Commissioner Lieberman called the meeting to order at 7 p.m.
Present: Commissioners Lieberman, Eastwood, Hark, Johnson, Peterson, Tomten and
Kraske
Others: Sue Fitzgerald, City Planner
Approval of Minutes. Motion made by Chairperson Lieberman, seconded by
Commissioner Johnson to approve the June 3, 2003 and July 7, 2003 Heritage
Preservation Commission minutes. All in favor. Motion passed unanimously.
Discussion Items.
The Mortgage Company. Rick Wells was present to discuss changes on the previously
approved plans for the Mortgage Company. The plan changes the wall from 80 feet to
approximately 48 feet. It will be less than what was proposed. The wall will be spray
painted to match the limestone on the other side of the lot and, if the Commission
would be in favor of, putting on cultured stone to match the limestone wall on the west
side of the property. The wall would not be seen from Chestnut Street. It is the wall
behind the veterans building.
Motion by Commissioner Johnson, seconded by Eastwood, to
accept the changes presented. All in favor.
Annual State Preservation Meeting discussion. Amy Mino, Executive Director of
Minnesota Landmarks which is a nonprofit organization that manages the Landmark
Center in downtown St. Paul, was present to discuss the conference that is to be held
in the year 2007. Minnesota Landmarks was interested in bringing the National
Preservation Conference to St. Paul because of the opportunities to show off the
Landmark Center and the restoration effort as well as to show off the exceptional
historic resources in the Twin Cities region.
In the interim years before the conference, they are all working on trying to solidify the
base for preservation in Minnesota. Ms. Mino was present to have the commission start
thinking about the conference and about what Stillwater might want to do for the
conference. Stillwater will probably have a prominent place on the agenda for the
conference because of its proximity and the wonderful things done as far as historic
preservation.

There is a local steering committee of about 20 people and these are the people that
worked on the bid proposal. There will be a broader advisory committee as that is
were representatives from the HPC's around the area getting involved. Commissioner
Lieberman has been invited to the initial brainstorming meeting scheduled in January
2004.
Background materials and Ms. Mino's business cards were left for further information
and if there were any questions or ideas to pass on.
Commissioner Johnson commented that this is a real good opportunity for Stillwater to
maximize the potential because it will most likely be a travel spot for one of the tours.
The Chamber has been contacted regarding the potential for Stillwater.
Commissioner Lieberman commented on Ms. Mino's efforts and commended her on her
efforts in getting the conference to Minnesota. She was invited to stay and here about
the Territorial Prison Site project which will be complete by 2007 and might be
something of interest because it combines new and historic.
Case No. DR/03 -43. Design review of Terra Springs before Planning Commission
meeting of August 11, 2003, Final PUD submittal located at 608 North Main Street,
Brian Sweeney - Frauenshuh Sweeney and Jack Buxell, applicants.
The applicants' are requesting final design review for: Site plan, landscape plan,
lighting plan for Buildings 1 and 2 of the Terra Springs project.
The Planning Commission will review the project for final PUD submission at the August
11 meeting.
The project will include 227 units, or approximately 29 units per acre, underground and
surface parking, retail, and an Interpretive Center. The project planned in three
phases:
Phase 1: Buildings 1 (18 units) and 2 (40 units). Final PUD submission July 2003,
Construction beginning Fall 2003, Completed Late Spring /Summer 2004
Phase 2: Buildings 3 & 4. Final PUD submission: Late Fall 2003: Construction
beginning Spring 2004; completed December 2004.

Phase 3: Building 5: Final PUD submission: Summer 2004: Construction
Fall 2004; Completed Summer 2005.
The materials used for Buildings 1 and 2 will consist of fiber cement board siding, brick
and stone. The upper 2/3's of the building is fiber cement board siding with the lower
1/3 of the buildings being brick and stone. Total on -site parking is 513 spaces. The
schedule for the landscape plan submitted is not complete; the initials on the site plan
need to be identified, along with quantity of each plant material. The elevation plans
show roof top units shielded with a parapet wall. The units need to be under the roof,
completely shielded.
The entrance monument sign is 41/4 feet high and 21 feet long. The base and the
background behind the name "Terra Springs" is stone. In order to eliminate lighting
the sky, it is staffs recommendation that the monument have the lighting fixtures at
the top of the sign, lighting it in a downward fashion.
The applicant will bring cuts of all the lighting fixtures to the meeting. They will discuss
the existing historic monument also at the meeting.
Jack Buxell was present to discuss the moving of the monument. It will be included as
part of the linear central green. The site development work is all in the process of
being bid out final awards will be made within the next 30 days or so.
Building 1 and Building 2 are on the agenda for discussion. The overall site plan was
submitted so the commission could see how it all was tied in to each other and the
definition of the building line.
Commissioner Lieberman asked Mr. Buxell to show were the public access would be.
Mr. Buxell said there would be a central green that would be open to the public which is
going to retain the remains and that which is left from the fire. There will be a
reflecting pool in what was the crawl space of the original building, the factory building,
and then the remainder of the factory building some of it will be taken out, but portions
of it will remain and a flower garden will be created which will also be open to the
public. The warehouse building, that which was saved by the fire department, that will
be retained and fixed up and the building will be built on the inside of that creating
court yards between the homes and the brick walls. There will be the archaeological
find which was found a number of months ago is going to be retained and will be part
of a larger interpretative trail which will circle the site as well as go through the site.
The existing sidewalk system will be used and lights out to the caves and to other

