Commissioner Lieberman called the meeting to order at 7 p.m.
Present: Commissioners Lieberman, Eastwood, Hark, Johnson, Peterson, Tomten and
Kraske

Approval of Minutes. Due to damaged tapes, the June 2, 2003, Heritage
Preservation Meeting minutes will be discussed at the end of the meeting.
Discussion: Amy Mino — Executive Director of Minnesota Landmarks will discuss the
2007 Conference of the National Trust for Historical Preservation will be held in the
Twin City area.
Case No. DR/03 -17. Design review of signage, sales trailer and parking for Terra
Springs Condominium project, as well as relocation of the existing monument, located
at 608 North Main Street. Brian Sweeney, applicant.
The applicant will be requesting a variance to the Sign Ordinance at the July 14, 2003
Planning Commission meeting. It is the charge of the HPC to review and approve the
design of the sign requested. They are proposing an 8' high by 30' long identification
sign that will be attached to the fence facing north Main Street. It will have the name of
the project, Terra Springs, the location, a phone number and the web site on it. The
background will have graphics of the project, along with graphics of Downtown
Stillwater (see photo).
The sales trailer is located on site at the time of this report. An existing driveway will
be use for access to the trailer and there will be parking for approximately 4 — 5 cars
perpendicular to Main Street. Landscaping will be discussed at the meeting; along with
re- location of monument.
Mr. Sweeney said that they actually had couple of items for discussion tonight. They
include the requested sign variance and also Jack Buxell, the architect, would like to
present some options for moving the monument. Mr. Sweeney also introduced Evelyn
Tidlow, who is with URS, a registered state archeologist, and she will present the
proposal to monitor the construction from a historic perspective.

Discussion followed regarding the length of the frontage of the property and the size of
the sign (240 square feet) relating to the length of the frontage. There is additional
signage that would be taken down when the requested sign is approved.
Motion made by Commissioner Johnson, seconded by Commissioner
Hark to approve the sign located on the fence and that the 2nd
construction sign be relocated either north or south of the main sign on
the fence. All in favor with the following conditions:
1. All revisions to the approved sign shall be reviewed and approved by the Heritage
Preservation Commission.
Evelyn Tidlow of URS, responded to the Heritage Preservation Commission's request to
have mitigation measures for impacts to historic resources. In particular, Ms. Tidlow
addressed the request that a state archaeologist to ensure that the development
proceeds within the appropriate historic framework and the significant finds found
during construction can be properly addressed. That seems to be the most immediate
need for the Terra Springs as the hope to break ground very quickly.
In reviewing what was done previously, URS /BRW has a cultural resource group. There
are five archaeologists and four architectural historians on staff. Ms. Tidlow has
proposed that they will be out there monitoring during construction primarily to assist
the construction crew to start with and avoiding any impacts to the oldest part of the
site. That seems to be the most significant. Ms. Tidlow has suggested that the size
and complexity of what is anticipated out there based on the Phase II work that was
done and the time spent on the site, is that we will be seeing a lot of complex wall
interaction and a series of building episodes happening. One of the proposals
suggested was the video taping of the construction when clearing the site and as it is
moved from area to area to get an idea of the complex site and how it evolved over
time. Assistance will be needed for the video taping. Still photography will also be
taken.
Ms. Tidlow doesn't feel that, based on what was previously excavated, they do not
anticipate a huge number of artifacts that would be deemed significant. They found
very little beyond building debris. They will probably not collect many artifacts.
Construction would be stopped briefly to take photographs. If anything of significance
is found, Terra Springs would be contacted.
These are initial recommendations and would like some feed back.

