The Heritage Preservation Commission may take action or reply at the time of the statement or may give direction to staff regarding investigation of the concerns expressed. Out of respect for others in attendance, please limit your comments to 5 minutes or less. 5. CONSENT AGENDA (ROLL CALL). Chairman Larson called the meeting to order at 7:04 p.m. Present: Chairman Larson, Commissioners Johnson, Brach, Goodman, Welty (arrived at 7:07 p.m.), Council Representative Menikheim Absent: Commissioner Krakowski Staff: Community Development Director Turnblad, City Planner Wittman APPROVAL OF MINUTES Possible approval of August 5, 2013 meeting minutes and August 12, 2013 special meeting minutes Motion by Commissioner Johnson, seconded by Commissioner Brach, to approve the minutes of the August 5, 2013 meeting. All in favor. Motion by Commissioner Goodman, seconded by Councilmember Johnson, to approve the minutes of the August 12, 2013 special meeting. All in favor. OPEN FORUM Commissioner Johnson noted that a neighbor of the Van Horn property on Pine and Fifth Streets, where a garage is about to be demolished, is interested in relocating the garage to his own property. City Planner Wittman responded that staff has been in contact with both parties and suggested some options for relocating the garage; however, the demolition permit has been granted and it will be up to the property owners involved. Ayes: Chairman Larson, Commissioners Brach, Goodman, Johnson, Welty. Nays: None Heritage Preservation Commission Meeting September 4, 2013 PUBLIC HEARINGS Case No. DEM /2013 -49. A demolition request for a detached garage located at 408 Greeley Street North in the RB, Two Family Residential District. April Rust, applicant. City Planner Wittman explained that the applicant is requesting a demolition permit for an approximately 400 square foot garage located at 408 Greeley Street North in order to replace it with a functional two -car garage. Staff finds the structure is not an historic resource and there is no feasible alternative to demolition. April Rust, applicant, offered to answer any questions. Chairman Larson reminded the applicant that the new garage will need to follow the Conservation District guidelines. Motion by Commissioner Johnson, seconded by Commissioner Brach, to approve the demolition, finding that the property is not deemed by the Commission to be an historic resource and that there is no alternative to demolition. All in favor. Commissioner Johnson reminded the applicant that the Infill Design Guidelines will apply to the new structure. NEW BUSINESS Design permit violation In response to an inquiry by Chairman Larson about a property where a design permit was not followed, City Planner Wittman reviewed options provided by the City Attorney. The options include: issuing a citation for violating the zoning code; or issuing an injunction requiring the property owner to change what they've done to match what was approved in the permit. Since a certificate of occupancy on this residence has not been issued, the owner may request that the Commission consider an amendment to the design permit to allow what was built. Because the City's zoning code and building code aren't linked, there is nothing allowing the building inspector to postpone issuing a certificate of occupancy based on non- compliance with the design permit. City Planner Wittman said she will talk with the City Attorney about the options and bring them back to the Commission at the next meeting. Council Representative Menikheim remarked that the Council is beginning to focus more on enforcing rules and special use permits. Commissioner Johnson requested a recap of the Council action regarding denial of the permit for a trash enclosure at the Water Street Inn. City Planner Wittman responded that the Council upheld the denial and gave Mr. Dougherty until September 20 to submit a new design. Should he not submit a new design consistent with the SUP and development agreement, a citation will be issued. Commissioner Johnson pointed out that Council Representative Menikheim was the only Councilmember who did not support the HPC's recommendation for denial. Councilmember Menikheim responded that he perceived a lot of personal animosity carried forth for years which comes into play in decisions, in his view. Page 2 of 4 Heritage Preservation Commission Meeting August 5, 2013 Commissioner Johnson reminded Council Representative Menikheim that Mr. Dougherty was one of the three parties who signed the original SUP requiring that trash be kept inside the building. He perceived two different messages from the two meetings: 1) it's an old SUP and it wasn't enforced, so now we should start from scratch; 2) we should enforce the ordinances and direct staff to follow through. Council Representative Menikheim replied that it's not a change in position but the process as it unfolds. City Planner Wittman said staff will be following up. OTHER BUSINESS Discussion of 2013 -2014 Podcast Project City Planner Wittman stated that the Council voted to contract with Dan Hoisington, against the Commission recommendation for Don Empson, on a split vote. Mr. Hoisington would like to meet with the Commission for direction on the project. He also asked, if the City is favorable, if he could do two additional podcasts for a total of 16. Commissioner Johnson suggested there might be some appropriate homes around the historic courthouse, St. Michael's, St. Mary's, several houses on Pine, 6th and Chestnut Streets that are unique. Chairman Larson noted the podcast shouldn't exclude the smaller "working people" houses which are