HomeMy WebLinkAbout2013-050RESOLUTION NO. 2013-050 A RESOLUTION APPROVING A VARIANCE FOR IMPERVIOUS SURFACE COVERAGE AT 106 LAKESIDE DRIVE CASE NO. 2012-15 WHEREAS, Paul Larson, owner of the subject property, made application for approval of a variance from the maximum permitted impervious surface on his property located at 106 Lakeside Drive; and WHEREAS, the legal description of the property is: Lot 8, Lakeview Terrace, Washington County, MN; and WHEREAS, on May 14, 2012 the Planning Commission held a public hearing on the variance, no comments were submitted by the public, and unanimously recommended approval with four conditions; one of which required the submittal of a stormwater mitigation plan prior to consideration of the case by the City Council; and WHEREAS, on March 13, 2013 the landowner submitted the required stormwater mitigation plan. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Stillwater hereby approves the requested variance with the following conditions: 1. The project shall be completed according to the plans on file in the Community Development Department, unless specifically modified by other conditions of approval. 2. An erosion control plan must be submitted to the City Engineer and found satisfactory before any earth work begins, or a building permit is issued. Furthermore, an erosion control installation inspection must be scheduled with the City Engineering Department and found satisfactory prior to beginning any earth work on the property. 3. The exterior colors of the entire home shall be limited to earth tones. The earth tone colors must be specified by the property owner and approved by the Community Development Director prior to issuance of a building permit. 4. The stormwater mitigation improvements, as detailed in the plan on file in the Community Development Department, shall be maintained by the property owner in such a condition as is necessary to effectively treat the amount of runoff created by all impervious surface on the property that exceeds 20% of the lot's area.