elements that will part of the interpretative experience. The interpretative experience
will address not only its historic starting with the Indian events but also coming forward
through the Territorial Prison. But, one of things that should be included is the
geological on the site.
There will be a perimeter drainage system around the site which is going to intercept
water coming up from under that wall and will allow the water table inside the site to
return to its elevation.
There will be permeable roads, pavers on the roads to retain the original historic
character of the site and a sophisticated storm water management system.
Sidewalks are to be pavers. There is a whole sidewalk system around the buildings
almost all of the buildings have walk -ups to the front doors. On the townhouses, the
buildings are a mixture of three story, four, six, four, four story. There is retail as part
of Building 1 and Building 5 and on Main Street and that will be available for either
restaurants or coffee shops or small sundry facilities or offices.
Building 1 has minor changes. There are more stairs and there was a change in the
design of the gable so there are more flats. There are a few more balconies. The
proposal on the brick and siding and stone colors and materials are predominantly the
same. The are spots up inside the roof behind the parapets where the mechanical
units will be tucked and there will be few that will end up on the ground. Noise of the
mechanical units was a concern. The units that will be used are quite. The units
themselves are small. They are sound insulated from the building so there is no
vibration. The units on the ground will be shielded by landscape.
The signage package contains the entrance monument. Individual vendors should
come back through the HPC for approval.,
The back of the entrance monument will become a back drop for the entrance the front
of it will face down the center of the green and the two seating areas will be displayed
and have flower beds both behind it and to the sides. The sidewalk will wrap up and
around.
The lighting package is made up of about seven basic different fixtures. The city has
two street lights on the site. They are the tall down lit box light . They are the same
that run down through the city. In the more developed portion of downtown, there are
two new lantern lights in between each one. So the proposal is to add two lantern

lights between each one of the overhead lights and continue that across the front of
the entire site. The lantern light will be the same as elsewhere in the city.
The same light will be used around the inside of the green which will be on 12 foot
poles so the total height of the fixtures will be about 16 feet as opposed to the city's
fixtures that are around 20 to 22 feet. The other thing is that the lenses are adjustable
so that the shape of the lighting is more elliptical and that is the goal. The other
element of the lighting, the dominant part of the lighting system, is that every stair
there will be a gate and lighting for that stair. The advantage of that is the lighting is
structured so that the lighting is down you don't see the light source.
In the parking areas there will overhead lights similar to the tall lights but much shorter
and characteristic. They will have cut off fixtures and a double- headed unit that will
basically just light to the outside of the parking lots.
Around the perimeter of the site there will be two different types of fixtures, which are
up- lighting. There is a 250 watt up -light and 100 watt. The lighting will be very quite.
There will be lights in the reflecting pool. The existing walls will have up- lighting as
well.
Discussion on the up- lighting and concern about "lighting up the sky ".
Building 1 will be in a soft green and Building 2 will be a blue -grey. The windows will
all be cream colored /almond colored trim. Shingle colors will be earth toned through
out the site. The brick will be red and beige. The goal is to have shaska colored bricks
and to have hand formed brick. The hand rails would be color coated aluminum.
Commissioner Lieberman suggested that a master sign plan be developed for
consistency.
Jack Buxell suggested that some guidelines be developed to go along with the City's
sign ordinance since there will be only three to four retail stores.
The complete sign package will be submitted at the next Heritage Preservation
Commission meeting.
Commissioner Johnson commented that this is the final approval for the first two
buildings.