the real story of Stillwater. Commissioner Welty commented that the podcasts should address not only the architectural style but also the functionality of the home and how its residents lived. Commissioner Johnson added that what is interesting is the history of pasture and outbuildings needed to maintain horses that belonged to some of the bigger houses, accounting for a blend of newer homes that have been built in among older ones. Commissioner Goodman added that the podcast could reflect the timing of development of the town, with new and old homes together, a dormant period until after World War II, and then an upswing in building. Commissioner Johnson suggested that Mr. Hoisington take a trolley tour to see what it focuses on. City Planner Wittman stated she will convey to Mr. Hoisington that the Commission is interested in depicting the lumbering era, different architectural styles, and different classes of homes in the same neighborhood. She feels the City might be able to obtain at least one more CLG grant. Discussion of HPC Vacancy City Planner Wittman informed the Council that she received a new application from Carrie Bren, and found previously submitted applications from Pat Thorson and John Rheinberger. She asked for direction. The Commission agreed to recommend to the Council that Pat Thorson be appointed, if she is still interested, and to interview Carrie Bren for a future seat, since she isn't able to start until January. Idea for a community event Page 3 of 4 Heritage Preservation Commission Meeting September 4, 2013 Commissioner Welty said she understood there used to be a luge in Stillwater. It would be great if there were a luge or some sort of sledding run to use as the centerpiece of a wintertime community festival. City Planner Wittman reminded the Commission that the Council has directed staff to obtain proposals from event coordinators interested in running community wide events. The signs will be of the same shape and size and will be in the same location as the existing Prime Mortgage Signs. Two of the signs will be a part of integrated groupings: one of the signs will be above the door on the west elevation (approximately 6 square feet) whereas the other sign will be located on the red accessory structure (approximately 11 square feet). The last night will be a modification of a hanging building directory sign. A window decal sign is also proposed but does not exceed 1/3 of the total window area and, therefore, is not regulated by the City's sign regulations. The window decal, however, will be of the exact shape, size and color of the existing window decal in this location. APPLICABLE REGULATIONS AND STANDARDS Municipal Code Section 31 -509, Subd. 2, Permits Required, states: "All signs requires a design review permit" but the City has not amended the sign regulations to specifically address standards and regulations for the Village Commercial (VC) zoning district. Municipal Code Section 31 -209, Design permit states: • The Standards for Review , Sec. 31 -5090 indicates the HPC shall utilize the following standards: o Architectural character: ■ The suitability of the building for the intended purpose. • The consistency of the applications design with approved design guidelines. • The compatibility of the character of the design with adjacent development. o Outdoor advertising: The number, location, color, size, height, lighting and landscaping of outdoor advertising signs and structures in relation to the creation of traffic hazards and the appearance and harmony with adjacent development. o Historical structures, vistas, sites and the impact of development on these resources. 105 New England Pl. Unit #250 Page 2 o Special design guidelines for areas or districts of the city officially adopted by the city council. • This Code Section further notes "the Heritage Preservation Commission may include conditions the committee deems reasonable and necessary to carry out the intent of this chapter and this section ". The Liberty Village Architectural Review & Design Guidelines indicate: "All signs in Liberty Villages are regulated by...a design permit and must meet the approved design guidelines for signage". It also states "When there is more than one business or use in a building with more than one sign, a building sign plan must be provided with the sign permit application ". A sign plan was adopted by the City in 2006. The approved 2006 sign plan permits 1 square foot of signage per 1 linear foot parallel to the street. Unit #250 has 70 square feet of frontage. In addition, the 2006 sign plan prohibits internally lit signage. The proposed signs will not be internally lit. FINDINGS Staff finds the application is consistent with the with the purpose of the zoning code, the comprehensive plan, and the heritage preservation ordinance. Additionally, the size, height, location and materials of the sign for the Bell Mortgage sign relates to the scale and design of existing building signage, minimizes the risk for traffic hazards and meets the design guidelines for Liberty Village. IV, 25 254 RECOMMENDATION As per Review of the application by the design review committee (Section 31- 209e): "The design review committee must make a final decision on the granting or denial of a sign permit after seeking the recommendation ". Staff recommends approval with the following conditions: 1. All revisions to the approved plan shall be reviewed and approved by the HPC. 2. No additional signage permitted for this business unless permitted through an approved temporary sign permit. Each sign will be a (approximately) 32' square feet white sandblasted