Chairman Larson called the meeting to order at 7:08 p.m. Present: Chairman Larson, Commissioners Johnson, Welty, Brach (arrived at 7:50 p.m.), Council Representative Menikheim Absent: Commissioners Goodman and Krakowski Staff: Community Development Director Turnblad, City Planner Wittman OTHER BUSINESS Discussion of conceptual re -use plan for the Wolf Brewery Building - Mark Finneman, owner's representative Community Development Director Turnblad explained that Mark Finneman has been retained by a group interested in purchasing the Wolf Brewery property and converting it into a boutique hotel. Mark Finneman of Finn Daniels Architects, St. Paul, introduced himself and explained the intent to convert the Joseph Wolf Brewery Building into a hotel with about 40 rooms. A historical consultant will guide the project through the State historic preservation process. A structural analysis is underway and a feasibility study will be done to address the marketability of the project and assess the impact of potential tax credits. The building is quite complicated with many levels. A schematic design will be done in about a week. He would like to learn about the City approval process and proceed as quickly as possible. Commissioner Johnson explained the review process and the possibility of convening a subcommittee to review the concept in order to accommodate the applicant's timelines. City Planner Wittman agreed to facilitate a subcommittee meeting to begin concept review. HPC training materials Community Development Director Turnblad informed the Commission that a CD is being provided to each Commissioner with materials related to the Commission's roles, duties and responsibilities. Review will take place after a new Commissioner is on board. Chairman Larson reminded Commissioners to recruit candidates interested in serving on the Commission. Staff updates on utility markers, lighting on plaza, and new member advertisement. City Planner Wittman updated the Commission on a number of projects: staff has forwarded the pedestrian plaza lighting inquiry to the Public Works Department and the contractor is researching alternative lighting options. The Public Works Department has been informed of the optic fiber locator markers located on Heritage Preservation Commission Meeting July 1, 2013 public property. They have spoken with the contractor and most in the urban core have been removed. The City has published the HPC vacancy and has not received any letters of interest to date. Discussion on status and future of 114 Chestnut Street West Council Representative Menikheim noted the building is reportedly the oldest building in the City. He expressed concern about its deterioration. It is for sale by an LLC. He asked if the City has a desire to try to save it. Commissioner Johnson asked if there is opportunity for grant funding to improve the facade. Community Development Director Turnblad responded that grant funding would take special legislation. There may be other tools for the City to become involved. It is just outside the downtown historic district, so is not a contributing structure. A local historic designation cannot be done if the property owner doesn't agree to it. However the Commission could make a recommendation that it is an important building and strongly encourage the Council to take action to save it. Motion by Commissioner Johnson, seconded by Brach, to direct staff to draft a statement for consideration at the next meeting, encouraging the City to become involved. All in favor. APPROVAL OF MINUTES Possible approval of June 3, 2013 meeting minutes Commissioner Johnson noted that on page 4, the motion for Case No. DR/2013 -32 should have included a condition setting a maximum height of six feet to meet sign height restrictions. The podcast presentation inquiry on page 4 was made by Commissioner Johnson. The motion for appointment of the new chair on page 1 was by Johnson, seconded by Brach. Motion by Commissioner Johnson, seconded by Commissioner Welty, to approve the minutes of the June 3, 2013 meeting as amended. All in favor. OPEN FORUM There were no public comments. PUBLIC HEARINGS Case No. DR/2013 -17. Design review of proposed signage and facade repair for Osaka Express located at 108 Main Street North in the CBD, Central Business District. Sean Flynn, Northstar Sign, applicant. City Planner Wittman explained that on June 14, staff received a request from Cameron Kelly, representing Osaka, for the suspension of the application review indicating the applicant requires more time to prepare materials for a complete submission. Motion by Commissioner Johnson, seconded by Commissioner Brach, to table the design review of the proposed signage and facade repair for Osaka Express located at 108 Main Street North, Case No. DR/2013 -17 until the August 5, 2013 HPC meeting. All in favor. DESIGN REVIEWS Page 2 of 5 Heritage Preservation Commission Meeting July 1, 2013 Case No. DR/2013 -34. Design review of proposed signage for Crew Outfitters located at 1709 Greeley Street South in the BP -I, Business Park Industrial District. Jeff Lundeen, applicant. City Planner Wittman stated the applicant is requesting approval of a design for a 60 square foot (five feet tall by 12 feet wide) black awning sign to read "Crew Outfitters." The sign will be lit with fluorescent lighting located under the awning. Staff recommends approval. Applicant Jeff Lundeen indicated the signage will be no more than half the total size of the awning per regulations. There will be hook -type lighting above the logo rather than below, which will add more character to the front of the building. He asked if the words Luggage and Backpacks could be included on the awning. City Planner Wittman replied that additional words would be considered to be part of the total allowable square footage, and the Commission would need to approve the change. Motion by Commissioner Johnson, seconded by Commissioner Brach, to approve signage for Crew Outfitters located at 1709 Greeley Street South, Case No. DR/2013 -34, as conditioned, with the additional clarification that the signage will be 60 square feet or less, that it will amount to less than half the square footage of the awning; and that lighting will be down -lit above the awning and that a photo of the lighting shall be submitted as part of the application. All in favor. Case No. DR/2013 -35. Amendment to the Stillwater Marketplace Comprehensive Sign Plan. KFP Investment Properties, LLC, Jay Feider, applicant. City Planner Wittman explained that the applicant is requesting an amendment to the multi- tenant sign plan for Stillwater Marketplace. The amendment would permit businesses to have the option of using raised plastic letters instead of the already approved lit lettering style. Staff recommends approval. Jay Feider, owner of the building at 1754 Market Drive, said he is requesting the change for this building only, not for the other buildings that are considered part of Stillwater Markeplace. Commissioner Johnson said he would prefer if the amendment would apply to everything within Stillwater Marketplace rather than just one structure. There was discussion about what properties are included in the original Stillwater Marketplace. Community Development Director Turnblad noted that staff can look through the sign plans on record to find geographic areas tied to those sign plans. Motion by Commissioner Brach, seconded by Commissioner Welty, to approve the amendment to the Stillwater Marketplace Comprehensive Sign Plan permitting businesses to have the additional option of using raised plastic letters instead of the already approved lit lettering style, noting that it applies only to 1754 Market Drive, as opposed to all of Stillwater Marketplace, Case No. DR/2013 -35, as conditioned. All in favor. Case No. DR/2013 -36. Design review of signage for Glitter & Gabby located at 1754 Market Drive in the BP- C, Business Park Commercial District, DeMars Sign, applicant. City Planner Wittman reviewed the request. The applicant is requesting approval of a 9.76 square foot sign (46.5 inches wide by 30.25 inches tall), with unlit raised acrylic plastic letters that read "G & G it's play time." Staff recommends approval. Page 3 of 5 Heritage Preservation Commission Meeting July 1, 2013 Motion by Commissioner Johnson, seconded by Commissioner Welty, to approve signage for Glitter & Gabby located at 1754 Market Drive, Case No. DR/2013 -36, as conditioned with the suggestions that the "G & G" be outlined for better delineation, and that a different font and a more consistent color scheme be used, and with the understanding that the sign is not lit. All in favor. Case No. DR/2013 -37. Design review for the installation of two HVAC rooftop units located at 214 Main Street South in the CBD, Central Business District, HAF Architects, applicant. City Planner Wittman explained that the applicant is requesting approval for the installation of two five -ton HVAC rooftop units. Although the units are screened from Main Street, they will be visible from the hillside and bluffline. The two units will be finished in a matte dark gray, matching the five existing rooftop units. Staff recommends approval. Larson noted that most rooftop units downtown that are not screened, and questioned when the Commission will start requiring screening. Community Development Director Turnblad replied that screening is really addressed case by case. More options for placement of mechanical structures are available with new construction; retrofits are more difficult to place and screening can make the visibility worse. Motion by Commissioner Johnson, seconded by Commissioner Welty, to approve the installation of two HVAC rooftop units located at 214 Main Street South, Case No. DR/2013 -37, as conditioned, with the additional condition that ductwork be painted matte dark gray to match the color of the unit. All in favor. Case No. DR/2013 -38. Design review of trash enclosure for the Water Street Inn located at 127 Water Street South in the CBD, Central Business District, City of Stillwater, applicant. City Planner Wittman reviewed the request. The applicant is requesting approval for a 96 square foot trash enclosure (eight feet deep by 12 feet wide) to be faced with brick, with a pre - finished painted metal paneled gate. The enclosure will be located in the southeast corner of the parking lot upon completion of parking lot improvements. Staff recommends approval. Community Development Director Turnblad noted that the City is applying for the review as part of a 2011 development agreement that provided, in conjunction with the pedestrian plaza project, that the City would pay half the cost of the trash enclosure. Commissioner Johnson commented that the space proposed is an extremely visible area and would be no better than where trash is now on the opposite corner of the parking lot, noting that the trash area is not well tended. He feels the proposed location is not appropriate. He suggested the area behind the green plywood patio bar area where there is space right outside the kitchen door. Commissioner Larson expressed concern about pedestrian safety considering the view angles when turning the corner. City Planner Wittman pointed out there is just as much pedestrian traffic on any other corner of the parking lot. Motion by Commissioner Johnson, seconded by Commissioner Brach, to table approval of the trash enclosure for the Water Street Inn located at 127 Water Street South, Case No. DR/2013 -38, for a new site plan, with the suggestion it be located adjacent to the building, preferably on the northeast corner of the building, with service access to Water Street. OTHER BUSINESS continued Approval of CLG projects July 1, 2013 Dan Hoisington reviewed a brochure he created as part of the podcast project. Commissioners provided input on the brochure content and design. He also reviewed materials on the local designation district project. Motion by Commissioner Johnson, seconded by Commissioner Brach, to approve work that has been done to date on the podcasts and the local designation district project, and direct Commission members to provide any additional comments to Mr. Hoisington by July 9. The sign will be lit with existing structure lighting, as are all other signs for existing businesses located in this building. The sign will appear substantially similar to the temporary sign that has been recently approved and installed. APPLICABLE REGULATIONS AND STANDARDS Municipal Code Section 31 -509, Subd. 8(b), Sign regulations states: • For wall signs in the BP Districts, 'the gross surface area ... may not exceed one square foot for each foot of building, parallel to the front lot line'. The structure's (approximate) 100' feet in length along Curve Crest has been equally divided among the three units; each business has been permitted to have 33 square feet of signage. Municipal Code Section 31 -209, Design permit states: • The Standards for Review , Sec. 31 -5090 indicates the HPC shall utilize the following standards: o Architectural character: • The suitability of the building for the intended purpose. • The consistency of the applications design with approved design guidelines. • The compatibility of the character of the design with adjacent development. 