HomeMy WebLinkAbout1056 Ord (Bldg Permit Time Limits) ORDINANCE 1056 AN ORDINANCE AMENDING CHAPTER 33 OF THE STILLWATER CITY CODE The City Council of the City of Stillwater does ordain: 1. AMENDING. Section 33-1 is amended by readopting a provision that was stricken by mistake. The provision will read as follows: Section 33-1, Subd. 3 — Time Limits (1) All residential structures shall have the exterior finished within one hundred twenty (120) days of the date their permit was issued. (2) Every permit of any kind issued by the Building Official shall expire by limitation and become null and void if the building or work authorized by such permit is not commenced within ninety (90) days from the date of such permit or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of ninety (90) days. Before such work can be recommenced, a new permit shall be first obtained to do so, and the fee shall be one-half of the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work; and provided further that such suspension or abandonment has not exceeded one (1)year. (3) Any permittee holding an unexpired permit may apply for an extension of the time within which he may commence work under that permit when he is unable to commence work within the time required by this section for good and satisfactory reasons. The Building Official may extend the time for action by the permittee for a period not exceeding ninety (90) days upon written request by the permittee showing that circumstances beyond the control of the permittee have prevented action from being taken. No permit shall be extended more than once. 2. SAVING. Except for the change, the City Code will remain in full force and effect. 3. EFFECTIVE DATE. This ordinance will be in full force and effect from and after its passage and publication according to law. Enacted by the City Council of the City of Stillwater this 18th day of December, 012.