high - density urethane (HDU) foam board sign with black lettering. The signs will be enclosed in a black aluminum frame that will be mounted into the mortar of the structure. The signs will not be illuminated and will replace the existing temporary banner signs that have been in place on this site. APPLICABLE REGULATIONS AND STANDARDS While the structure is located in the Downtown Stillwater Design Review District, it is not located in the Downtown commercial Historic District. The Downtown Design Manual indicates all signs must comply with the zoning regulations. The proposal meets the zoning code regulations of one wall sign allowed per business per street face and that the total signage may have one square foot per one linear foot per street face. The standard for review of a design permit application include the Commission's review of the number, location, color, size, height, lighting and landscaping of outdoor advertising signs and structures in relation to the creation of traffic hazards and the appearance and harmony with adjacent development. The Commercial Historic District Design Manual guidelines state "... signs were simple, bold and well crafted. Lettering was in clear, no- nonsense styles, maximizing the contrast between the background and the lettering." FINDINGS Upon a finding by the design review committee that the application will meet the standards of design review, secure the purpose of the zoning code, the comprehensive plan and the heritage preservation ordinance, the design review committee may approve the design permit, subject to conditions as it deems necessary. If a finding is made that the permit would violate the standards of design review, it must deny the application. The window signs do meet the following guidelines for window signage: • It may often be desirable to keep the display space clear. In these cases, insert the sign at the base or the head of the window, or both. • Keep the lettering small remembering that the reader will be in close proximity to the sign. Use several ines where necessary and consider curving the top line at the head of the window. APPLICABLE STANDARDS AND REGULATIONS As per Chapter 34 of the municipal code, staff has determined the structure is a historic resource as it embodies the distinctive characteristics of an architectural or engineering type or style, or method of construction. For a historic resource, the Commission must decide on one of the following: (i) Negative finding. If the commission finds that the property is not a historic resource, then the commission shall notify the building official that a demolition permit may be issued. (ii)Positive finding with no feasible alternative to demolition. If the commission finds that the property is historically significant or a historic resource, but that there is no feasible alternative to demolition, then the commission shall notify the building official that a demolition permit shall be issued. (iii) Positive finding with feasible alternative to demolition. If the commission finds that the property is historically significant or a historic resource, and that there is a feasible alternative to demolition, then the commission shall deny the demolition permit and direct the community development director to prepare a designation study of the property. Before approving the demolition of a building, the commission shall make findings that the demolition is necessary to correct an unsafe or dangerous condition on the property, or that there are no reasonable alternatives to the demolition. In determining whether reasonable alternatives exist, the commission shall consider, but not be limited to, the significance of the property, the integrity of the property and the economic value or usefulness of the existing structure, including its current use, costs of renovation and feasible alternative uses. The commission may require a mitigation plan as a condition of any approval for demolition of a building. Such plan may include the documentation of the property by measured drawings, photographic recording, historical research or other means appropriate to the significance of the property. With the approval of the city council, the commission may stay the release of the building, wrecking or demolition permit for up to 180 days as a condition of approval for a demolition of a building that has been found to contribute to a potential historic district to allow parties interested in preserving the historic resource a reasonable opportunity to act to protect it. DEMOLITION FINDINGS The property owner is making reasonable effort to preserve the integrity of the oldest portions of the structure; the architecturally significant portions of the home, as well as the oldest portions of the structure, are proposed to remain intact thus preserving the historic resource. The property owner has proposed upgrades which will help protect the exterior facade of this resource as well as bring to use non - utilized upper stories of the structure. Additionally, the property owner is proposing additions to the structure that will complement the remaining portions, while returning key elements of the original structure's design. 