed back onto the second surface so it is not projecting outward. Commissioner Johnson noted he appreciates that the rear will have a more industrial, warehouse type look. Motion by Commissioner Johnson, seconded by Commissioner Welty, to approve the sign plan as submitted, with the rear signage internal lighting to be a warmer, lower intensity of illumination, and mounting of projecting sign with double headed fixture, for a period of one year, to be reviewed by staff. All in favor, 7-0. Case No. DP/2014-4. Request for a Design Permit for an unlit, wall sign for Lemke Anderson PR located at 102 Main Street North. Chauncey Peterson, applicant. Case No. DP/2014-5. City Planner Wittman noted that the property owner has requested the items be continued until the March meeting. Motion by Commissioner Johnson, seconded by Commissioner Mino, to continue Case No. DP/2014-4 and Case No. DP /2014-5 at the request of the applicant. All in favor, 7-0. OTHER BUSINESS Seasonal Food Vendor Design Standards City Planner Wittman reported that the City Council discussed the need for design guidelines/standards for seasonal vending trailers, carts and vehicles that are not removed each day after closing for business. Currently, the HPC does a design review for vendors that have a structure. However, there is no design review required for carts , trailers , or food wagons. Staff is seeking guidance from the HPC for the development of a proposed ordinance amendment to address vending businesses that do not move from their approved sites each day. Commissioner Johnson suggested he would prefer to avoid the state fair type vendors with the single fold awnings that have a gen eric appearance. Page 2 of3 Heritage Preservation Commission Meeting February 3, 2014 Commissioner Welty pointed out perhaps the ordinance should prohibit neon or outside music. Other than that, she feels that unique vendor carts can add vitality to the urban streetscape and wouldn't want much more regulation. City Planner Wittman responded that vendors wouldn't be allowed to have outside music without a permit and are prohibited on streets or on public land except in conjunction with an event such as Summer Tuesdays. Commissioner Johnson noted that an ordinance might also address parking requirements, since private land usually has to have a number of parking spaces. Vending carts could take up one or two of the required spaces and may create additional parking demand. Commissioner Larson said he would object to the very generic white aluminum utility type trailers. City Planner Wittman suggested the Commission consider basing an ordinance on current design standards and incorporating allowed materials and color. She agreed to check other communities' ordinances for comparison. She will bring back a proposed ordinance to the Commission's next meeting. StaffUpdates-Verbal Report City Planner Wittman reported that The Water Street Inn will be submitting plans to include trash inside their building addition. Staff is still investigating how to make pedestrian walkway lights more consistent with other downtown lights. Pre-application has been submitted for Certified Local Government Grants for the Bergstein and Shoddy Mill buildings, but staffhas learned that MnDOT needs to have the structures delisted andre-listed on their new site, so instead, a pre-application will be prepared for funding for the Sabin 's and H.R. Murdock Additions and possibly the Wilkins Addition. The City licenses 12 bus benches a year that contain advertising -staff has discovered one bench that is not licensed and is investigating what company put it there. At the next meeting, she will do a workshop for commissioners on how to obtain packets on Dropbox, because in April the City will move to electronic distribution. The signs will also contain the Allina Health logo in green and blue. APPLICABLE GUIDELINES AND REGULATIONS Free standing signs in the BP-I zoning district may not exceed 100 square feet for each exposed fac e and may not exc ee d six f eet in height. The proposed sign meets the requirements of the zoning code. The signs also conform to the 1989 West Stillwater Business Park Plan. The proposed sign meets the requirements of the zoning code as well as the multitenant sign plan approved by the HPC with the adoption of DP /2013-42. The signs also conform to the 1989 West Stillwater Business Park Plan. RECOMMENDATION Staff recommends the Commission approve the Design Permit as submitted with the following conditions: 1. The sign may not project more than 16" from the wall which the sign is affixed. 