1060 Curve Crest Blvd. Page 2 o Outdoor advertising: The number, location, color, size, height, lighting and landscaping of outdoor advertising signs and structures in relation to the creation of traffic hazards and the appearance and harmony with adjacent development. o Historical structures, vistas, sites and the impact of development on these resources. o Special design guidelines for areas or districts of the city officially adopted by the city council. • This Code Section further notes "the Heritage Preservation Commission may include conditions the committee deems reasonable and necessary to carry out the intent of this chapter and this section ". • Findings and decisions (Section 31 -209h) further states: "Upon...finding...that the application, subject to any condition imposed, will [meet] the standards of design review, secure the purpose of this chapter, the comprehensive plan and the heritage preservation ordinance, the design review committee may approve the design permit, subject to conditions as it deems necessary. If a finding is made that the permit would violate the standards of design review, it must deny the application ". The West Business Park design standards indicate: • "Signs and related building graphics shall be a part of the overall building and site design...size, height, location and material shall relate to the building scale and design ". FINDINGS Staff finds the application is consistent with the with the purpose of the zoning code, the comprehensive plan, and the heritage preservation ordinance. Additionally, the size, height, location and materials of the sign for The Hairdressers relates to the scale and design of existing building signage while minimizing the risk for traffic hazards. RECOMMENDATION As per Review of the application by the design review committee (Section 31- 209e): "The design review committee must make a final decision on the granting or denial of a sign permit after seeking the recommendation of the community development director ". Staff recommends approval with the following conditions: 1. All revisions to the approved plan shall be reviewed and approved by the HPC. 2. No additional signage permitted for this business unless permitted through an approved temporary sign permit. APPLICABLE REGULATIONS AND STANDARDS Municipal Code Section 31 -509, Subd. 8(b), Sign regulations states: • For wall signs in the BP Districts, "Upon submittal of a sign permit request for an operator within a multiple -use or multiple tenant building, proof must also be provided by the applicant that a sign plan has been a[proved for the entire building...The signs are subject to the following restrictions: o All signs must be visually consistent in location, design and scale. o The total gross signage for the entire building shall not exceed one square foot for each foot of building face parallel, or substantially parallel, to a street lot line or a minimum of 25 square feet per business, whichever is more ". Municipal Code Section 31 -209, Design permit states: • The Standards for Review , Sec. 31- 509(f) indicates the HPC shall utilize the following standards: o Architectural character: • The suitability of the building for the intended purpose. • The consistency of the applications design with approved design guidelines. 1266 Frontage Road West Page 2 • The compatibility of the character of the design with adjacent development. o Outdoor advertising: The number, location, color, size, height, lighting and landscaping of outdoor advertising signs and structures in relation to the creation of traffic hazards and the appearance and harmony with adjacent development. o Historical structures, vistas, sites and the impact of development on these resources. o Special design guidelines for areas or districts of the city officially adopted by the city council. • This Code Section further notes "the Heritage Preservation Commission may include conditions the committee deems reasonable and necessary to carry out the intent of this chapter and this section ". • Findings and decisions (Section 31 -209h) further states: "Upon...finding...that the application, subject to any condition imposed, will [meet] the standards of design review, secure the purpose of this chapter, the comprehensive plan and the heritage preservation ordinance, the design review committee may approve the design permit, subject to conditions as it deems necessary. If a finding is made that the permit would violate the standards of design review, it must deny the application ". The West Business Park design standards indicate: "Signs and related building graphics shall be a part of the overall building and site design... size, height, location and material shall relate to the building scale and design ". FINDINGS Staff finds the application is consistent with the with the purpose of the zoning code, the comprehensive plan, and the heritage preservation ordinance. Additionally, the size, height, location and materials of the Sti11H20 sign relates to the scale and design of the existing building. Valley Ridge exterior signage shall consist of store identification only. Copy shall be restricted to the Tenant's proper names and major product or service offered. Corporate logos, emblems shields and similar identifying devices shall be permitted provided they are confined within the signage panel. 2. All signs shall be located in the designated sign band area assigned by the Landlord. 3. All signage is to consist of individual illuminated letters or illuminated by direct light source. Fixture subjects to owner's review and approval. Minimum letter height to be 10 ". 4. Neon must be double -row for even illumination. 5. All neon must have 30 M.A. transformers. FINDINGS Staff finds the size, height, location and materials of the First State Bank sign relate to the pedestrian orientated design of the neighborhood, minimizing the risk for traffic hazards. In addition, the 2006 sign plan prohibits internally lit signage. The proposed signs will not be internally lit. FINDINGS Staff finds the application is consistent with the with the purpose of the zoning code, the comprehensive plan, and the heritage preservation ordinance. APPLICABLE HISTORY This item was tabled at the July 1, 2013 Heritage Preservation Commission (HPC) meeting. The HPC determined the proposed location was not in keeping with past HPC and City Council actions on the Water Street Inn. The HPC suggested that the property owner consider a location immediately next to the Inn. • The Water Street Inn was constructed with a Special Use Permit (SUP 94 -39). One condition of the SUP was: "All trash receptacles shall be located inside the building ". • August 8, 2011 Planning Commission minutes include the following statement from former City Planner Pogge when discussing the trash enclosure: "The City will reimburse half the cost of relocating the trash enclosure next to the hotel building, up to $10,000." • The March 2011 Development Agreement notes: "The City will cooperate with the Developer in an effort to relocate their trash enclose that will be displayed by the acquisition to the west side of the Water Street Inn building. The new enclosure will meet the requirements of the Downtown Design Guidelines and have a minimum of six feet of clearance maintained on the sidewalk between the enclosure and the back of curb for Water Street. The City will reimburse the Developer fifty percent of the cost of the enclosure up to a maximum of $10,000 ". 101 North Water Street Page 2 In each reference, it seems clear that the trash enclosure was intended to be located either inside or immediately next to the Inn APPLICABLE REGULATIONS AND STANDARDS The Code states the intent of the design review procedure is to secure the general purposes of the comprehensive plan, West Stillwater Business Park Plan and downtown plan, to maintain the character and integrity of neighborhoods and commercial districts by promoting excellence of design and development, preventing traffic hazards, providing adequate services and encouraging development in harmony with its neighborhood or planning area. The standards of the design review indicate Landscaping may be reviewed by the Commission, indicating: "The location, height and material of walls, fences, hedges, trees and screen plantings to ensure harmony with adjacent development or to conceal areas, utility installations or other unsightly development ". The Commercial Historic District Design Manual guidelines state to "screen exterior trash enclosures and storage areas...from view of nearby streets and adjacent structures in a manner that is compatible with the building and site design" and to "Use architectural elements to screen mechanical equipment ". FINDINGS AND RECOMMENDATION Upon a finding by the design review committee that the application, subject to any conditions imposed, will [meet] the standards of design review, secure the purpose of this chapter, the comprehensive plan and the heritage preservation ordinance, the design review committee may approve the design permit, subject to conditions as it deems necessary. If a finding is made that the permit would violate the standards of design review, it must deny the application. Staff believes that the parking lot location proposed by Mr. Dougherty meets the standards of the Design Review Manual, the Zoning Code, the Comprehensive Plan and the Heritage Preservation Ordinance. If granted, would the proposed variance be out of harmony with the Comprehensive Plan? No, it would not be out of harmony with the Comprehensive Plan. The plan was proposed in the Comprehensive Plan. 3. No variance may be granted that would allow any use that is prohibited in the zoning district in which the subject property is located. The property is zoned CBD, Central Business District. The creation of the pedestrian walkway is consistent with the zoning code and not a prohibited use. City staff finds the variance review criteria to be satisfied and therefore recommends approval as requested. Commissioner Kocon questioned the square footage of the restroom as more than needed. Mr. Pogge responded that the size meets ADA standards for the minimum required for a handicapped stall and