657 Broadway Street South Page 3 Although the City has record of the significance of the property, the non - historic additions are proposed for demolition. These portions of the structure are not consistent with the architectural style of the residence and do not contribute to the historic value of the resource. Staff finds that the property owner has proposed a feasible alternative to the total demolition of the historic resource and that there is a negative finding for those additions proposed to be demolished. RECOMMENDATION Staff recommends the HPC open the public hearing to take public comment, including testimony from the applicant. Once all comments have been made, the HPC should close the public hearing and take action on the request. If the Commission agrees with the demolition findings, above, the Commission must notify the Building Official that the permit may be issued. Sec. 34 -1. - Purpose of chapter. This chapter is adopted for the purpose of protecting the historic and aesthetic qualities of the city by preserving, rehabilitating or restoring, when reasonable, buildings or structures which constitute or reflect distinctive features of the architectural or historical resources of the city, thereby promoting the public welfare and preserving the cultural heritage of the city. (Ord. No. 1047, § 1, 6 -5 -12) Sec. 34 -2. - Definitions. The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this subdivision, except where the context clearly indicates a different meaning: Building or structure of potential historic significance means a building or structure or portion of a building or structure built on or prior to December 31, 1945. Commission means the heritage preservation commission. Community development director means the Stillwater Community Development Director or his or her designee. Demolition means one of the following: (1) Razing a building. (2) Removal of 50 percent or more of the total facade. (3) Removal of more than 20 percent of the exterior front facade of a structure including the front facing roof. The amount of front facade that is required to be removed for a front porch shall not be counted toward the 20 percent. (4) Demolition by neglect. A demolition shall not mean any of the following: (1) (2) A structure required to be demolished in accordance with Minn. Stat. ch. 463. Destruction by fire that has been determined to be a total loss by the community development director. However, a fire that is caused by arson and was proven to be started by an act of the owner or the owner's agent shall be considered a demolition. (3) Destruction by a natural disaster or other similar event and which has been determined to be a total loss by the community development director. (4) Items that are considered maintenance in the opinion of the community development director. (5) Items that are considered maintenance in the opinion of the community development director. Historic resource means any building or structure that is not currently designated as a heritage preservation site, but which is worthy of such designation because of its historical, cultural, architectural, archaeological or engineering significance for one of the following reasons: (4) (5) (6) (7) The property is associated with significant events or with periods that exemplify broad patterns of cultural, political, economic or social history. The property is associated with the lives of significant persons or groups. The property contains or is associated with distinctive elements of city or neighborhood identity. The property embodies the distinctive characteristics of an architectural or engineering type or style, or method of construction. The property exemplifies a landscape design or development pattern distinguished by innovation, rarity, uniqueness or quality of design or detail. The property exemplifies works of master builders, engineers, designers, artists, craftsmen or architects. The property has yielded, or may be likely to yield, information important in prehistory or history. Historically significant building or structure means any building or structure or portion of a building or structure on the National Historic Register, a designated local heritage preservation site or a contributing structure or building in a designated national register historic district. Nonhistoric structure or building means a structure or building built on or after January 1, 1946, or is not on the National Historic Register, or is not a designated local heritage preservation site, or is a noncontributing structure or building in a designated national register historic district. (Ord. No. 1047, § 1, 6 -5 -12) Cross reference— Definitions generally, § 21 -2 Sec. 34 -3. - Permit required. No building or structure may be demolished without obtaining a demolition permit. An application for a demolition permit must be filed with the city building official. (Ord. No. 1047, § 1, 6 -5 -12) Sec. 34 -4. - Procedure. The building official must forward a copy of each demolition permit application to the community development director. Subd. Community development director review. The community development director shall review the 1. permit, conduct an on -site visit of the property with the applicant, make one of the following determinations, and take the associated action: (1) (2) The building or structure is historically significant. If the building or structure is found to be historically significant, then the application will be sent to the commission for review according to section 34 -4, subdivision 2. The building or structure is a historic resource. If a building or structure is potentially historic due to being built on or prior to December 31, 1945, and it is determined to be a historic Subd. 2. resource, then the application will be sent to the commission for review according to section 34-4, subdivision 2. (3) The building or structure is potentially historic but not historically significant or not a historic resource. If a building or structure is found to be potentially historic, but it is determined that