His tendered resignation from Stillwater's City Planner position will be effective Wednesday, February 6, 2013. The City Planner position is essential to many City programs and services. However, given the hiring freeze that is in effect, the position cannot be filled without explicit approval from the City Council. In addition, if the Council authorizes staff to fill the position, it could easily take three months or more to accomplish the task. REQUEST Therefore, staff is requesting permission to: 1. Fill the City Planner position after it becomes vacant; and 2. James Roush commended City staff and thanked everyone who worked with him, including the residents. PETITIONS, INDIVIDUALS, DELEGATIONS & COMMENDATIONS CVB Annual Report - Tikki Oswald, Americlnn Tikki Oswald reported on activities of the Convention and Visitors Bureau for the past year. The web site attracted 60% more visitors. There was a 275% increase in wedding page traffic and a 121% increase in winery and brewery page traffic. The CVB will be revamping the web site and launching a new design and map in April 2013. A five year planning session will take place next month. New guidebooks will be distributed beginning next week. The CVB is looking at how to be more visible downtown. Ms. Oswald also reported on the various partnerships that have been developed, and invited input from the Council. OPEN FORUM There were no public comments. Page 2 of 6 City Council Meeting January 8, 2013 STAFF REPORTS Community Development Director Turnblad reported that staff has been working with a manufacturing company in Vadnais Heights that wants to expand and relocate. He asked that the Council schedule a 4:30 workshop on February 19 to discuss TIF assistance. Public Works Director Sanders stated that the neighborhood meeting for the 2013 street reconstruction project will be held on January 17. City Clerk Ward reminded the Council that this month the meetings will be on the second and fourth Tuesday instead of the first and third Tuesday. Mayor Harycki noted that over the holidays, former Councilmember Taco Bealka passed away. He also extended condolences to City Clerk Ward for the loss of her mother. City Administrator Hansen reminded the Council that the Council retreat will take place from 8 a.m. until noon on January 18 at the Library. CONSENT AGENDA Resolution 2013 -03, directing payment of bills Resolution 2013 -04, designation of depositories for 2013 Resolution 2013 -05, designating a responsible authority and assigning duties in accordance with the State of Minnesota Data Practices Statute Resolution 2013 -06, renewal of towing license for 2013 Resolution 2013 -07, designating the Stillwater Gazette and St. Paul Pioneer Press as the City's legal publications and approving contracts with the Stillwater Gazette and St. Paul Pioneer Press for 2013 Possible approval of 50/50 cost sharing split with Water Board - Tunnel Collapse — 3rd Street Possible authorization to proceed with new hire replacement of Patrol Officer Motion by Councilmember Polehna, seconded by Councilmember Menikheim, to adopt the Consent Agenda. NEW BUSINESS Possible approval of first reading of Background Check Ordinance City Attorney Magnuson explained that over the last year the League of Minnesota Cities has met with the State Department of Public Safety to develop a protocol for access of public agencies to BCA records for the purpose of background checks. That group is insisting Cities adopt the model ordinance they recommend. Page 3 of 6 City Council Meeting January 8, 2013 Motion by Councilmember Kozlowski, seconded by Councilmember Polehna, to approve the first reading of an Ordinance relating to criminal history background checks for applicants for City employment and City licenses. Ayes: Councilmembers Menikheim, Kozlowski, Weidner, Polehna, Mayor Harycki Nays: None Possible approval of meeting date change and budget meeting dates for 2013 City Clerk Ward reviewed the recommended meeting changes: replacing August 7, 2013 (Night to Unite) with Tuesday, July 30; replacing November 5, 2013 (School District Special Election) with Tuesday, October 29; and recommended budget workshop dates August 20, 2013, from 4:30 -6:00 p.m.; and August 27, 2013, from 4:30 -10:00 p.m. Motion by Councilmember Weidner, seconded by Councilmember Menikheim, to approve the meeting date changes and budget workshop dates. All in favor. Discussion on Garley concept Community Development Director Turnblad indicated that the new road that will serve the new armory and fire station requires an access onto CSAH 12. The intersection location approved by the County is on property owned by the Garleys. Negotiations for acquisition of the necessary property began quite a while ago. Initially, there was no interest on the part of the landowners to sell, so an eminent domain proceeding was planned. Since the eminent domain process would be much more costly to the City than the actual fair market value of the land, staff reacted with interest when Mr. Garley asked if the City would consider trading the needed land (and additional temporary construction easement) for the two existing homes on the armory site that need to be demolished to accommodate construction of the road. Prior to investing much money in surveying and engineering consultants, Mr. Garley would like to know whether the City Council would be in favor of the proposed trade concept. The two new home sites would require City services and would need to be annexed into the City. Mayor Harycki stated they are great houses and it would be nice to see them moved. He thinks the concept is a great idea. City Administrator Hansen explained that even though the City would still pay the Garleys approximately $25,100 for the property and would be giving up the houses, it would save the expensive cost of eminent domain proceedings and the cost of demolishing both houses. Councilmember Polehna remarked it can be difficult to sell homes for moving. Councilmember Menikheim commented that both parties would come out as winners. Designation of Vice Mayor Councilmember Menikheim nominated Councilmember Polehna as Vice Mayor. Motion by Councilmember Menikheim, seconded by Councilmember Weidner, to adopt Resolution 2013 -08, Designation of Vice Mayor. Ayes: Councilmembers Menikheim, Kozlowski, Weidner, Polehna and Mayor Harycki Page 4 of 6 City Council Meeting January 8, 2013 Nays: None Discussion on Aiple Property Washington County Commissioner Gary Kriesel stated the County is interested in knowing if the City would like to take ownership and maintain the property. Community Development Director Turnblad added that Ms. Aiple is interested in selling her property and having it end up in the public realm. In December the County Board agreed to consider using its Land and Water Legacy Bond funds to pay part of the purchase price and to order an appraisal. They stated they