APPROVAL OF MINUTES
Possible approval of December 3, 2012 meeting minutes
Motion by Commissioner Zahren, seconded by Commissioner Brach, to approve the minutes of the December
3, 2012 mee ting. All in favor.
OPEN FORUM
Brian Larson, 2008 Hazel Court, spoke regarding Larry Cramer’s Rafters rooftop project. The applicant has
a proposed alteration to the stair going to the roof and wants the Commission’s input. After meeting with the
buildin g official, Mr. Cramer determined there was a way to stay completely on his property and create a
three foot wide stair on the exterior of the building, entering the building on the second level. The building
official was OK with this concept. Mr. Larson p resented a preliminary sketch showing the exterior structure.
Commissioner Johnson pointed out the elevation where the exterior stair is proposed is not historic, but the
exterior stair looks a little awkward on the building.
Mr. Larson responded its s hape and form are governed by the space that is available.
Commissioner Zahren agreed it is awkward and looks like a warehouse, which hinders the City’s attempts
to beautify Water Street.
Commissioner Goodman said the exterior fire escape is a look see n on older buildings. He doesn’t have a
problem with it.
Commissioner Zahren asked if Mr. Cramer realizes that the customers’ view will be impacted by the
addition of the stairway.
Commissioner Johnson suggested a different 180 degree turn for the stairw ay which would make the
platform nearer the top.
Mr. Larson said that would lead right into about the middle of the bar.
City Planner Pogge expressed concern about the treatment of the sidewalk on Water Street.

DESIGN REVIEWS
Case No. DR/2012 -36. Design review of awnings and building painting located at 102 Main Street South, 106
Main Street South and 279 Myrtle Street East in the CBD, Central Business District. Acme Awning, applicant.
Continued from th e December 3, 2012 meeting.
Anthony Misenor of Acme Awning presented revised renderings of awnings proposed for the Main Street
side of the building which cover the space above the windows. He also resized the awning on Myrtle Street
to match No Neck Tony ’s.
Regarding signage, Mr. Misenor stated the tenant of the bookstore doesn’t want to cover up the white space
above the windows with awning, but wants to put a sign there.
Commissioner Johnson suggested putting the sign above the awning like at No Neck Tony’s.
City Planner Pogge clarified that because there are two street elevations for the business, a sign can be
placed on each.
A representative from ACME Awning representing building owner Olivia Horning stated he doesn’t like the
awning changes and prefers just two awnings over the doors of the businesses.
Commissioner Johnson commented that different sizes of awnings lack continuity. Awnings add to the
storefront appearance by covering up some of the closed transom area that no longer exists, givi ng more
uniformity to the front.
Commissioner Zahren added that the new awnings will improve the look of the building.
City Planner Pogge pointed out the applicant has two years to install awnings if approved.
Motion by Commissioner Johnson, seconded b y Commissioner Krakowski, to approve awnings and painting as
revised. All in favor.
Case No. DR/2013 -01. Design review of signage for DiaSorin located at 1990 Industrial Blvd located in the
BP -C, Business Park Commercial District. Douglas Schuenke, applic ant.
Bill Waterhouse , facilities manager, and Suzanne LaBarron , assistant to the vice president of operations,
offered to answer questions regarding the application for a new sign that is proposed to contain the words
“DiaSorin” in individual aluminum cha nnel letters painted white on a blue background.
Motion by Commissioner Larson, seconded by Commissioner Krakowski, to accept the proposal as submitted
with conditions. All in favor.
Case No DR/2013 -03. Design review of window replacement for Marx loca ted at 241 Main Street South in the
CBD, Central Business District. Mark Hanson, applicant.