it does not meet the definition of a historic resource, then the application for a demolition permit will be referred to the building official for issuance of a demolition permit. (4) The building or structure is nonhistoric. If a building or structure is nonhistoric, then the application for a demolition permit will be referred to the building official for issuance of a demolition permit. Heritage preservation commission review. If the community development director determines that a building or structure is historically significant or a historic resource, then the commission must review the demolition request to determine whether a demolition permit may be issued. (1) Required demolition permit application materials. An application form and 15 copies for commission review must be submitted to the city in order to place the demolition request on a commission agenda for consideration. The demolition permit application must include the following information: (a) A map showing the location of the building or structure to be demolished on its property and with reference to neighborhood properties; (b) A legal description of property and owner of record; (c) Photographs of all building elevations; (d) A description of the building or structure or portion of building or structure to be demolished; (e) The reason for the proposed demolition and data supporting the reason, including, where applicable, data sufficient to establish any economic justification for demolition to determine why restoration or reuse is not economically feasible; (f) Proposed plans and schedule for reuse of the property on which the building or structure to be demolished is located. The heritage presentation commission may apply the standards set out in the neighborhood conservation design guidelines when appropriate; (g) Relation of demolition and future site use to the comprehensive plan and zoning requirements; and (h) A description of alternatives to the demolition. Public hearing. The commission must hold a public hearing according to section 31 -204, subdivision 3 of this Code. Additionally, 12 days prior to the public hearing, the applicant shall cause a sign to be installed at the street frontage of the property stating a notification message as prescribed by city staff that is intended to notify the public of the proposed demolition. The commission will conduct the public hearing, review the demolition request, and decide upon one of the following courses of action: (2) (a) (b) For a historically significant building or structure: (1) No feasible alternative to demolition. If the commission determines that the owner has made a reasonable effort to sell or preserve the structure and after finding that there is no available feasible alternative to demolition, then the commission shall notify the building official that a demolition permit may be issued, as provided in subsection (3) below. (11) Feasible alternative to demolition. If the commission determines that there is a feasible alternative to demolition, the permit must be denied. For a historic resource: (I) Negative finding. If the commission finds that the property is not a historic resource, then the commission shall notify the building official that a demolition permit may be issued, as provided in subsection (3) below. (ii) Positive finding with no feasible alternative to demolition. If the commission finds that the property is historically significant or a historic resource, but that there is no feasible alternative to demolition, then the commission shall notify the building official that a demolition permit shall be issued, as provided in subsection (3) below. (iii) Positive finding with feasible alternative to demolition. If the commission finds that the property is historically significant or a historic resource, and that there is a feasible alternative to demolition, then the commission shall deny the demolition permit and direct the community development director to prepare a designation study of the property, as provided in section 22 -7, subdivision 4 [Procedures for the designation of heritage preservation sites]. 1. Failure to designate property. If the city council does not approve the preparation of the designation study within 30 days of the commission determination, or if the completed designation study is not approved within 180 days of the commission determination, or if the city council denies implementation of the designation after completion of the designation study, then the building official shall issue the demolition permit. (3) Commission findings and conditions. While reviewing the demolition permit request, the commission shall consider the following findings and conditions: (a) Destruction of a building or structure. Before approving the demolition of a building, the commission shall make findings that the demolition is necessary to correct an unsafe or dangerous condition on the property, or that there are no reasonable alternatives to the demolition. In determining whether reasonable alternatives exist, the commission shall consider, but not be limited to, the significance of the property, the integrity of the property and the economic value or usefulness of the existing structure, including its current use, costs of renovation and feasible alternative uses. The commission, with the approval of the city council, may delay a final decision for up to 180 days to allow parties interested in preserving the historic resource a reasonable opportunity to act to protect it. (b) Mitigation plan. The commission may require a mitigation plan as a condition of any approval for demolition of a