turning radius. Some of the space is a utility room that accommodates sprinkler systems for Lowell Park. Mr. Turnblad said that putting more urinals or stalls in what appears to be empty space is not an option with the ADA requirements. Commissioner Siess asked why the restroom will be located on the corner of Water Street, right by the bus stop. Mr. Pogge responded that the city looked at three different locations, and this one was deemed the most desirable for this project. Other locations were more prone to flooding or more likely to block views of the river. Ms. Siess asked if the designated handicapped parking should be closer to the restroom. Mr. Pogge responded that parking location serves the commercial area more than the park area as it is more likely to be the ultimate destination of visitors. The public hearing was opened. As no one was present who wished to speak, the public hearing was closed. When asked about whether or not a variance was required from the DNR, Mr. Pogge replied that the department has been in discussion with FEMA and the DNR and both have said the project is okay, though neither is required to give formal approval. Commissioner Malsam, seconded by Commissioner Kocon, moved to approve Case No. 2011 -20 with the variances as listed above. Motion approved unanimously. Case No. 2011 -21. A street vacation for a portion of the east 9 ft of Water Street starting at the north line of Myrtle St E and extending north 208.1 ft. City of Stillwater, applicant. Mr. Pogge introduced the case. The request before the Commission is for the vacation of a 9 -foot strip of land along the east side of Water St N that begins at the north right of way line of Myrtle St 13 City of Stillwater Planning Commission August 8, 2011 E and runs north 208.1 feet as shown as Parcel "C" on the attached map. The City will retain a sidewalk easement over the west five feet of the portion of Water Street being vacated. The City of Stillwater is seeking to voluntarily acquire a 43.88 foot by 91.4 foot parcel of land from St Croix Preservation Co Inc, Parcel "A" on the included map. Parcel At will be incorporated in the new pedestrian walkway project that connects Main St to Lowell Park and the various parking areas east of Main Street. In exchange for Parcel "A" the City has agreed to provide the following to St Croix Preservation Co Inc: convey a 5.0 foot by 208.1 foot parcel of land adjacent to North Lowell Park, Parcel "B "; vacate a 9.0 foot by 208.1 foot section of Water St, Parcel "C "; reimburse the owner for cost related to the acquisition; provide a loan to reconstruct the entire Water St Inn parking lot; and relocate the exiting curb line and utilities in the portion of Water Street proposed to be vacated. As to the question of the street vacation itself, Mr. Pogge listed 3 criteria. 1. Is it necessary or desirable - do we need the property for public purpose in the future? There are some public utilities in there, namely storm water intake and a portion of Water Street. The city has agreed to relocate the curb line and storm water utilities out of Water Street and would pay those costs as part of the land transfer. 2. Are there any terms or conditions, reservations or dedication of easement that are necessary for protecting the public in the future? The City is obtaining a sidewalk easement. 3. Does the street vacation have a public benefit? It is not being vacated for the benefit of the property owner. The City is gaining more land than it is losing, so there is a public benefit. The curbline will be moved four feet to the west, to the back curve. Staff is recommending approval of the street vacation. Commissioner Dahlquist had a number of questions: 1. Will vacating the 9 feet change the setback locations on the remaining property for future use? Mr. Pogge responded that any time you move the property line, it will change the setbacks, which will go to the new property line. This is zoned Central Business District and since there is no existing building on the site it requires a 15 ft setback from the property line. 2. Moving the curb line out, will parking remain? Mr. Pogge said yes, there will be parking on both sides. 3. In the background portion of the report, it mentions as part of the negotiated agreement that the City is reimbursing the owner for costs associated with the agreement. Mr. Pogge responded that there are minimal costs of under $10,000 for as re- striping and expansion of the parking lot. The City will also provide a loan that Water Street Inn will repay over 15 years with an interest rate of 3.25% to cover reconstruction of the entire parking lot. The exact amount of the loan is not known yet. 4. Is there an estimate of total cost? Mr. Pogge said that the loan will be repaid so that is not included as a cost. The utility cost is about $33,000 and the portion of reimbursement is about $10,000 so it is under $50,000. 14 City of Stillwater Planning Commission August 8, 2011 The City will also reimburse half the cost of relocating the trash enclosure next to the hotel building, up to $10,000. Commissioner Spisak questioned the 9 foot variance and the need to relocate the sidewalk. Mr. Pogge explained that in this district a 15 foot setback is required, so with the new property line where the building would potentially be built, the setback is closer to Water Street itself. On the drawing displayed, Mr. Pogge pointed out the ROW line with the sidewalk in the ROW itself, which would normally require 15 feet between the ROW line and the building. By including the sidewalk as part of the Water Street property, the owner can move the building 5 feet closer to the street. Commissioner Siess asked for clarification that Water Street Inn would get a new parking lot. Mr. Pogge responded that they will be reimbursed for part of the cost along with a repayable loan. As a trade -off, the City gets a valuable piece of property to make the pedestrian connection. Chair Dahlquist opened the public hearing. public hearing was closed. Commissioner Buchanan, seconded by Commissioner Spisak, moved to approve Case No. 201 1 -11 street vacation as conditioned. Motion carried unanimously. This is a recommendation to the City Council for approval, to be placed on the agenda for their first meeting in September. As there was no one present who wished to speak, the Case No. 2011 -09. An ordinance amendment for seasonal outdoor sales and vending carts. City of Stillwater, applicant. Planning Commissioners have over the years been dissatisfied with the City Zoning Ordinance requirement that vendors and seasonal outdoor sales have a Special Use Permit (SUP). By the very nature of these uses, the operators are not tied to the property for which the SUP is issued. They are more similar to transient merchants than they are to commercial uses for which Special Use Permits are issued. In response, the Planning Commission asked City staff to research a more fitting way to permit these uses. At the August 9, 2010 Planning Commission meeting, staff presented several options. The Commission discussed the options and came to a consensus. Subsequently the Commission has worked through a first draft of an ordinance that creates an annual permitting process for seasonal outdoor sales and vending. The permit for the businesses would be approved by the Planning Commission for the first year. That initial permit would expire on December 31st. For each subsequent year (without substantial changes), the permit would be reviewed and issued by City staff. 15 HERITAGE PRESERVATION COMMISSION DATE: July 31, 2013 CASE NO.: 2013 -42A -C APPLICANT: Jesse Hamer, Valley Ridge Mall and Office Max REQUEST: Design permit approvals for: A. Signage for Office Max to be located in Valley Ridge Mall ZONING: BPC — Business Park Commercial COMP PLAN DISTRICT: Commercial PREPARED BY: Abbi Jo Wittman, City Planner, The applicant is requesting approval of three design permits for proposed activities at 1570 Frontage Road (Valley Ridge Mall, a 240,000 +1- square foot retail shopping center): A. Facade Improvements: The applicant is requesting a design permit for a proposed upgrade to the exterior facade. The improvements proposed will be carried out over the next few years, working from the west side elevation to the east end of the structure. The proposed improvements will mimic the muted, earth tone color palette already on the Anytime Fitness entrance, as approved by the HPC in 2011. Included in the renovation will be the installation of a new main mall entrance multitenant master sign that will read `Valley Ridge'. B. Master Sign Plan: The applicant is requesting a design permit for proposed amendments to the Master Signage Plan for the multi- tenant structure. This includes the following changes: 1. On the basis of one square foot of wall signage per front foot of building, the Valley Ridge facility would be allowed a total of about 975 square feet of wall signage. The total allowable wall- mounted signage currently under the terms of the approved Master Sign Plan is 1,943. The proposed Master Sign Plan reduces the total square footage of wall signage to a maximum of 1,288 square feet. The size of individual signs is to be based on unit size. a. Exterior lit signs may be permitted but only with owner approved downward facing gooseneck lighting. b. The Sign Plan will also incorporate a temporary banner program the mall has had in place for several years. One banner at a time would hang on the new freestanding sign. Tenants are each given the opportunity on a rotation basis to have their banner on the master sign. 2. A renovated freestanding master sign will allow for three anchor businesses to have permanent signage at the entrance to the mall. 1570 Frontage Road Page 2 a. This sign was originally approved as the River Heights Auto Mall sign. The sign will be reduced from the originally- approved height of 25' to a total of 19'6"; the total business signage on the master sign will not exceed 100 square feet per face. C. Office Max Signage: The applicant is lastly proposing signage for Office Max, a new tenant for the mall. The signage will include two wall- mounted signs: one on the west elevation and one on the south elevation, west of the main mall entrance, as well as a cabinet in the freestanding master sign. APPLICABLE STANDARDS AND REGULATIONS The intent of the design review procedure is to secure the general purposes of the comprehensive plan, West Stillwater Business Park Plan and downtown plan, to maintain the character and integrity of neighborhoods and commercial districts by promoting excellence of design and development, preventing traffic hazards, providing adequate services and encouraging development in harmony with its neighborhood or planning area. The applicable Zoning Code regulations indicate: Permitted signs by a sign permit in BP- business park districts. All commercial, office and industrial signs in all BP districts are subject to the following conditions: (b) Wall signs. Wall signs in the BP district shall meet the following requirements: Where a principal building is devoted to two or more uses, the operator of each use may install a wall sign upon each share of the building. A sign plan must be submitted for the entire building that shows the location, sizes, types and elevations of all signs. Upon submittal of a sign permit request for an operator within a multiple -use or multiple- tenant building, proof must also be provided by the applicant that a sign plan has been approved for the entire building. If no such sign plan has been approved by the heritage preservation commission, then a sign plan shall be submitted and approved by the heritage preservation before a sign permit may be approved for the single operation