Mark Hanson, applicant, indicated he wants to redo the windows for the apartments. The exterior trim will
be the same as it is now and the windows will look the sa me but are more energy efficient. Awnings will
remain.
Motion by Commissioner Zahren, seconded by Commissioner Brach, to approve the proposal with conditions.
All in favor.
NEW BUSINESS
New Web Site highlighting St. Croix Valley history
City Planner P ogge introduced Matt Thueson, digital content manager for the St. Paul Chamber Orchestra
and a Stillwater resident who has served on the the board of the Washington County Historical Society. He
proposes to develop a web site with historic content on the S t. Croix area.
Mr. Thueson said he has a long -time interest in Stillwater history. He presented an experimental concept for
a web site that uses the internet to let people see Stillwater as it was historically and as it is today. It would
have smartphone and GPS capabilities and would allow users to zoom in on the 1870 bird’s eye map to see
their current location in 1870 Stillwater.
City Planner Pogge said he hopes this project will generate some grant opportunities.
Commissioners expressed positive c omments about the project.
CLG Grants
City Planner Pogge said staff discussed doing a reuse study for the Shoddy Mill/Bergstein site since the City
will own these buildings soon. He will look into a grant for this and for Matt Thueson’s project. A
subseq uent grant might be sought for improvement of the buildings, for instance for restrooms, meeting
space, and possibly a concession area for bikes or canoes. He added that Stillwater is partnering with the
Washington County Historical Society on a grant to g et the Brunswick Inn on the National Register. A
private group has approached the City about doing some rehabilitation work, which could be eligible for tax
increment financing if it’s on the National Register.
iPads
City Planner Pogge said it would be a huge cost savings to the City for the Commission to use iPads rather
than paper packets. Fees to applicants would be raised $25 to help pay for it, but would save applicants the
cost of providing so many duplicate copies of application materials. The pur chase of iPads for the
Commission will go before the Council in January.
Aiple Property
Commissioner Johnson noted he heard the property owner offered the City first right of refusal to purchase
the property north of the Zephyr.
City Planner Pogge sai d tomorrow night, the Council will discuss what role the City would like to have in
purchasing this property if any. There have been extensive conversations with the National Park Service,
Department of Natural Resources and other agencies about this prope rty.

Commissioner Johnson said long ago the City looked at creating an entrance into that end of the downtown.
It would be a shame to lose the property to the construction of private homes. He would like to see the area
preserved as a natural entry into the City.
DESIGN REVIEW continued
Case No DR/2013 -02. Design review of signage for Abra Auto Body & Glass located at 2000 Curve Crest Blvd
in the BP -I, Business Park Industrial District. DeMars Signs, applicant.
City Planner Pogge explained that the mon ument sign is an aluminum panel. The building sign is individual
internally lit channel letters. The applicant proposes a black aluminum panel behind it. In the past, the City
has not allowed an aluminum background behind channel letters. Staff recommends approval with the
omission of this black background. An option may be to include a black border around the letters
themselves.
Commissioner Johnson noted that the black background is on the smooth wall surface and does not cover
any architectural elements .
Motion by Commissioner Johnson, seconded by Commissioner Zahren, to approve the monument sign and wall
sign as submitted, deleting condition 3 which would have eliminated the black background. All in favor.
NEW BUSINESS continued
Discussion of Demolit ion Ordinance
City Planner Pogge informed the Commission that the City Council denied demolition for both properties
owned by St. Paul Lutheran Church, which triggered staff to begin a local designation process. Staff talked
to five or six firms and rece ived one proposal that was rather high. The proposal was presented to the
Council, which elected not to hire the firm. This means that if the designation is not completed by May 5,
the church will be allowed to demolish the two houses. He pointed out that the process has revealed that the
Commission needs to tweak some parts of the ordinance: 1) to add a $5,000 escrow requirement for all
demolition permits 2) review the demolition ordinance. Currently there is a six month timeline to complete
local designat ion, which should be lengthened to nine months. He stated that qualified historians are
currently backlogged which, combined with the City’s tight timelines, drove the cost estimate up.
Commissioner Johnson pointed out that there is a second point of Cou ncil approval or denial for a local
designation process in the requirement that the expenditure requires Council approval. This means the
demolition of a building could ultimately be based on fiscal rationale.
Council Representative Cook reviewed the dis cussion that took place at the City Council meeting. She
suggested talking to newly elected officials immediately to educate them on this type of issue.
Commissioner Johnson said there also should be an expectation of what is reasonable cost for such
desi gnation. Having the client pay via the escrow will help. He expressed surprise that the Council opted not
to take it through the designation process after the Commission recommended that the designation process
proceed. He would like to ensure that even if a Commission vote on an issue is split, individual
commissioners stick together and support the decision of the group. He has heard there may have been
uncertainty on the part of some Council members that the designation may not have been wholeheartedly
s upported by the Commission.