building. Such plan may include the documentation of the property by measured drawings, photographic recording, historical research or other means appropriate to the significance of the property. (c) Demolition delay. With the approval of the city council, the commission may stay the release of the building, wrecking or demolition permit for up to 180 days as a condition of approval for a demolition of a building that has been found to contribute to a potential historic district to allow parties interested in preserving the historic resource a reasonable opportunity to act to protect it. The release of the permit may be allowed for emergency exception as required in section 34 -5 (Ord. No. 1047, § 1, 6 -5 -12) Sec. 34 -5. - Emergency demolition. If a historically significant building or structure or historic resource poses an immediate threat to health or safety due to its deteriorated condition, the owner of the building or structure may request issuance of an emergency demolition permit. If both the community development director and building official find that the condition of the building or structure poses a serious and imminent threat to public health and safety and that there is no reasonable alternative to the immediate demolition, together the community development director and building official may issue an emergency demolition permit. (Ord. No. 1047, § 1, 6 -5 -12) Sec. 34 -6. - Fee. For purpose of reimbursing the city for administration of this chapter, the city will by resolution, from time to time, set the amount of fees to be charged for processing all applications and appeals. In addition to any other relief provided by this chapter, the city attorney may apply to a court of competent jurisdiction for an injunction to prohibit the continuation of any violation of this chapter. This application for relief may include seeking a temporary restraining order, temporary injunction and permanent injunction. (Ord. No. 1047, § 1, 6 -5-12) Sec. 34 -8. - Violation of chapter. Any person violating any provision of this chapter shall be guilty of a misdemeanor, and a separate offense shall be deemed committed on each day during on which a violation occurs or continues. As the downtown banners are not advertising, they are not regulated under the zoning regulation section pertaining to signs. Given this, Section 22 -7 of the Municipal Code indicates the purposes of the heritage preservation commission are to: • Safeguard the city's heritage by preserving sites and structures which reflect elements of the city's cultural, social, economic, political, visual or architectural history; • Protect and enhance the city's appeal and attraction to residents, visitors and tourists and serve as a support and stimulus to business and industry; • Enhance the visual and aesthetic character, diversity and interest of the city; • Foster civic pride in the beauty and notable accomplishments of the past; and • Promote and preservation and continued use of historic sites and structures for the education and general welfare of the city's residents. The Commission should discuss whether or not the banners help fulfill the purposes of the HPC and whether or not the banners are appropriate for downtown Stillwater. September 9, 2013 Ms. Abby Whitman City Planner City of Stillwater Dear Ms. Whitman: Subject: Downtown City Banners Reference: Historic Star and Banner Symbolism I am concerned and wish the HPC's evaluation of the appropriateness of the symbolism that the number of star and bar elements on the red, white, and blue banners appear to convey. To me, the contemporary design of the number of stars and bar elements conveys culturally and historically insensitive meaning and inferences related to the initial secession of states followed by thN secession of additional states leading to the Civil War and the sentiments that linger to date concerning the flags of the Confederacy. The following history of the Confederate flags is provided for your understanding and consideration: The past to present chronology of the flags of the Confederacy is as follows: -After the seven states of South Carolina, Mississippi, Florida, Alabama, Georgia, Louisiana and Texas succeeded from the Union, the first official flag of the Confederacy from March 1861 through May 1863 consisted of seven stars on a blue background with two red and one white bar that was known at the time and since as the Stars and Bars flag (attachment 1). - After the Confederacy's attack and forced surrender of Fort Sumter on April 12, 1861, a seven star flag on a blue background flew over the fort (attachment 2). -The lyrics of the song, The Bonnie Blue Flag, the popular song of the Confederacy, tells the story of original seven states that joined the Confederacy then encouraged and honored the additional states that thereafter joined the Confederacy (attachment 3). -After the surrender of Fort Sumter, the four states of Virginia, Arkansas, Tennessee and North Carolina joined the Confederacy followed by the states of Kentucky and Missouri's expected inclusion in representing the thirteen stars of the present day Confederate flag. The six states added to the Confederate flag that endures to today are perceived to be represented by the six bars on the banners in the same way that the thirteen stripes on the past to present US flags represent the original thirteen colonies (attachments 4 and 5). -2- - Looking to the elements of the present day state flags of the 13 states that represented the 13 states of the former Confederacy relative to all other state flags, note the ongoing use of the stars and bars as well as the cross