or use in question. The signs are subject to the following restrictions: i. All signs must be visually consistent in location, design and scale. ii. The total gross signage for the entire building shall not exceed one square foot for each foot of building face parallel, or substantially parallel, to a street lot line or a minimum of 25 square feet per business, whichever is more. (c) Freestanding signs. Freestanding signs in the BP district shall meet the following requirements: (1) Area. The gross surface area of a freestanding sign may not exceed 100 square feet for each exposed face nor exceed an aggregate gross surface area of 200 square feet. (2) Location. A freestanding sign must be set back 15 feet from the front or side property line. (3) Height. Along State Highway 36 freestanding signs may not project higher than 25 feet. Along County Road Five from Highway 36 to Croixwood Boulevard and South Greeley from Orleans to Highway 36 freestanding signs may not project higher than 20 feet. (e) Each multitenant or multi -use building is permitted one building master identification sign according to the following requirements: (f) (1) Building master identification signs may not contain the names of any tenants or occupants of the center. (4) If the multitenant commercial building has a floor area of greater than 100,000 square feet, the center may have a master identification sign with a maximum area of 120 square feet on each side and a maximum height of 25 feet. Total allowable sign area. The total aggregate sign area allowed on a property for all signs permitted in subparts (a) through (e) above shall be as follows: a minimum of 100 square feet; and at a rate of 15 percent of the building wall area facing a public street, up to a maximum of 300 square feet. When a building faces two or more public streets, the building wall area shall be determined by adding the wall area of each building wall that faces a public street and dividing by the number of public streets the building faces. The applicable standards of the design review are as follows: (1) Architectural character: is The suitability of the building for the intended purpose. ii. The consistency of the applications design with approved design guidelines. iii. The compatibility of the character of the design with adjacent development. (2) Outdoor advertising: The number, location, color, size, height, lighting and landscaping of outdoor, advertising signs and structures in relation to the creation of traffic hazards and the appearance and harmony with adjacent development. (3) Historical structures, vistas, sites and the impact of development on these resources. (4) Special design guidelines for areas or districts of the city officially adopted by the city council. Design guidelines have been developed for the West Stillwater Business District to ensure consistent quality design. The following guidelines will be used: 1) Applicable Architectural Standards include: i) Unadorned pre- stressed concrete panels, standard concrete block or metal siding shall not be used as exterior materials for new buildings. Architecturally enhanced block or concrete panels may be acceptable. ii) Architectural consistency on all sides of the building is required in terms of colors, materials and details. 2) Site Plan Standards include: Overall lighting shall be directed down and shielded from adjacent properties or roadways. 3) Signs: i) Signs and related building graphics shall be a part of the overall building and site design. Sign size, height, location and material shall relate to building scale and design. 1570 Frontage Road Page 4 ii) Wall signs or low profile (maximum 6 feet in height) shall be permitted for office, warehouse, wholesale or industrial uses. iii) Retail Signage shall be consistent with the Sign Ordinance. FINDINGS AND RECOMMENDATIONS The design review committee must review all applications...the design review committee must make a final decision on the granting or denial of a sign permit after seeking the recommendation of the community development director. The sign applicant or any party aggrieved by the decision of the committee has a right to appeal the decision to the city council. Upon a finding by the design review committee that the application, subject to any conditions imposed, will [meet] the standards of design review, secure the purpose of this chapter, the comprehensive plan and the heritage preservation ordinance, the design review committee may approve the design permit, subject to conditions as it deems necessary. If a finding is made that the permit would violate the standards of design review, it must deny the application. As per Review of the application by the design review committee (Section 31- 209e): "The design review committee must make a final decision on the granting or denial of a sign permit after seeking the recommendation of the community development director ". A. Facade Improvements: Due to the architecturally enhanced block and concrete panels and the consistency in colors and details, staff finds this application meets the purpose the standards for design review set forth in the zoning code, comprehensive plan and the heritage preservation ordinance, staff recommends approval based on the following conditions: 1. The design permit shall be valid for all exterior facades of the structure. In the event the Community Development Director determine substantial alterations are proposed for future phases of facade renovation, staff shall bring the proposed modifications before the HPC for design review. 2. The multitenant master sign shall not exceed 120 square feet. 3. Overall lighting shall be directed down and shielded from adjacent properties or roadways. B. Master Sign Plan: 1. Wall signage. Although the total gross signage for the entire building exceeds the maximum allotted signage for the structure, the new Master Sign plan proposes a considerably less signage than the approved current Master Sign Plan. This, coupled with the fact the Plan requires signs to be visually consistent in location, design and scale, the Plan conforms to the Municipal Code. As this Plan is an amendment to a previously adopted Plan, the intention of the Zoning Code is upheld and the standards for design review are met. In addition, the banner program conforms to the City's standards for temporary signage. Staff recommends Design Permit approval of the Master Sign Plan for Valley Ridge Mall with the following conditions: 1570 Frontage Road Page 5 1. The Master Sign Plan shall be amended to include the signage allotted on the Free- standing sign. The Plan shall outline tenants eligible to place temporary banners on the sign. 2. All signs are required to receive review and approval by the City prior to installation. 3. Changes to the Master Sign Plan shall be reviewed and approved by the Heritage Preservation Commission. 2. Freestanding sign. The one freestanding sign, located at the entrance to the structure off of HWY 36, is visually consistent with the color and materials of the proposed exterior facade of the structure, thereby conforming to the Design Review section of the Municipal Zoning Code as well as the West Stillwater Business Park. The sign's 100 square feet per side is consistent with Sign Regulations of the Zoning Code. Staff recommends Design Permit approval of the Freestanding Sign for Valley Ridge Mall with the following conditions: 1. A landscaped area equal to twice the sign area, comprised of bushes or flowers, shall be provided around the base of free standing sign. This landscaped area shall be reviewed and approved by staff. 2. Sign permit applications shall be submitted for review and approval by the City for the two sign cabinets in the freestanding sign. 3. All revisions to the approved plan shall be reviewed and approved by the HPC. C. Office Max signage: Wall signage is proposed on the West Elevation and the South Elevation of the shopping center, as well as the top sign cabinet on the Freestanding sign. All of the signs are consistent with one another, as well as with the color and materials of the Master Sign Plan, the West Stillwater Business park design guidelines and the Design Review section of the Municipal Code. Staff recommends Design Permit approval of three signs for Office Max with the following conditions: 1. The West Elevation signs shall not exceed the maximum allowable signage permitted in the Master Sign Plan. 2. The cabinet sign shall be similar in nature to the wall- mounted signage. Substantial alterations to the design shall require design review by the HPC. 3. No additional signage may be permitted for this business. Pylon Banner Program Any of the tenants of Valley Ridge will be allowed to advertise their business with temporary banners attached beneath the center's pylon sign. The temporary banners will be in the form of a 4' x 6', two -sided banner. No tenant shall be allowed to hang their banner more than three times per year and more than one week per occurrence. Each tenant shall submit for a temporary banner /advertisement permit with the City per appropriate methods. In Lieu of this program which has existed for five years, Valley Ridge would like to explore converting the lower "tenant box" on the new pylon to an electronic reader board" that would take the place and serve at the banner program for advertising tenant's businesses. The work would result in facade changes and building expansion. Future signage, lighting and overall site plan improvements will need to be submitted at a later date. A pre - application Design Review meeting was held on July 15`h. Chairman Larson, Commissioners Brach and Johnson, and city staff met with representatives of the Wolf Brewery development team. At that meeting, the Commissioners assisted the applicants with conceptual design details that followed the Downtown Design Guidelines. The Downtown Design Guidelines address setback, proportion, height, parking, rear entrances, roofs, utility areas and mechanical equipment, detailing, facade openings, color, lighting, awnings, signs and graphics and landscaping. The applicant has utilized those standards in the development of this application submission. APPLICABLE REGULATIONS AND STANDARDS The subject property is listed as a contributing structure in the Downtown Commercial Historic District. As such, City staff considers the property to meet the definition of a heritage preservation site. Any remodeling, repair or alteration (including paint color) that will change the exterior appearance of a heritage preservation site necessitates a Site Alteration Permit2. The permit review standards for a Site Alteration Permit are found in City Code Sec 22 -7, Subd 6(3). Staff has outlined the remainder of this memo based upon that Code section. The following guidelines are specified for use in evaluating applications for Site Alteration Permits: ` City Code Sec. 22 -7, Subd. 2. 2 A Site Alteration Permit is a sub -type of the Design Permit (Sec 31 -209 (c)(1)). But, the Site Alteration Permit has more exacting review standards (Sec. 22- 7,'Subd 6(3)) than a routine Design Permit. 