2. Substantial changes shall be review by the Heritage Preservation Commission. At the Commission's last regularly-scheduled meeting, the Commission continued the items at the request of the property owner due to potential modifications to the requests. To date, additional items have not been received though staff has b een in discussion with the property owner regarding the proposal. The 60-day deadline is March 21,2014 . The City can exercise the right to extend the deadline an additional 60 days, if needed. RECOMMENDATION Staff recommends the Commission continue DP /2014-4 and DP /2014-5 to allow the a pplicant to submit permit application materials no later than April18, 2014 to be heard b efo r e the Commission at the regularly-scheduled meeting in May. HERITAGE PRESERVATION COMMISSION MEETING DATE: March 3, 2014 CASENO.: N/A APPLICANT: City of Stillwater REQUEST: Consideration of a recommendation to the Stillwater Planning Commission regarding a Zoning Text Amendment (ZAT) establishing design review standards for certain seasonal food vending facilities PREPARED BY: Abbi Jo Wittman, City Planner BACKGROUND At the Commission's last regularly-scheduled meeting, staff informed Commissioners of the Council's request for design review standards for those mobile seasonal food vending carts and trailers that are not removed nightly. Based on that discussion, staff has drafted the attached amendment to Sec. 41-7. Seasonal outdoor sales, Subd. 2. Seasonal food vending. RECOMMENDATION Staff recommends the Commission review the attached draft amendment for determination of inclusion or removal of any necessary design review requirements. The draft shall be sent to the Planning Commission for consideration of a Zoning Text Amendment. ATTACHMENTS Draft Sec. 41-7. Seasonal outdoor sales. Subd. 2. Seasonal food vending Sec . 41-7. Seasonal food vending is allowed by annual permit only on private property as an accessory use within the CBD zoning district, subject to the requirements of this subdivision. For purposes of this subdivision, "seasonal food vending" does not include food vending for events. Event food vending requires an event permit pursuant to City Resolution No. 2010-204 and any subsequent revisions to that resolution. The annual permit for a seasonal food vending cart or vehicle may be approved by the city subject to the following: (1} A completed permit application form must be submitted annually (including permit fee) to the community development department. The completed applic~tion must be submitted at least 60 days prior to the first seasonal usage of the cart or vehicle. To be considered complete, the application must include the completed application form, permit fee, and the following additional information . (a) Address of the private property upon which the cart or vehicle will operate. (b) Site and operations plans detailing at least the following: 1. Size and location ofthe area being occupied by the seasonal food vending operation. e. Color pictureW and dimensions of all four sides of the vehicle or cart, including exterior facade design. , . This includes indoor lighting which is visible from (d) The food vending cart or trailer shall not use outside sound amplification, televisions or other similar visual displays, nor may it use noisemakers such as bells, horns or whistles. 3. Location of exits from principal building on the property. The vending equipment and operation must not block the exits. 4. Storage location for vehicle or cart when not open for business. 5. Method of containing trash and recycling. 6. Pedestrian and traffic control safety measures. The sales area may not impede pedestrian or vehicular circulation patterns on or around the site. If parking stalls are being used by the vending operation, this must be indicated on the site plan. The total number of parking spaces required of the principal use of the private property shall not be reduced below the minimum number required by ordinance. 8. Miscellaneous operation details including: a) dates and hours of operation, b) merchandise or service being offered for sale, and c) contact information for the landowner, the applicant, and the manager of the seasonal vending operation. (c) Utility plan. Indicate how utilities will be provided to the operation. (d) Signage plan. The annual permit application must include details of all proposed signage. A drawing for each proposed sign shall be submitted. The drawing shall show dimensions and describe materials, lettering, colors, illumination and support systems. The proposed signage shall be reviewed against the following standards. 1. The total number of signs associated with a seasonal vending operation is limited to two. 2. All signage for the seasonal vending operation must be contained on the subject private property. 3. One sandwich board type sign may be permitted if it satisfies the standards found in the policy adopted by the city council on November 11, 2008, and updated on July 8, 2009, and any subsequent revisions to that resolution. 