Discussion followed regarding the amount of time needed if something significant is
found and who decides what is significant. A privy or a well would be deemed
significant and any finds pre - prison would also.
Recommendation Commissioner Johnson to have Commissioner Peterson as the
official liaison with regard to archeological artifacts and determining whether they might
be significant when the question arises and to be made available to the archeologist
and the developers as the project goes forward or if there is something that is wanted
to add to the Warden's Museum collection as the excavations are made. This way the
City can feel comfortable that there is a connection back to the HPC. A stop work time
window of 48 hours be given if artifacts or architectural features are found that appear
significant by the URS staff that there is an opportunity for a 48 hour stop work so that
Commissioner Peterson.
Jack Buxell commented that an effort was made in that they did dig and scratch the
ground all over the site and they found old foundations that were expected. Mr. Buxell
had a concern about stopping work within reason. He would like to be included in the
decision making process. There is a primary area of concern and a secondary area and
there is a difference of what is found in the southeast corner of the site and the
construction in that area then in the rest of site. Mr. Buxell wanted to know if there was
a way to define what is significant.
In response, Commissioner Johnson said the site is a large site so there is a lot of other
areas to continue to excavate and work as maybe one spot is looked at a little closer it
is not a small site that is being developed. The southeast corner there is concern.
There is a suspicion of a disposal or dump site that may have been picked up and may
have a lot of interesting information. You don't know what you are going to find and
what the significance maybe as part of archeology and trying to give a definition as to
what is significant until it is found is hard to do. Evelyn Tidlow and her team be the
stewards of significance in consultation with Commissioner Peterson.
Motion by Commissioner Johnson, seconded by Commissioner Eastwood that
artifacts or architectural elements or historic items of significance have stop work
for up to 48 hours based on discretion of URS /BRW staff with the concurrence of
Brent Peterson who would be representing the HPC. All in favor.
Mr. Sweeney said that Evelyn Tidlow was going to join them on their task force group
when they meet next which they will discuss interpretive trail, status of the wall, the
proposal from Bahr which the city staff has endorsed.

Mr. Buxell has one other issue regarding the monument. The existing historical marker
is part of this area and there is a sewer and water line that goes directly through and
underneath it and it is in the way of the roadway so one of the first things is where we
to put it and what we do with it. It can be moved in one, two or three pieces. All of
the stone is remnants of the prison building.
Considerable discussion on location of historical marker and the exposure to the public.
One location is on the interpretative trail and other is as an entry element to the site. Is
it going to be a major feature of the site. It was felt that it would get lost on the
interpretative trail. It needs to be accessible to the public and kept as a whole.
Commissioner Lieberman recommended to defer to the architects and the developers to
find an appropriate location for the monument the preference is that the monument be
taken in its entirety.
Commission Lieberman expressed appreciation that we are fortunate enough to be
working with developers and architects who have consistently shown the highest regard
for the historical elements of the site is worth everything.
Discussion regarding the trailer. The hours are 1 p.m. to 6 p.m. Tuesday through
Sunday. The trailer will stay in place until the following year. One option is to move
the sales office into the retail center.
Case No. DR/03 -34. Design review of signage for the Desch Building. Mark
Desch, applicant.
The applicant is requesting design of an expansion of an existing monument sign. The
existing monument sign is 45" by 64 "or approximately 20 square foot sign. The sign
ordinance for the CBD zoning district permits up to 30 square feet on a six foot high
monument sign. The proposal is to add a 1 foot by 5 foot sign at the top of the
existing sign. The proposed sign will have backlit lettering. The sign is within the
permitted requirements of the CBD zoning district. Colors will be discussed at the
meeting.
The applicant was present and said that this is a resurrection of something that was
started on two years ago. The applicant is requesting a 1 x 5 backlit sign on top of the
current monument it will be bolted on top with the name and logo and to use the
company colors.

Commissioner Lieberman said this was a far better approach then previously discussed
at a previous meeting. This sign plan maintains the integrity of the building.
This back lit is lit from the back of the sign and is not translucent. That is imperative
that it is not translucent.
Motion by Commissioner Johnson, seconded by Commissioner Peterson to
approve the sign as submitted. All in favor with the following condition.
1. All revisions to the approved plan shall be reviewed and approved by the Heritage
Preservation Commission.
2. No additional signage.
3. No internally lit signage.
4. Sign will be lit with with bracket lighting from top shining downward.
Case No. DR/O3 -35. Design review for an awning and signage for Chives
located at 114 Chestnut Street. Jeffrey Dahl, applicant.
The applicant is requesting design approval for a 6 to 7 foot long awning over the front
door area, going further to the west of the front of the building to incorporate the
menu sign on the wall. The awning would be black with purple or green stripe at the
edge of the valance. It will have the same pitch as Water Music next store.
The sign for design review is the existing sign of the former business repainted. It is
located on the front of the building. The sign is 2 feet by 10 feet and will have a white
background with the word "Chives" in black lettering. The boarder and the chive
graphic are dark green and purple. The awning and the sign will not be lit.
Commissioner Lieberman welcomed the new restaurant owner.
Mr. Dahl was present and said that the sign is going to be above the awning on the wall
and will be mounted just below the second window above the door and centered over
the door as well as the awning.
The Brunswick sign will remain and not interfere with the awning.
Discussion on the white background. Applicant would like to keep the white
background.