City Planner Pogge agreed that it would be good to meet with the Council to emphasize the role of historic
preservation in Stillwater.

BACKGROUND

requesting a partial demoliti on
permit for the existing residential
home on the property . It is the
owner’s intent is to remove the
existing roof and replace it with a
taller roof structure in order to add
living space to the third floor.
The current demolition ordinance
requires review by the HPC when
more than 20% of a front façade or
front facing roof is removed. As a
corner there are two fronts on this
building and thus by removing
entire roof a review is triggered.
The current structure was built in 1890 according to the Washington County Assessor’s
Office.

S PECIFIC REQUEST
The applicant is requesting consideration of a partial demolition permit in order to remove
the existing roof and replace it taller roof structure in order to add living space to the third
floor.
EVALUATION
Staff Review
Chapter 34, Section 34 -4, subd. 1 of the City Code requires City Staff to review a building or
structure built on or prior to December 31, 1945 and determine if it is a historic resource. If
City Staff determines that it is a potential histor ic resource then the request must be
forwarded to the HPC for review.
Staff completed an on -site visit of the home on January 24, 2013 . Even with the previous
additions and changes to the home, overall the home was found to be reflective of ca. 1890
co nstruction.
After the on -site review, staff reviewed internal records for the home. An architectural
survey has not been completed for t he area where the home is located in and no
architectural inventory form for the property could be found at SHPO. T hus the City has
no historic research on the property.
Based on the review of the property, staff made a determination that the property could
potentially be locally designated since the property “embodies the distinctive characteristics
of an architectur al style.” Thus, as required by the demolition ordinance, the application is
being forwarded to the HPC for review and consideration.
HPC Submittal
Section 34 -4, subd. 2 of the City Code lists eight (8) items that must be considered prior to
approval of a demolition permit by the Commission. In this case, as with other similar
partial demolitions, some of the listed submittal items may not apply. Staff will discuss this
later.
(1) A map showing the location of the building or structure to be demoli shed on its
property and with reference to neighborhood properties;
This information is included in the attached application.
(2) A legal description of property and owner of record;
The legal description was included in the applicant’s application.
(3) Photographs of all building elevations;
This application contains two of the building elevations.

(4) A description of the building or structure or portion of building or structure to be
demolished;
The current r oof is proposed to be demolis hed in order to allow a new taller roof in order to
create living space on the third floor. The current roof is a 9/12 pitch. The new roof is
proposed to be a 12/12 pitch. Overall the new roof will be approximately 30 to 36 inches
taller than the curren t roof.
(5) The reason for the proposed demolition and data supporting the reason, including,
where applicable, data sufficient to establish any economic justification for demolition;
The applicant’s request is to remove the current roof with a taller o ne and keep a majority of
the structure and simply to install a new taller roof in order to expand the living space on the
third floor.
The applicant ’s need for additional space is what is driving this request. Economic
justification does not apply in this case.
(6) Proposed plans and schedule for reuse of the property on which the building or
structure to be demolished is located;
In this case, the home will remain and the roof will simply be replaced with a new taller roof.
(7) Relation of dem olition and future site use to the comprehensive plan and zoning
requirements;
The current comprehensive plan land use designation for the property is Low/Medium
Density Residential and is zone d RB , two -family residential. Churches are specially
permitted uses in the RB zoning district.
This site is in the Neighborhood Conservation Design District .
(8) A description of alternatives to the demolition;
While the applicant does not provide any alternatives, one alternative would be to keep the
roof that is currently in place. This would fail to meet the applicant’s desire to create new
living space for their growing family and is not a good alternative for them.