of St. Andrew in addition to red, white, and blue colors relative to other state flag elements and colors. (attachments 6 -7) In the entire history of the US flags and succession flags, only the Confederacy has been associated with seven stars. The mathematical probability of the number of the two distinct elements of the contemporary design of the banners being random and without deliberate intent of conveying other than intended patriotic symbolism is unlikely. I believe the question should be asked how else could a contemporary flag be designed that would better convey the symbolism of the Confederacy than the banner design presently in use? The fledgling Confederate Navy therefore adopted and used jacks, battle ensigns, and small boat ensigns, as well as commissioning pennants, designating flags, and signal flags aboard its warships. The First Confederate Navy Jack, in use from 1861 to 1863, consisted of a circle of seven to fifteen 5- pointed white stars :% against a field of medium blue. The City is seeking historical consultants for completion of studies to determine whether properties are eligible for designation as local heritage preservation sites. A designation study will be prepared when a demolition permit has been requested for a property that the Stillwater Heritage Preservation Commission (HPC) has found to be potentially eligible for local designation. Summit proposes to be on the City's pre- approved list of historical consultants. Summit will prepare historical designation studies according to the approach outlined below. The studies can be completed within 60 days according to the general schedule provided in Section 2 and at a cost described in Section 3. The general schedule and cost are for a single property with up to one main building, such as a house, and one ancillary building, such as a garage. Summit understands the importance of the historic designation studies for the City. As a historic river town, Stillwater's tourism economy, as well as general quality of life, are greatly enhanced by its historic buildings. The designation studies will provide buildings with protection and recognition, and preparing them quickly will allow project reviews to conclude in a timely manner. PROJECT APPROACH Summit historians will prepare local designation study reports as requested by the City. Before any work is started on the study reports, Summit staff will assess previous documentation for each property, where the gaps are, and what work is needed to complete the study report. It is anticipated that this work will be focused on the role of the property in the development of Stillwater, the background of its architect, and the developmental history of the building. In researching properties, we will build off of existing historic contexts as much as possible, such as the neighborhood histories. Historical research for properties will be undertaken at the Stillwater Public Library St. Croix Collection, Minnesota Historical Society library, and Washington County Historical Society. All properties will be assessed in the field to develop architectural descriptions and locate them on site maps. Each property will be photographed to provide a record of current site conditions. Each local designation study report will follow the format of previous designation studies prepared for the HPC. The following existing improvements are not consistent with the aforementioned Design Review Permit: • A scissor truss was placed where an arched truss should have been located; and • The front elevation triangular windows were not represented on the submitted drawings; and • There are less columns represented on the structure and they are not located in the proposed place; and • The north elevation window sizes, number and location are not consistent; and • A frieze board was depicted as a horizontal trim around all exterior elevations. APPLICABLE REGULATIONS AND PROJECT HISTORY All infill homes in the NCD are required to follow the NCD design guidelines. These design guidelines serve as a common reference for all those involved in the process of new 317 William Street North Page 2 construction. The guidelines are intended to serve as a framework to guide the design process, while allowing for individuality and creativity in architectural design. The municipal code indicates the community development director shall perform site supervision of building permits for which design permits have been granted to ensure compliance with all provisions and conditions of the design approval. Upon discovery of the modifications, staff advised the property owner of the following options: • Remove those improvements that are in conflict with the originally approved design and complete the exterior facade improvements consistent with DR/13 -34; or • Submit a request for modification. The community development director must refer major modifications to the board or official body with final decision - making authority any requested modification that involves. A major modification is considered to be any modification that consists of a significant increase in size or change in nature of a project. A public hearing must be held by the decision - making authority. There are no guidelines for HPC review of the modification request. RECOMMENDATION The HPC should open the public hearing and discuss this matter with the applicant as well as take comments from the public. Once all comments have been made, the HPC should discuss the modification request in relationship to the original design for determination as to whether or not the HPC would like to approve the modifications.