Discussion on lighting. No lighting has been proposed. Applicant said she would like
to use a goose neck lighting.
Motion by Commissioner Johnson, seconded by Commissioner Tomten to
approve application as submitted with the added conditions of Numbers 6
through 9. All in favor with the following conditions.
1. All revisions to the approved plan shall be reviewed and approved by the Heritage
Preservation Commission.
2. Awning will not be lit.
3. No additional signage.
4. Structural elements of the awning shall be at least eight feet above the sidewalk.
5. The awning valance shall be at least seven feet above the sidewalk.
6. Lighting shall be permitted and it shall be a down lit, shielded fixture.
7. Lighting fixture shall be submitted to staff for approval.
8. Pitch shall match that of Water Music.
9. Sign background color of white shall be submitted to staff for approval.
Case No. DR /03 -10a. Design review of signage for Kwik Trip and car wash
located at Liberty Village. Scott Teigen, applicant.
The applicant presented to the committee the project at the February 3, 2003 HPC
meeting. At that time it was noted that a sign package and a lighting plan would be
submitted at a later date. Attached for your review and approval are the signage
package and the lighting plans for Kwik Trip, the mail center and the car wash. The
Liberty Architectural Review Committee is currently reviewing the signage package, if
they have substantial comments, the applicant will need to present them to the
Commission.
Mr. Tiegen passed out a hand out that had more updated information that is the result
of the Liberty Architectural Review Committee. The review committee approved the
signs with out conditions. However, a comment that any minor "tweeking" of sign
color and exterior changes are authorized to city staff and ARC approval.
The changes are architectural changes. There is an addition of a third cupola to the
building. This is needed because of ventilation. Also, because of a grading problem, a
rod iron fence is an option to be installed.
Commissioner Tomten said that they were looking at other ways to solve the problem

other than installing a fence.
A service door with a deck with a wrought iron railing is another addition. This is a
safety issue.
The lighting and landscape plan were discussed. The lighting is contained. The
lighting is on the buildings and the canopy. A spot light will be used on the signs.
The Commission and the applicant went through the updated sign package. The
monument sign was presented as 14 x 14. Discussion followed on the size of the
monument sign. Applicant and Commission chose to cut the monument sign to half
which would be 7 x 7.
Discussion on roof pitch with the canopy over the pumps as well as the building and
the the wall signs because it is on a pitched roof have to stand out on brackets when
you mount them on the roof. It makes for a little bit more clutter and little busier look
when you have signs standing from the roof. There is quite a bit of signage that
becomes a bit redundant and doesn't have quite as much need or emphasis because of
the signs on the highway and the monument sign coming in. At that point, once you
turn into the driveway, you know you are coming into convenience store. Identification
needs become less. Kwik Trip identified over the main entrance definitely, ice,
groceries, car wash those things identify features within the site but the continuous
reuse of Kwik Trip doesn't really add anymore information and tends to clutter.
Removal of the two signs on the sides of the canopy and with the reduction of the
monument sign, helps.
Lighting plan was discussed. The fixtures are flush mounted.
Deck off service door will only be out about 3 feet with the wrought iron fence. Mr.
Tiegen said they are really trying to screen the service door and keep it safe.
Commissioners suggested looking at a wood picket type versus metal.
Motion by Commissioner Johnson, seconded by Commissioner Eastwood, to
approved the new sign and layout package submitted at tonight's meeting
with the following conditions. All in favor. Commissioner Tomten abstained.

2. No additional signage.
3. The monument sign on Settlers Way shall be reduced to approximately 7 x 7 total
height that includes the supports and to the top ridge of the canopy over it.
4. Third cupola shall be added to the retail building.
5. Railing on second floor to be picket.
6. A sign be it wood or iron stake if needed to be used on the northeast side for the
grade separation along the elevation of the building as well the small balcony and
canopy on the north end of the building.
7. The gas pump canopy signs that are on the two sides facing the car wash and the
retail store shall be eliminated.
8. The lighting under the canopy be flush, ceiling mount lighting as submitted in the
original package and be adjustable.
Case No. DR/03 -36. Design review of outside seating for Acapulco
Restaurant located at 1250 W. Frontage Road. Chris Novak, applicant.
The applicant is requesting design review and approval of a 1,200 square foot outdoor
patio for the Acapulco Restaurant. A 31/2 -foot wrought iron fence will surround the
proposed patio. The entrance to the outside seating will be through the restaurant;
there will be no exterior entry or exit. Lighting for the patio will consist of four eight to
nine foot pole lights, goose neck lighting on the walls and some sconce fixtures at the
door into the restaurant.
Mr. Novak presented the application package. The seating would 13 tables evenly
spaced four seating per table.
Commissioners commented on how the overall plan softens the store front and makes
it more attractive. It also helps a lot with the parking.
City staff will refer to the fence ordinance in regard to the height of the fence.
Motion by Commissioner Tomten, seconded by Commissioner Eastwood to
approve the accept the application as presented with additional conditions. All in
favor.
Conditions of Approval:
1. All revisions to the approved plan shall be reviewed and approved by the Heritage
Preservation Commission.
2. Landscape plan to submitted and reviewed by staff.
3. Fence to be 6 to 7 feet in height.