402 North Main Page 2 Every reasonable effort shall be made to provide a compatible use for a property which requires minimal alteration of the building, structure or site and its environment or to use a property for its originally intended purposes. Utilizing contributing structures and new infill development for the formation of a small hotel will necessitate minimal alteration to the building. The potential use of a brewery on this site will be similar to the building's originally intended purpose. The distinguishing original qualities or character of a building, structure or site and its environment shall not be destroyed. The removal or alteration of any historic material or distinctive architectural features must be avoided when possible. The applicant is proposing to retain the stone walls of the contributing structures, preserving the most distinguishing and original qualities and character of this site. Additionally, original window and door openings, including the arched window opening on the north elevation will be preserved. All buildings, structures and sites shall be recognized as products of their own time. Alterations that have no historical basis and which seek to create an earlier appearance shall be discouraged. Alterations and additions are contemporary in nature, blending newer infill development with the greater mass of the historic features. Changes which may have taken place in the course of time are evidence of the history and development of a building, structure or site and its environment. These changes may have acquired significance in their own right and this significance shall be recognized and respected. Additions and alterations to individual historical portions of the site compliment the adjacent features. Distinctive stylistic features or examples of skilled craftsmanship which characterize a building, structure or site shall be treated with sensitivity. Exterior arches and stone head are proposed to be retained. Deteriorated architectural features shall be repaired rather than replaced, whenever possible. If replacement is necessary, the new material should match the material being replaced in composition, design, color, texture and other visual qualities. Repair or replacement of missing architectural features must be based on accurate duplication of features, substantiated by historic, physical or pictorial evidence rather than on conjectural designs or the availability of different architectural elements from other buildings or structures. All exterior materials are proposed to be retained. New materials match the material being replaced. The surface cleaning of structures shall be undertaken by the gentlest means possible. FINDINGS City Code Sec 22 -7, Subd 7 identifies three findings that need to be made in order to approve a Site Alteration Permit. They are reproduced and analyzed below. Alterations or additions to an existing building must not materially impair the architectural or historic value of the building. These findings should consider the existing structures and exterior appearances, building height, building width, depth or other dimensions, roof style, type of building materials, ornamentation and paving setback. The exterior appearances, including new brick materials, are similar to newer infill development, providing uniformity throughout the site while not detracting from the historical and architecturally significant features. The proposed height, width and depth of the additions are comparable to the mass of the existing stone structures. The standing seam roof is designed to help screen mechanical equipment while note detracting from the exterior elevations. The roof pitches are similar to those originally located on this site. The ornamentation, including metal guardrails and awnings, are consistent with existing metal features, not of a historic time period; the metal compliments the architectural integrity of the historic portions of the site. The unique location or singular physical characteristic representing an established and familiar visual feature of a neighborhood, community or the city. (3) Planning commission review. The commission shall advise the city planning commission of the proposed designation of a heritage preservation site, including boundaries, and a program for the preservation of a heritage preservation site, and secure from the city planning commission its recommendation with respect to the relationship of the proposed heritage preservation designation to the comprehensive plan, the effect of the proposed designation upon the surrounding neighborhood and any other planning considerations which may be relevant to the proposed designation. The planning commission shall also give its recommendation of approval, rejection or modification of the proposed designation. The recommendation shall become part of the official record concerning the proposed designation and shall be submitted by the commission along with its recommendation concerning the proposed designation to the city council. The commission may make modifications, changes and alterations concerning the proposed designation as it deems necessary in consideration of the recommendations of the city planning commission. (4) Communications with state historical society. A copy of the commission's proposed designation of a heritage preservation site, including boundaries, and a program for the preservation of a heritage preservation site shall be sent to the state historical society. (5) Hearings. Prior to the commission recommending to the city council any building, district or object for designation as a heritage preservation site, the commission shall hold a public hearing and seek the recommendations of concemed citizens. Prior to the hearing the commission shall cause to be published in a newspaper of general circulation notice of the hearing at least 30 days prior to the date of the hearing, and notice of the hearing shall be sent to all owners of the property proposed to be designated a historic preservation site and to all property owners within 300 feet of the boundary of the area to be designated. (6) Findings and recommendations. The commission shall determine if the proposed heritage preservation site is eligible for heritage preservation as determined by the criteria specified in subdivision 4(2) of this section, and if the commission recommends to the city council that the site be designated for heritage preservation, of 6 7/26/2013 2:39 PM vlunicode http: // library. municode .com / print .aspx ?h= &clientID= 13056 &HTM... the commission shall transmit to the city council with its recommendation its proposed program for site preservation. (7) City council designation; hearings. The city council, upon the request of the commission, may by ordinance designate a heritage preservation site. Prior to the designation, the city council shall hold a public hearing, notice of which shall be published in a newspaper of general circulation at least 30 days prior to the date of the hearing and notice of the hearing shall be sent to all owners of property which is proposed to be designated a heritage preservation site and to all property owners within 300 feet of the boundary of the area to be designated. (8) Eminent domain. The commission may recommend to the city council after review and comment by the city planning commission, that certain property eligible for designation as a heritage preservation site be acquired by gift, negotiation or by eminent domain as provided for in Minn. Stat. ch. 117. Subd. Additional powers and duties of the commission. The commission shall have the following 5. powers and duties, in addition to those otherwise specified in this section: (1) The commission shall conduct a continuing survey of all areas, places, buildings, structures or objects in the city which the commission, on the basis of information available or presented to it, has reason to believe are significant to the city's culture, social, economic, political or architectural history. (2) The commission shall continually survey all areas to determine needed and desirable improvements of older buildings throughout the city, acting in a resource and advisory capacity to owners of historically significant sites regarding their preservation, restoration and rehabilitation. (3) The commission shall work for the continuing education of the city's citizens with respect to the city's civic and architectural heritage. It shall keep current a public register of designated and proposed heritage preservation sites along with the plans and programs that pertain to them. (4) The commission may recommend that the city accepts gifts and contributions made to the city and to assist the city staff in preparing applications for grant funds for heritage preservation. (5) The commission may on a continuing basis collect and review certain city planning and development records, documents, studies, models, maps, plans and drawings to be entered into the public library historical archives as a permanent record of city history and development. (6) The commission shall make no application to the national register or to the state for the designation of a historic site or district without the city council's consent. (7) The Heritage Preservation Commission must also assume responsibility for the design review of any dwelling house hereafter proposed for construction on now existing vacant lots or on Tots that become vacant by reason of demolition or destruction of existing structures within the Neighborhood Conservation District (NCD). In furtherance of that purpose, the Stillwater Conservation District Design Guidelines, as approved by the City Council on February 17, 2006, are hereby adopted by reference as if fully set forth in this ordinance. Copies of the Design Guidelines are on file in the office of the City Clerk and available at the Stillwater Public Library. The following process will guide the HPC and the applicants. a. Initial Review Meeting. Applicant must first meet with City Planning Staff. Applicant Submission and Filing Fee. Applicant must submit completed Application and Design Checklist, along with a filing fee that is initially $100.00, but that may be changed from time to time by resolution enacted by the City Council. c. Planning Staff Reviews Project and Prepares Report: This report will be sent to applicant and the HPC. d. HPC Design Review and Public Hearing: The HPC must hold a public hearing on the design review applications. Notice of the hearing must be published in the City legal newspaper at least 10 days before the hearing and notice mailed to property owners within 350 feet of the site. At the hearing, after all have been given an opportunity to be heard, the HPC will either approve, approve with conditions, or disapprove the proposed design. e. Approval: If the application is approved, a Design Permit will be issued by the Planning Staff to the applicant, and Building Department. f. Appeal: The applicant or any interested person aggrieved with the HPC action, may, within 10 days, revise and resubmit the application to the HPC or appeal the decision to City Council. g. Building Permit: Once approved, the plans may be completed and submitted to Building Officials for Building Permit review. The plans will also then be reviewed for Design Permit compliance by the Planning Staff. h. Enforcement: The Community Development Department will monitor compliance with the Design Permit and any conditions of approval. Review of permits. Permit review shall be as follows: Site alteration permit. The commission shall review and recommend approval or (1) disapproval of the issuance of a site alteration permit to do any of the following in a heritage preservation site. The application shall be accompanied by detailed plans including a site plan, building elevations and design details and materials as necessary to evaluate the request. Regular city permits shall also be required. a. Remodel, alter or repair in any manner, including paint color that will change the exterior appearance of a historic building or a site. b. New construction. c. Signs. The design review committee shall make a final decision on the granting or denial of a sign permit after seeking the recommendation of the community development director. The sign applicant or any party aggrieved by the decision of the committee has a