DEMOLITION FINDINGS
Section 34 -4, subd. 2 outlines the criteria for approval or denia l of a demolition permit.
There are two criteria the Commission must consider in either approving or denying a
permit.
1. Is the building or structure a historic resource?
The code defines a historic resource as:
“Any building or structure that is not currently designated as a Heritage
Preservation Site but which is worthy of such designation because of its
historical, cultural, architectural, archaeological or engineering significance.”
As noted earlier , the property has good integrity and o verall th e home was found
to be reflective of ca. 1890 construction. Staff does not believe that it could be
nationally listed; but, it could be locally designated as a heritage preservation
site.
2. Is there a feasible alternative to demolition?
While there is cer tainly an alternative to the partial demolition, in this case, in
staff’s opinion the change is minor and there are a number of examples of 12/12
pitch roofs in the neighborhood. Changing the roof pitch will have a minor
impact on the neighborhood and all ows the home to serve the needs and desires
of the current owners; therefore , s taff recommend s approval of the demolition
permit.
I f the Commission agrees with the above finding, then the Commission must notify the
building officinal in writing that the p ermit may be issued .

ALTERNATIVES
T he HPC has several alternatives related to this request:
A. Approve. If the proposed demolition request is found acceptable to the HPC,
they should be approved . Staff would recommend the following conditions of
approval:
a. The roof change shall follow the plans submitted to the HPC and dated
January 24, 2013. The existing soffit, fascia overhang, and end walls shall
remain.
B. Approve in part.
C. Deny. If the HPC finds that the property is historic resource and that there is a
feasible alternative to demolition then the commission shall deny the demolition
permit and direct City Staff to prepare a designation study for the property as
provided in Section 22 -7 Subdivision 4 of the City Code.
a. If the permit is denied, the r equest must be forwarded to the City Council
who must approve the preparation of the designation study within 30
days or the permit will automatically be issued.
b. The designation study must be completed and approved by the HPC and
City Council within 180 d ays of the date the HPC acts on this request or
the permit will automatically be issued.
D. Table. If the HPC needs additional information to make a decision, the request s
could be tabled until your March 4, 2013 meeting so that additional information
could be submitted. The 60 day decision deadline for the request is March 22,
2013 .
RECOMMENDATION
Approve as requested.

DISCUSSION
Last summer, the HPC reviewed a number of plans for a new roof top patio for Rafters
located at 317 Main St S. Since that time, the applicant has been in discussion s with a
number of contractors about the project and he has determined that he cannot make the
project financially work in the current configuration.
The approved plans call for two sets of internal stairs to be extended to the roof and
protected with two separate “dog house s ”. In an effort to save money, the applicant i s
seeking to eliminate the main set of stairs and dog house and replace it with an external
set of stairs that will extend out a window on the second floor and up to the roof top.
The second dog house for t he emergency exit will remain; however, with the change to
the new external stairs, the owner will not need to enclose them to the ground floor,
thus saving money and making the project more viable.
The building is located in the core Stillwater Commercial Historic District as listed on
the National Reg istry of Historic Districts . The building itself is a noncontributing
building to the Historic District and was built prior to 1884.