Case No. DR/03 -37. Design review for signage for The Grotto located at
402 South Main Street. Wayne Cullinan, applicant.
The request is for design review and approval of signage that will replace the Buona
Sera signage. The applicant states in the attached letter that " Buona Sera" has been
deemed illegible and they want to rename their restaurant "The Grotto ". It will be
constructed out of welded and formed aluminum, painted in matt finished lettering in
deep burgundy color with a sand beige trim. A soft white will emanate from behind
the letters to accent the name at night. The existing goose -neck fixtures will also be
used.
Motion by Commissioner seconded by Commissioner
to approve the package as submitted with the following conditions. All in favor.

Case No. DR/03 -38. Design review of signage for Willoughby's Arts &
Antiques located at 224 East Chestnut Street. Robert Cullen, applicant.
The request is for design review and approval of an 20" x 168" wooden exterior sign
for the above business. It will be the same size as the current sign that is being
replaced. Colors will be white lettering on a dark forest green background with white
trim. The sign will not be lit.
Commission discussed the comparison of the size of the sign at O'Brien Photography.
The desire is to have them at a similar height or at least close enough not to be
noticed.
Motion by Commissioner Johnson, seconded by Commissioner Hark to approve
the application as submitted with the following conditions. All in favor.
Conditions of Approval:
1. All revisions to the approved plan shall be reviewed and approved by the Heritage
Preservation Commission.
2. No additional signage.
3. The size of the sign is limited to 20 square feet.

Case No. DR/03 -39. Design review of signage for Family Means located at
1845 Northwestern Avenue. Brian Larson, representing applicant.
The applicant presented the plans for Family Means at the March 4, 2002 Heritage
Preservation meeting. The sign was not part of that package. The proposed 55 square
foot sign will be a 6 foot by 11 foot monument sign, constructed on a 1'6" high brick
base that is the same brick used on the fagade of the building. It will be internally lit.
Colors are white lettering on a steel gray background.
Motion by Commissioner Tomten, seconded by Commissioner Peterson to accept
the application as conditioned with eliminating condition number 3. All in favor.
Conditions of Approval:
1. All revisions to the approved plan shall be reviewed and approved by the Heritage
Preservation Commission.
2. No additional signage.
Case No. DR /03 -40. Design review of site plan, signage and trash enclosure
for Movie Gallery located at 1798 Market Drive. Kim Jacobsen, KRJ
Associates, applicant.
The request for design review and approval is primarily for the site plan and the trash
enclosure. Signage was approved at the May 5, 2003 Heritage Preservation
Commission meeting. The attached site plan basically shows the same layout as what
is currently out there now, with two exceptions, the trash enclosure at the back of the
building and the second renovation to the existing plan is the proposed tenant outdoor
patio, located on the southeast side of the building.
The trash enclosure with match existing block and color of the building. The opening
will be color chain link fence system with slats. It will not be covered.
Jeff Brier also being presented is the Dunn Brothers drive through lane and the location
of the rear door and the new front entrance.
The Movie Gallery is one occupant and the Dunn Brothers is the second. The Movie
Gallery currently has 8,000 square feet and would like to reduce that to 6,000 square
feet and allow Dunn Brothers to take the west 2,000 square feet.

The signage for Dunn Brothers will be submitted at the next HPC meeting.
For clarification there is no additional lighting on the drive through side along Hwy 5,
there will be a menu board and just a small window with no canopy or anything as far
as the pick up window. There will be a sign that says "drive through ".
Discussion followed regarding the shared driveway.
Motion by Commissioner Johnson, seconded by Commissioner Eastwood to
approve as submitted with conditions of approval and that the applicant will
come back with a sign package. All in favor.