right to appeal the decision to the city council, which shall sit as a board of adjustment and review. d. Moving of buildings. e. Partial or total demolition. This does not apply to structures required to be demolished according to Minn. Stat. ch. 463. (2) City activity. The commission shall review and make recommendations to the city council concerning city activity that could change the nature or appearance of a heritage preservation site. (3) Preservation program. All commission decisions with respect to this section shall be according to the approved program for the rehabilitation of each heritage preservation site. The following guidelines shall be used to evaluate applications for site alteration permits: a. Every reasonable effort shall be made to provide a compatible use for a property which requires minimal alteration of the building, structure or site and of 6 7/26/2013 2:39 PM vlunicode http: // library. municode .com /print.aspx ?h= &clientID= 13056 &HTM... Subd. 7. its environment or to use a property for its originally intended purposes. b. The distinguishing original qualities or character of a building, structure or site and its environment shall not be destroyed. The removal or alteration of any historic material or distinctive architectural features must be avoided when possible. C. All buildings, structures and sites shall be recognized as products of their own time. Alterations that have no historical basis and which seek to create an earlier appearance shall be discouraged. d. Changes which may have taken place in the course of time are evidence of the history and development of a building, structure or site and its environment. These changes may have acquired significance in their own right and this significance shall be recognized and respected. e. Distinctive stylistic features or examples of skilled craftsmanship which characterize a building, structure or site shall be treated with sensitivity. f. Deteriorated architectural features shall be repaired rather than replaced, whenever possible. If replacement is necessary, the new material should match the material being replaced in composition, design, color, texture and other visual qualities. Repair or replacement of missing architectural features must be based on accurate duplication of features, substantiated by historic, physical or pictorial evidence rather than on conjectural designs or the availability of different architectural elements from other buildings or structures. g. The surface cleaning of structures shall be undertaken by the gentlest means possible. Sandblasting and other cleaning methods that will damage historic building materials shall not be undertaken. h. Contemporary design for alterations and additions shall not be discouraged when such alterations and additions do not destroy significant historical, architectural or cultural material and such design is compatible with the size, scale, color, material and character of the property, neighborhood or environment. Whenever possible new additions or alterations to structures shall be done in a manner that if the additions or alterations were to be removed in the future, the essential form and integrity of the structure would be unimpaired. Findings. Before approving any permit application required under subdivision 6 of this section, the commission shall make findings based on the program for preservation and architectural control for the heritage preservation site in regard to the following: (1) Alterations or additions to an existing building must not materially impair the architectural or historic value of the building. These findings should consider the existing structures and exterior appearances, building height, building width, depth or other dimensions, roof style, type of building materials, ornamentation and paving setback. (2) Prior to approval of any building demolition, the commission shall make written findings of the following: Architectural and historic merit of the building, the effect on surrounding buildings, the effect of any new proposed construction on the remainder of the building (in case of partial demolition) and on surrounding buildings, the economic value or usefulness of the building, as it now exists or if altered or modified in comparison with the value or usefulness of any proposed structures designated to replace the present building. Subd. Limitations. If within 45 days from the filing of a building permit application the commission 8. has neither approved nor denied the building permit application, the plans and permit application shall be deemed to have been approved by the commission and if all other requirements of the city have been met, the commission shall authorize a permit for the proposed work. No permit shall be issued or work commenced if the commission disapproves the application in accordance with this section. Subd. Emergency repair. In emergency situations where immediate repair is needed to protect the 9. safety of the structure and its inhabitants, the building official may approve the repair without prior commission action. In the case of a permit issued under this subdivision, the building official shall immediately notify the commission of its action and specify the facts or conditions constituting the emergency. Subd. Appeal to the city council. The permit applicant or any party aggrieved by the commission's 10. decision shall, within ten days of the date of the commission's order and decision, have a right to appeal such order and decision to the city council. The appeal shall be deemed perfected upon receipt by the clerk of two copies of a notice of appeal and statement setting forth the grounds for the appeal. The clerk shall give one copy of the notice of appeal and statement to both the city council and the commission. The commission, in any written order denying a permit application, must inform the applicant of his right to appeal to the city council and include this subdivision in all such orders. Subd. Penalty for violation of section. An owner or occupant of any area, place, building, structure 11. or other object within a duly designated heritage preservation site who violates this section shall be guilty of a misdemeanor. Any architect, builder, contractor, agent, person or corporation who assists in the commission of a violation of this section shall be guilty of a misdemeanor. For each such day an owner or occupant of any area, place, building, structure or other object within a duly designated heritage preservation site allows any work to be performed on any area, place, building, structure or other object in violation of this section, it shall constitute a separate violation, and it shall be punishable as such. A heritage preservation site on which there exists any remodeling, repairing, construction or a building moved in violation of this section, is declared a nuisance and the imposition of the penalties prescribed shall not prevent the city from instituting an appropriate action or proceeding to prevent an unlawful remodeling, repair, construction, building, building moving or demolition or to restrain, correct or abate a violation. Subd. Repository for documents. The clerk's office is designated as the repository for at least one 12. copy of all studies, reports, recommendations and programs required under this section. (Ord. Because the proposed rehabilitation will utilize federal funding, the project is subject to the federal historic preservation law cited above. Under the regulation at 36 CFR 800.4(b) -(c) it is the Federal agency (or authorized representative) responsibility to identify and evaluate historic properties that may be affected by the proposed project. Several of the proposed rehabilitation items, including windows, siding, soffit and fascia, could have a major effect on the historic characteristics of this property. Therefore, the property first needs to be evaluated using National Register criteria to determine its potential eligibility. I note that the historical information provided for the home thus far is somewhat contradictory; with construction dates given of both 1857 and 1878. One of the survey sheets sent to us stated that this is the oldest home remaining in the survey area. This needs to be verified. In addition, better photos of the home's existing condition and materials are needed, in order to verify the current physical integrity of the structure. We will need the recommended National Register eligibility determination for the property in order to continue review of this project. Don Empson (Empson Archives) and Dan Hoisington (Hoisington Preservation Consultants) both submitted excellent project proposals. Each of the proposals has its own set of strengths: Empson Archives • Considerable historical research experience in Stillwater. Based upon experience, Don identified houses in a three block area on the North Hill that would work very well as the City's first residential walking tour. • Local ties will enable Don to interview owners of each of the properties. • Each videocast would include not only pictures and stories of the property and owners, but would also identify architectural details of the highlighted residence and how they fit with the general architectural style of the house and period of construction. • Don would produce the 14 requested podcasts plus a 15th podcast set in Pioneer Park as an introduction to the walking tour. Hoisington Preservation Consultants • Considerable experience producing historical podcasts for both commercial and residential properties in a number of cities. • Pioneering experience producing walking tours that use brochures coupled to videocasts played on personal hand held devices. • Produced the current video walking tour for Downtown Stillwater. • Submitted the lower "bid" of the two received for the project. Since Dan took ill during the middle of this past year's videocast project, which threw scheduling off, Dan has discounted this year's project bid price. Purpose 1.1. Background Information The City of Stillwater is a dynamic and vibrant community, nestled along the bluffs of the St. Croix River, one of America's protected Wild and Scenic Rivers. Stillwater is a stand -alone City within the Metropolitan Urban Service Area (MUSA), located just 20 miles east of the Twin Cities metropolitan area. The City is a historic community with a growing population of 18,638 residents with a median home value of $242,000. Stillwater is one of the most visited cities in Minnesota, featuring a historic downtown, well known for its quality restaurants and shops featuring antiques, art, rare books and various specialty items. The City is also well known for its restored riverboats, Victorian bed and breakfasts, and seasonal recreation activities on the St. Croix River. In December 2005 the City of Stillwater was designated a Preserve America Community. The Preserve America initiative is a White House effort to encourage and support community efforts for the preservation and enjoyment of America's priceless cultural and natural heritage. 