SPECIFIC REQUEST
Since the project is located in Stillwater’s historic downtown district, the Heritage
Preservation C ommission is required to review and take action on the request.
Staff has concerns with the current proposal. While historically downtown Stillwater
has had external fire exits and new roof top patios have been permitted to have external
stairs, none h ave made a proposal like this one.
From a design standpoint, t aking an existing window opening and converting it to a
part window/part doorway entry impacts architectural integrity and the look of the
building . Additionally, adding the stairs in the pr oposed location masks the building.
Finally, the proposal sets a poor precedent that staff is concerned about. Due to the
listed reasons, staff finds that this does not meet the intent and standards of the
Downtown Design Guidelines.
From a constructabil ity standpoint, staff does not believe that this can be constructed
and remain entirely on the owners property. One of the drawings submitted with this
application shows the survey of the property along with the proposed stairs
superimposed on them. O n t he west side there is only 3.02 feet between the building
and the property line. This tapers down to 2.94 feet on the east side of the stairs. The
issue is that the external stairs are required to be a minimum of 3 feet wide.
Additionally, while hand ra ils are allowed to protrude into the 3 feet the actual guard
rail is not permitted to protrude. In talking with the building official, staff believes that
one would need a minimum of 3.25 feet between the building and property line to
install a set of sta irs that is 3 feet wide. While staff would permit the stairs to be within
an easement, based on previous correspondences from the adjacent property owner
staff is of the opinion that securing the needed easement is unlikely.
ALTERNATIVES
T he HPC has s everal alternatives related to this request:
A. Deny. Deny the requested since it fails to meet the intent and standards of the
Downtown Design Guidelines.
B. Approve. If the proposed design review request is found acceptable to the HPC,
they should approve th e request. If the Commission chooses to approve the
permit then staff would recommend the minimum conditions for approval listed
below.
C. Table. If the HPC needs additional information to make a decision, the request s
could be tabled until your March 4, 20 13 meeting so that additional information
could be submitted. The 60 day decision deadline is March 24, 2013 .

STAFF RECOMMENDATION

MINIMUM CONDITIONS FOR APPRO VAL
1. All revisions to the approved plan shall be revie wed and approved by the
Heritage Preservation Commission .
2. The applicant shall submit a SAC determination letter prior to the issuance of a
building permit.
3. The application shall submit plans on the roof top deck certified by a structural
engineer prior to the issuance of a building permit.
4. Plans shall be approved by the building inspector and fire marshal prior to the
issuance of a building permit.
5. The applicant shall receive all appropriate Washington County Health
Department approvals.
6. The property or bus iness owner shall purchase 6 monthly parking permits to
compensate for deficit in on -site parking between May 1st and October 31st each
year.
7. The east edge of the patio shall be no closer than 3 feet to the building edge.
8. No smoking shall be permitted on t he roof top patio.
9. No amplified music shall be permitted on the roof top patio.
10. Food and beverage service for all customers on the outdoor patio shall cease at
9:30 pm. All customers shall exit the outdoor patio area by 10:00 pm. After one
year, the Sti llwater Police Chief may revisit the hours of operation and expand
them up to one hour at his or her discretion. If the hours of operation are
expanded in the future, the Stillwater Police Chief may rescind the extend hours
upon receiving substantiated co mplaints, safety issues, or violations of the
conditions of this permit. Additional hours of operation beyond 11:00 pm
requires review and approval of the Planning Commission.
11. Drinks of all types are permitted on the roof top patio; however, no physical ba r
or alcohol beverage service station shall be located on the rooftop. After one
year, the Stillwater Police Chief may revisit this condition.
12. No glassware or glass bottles shall be available on the roof top patio.
13. There shall be no waiting area on the roof top patio.
14. When the roof top patio is open, a security staff member shall present at all times
on the patio.
15. Security cameras will a minimum resolution of 2 mega pixels and capable to
keep a minimum of 7 days of video shall be installed on the patio. The video
cameras shall capture all entrances/exits to the roof top patio and views of the
entire patio area.
16. A minimum of a 9 foot tall barrier shall be installed along the south edge of the
patio. Final design shall be approved by the City Planner prio r to the issuance of
the building permit.
17. A copy of a survey showing the current heights of this and the adjacent buildings
shall be submitted to the City prior to the issuance of a building permit.

18. A certificate of survey signed by a licenses land surve yor shall be submitted to
the City prior to the issuance of a building permit. At a minimum, the certificate
of survey shall show the building, property lines, and the proposed stairs and
supporting structure including, but not limited to, all beams, rail s, and other
supports that extends beyond the 36 -inch stair width.
19. The applicant shall submit permanent easements for any portion of the stairs that
extend beyond their property line prior to the issuance of a building permit.
20. The applicant shall submit co nstruction easements for the stairs prior to the
issuance of a building permit.
21. This special use permit shall be reviewed before the Planning Commission and
City Council for possible revocation or amending of the conditions i f
substantiated complaints, sa fety issues, or violations of the conditions of this
permit are received by the Community Development Director.
22. The gross receipts must be at least 60% attributable to the sale of food with no
more than 40% attributable to alcoholic sales.

