HomeMy WebLinkAbout2012-111RESOLUTION 2012 -111 RESOLUTION ADOPTING ASSESSMENT FOR TREE REMOVAL WHEREAS, a request by Jay R. and Joanne I Radke was made for action of the City to remove a large cottonwood tree at the Owner's property at 2541 Hidden Valley Lane; and WHEREAS, that request and an agreement of assessment and waiver of irregularity and appeal has been approved by the City Council on July 3, 2012; WHEREAS, said agreement has been signed by Jay R. Radke and Joanne I. Radke; and WHEREAS, the property is described as 2541 Hidden Valley Lane, Stillwater, MN 55082, CROIXWOOD FIRST ADD Lot 6, Block 7, Parcel No. 32.030.20.22.0006 and the amount to be assessed is $1,295 plus any tax and fees. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER, MINNESOTA: Such proposed assessments, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Property owners may at anytime prior to certification of the assessment to the county auditor, pay the entire assessment on such property, with interest accrued to the date of payment, to the City of Stillwater Treasurer. NO INTEREST WILL BE CHARGED IF THE ENTIRE ASSESSMENT IS PAID BY NOVEMBER 15, 2012. If the assessment is not paid by November 15, 2012, accrued interest from the date of the adoption of the assessment roll through December 31, 2012 will be added with the first installment due in 2013. If payment is not received by November 15, 2012, the amount listed above will be collected over a 5 -year period with interest added at 4.5% per year on the unpaid balance. The yearly installments will be collected with the property taxes that are paid to Washington County. At anytime thereafter, prior to November 15th of any year, pay the remaining principal balance (in whole or part) to the City of Stillwater. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes. Adopted by the Council this 17th day of July, 2012. ATTEST: Diane F. Ward, City Clerk