1.2. Previous Related CLG and Preservation Work by the Stillwater HPC As its first CLG project in 1992, the City of Stillwater hired a consultant to prepare a historic context document entitled Stillwater Historic Contexts: A Comprehensive Planning Approach. The document was funded with local funds and a CLG Grant. One of the recommendations in the context study was to divide the city into 17 manageable neighborhoods, called Historic Preservation Planning areas, for survey and evaluation purposes. Ten of the seventeen neighborhoods have been surveyed to date. In each of the surveys, local significance was identified and a preliminary determination for local designation was done for each property within the surveyed area. 1 The ten neighborhoods that have already been surveyed are: North Hill Original Town South Hill Original Town Sabin /Greeley Addition Dutchtown Neighborhood Holcombe District Hersey Staples & Co. Carli & Schulenburg's Addition Churchill, Nelson & Slaughter's Addition -West Half Churchill, Nelson & Slaughter's Addition -East Half Staples Mays Addition These surveys have been funded with local funds, in -kind match and CLG Grants. With a 2005/2006 CLG Grant, the City hired a consultant to prepare a plan for identifying potentially significant historic structures and sites in the community and to develop a plan to implement a local historic designation program. The work resulted in identifying 776 "Heirloom Homes" and 61 "Landmark Sites" in the City that could be included in a local designation program. Heirloom Houses are a cross - section of homes that are representative of nineteenth century Stillwater. The homes contain a fair amount of their original design elements. These homes are generally not eligible for listing on the National Register of Historic Places; however, due to the local value they should be recognized. Landmark Houses and Sites are the finest old homes and most remarkable sites in Stillwater. They have architectural integrity and they have a strong connection to the history of Stillwater. They sites may be eligible or are already listed on the National Register of Historic Places. Starting in 2007, the City of Stillwater, in conjunction with a paid consultant, completed the first of three phases of the Heirloom Home and Landmark Sites program. This first phase involved the development of an on -line interactive and searchable database for properties the Heirloom Home and Landmark Site program. The City undertook the second phase of the program in 2008 and the final phase in 2010. Currently 150 residential properties are listing on the site. 113 are listed as Heirloom Houses and 37 are listed as Landmark Houses. Work Summary and Objective The City of Stillwater seeks to hire a consultant to prepare a self - guided, audio - visual program about Stillwater's historic homes. The main objective of this project is to complete research, collect photos, and create a series of video podcasts of various 2 residential buildings in Stillwater's historic neighborhoods. Also, a walking tour guide and educational guide will be produced. A historian meeting the professional standards of the Department of the Interior will be contracted to complete the above items. Supplemental research will be completed as necessary in a variety of primary and secondary sources. 2.2. Description of Final Products The final products will include three main components: 1) A walking tour guide: a) identifying all Stillwater homes that are listed on the National Register of Historic Places; b) showing the outline of the City's historic neighborhoods; and c) locating 14 selected homes for which video podcasts will be produced. Color and black & white pictures will be used in the guide, which will include pictures of a minimum of 20 homes. This guide will be comprehensive enough for visitors to use on the walking tour and it will list reference materials for those visitors interested in additional information. 2) 14 accompanying video podcasts to highlight each of the selected residential properties. The podcasts need to be formatted so they can be placed on the City of Stillwater's YouTube Channel, website and burned to CD /DVD. 3) A guide available for download outlining educational uses for the video podcast and walking tour guide. 2.3. Project Work Plan The consultant will prepare and submit to the City a Project Work Plan that describes the consultant's approach to completing the elements of the project along with a timeframe for completion. As part of the CLG grant the City is committed to the following major milestones. Any necessary modifications to the major milestones must be addressed in the proposal. 2.3.1. Monthly written updates will be provided by the consultant to the City's project director. The updates are due in the SHPO Grants Office by the 15th of each month. These updates need only be a few sentences in length. 2.3.2. By October 3, 2013, a list of the 14 properties to be featured in the video podcasts will be submitted to the Stillwater HPC. The HPC will have created a list of potential properties from which the consultant may make selections. 2.3.3. By November 28, 2013, a sample script for one of the featured properties shall be submitted to the Stillwater HPC for review. 2.3.4. By January 2, 2014, a sample audio file shall be submitted for one of the featured properties to the Stillwater HPC for review. 2.3.5. By February 27, 2014, a draft brochure will be submitted to the Stillwater HPC for review. 2.3.6. By May 1, 2014, a draft of all podcasts will be submitted to the Stillwater HPC for review. 2.3.7. By June 15, 2014, final podcasts, walking tour brochure, and educational guide will be submitted to the City of Stillwater. 3 2.3.8. By July 15, 2014, final products and director's report will be submitted to the Minnesota Historical Society Grants Office by the City of Stillwater. 2.4. Meetings The consultant will attend a minimum of two HPC meetings in Stillwater. The preferred two meetings are September 2, 2013 for an introduction and overview of the project and May 5, 2014 to review the final work product and acceptance of work by HPC. The HPC reserves the right to require additional meetings to review material and project progress reports as necessary. 2.5. Deadlines and Meetings Per terms of the grant, the project is required to be completed by June 30, 2014. The following is outline of required meetings and deadlines. The schedule can be modified if necessary as long as the June 30, 2014 deadline is met. Any anticipated schedule modifications should be addressed in the proposal. Professional Qualifications The consultant personnel shall meet the Secretary of the Interior's Professional Qualifications Standards (as published in the Federal Register of September 29, 1983.) 4 2.7. Updates to the HPC The consultant shall provide monthly written progress reports. The reports should be short in nature (one or two paragraphs). The reports must be submitted to City Staff by the 1st day of each month, September 2013 through June 2014. The City will incorporate the consultant's progress reports into the HPC's monthly progress report submitted to the State Historic Preservation Office (SHPO) by the 15th day of each month for the duration of the project. The HPC may request other written progress reports as necessary. 2.8. Final Products The consultant will create, produce, and supply to the City the following items: 2.8.1. A minimum of 10,000 two -sided full color walking tour brochures. The brochures shall be 11x17 folded brochures and be printed on 100 #, gloss paper stock. Original digital files (PageMaker, InDesign, Publisher, etc.) and PDF files in both a high quality print and web file types shall be provided. 2.8.2. Fourteen digital video podcasts. The podcasts need to average four minutes in length. The consultant shall publish the files on YouTube and make them available free of charge. The consultant shall produce a CD /DVD version of the podcast that can be distributed to the general public and provide five master disks to the City that can be used to mass produce disks from. 2.8.3. Website that includes a digital version of the walking tour brochure and video podcasts along with the educational guide. Along with the above items, three master hard copy of all printable materials and five digital masters of all of the material produced needs to be submitted. 2.9. Budget and Support Services The consultant's contract will be funded by a $9,000 Certified Local Government Grant from the Minnesota Historical Society. The City will provide a cash match in the amount of $4,000. Total available funding to pay for the consultant services is $13,000. An additional $3,750 is available from the City to cover the consultant's costs for printing the walking tour brochures. All materials produced by the consultant during the course of the project will be owned by the City of Stillwater. The City of Stillwater will administer the grant project. 3. Submission Requirements 3.1. Project Work Plan The consultant shall provide a proposal that establishes a general concept for the program, including a proposed timeline, which is based on the above "Project Description ". 3.2. Project Cost The consultant shall provide a separate cost for each product. The cost will be a not - to- exceed fee for the requested services. 3.3. Statement of Qualifications 5 A Statement of Qualification from the consultant covering the following information: 3.3.1. Provide a brief description of the consultant's capability, history and organization. 3.3.2. Identify the name of the person designated as the contact person for this proposal with mailing address, telephone number, fax number and e-mail address. 3.3.3. Resumes of individuals who will carry out the proposed project development and their respective roles in the project. 3.3.4. Develop a work program and schedule for the proposal. 3.3.5. Provide information on similar project completed by the consultant, including contacts that can be used for reference. 3.4. Number of Proposals Submit six copies of the proposal. 3.5. Submission Deadline Proposals are to be received in the office of the Community Development Department no later than 4:30 p.m. on Thursday, August 1, 2013. No late proposals will be considered. Hoisington The Project We propose to work with the City of Stillwater to develop a public education program for the sum of sio,95o.00. In addition, we can provide Io,000 brochures as specified in the RFP for an additional $2,500. Technology has opened new doors for the interpretation of history. Fifty years ago, if one wished to learn about historic buildings, you might have purchased a guidebook or waited for the occasional walking tour led by a volunteer from the local historical society. Now, with the growing portability of information, we can take some of that storehouse of knowledge and place it, literally, at the fingertips of learner. Video " pastcasts" bring a new dimension to the interpretation of history. They permit the visitor to see images and hear sounds from the past. Best of all, the visitor can learn about the past while standing on the actual spot where history was made. In 2008 we developed a video podcast tour of downtown New Ulm, Minnesota —the first in the state following the release of the iPod Touch. This series has been a resounding success. Anne Makepeace, chair of the New Ulm Heritage Preservation Commission, and I gave a presentation on the project at the state preservation conference in September 2008, followed by a workshop at the National Trust for Historic Preservation's National Main Street Conference in March 2009. Since that time, I have worked with several other cities as we explore this new format and expand our capabilities. In 2009 the City of St. Cloud asked us to develop three walking tours. These proved so successful that we were invited back to create two thematic tours. In addition, we have worked with the cities of Faribault, Little Falls, Red Wing, and Urbana, Illinois. Two years ago, we developed a new tour for the Brown County Historical Society in New Ulm, focusing on public art related to the U.S.- Dakota War of 1862. Recently, the American Association for State and Local History awarded the 2013 Award of Merit to our museum exhibit on the U.S.