BACKGROUND
After the recent demolition cases related to St. Paul Lutheran Church, it has become clear
that the City should consider an amendment to the recently ad o pted demolition ordinance.
Specifically the code provides that the City has 180 day s after the HPC denies a demolition
permit to complete a local designation study and if it is not completed in that time then the
demolition permit is automatically approve d.
At issue is the time required to complete a study and the actual local designation process.
The process outline in the Stillwater City Code is based on the process recommended by the
US Department of Interior and the Minnesota State Historic Preserv ation Office.
By code, all local designation studies are required to be authorized by the City Council
before they are started. This takes a minimum of 15 days between when the HPC meets
and when it can be placed on the next Council agenda. Then the s tudy has to be completed.
After the study is completed a series of public hearings and meeting are required to be held
by the HPC , Planning Commission, and City Council on the proposed designation . On the
backend this takes a minimum of 4 to 5 months. T his leaves very little time to complete a
designation report between when the study is authorized by the Council and the public
hearing are required to start . The result is that many preservation consultants simply don’t
have the resources to complete a s tudy and the firms that do have the manpower to get a
report completed on a short basis, the cost of the reports are very high.
To fix this issue, City Staff recommends that the current 180 day time limit be extended to
270 day s . This additional time s hould afford the City sufficient time to complete a
designation study and have it done with a reasonable budget. The attached ordinance
makes this change.

ALTERNATIVES
The HPC has several alternatives related to this request:
A. Recommend City Council Ap proval. If the Commission finds the proposed
ordinance amendment is acceptable, the Commission should recommend that the
City Council approve the amendment a s presented.
B. Deny. If the HPC finds that the proposal is not advisable, then the commission
sho uld recommend that the City Council deny the proposed ordinance amendment .
C. Table. If the HPC wishes to have additional time to review the ordinance, the
Commission should table action to the March 4, 2013 meeting.

THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN:
1. Amending. City Code Chapter 34 , Section 4 Procedures, Subdivision 2, (b)(iii)1 is rep laced with
the following :
(1 ) Failure to designate property . If the city council does not approve the preparation of
the designation study within 30 days of the commission determination, or if the
completed designation study is not approved within 180 27 0 days of the commission
determination, or if the city council denies implementation of the designation after
completion of the designation study, then the building official shall issue the demolition
permit.
2. Savings . In all other ways City Code Chapter 31 shall remain in full force and effect.

BACKGROUND
Staff is proposing that the City apply for a CLG grant and a Minnesota Historical and
Cultural Grant to complete a Public Education Project to create video podcasts on
significant residential homes in our community. This follows the video podcasts the H PC is
working on this year and that will be completed in May.
The project will resu lt in the following products: 1) 14 audio/visual podcasts on the City’s
website describing various residential buildings/landmarks in Stillwater. The narrated
podcasts wi ll include historical information, in teresting stories , and photos. 2) The podcasts
could be downloaded to iPods, MP3 players or other mobile devices for use i n a self -guided
walking tour. 3) An accompanying walking tour brochure will be developed to coinc ide
with the podcasts.
GRANT BUDGETS
The overall project is budgeted to cost $1 6,7 50 of which $13 ,000 will go towards hiring a
consultant to assist the City on the project . The CLG Grant request is for $9,000 . Staff will
also be submitting for a Legacy Grant for $4,750 . T he City will provide a cash match of
$3,000. If the grant is received, the City will provide $1,550 of in -kind City Staff time to
support the project and $450 .00 of donated time of HPC members.
RECOMMENDATION
Review and make a reco mmendation to City Council regarding the FY 2014 CLG Grant
Application and Minnesot a Historical and Cultural Grant to MHS.