Case No. DR /03 -41. Design review of building modifications at 221 East
Chestnut Street. Mary McElerry, representing applicant.
The applicant is requesting design review and approval of building modifications and
signage directory for tenants on second floor. The building modifications will consist of
removing and replacing the rotted wood on the front fagade and repainting the
turquoise paint a beige color. There are two coal chute doors under the front window
that will be painted a bronze color. The brick work in the entry way is disintegrated
and needs to be replaced.
The sign is for the business on the second floor, it would be a directory sign and will be
placed on the right side of the exterior entry way.
Ms. McElerry was present. The directory sign will be placed on the right side on the
way in. The sign will only be 15 x 23 inches.
The front boards are rotted and were looked behind and two coal chute doors were
found so they would like to paint a beige color rather than replace the boards. The
coal chutes would be black and bronze. The metal sheeting of the ceiling it would be
replaced with pressed tin then paint that the same color as the coal chutes. A
galvanized tin would be used. The trim of the door will be a deep bronze. The brick is
disintegrated and will be replaced with the same type of brick. The windows on the
second floor, the exterior trim is in need of paint. It will be painted either deep bronze
or tan. There are 13 windows will trim. The metal on the parapet will not be painted.

The brick on the second floor will not be painted. The parapets could be recast in
fiberglass.
The tin work on the building is unique and the headers over the windows are metal
also.
Motion by Commissioner Johnson, seconded by Commissioner Eastwood with
some noted clarifications. One is that the tenant sign is located on the sidewall
of the east door facing to the west and paint colors as submitted with the dark
bronze around the window trims on the 1st and 2 "d floor the lighter beige on the
parapet. No work is proposed on the 2nd floor headers or upper roof parapet at
this time and the tin be replaced on the easterly entrance to match as close as
possible that will remain in the westerly entrance ceiling and the floor tiles to
replaced at the applicants discretion a preference towards a smaller ceramic tile.
All in favor.
Conditions of Approval:
1. All revisions to the approved plan shall be reviewed and approved by the
Heritage Preservation Commission.
2. No additional signage.
Case No. DR/03 -42. Design of exterior sign revision for office building
located at 2000 Industrial Blvd. Jennifer Cates, applicant.
On May 5, 2003, the Commission a signage package for the building above. The
applicant is requesting a revision to the approved sign. The proposed sign would be
two double sided 4 foot by 6 foot signs. These signs would be supported win cedar
posts, height of sign will be determined before the meeting The sign would be white
vinyl with a graphic of a hockey player with white text outlined in blue. The sign would
be lit with two ground lights, one on each side of the sign. Locations of the signs are
shown on the attached site plan.
Ms. Cates was present and only wants to do on the Industrial Blvd 4 x 6 double sided
sign. Then because this facility is located in the back, a smaller directional sign is
needed. The directional sign is to be 4 square feet maximum.
The main sign is to be an off white background with a band or boarder around the
edge.
Motion by Commissioner Johnson, seconded by Commissioner Peterson to
approve the application with the following conditions. All in favor.

3. Light fixture to be approved by city staff.
4. Lighting should be attached to the sign at the top and shine down on sign.
Commissioner Eastwood suggested that a letter of commendation be sent to the
Stillwater Police for the new paint jobs on the new patrol cars.
The parking structure being contemplated on the Water Street behind the co -op is still
very much alive and proceeding at pace and appears to be gather some momentum. It
is part of the Livable Community Grant which includes flood wall, trail and plaza and
the parking structure. The City has contracted with SEH to come up with some
architectural renderings of what it will look like, some elevation views from Main Street
out towards the river just to see how much of an impact the height and scale will have
on the view shed which is the primary concern. Also, part of the study is to look at a
parking structure behind Johnny's TV, in that area, as well as potential some parking,
two level, just north of the Lumber Baron's as other parking options. It will be a three
or four phase process of development. One is to get some design professional in on
some meetings. Then to have business owners in the downtown area and have public
input.
Any type of parking structure on Water Street will have an impact on the view shed.
The Heritage Preservation Commission should be thoroughly involved and have a
significant role in the historic downtown from the inception.
Discussion on dumpsters located at the Winery and why they aren't enclosed.
Discussion on Rivertown and a new sign. HPC has design review over that. Staff will
contact the owner and have them in for review at the next meeting.
Discussion followed regarding the June 2, 2003 minutes.
Discussion of bridge project.
Motion by Commissioner Lieberman, seconded by Commissioner Johnson to
adjourn at 10:15. All in favor.