- Dakota War of 1862 at the Brown County Historical Society. This included ten iPad learning stations. Pastcasts are a unique combination of new technology and old stories. • History: We'll approach this project from the perspective of a historian, because a good pastcast must be grounded in historic research and written with a strong narrative. Over the last year, I gained a background in Stillwater history and go into this project knowing the available resources. I have built in some additional research time in the project and would schedule an early review of potential scripts and photographs with staff of the Washington County Historical Society. One of the keys, though, is that the scripts need to be based on stories, not a list of facts, to catch the viewers' interest. Production: It takes a knowledge of production —how to take images and narration and create a short video. We have strong capabilities with video and sound equipment, as well as editing software and will supply the final product in high definition video. Good sound is vital to the project, and we have budgeted for use of a professional recording studio and narrators. Distribution: The video podcasts must be distributed widely using a variety of social media. What makes this format especially exciting is the ability to distribute these podcasts across myriad venues. We can supply multiple formats. Finally, we will expand the educational outreach through the production of a walking tour brochure and development of an educational guide. We can build off the format of the downtown brochure to maintain a consistent format and style. CITY OF STILLWATER, MINNESOTA : PROPOSAL FOR PUBLIC EDUCATION PROGRAM About the Consultant Daniel J. Hoisington Daniel J. Hoisington will manage all aspects of the project. Mr. Hoisington is fully qualified as a historian under the Secretary of the Interior's Professional Standards. He received a Bachelor of Arts in history from Greenville College, Greenville, Illinois, where he graduated with honors. He earned a Master of Arts in American history from the University of Virginia, and completed all course work for the Ph.D. degree. For twelve years he worked as a museum director, heading institutions in Massachusetts, Minnesota, Alabama, and Virginia. For three years, he served as president of the Bay State Historical League. In addition, he chaired grants review panels for the Massachusetts Council for the Arts and Humanities and the Massachusetts Foundation for the Humanities. In 1992 Mr. Hoisington founded a firm to provide consulting services to local historical organizations and preservation commissions. He is the author of twelve books and numerous journal articles. In 1998 the Minnesota Society of Architectural Historians honored his book, Heritage: Preserving Eden Prairie's Past, with its David Gebhard Award. His book, A German Town: A History of New Ulm, Minnesota, received honors from the American Association for State and Local History. He has given presentations to the Minnesota State Historic Preservation Conference, the Preservation Massachusetts Annual Conference, the Bay State Historical League Annual Meeting, the West Virginia Main Street program, and the National Trust for Historic Preservation Main Street Conference. It is important to place the sites within a larger narra- tive rather than view them simply as a collection of individual stories. The complete tour is the book; the stops are the chapters. Timeline: Within thirty days of contract. Two: Scripts and Storyboarding Method: During the fall and early winter, we will write scripts for the fourteen sites. There is a difference between a set of facts and a script. While grounded in historic fact, the script is shaped by a narrative. The consultant will rely on existing research to write scripts for each selected story/building, but additional information may be needed for each site. Timeline: September 2013 through December 2013 Deliverable: Three hard copies and one pdf copy of the scripts Three: Digital Images Method: Photographs and drawings convey information and meaning, often adding an emotional connection not found in words alone. We will work with the HPC to research, select, and scan photographs. In addition, we will take digital photos of the selected sites. As the scripts develop, it might become necessary to acquire images from additional sources. We have full video capabilities to film scenes and interviews as needed. Timeline: September 2013 through January 2014 Deliverable: Three hard copies and one pdf file of a written report on digital images Four: Implementation: Recording the Narratives Method: Once the scripts are written and approved, the soundtrack will be recorded at Track Stu- dios in St. Paul, Minnesota, relying on a mix of narrative voices. Timeline: No later than I March 2014 Five: Implementation: Putting It Together Method: With the scripts approved and the images gathered, we will pull together the narration and images, working with Final Cut Studio software, an industry standard. Original files will be created in high definition, allowing for multiple outputs. These include cable television, the internet, and MP3 players. This walking tour will encompass 14 historic houses in the North Hill neighborhood —all of them within a 3 -block square area. This selection of homes represent all the major architectural styles of the Nineteenth Century, as well as a vision of Stillwater's oldest and most - intact neighborhood. The houses I will present are: 504 N. 2nd 604 N. 4th 122 W. Linden 107 E. Laurel 402 N. 4th 410 N. 4th 626 N. 4th 625 N. 5th 401 N. 3rd 510 N. 3'd (14 chosen from these 16 homes) 414 N. 4th 222 W. Laurel The 15th podcast would be set in Pioneer Park to introduce myself as the tour guide; to point out the significance of the North Hill, and the role of the Second Street Hill as the first road out of the downtown "original bowl': This initial podcast would also point out the location of the Staples Mansion, the Sabin Mansion, and the cemetery that once occupied most of the area. The podcasts would be a combination of video, still photographs of each house, and its architectural details: reference materials, e.g. a newspaper clipping about the house: historic photos of the houses when available: illustrations of the architectural styles in general: photographs of the builders /owners: and other pertinent materials that are available. The whole podcast would be intended to educate the users about Stillwater houses in particular, and how they fit the pattern of Nineteenth Century domestic architecture. I will prepare and print the walking tour brochure as described in Section 2.8.1 of the Stillwater R.F.P. I believe this brochure should contain 1.) A brief explanation of the project and the City's sponsorship; 2.) A reference to the Heirloom /Landmark website where more houses, as well as the footnotes and reference materials for the podcast houses, can be found; 3.) A general map from downtown to the North Hill to Pioneer Park where the tour begins; 4.) A specific map —in good size —of the walking tour; 5.) A brief history of the North Hill; 6.) Individual photos of the podcast houses large enough to recognize including the captions; 7.) A description of how to access the podcasts; 8.) A list of reference materials (the Heirloom /Landmark site) and an acknowledgment of the St. Croix Collection at the Stillwater Public Library and the Washington County Historical Society; 9.) Acknowledgment of the funding sources and legal language; lo.) A link to the houses in Stillwater on the National Register; 11.) A link to an online guide to the City's historic neighborhoods; 12.) QR codes for each house. 13.) All of this in type large enough so the old folks can read it easily. 1 07/20/13 Within the podcasts, I will provide some historic photographs and some interior views, which should satisfy the requirement of zo house photographs. (I am unsure there is room in the brochure for 20 photographs, but I could prepare it if you wish.) Section 2.2.3. in the Stillwater R.F.P. calls for a guide outlining educational uses for the podcast and brochure. It seems to me that the educational uses of a walking tour of historic houses are pretty self evident, but I can make some suggestions on potential educational uses. When the project is completed, I will approach the local newspaper reporters: Mary Divine, Kevin Giles, etc. about doing a feature story on this project. Section 2.3 outlines a time table that I would follow. I would envision doing all the video this fall before the snow flies, and then doing the editing over the winter. I would envision having the project finished no later than May. Selection of the consultant is to be in August. I would like to begin the project as soon as possible. I will adhere to Section 2.4 (Meetings) and Section 2.5 (Deadlines and Meetings) as well as Section 2.7 (Updates to the H.P.C.). Section 2.8.3 describes a website that includes a digital version of the walking tour brochure, and video podcasts, along with the educational guide. I am not sure exactly how that will work within the Stillwater website, but I certainly can do it, given guidance by the City. The fee of $13,000 is acceptable. It is difficult to set out individual budget items because I cannot say how many hours various parts of the project will entail. I will have to buy some movie editing software, and I may pay a graphic artist to do the brochure because I would like a very professional job. I have obtained an estimate for printing the brochure, and it falls well within the allocated $3,75o. Ifyou agree half the work is done by December �i aoi�, I would like to be aid half the total, $6 soo in calendar year 2013. 2 07/20/13 I have lived in Stillwater for over 20 years, and much of that time has been spent on writing about or researching the old houses. I know many of the old house owners, and I have been inside many of these old houses. Before moving to Stillwater, I spent another 20 years researching and writing about St. Paul homes. I will be doing all the work myself, although mywife —a journalist —will help with the writing. As for references, I have now done 8 C.L.G. projects for the H.P.C., and I have worked with several of the H.P.C. members on informal old houses issues. At this point, I do not think even the most glowing recommendation from an outside person would sway whatever view the H.P.C. and S.H.P.O. might hold of my work. I am enthusiastic about developing this project because I have long thought about establishing walking tours. SO- Beni '.-_1.11.0:6k2i Art • I 4 1Derj+ ��j RESOLUTION 2013 CITY OF STILLWATER WASHINGTON COUNTY, MINNESOTA WHEREAS, the structure located at 114 Chestnut Street East, otherwise known as the Brunswick House, was constructed by William C. Penny about 1848 — the same year in which Stillwater was platted as a town and the year the "convention" in Stillwater took place; and WHEREAS, the property is adjacent to the Stillwater Commercial Historic District as listed on the NRHP, which runs along the south side of Commercial St.; and WHEREAS, the empty structure, waits for the next chapter in its long history and, therefore, is a building that needs to be taken care of — preserved and handed down to another generation to tell the stories of our past; and WHEREAS, the Heritage Preservation Commission has reason to believe the Brunswick House is significant to the City's history and will act in a resource and advisory capacity to owners regarding preservation, restoration and rehabilitation. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Stillwater hereby declares that the due to the structure being the oldest know wood structure in the City of Stillwater, and the ties it had to our early lumbering history, we believe the structure's preservation is important to the heritage of the area and the State of Minnesota.