don't want to go beyond the appraisal until the City Council expresses interest in working together on possible funding and operation maintenance scenarios. Eventually it will have to be decided who will own the property and operate it. He asked the Council for direction to continue to explore this and bring back some options. Mayor Harycki noted this is an opportunity for the City to significantly expand its river frontage especially as the trail evolves. Motion by Mayor Harycki, seconded by Councilmember Menikheim, to express interest in the concept, with the City taking lead management of the property. All in favor. The City Code does not require a public hearing for this application for several reasons. But, to err on the side of caution, a hearing has been set. Specifically, City Code Sec. 32 -1, Subd 4(1)b3 states that only administrative (i.e. staff) review is necessary if the plat is not creating a new parcel and the resultant platted lots are not being reduced below minimum standards. • The property is already platted into lots. • The replatting does not create additional buildable lots. In fact, redrawing property lines will result in fewer lots. • The Balay lot (Lot 2, Block 1, SPGLI Addition) increases in size from 9,098 square feet to 9,344 square feet. Also, Sec. 31 -1, Subd 4(3) states that if the Subdivision Code does not specifically address a land division scenario, and a new building site is NOT being created, then the proceeding can still occur without a public hearing, but the City Council must approve the land division. The land transfer to Balay that is accomplished by this replat was approved by the City Council in 2009. Currently the Planning Commission has the authority to approve most SUPs. On October 16th the City Council heard the first reading of the proposed ordinance amendment and requested that the language be altered. Specifically, the requested changes were to make the ordinance apply to SUPs in general (not specific to roof top patios), and that the Planning Commission would continue to review and issue most Special Use Permits except when accountability or unusual public safety concerns arose. At the January 14th Planning Commission meeting the Planning Commission unanimously recommended approval of the revised draft of the ordinance. DISCUSSION The revised amendment is as follows (changes in red): Sec. 31 -207 Special Use Permit and Conditional Use Permit (c) Procedure. Issuance procedure is as follows: (1) The planning commission is authorized to issue special use permits and conditional use permits for all uses designated in the district regulations of this chapter as permitted by a special use permit or conditional use permit. 1 However, on the rare occasion when accountability 1 For conditional and special use permits in the CA, General Commercial Zoning District, Floodplain Overlay District and the St. Croix River Overlay District, the city council shall be the final decision authority. (3) In conducting the criminal history background investigation in order to screen employment applicants, the Police Department is authorized to access data maintained in the Minnesota Bureaus of Criminal Apprehensions Computerized Criminal History information system in accordance with BCA policy. These two roads will be reconstructed similar to the project on Third Street South in 2012 with new pavement, curbs and sidewalks. The county will pay for a majority of the project, but according to their cost participation policy, a portion of these costs will charged to the City. It proposed that these costs be assessed to the affected property owners on these two street segments. In order to do so, the City will need to follow 429 process and this begins with a feasibility study RECOMMENDATION It is recommended that Council approve the authorization to do a feasibility study for the 2013 County Road Improvement Project for Orleans Street from South Fourth Street to Fourth Ave South and on 62nd Street from Osgood Avenue to Panama Street Improvement Project. ATTORNEY - a. Park Dedication -The consensus of the Board had been that the park dedication fee should be $2,500 per lot. There was discussion of how the equivalent land value would work. Local Water Management Plan -The Planning Commission had reviewed this Plan at their last meeting and made a few minor changes. (5 ayes) 8. ENGINEER - a. 2013 Overlay and Seal Coat Projects - Engineer Paul Pearson reviewed the maintenance program. The overlay projects could go out for bids at this time. With respect to seal coating, Paul Pearson had checked with the City of Stillwater and found that they are waiting until the results of the MNDOT study on why roadways are deteriorating on seal coated streets has been completed. He suggested that we also wait until the results are known. An advantage of waiting until 2014 would be that we would then have a larger project which we could bid on our own. M /S /P Johnson /Hiniker moved to advertise for bids relative to Arcola Court and that part of Arcola Trail from Highway 95 to just beyond Arcola Court as determined by the Engineer. No dogs were impounded in December and one was impounded in November where the owner picked up the dog and paid the fees. b. Hillcrest Animal Hospital - They are raising their fees, but not significantly. We only pay fees if the owner does not pick up their dog. c. Initial Complaints - There were 919 initial complaints in 2012 compared to 802 in 2011 and 769 in 2010. Steve Nelson will have more information at the Annual Meeting. 10. CLERK - a. Township Dinner - The dinner will be on Tuesday, February 5th, at the Outing Lodge, with a cash bar at 5:30 and dinner served at 6:00. b. MCDONALD PROPERTY - Jane Harper, Washington County Legacy Program, has requested a letter from us indicating our willingness to accept ownership of a 5 acre parcel to serve as access to the lake on the McDonald property. PARK COMMITTEE - They should be asked to look into what might be needed at the new McDonald Park if the Legacy Program purchase goes through. If it does go through, there should also be a neighborhood meeting. 13. LEADERSHIP TRAINING - This is scheduled for Tuesday, February 12th from 6:00 to 9:00 with a box lunch at 5:30. The topic is how to be an effective leader in a small community. The contract will follow. PARK ACUISITION - David Johnson reported on meeting with respect to possible park acquisition through the County Legacy Program of the approximately 17 acres on the SE corner of Highway 96 and County Road 15. If Washington County accepts this as part of their Legacy Program, they would pay no more than 50% of the land cost and nothing for improvements. The land is currently owned by Central Bank. The consensus was to have David Johnson discuss the possible land acquisition with Central Bank. David Johnson will discuss this with the Park Committee at their next meeting. 15.