4 . One sign may be painted or affixed directly to the vehicle or cart. 5. No sign associated with the seasonal vending operation is allowed to be on the subject property when the cart or vehicle is not present. (e) Signed agreement from the property owner allowing the proposed seasonal vending operation. (2) Submittal of a satisfactory inspection report of the proposed cart or vehicle from the Stillwater Fire Department. (3) Submittal of a permit issued for the cart or vehicle by Washington County health officials. (4) The annual permit for the first year of operation shall be reviewed by the Planning Commission. The first year permit shall be valid through December 31 of the year. (5) The annual permit for subsequent years of operation shall be reviewed by Community Development Department staff, unless there are substantial changes to the site plan or operations plan, or unless there are substantiated complaints of a public safety or public health nature. If there are such substantial changes or complaints, the planning commission must review the annual permit application for that year. (6) Seasonal food vending is only allowed on private property. No seasonal food vending permits will be issued for operation on public property or public rights-of-way. (7) For public safety reasons, all seasonal food vending operations must close by 2:30a.m. each day. Also, if during large events it is determined by the chief of police that downtown crowd control is necessary, seasonal food vending businesses may be required to close earlier than 2:30a.m. during that event. The City has preservation awards to individuals and organizations whose actions have furthered historic preservation efforts in the community. This year marks the 20th anniversary of the City's annual awards program though the City has not presented awards since the fall of2012. Attached are a list of the awards given to date. Thank you, and Mr. Mathis of the 106 Group, for presenting MNDOT's loop trail design to the Stillwater Heritage Preservation Commission (HPC) on Monday, January 6, 2014. We appreciate the ability to comment on proposed mitigation efforts that could adversely impact historic resources in this area as well as the proposed trail fence and guardrail design located within the Downtown Stillwater Design Review District. Regarding the historic wall titled D6, the HPC recommends stabilization must occur prior to ground disturbing activities occur. In order to achieve stabilization, the HPC recommends either: 1) Removal of the top 5-6' of the wall (referred to as 'the upper portion') that is currently tipping upward as to prevent further damage to the lower portion of the wall. In the event the upper portion of the wall is removed, MNDOT should coordinate with the City of Stillwater for the stacking of the rock material in a safe and secure location for the future repair and/ or potential reconstruction of walls in this area; or 2) Install a small, neutral or black colored diamond-patterned wire mesh over the entirety of wall D6 and leave this mesh in place for the City of Stillwater to remove at a time when the City plans to repair and/ or potentially reconstruct wall D6. Regarding the proposed fences and guardrails in this location, the HPC would like to see a design consistent with that of the City's Main Street stairs. The HPC would like to see a variation of the two-rail scheme shown us, with ball fittings, including end caps, opposed to welded joints. This design would be consistent with the industrial context of this portion of the City of Stillwater's Downtown. MNDOT bicycle trail guidelines call for a 42" high rail in most conditions and a 48" high rail at "precipitous drop-offs". We are unclear under what circumstances a 54" high bridge- type guard rail is needed, as shown to us in the example. NCHRP' s 2004 Bike Rail Height Final Report states: "In many locations, especially along shared-use paths at the top Page 1 ~'l!}WJ&~ T h e B i r t h p I a c e o f M i n n e s o t a) of slopes in a scenic corridor, the theoretical additional degree of safety afforded to bicyclists by a 1.4-meter (54-inch) high railing would not likely offset the associated aesthetic and cost impacts. " Ideally, we would like to see this rail as minimal in height and density as possible, and located only where deemed necessary. The HPC understands modifications to the two-rail system may need to be made in order to achieve user safety in these locations. If a 54" high guardrail is required, a sketch of a suggested concept is attached. As we noted last week, we recommend to MNDOT and the Stillwater City Council their consideration of redesign of the corrugated metal guardrail system separating pedestrian and vehicular use along HWY 95 entering into downtown Stillwater. As a primary entrance into the heart of our community and southern end of our Downtown Commercial Historic District, we believe a redesigned guardrail could achieve a more welcoming environment for pedestrian and bicycle users of the adjacent loop trail, as well as for vehicles on the highway. As a mitigation effort on the loop trail, we would prefer a design that enhances this very prominent entrance into our community, and appears less like a typical state highway guardrail. A box-beam weathering steel and post system is one possible alternative. While we understand there are certain requirements that must be met to achieve user safety in this location, we are requesting consideration of alternative design proposals in this area that recognize this unique entrance to our historic town. Once again, we appreciate your consideration of the HPC' s comments and thank you for the opportunity. We look forward to working with MNDOT and the Section 106 Group on future projects focusing on the historical and cultural resources in the area of the St. Croix Crossing project.