Motion by Commissioner Johnson, seconded by Commissioner
Eastwood to give final approval of the first two buildings
(Buildings 1 and Building 2) with the following conditions and a
lighting plan to be submitted to staff and a sign plan be prepared
for approval. The lighting regarding the monument sign will be
discussed and considered when the sign package is presented.
All in favor.
Conditions of Approval:
1. All utilities shall be completely screened from public view.
2. All lighting shall be directed away from the street and adjacent properties. Light
sources shall be shielded from direct view and protected from damage by
vehicles.
3. The entrance monument shall have down lighting rather than up lighting.
4. City Planner shall review and approve the Landscape Plan
5. All landscaping shall be installed before utility release or final project inspection.
No project shall be phased unless approval is granted by the Planning
Commission.
6. Continuous concrete curbing shall be installed to separate parking areas from
landscape areas.
7. Handicapped parking spaces and signage, in compliance with State
requirements, shall be shown on building permit plans and installed before final
inspection of the project.
8. The street address of the building shall be displayed in a location conspicuous
from the public street.
9. All trees required to remain on site, as indicated on the plans, shall be protected
by fencing or other necessary measures shall be taken to prevent damage during
construction activity.
10. No roof equipment shall be visible to the general public.
11. All gutters, downspouts, flashings, etc. shall be painted to match the color of the
adjacent surface.
12. Construction projects shall conform to the City's Noise ordinance. Construction
during the dry season shall mitigate excess dust problems.
13. A sign permit shall be required for all project signs.
14. Grading and drainage plan to be approved by City Engineer before building
permits are issued.
15. Sign package to be approved by the Heritage Preservation Commission, including
directional signs.
16. Exterior lighting plan to be reviewed and approved by the Heritage Preservation

Commission.
17. All security lights on building shall be downlit.
18. A sign permit is required for signage.
19. All exterior modifications to the approved plan are to be reviewed by Community
Development Director.
Case No. DR/03 -44. Design review of an awning and signage for Dunn Bros. Coffee
located at Stillwater Blvd and Curve Crest Blvd (Part of the old Video Update). DJR
Architecture, Inc., representing Dunn Bros. Coffee
The applicant is requesting design review of a proposed black awning to be installed
across the front fagade of the coffee shop and around the corner on the west side to
the drive thru window. The canopy will be canvas and will not have any text on it.
There are existing lights at the top of the building that illuminates the canopy; they will
remain.
The proposed signage for the coffee shop will consist of a sign on the front (Curve
Crest Blvd). This sign will be 1'3" by 21'6" long; it is individual internally lit channel
letter sign with halo lighting behind. The letters will be white; the background will be
tan color. Over the front door there will be a red and black internally lit sign that will
say "Roasted Fresh Daily ". On the west side of the building over the canopy and drive
thru window there will be externally lit (existing light fixtures) black text that says
"Drive Thru Coffee ". The text is 1'4112" high by 16' long.
Kelly Wilcox from DJR Architecture, was present representing Mike and Tami Welsh
who are owners of Dunn Bros. Mike and Tami Welsh were also present.
Ms. Wilcox presented the sign package showing a directional sign on Market Drive, a
sign for the drive through over the back entry, a drive through monument and a drive
through sign on the west side of the building on Stillwater Blvd. and then an awning
along the front of the building.
The proposed design along the back side of the building will be Dunn Bros corporate
signage over the back entry and at the back monument for the drive through. Ms.
Fitzgerald pointed out that the sign ordinance does not allow for signage on the back of
a building when it is not on a street. A sign could be put up on the west side just as
long as the business name doesn't appear on it and it is 2 square feet. The front of the
building has two different options. A simple black awning on the west side and then
along the south side the red piece would be an entry awning that would lean out over

the entry. There are white lights on the building now and they would paint them black
to match the awning. In addition there will be some tables out in front of the Dunn
Bros site in two parking spaces. Next summer they would like to add umbrellas. The
umbrellas would be black to match the awnings.
Motion by Commissioner Lieberman, seconded by Commissioner
Johnson to approve in concept the design package submitted by DJR
and they be referred to city staff with regard sizing issues and other
issues pertinent to the ordinance and because of the double frontage
on Curve Crest and County Road 5, they are eligible to have two signs
that have the name of the business. The other directional signs,
however, cannot. All in favor with the following conditions.
Conditions of Approval:
1. All revisions to the approved plan shall be reviewed and approved by the Heritage
Preservation Commission.
2. No additional signage.
Case No. DR/03 -45. Design review of wall murals for Len's Grocery, located at 101
N. Owens St. Kris Rumpsa, Kenya Designs, representing the applicant.
The applicant is requesting design approval for a mural on the south wall (on the
cement block area) and the on the east wall's cement block at Len's Grocery. The
murals will not be lit. The east wall mural has the grocery stores name on it.
According to the sign ordinance this sign is not permitted. They can the words "Family
Foods" and the hours, just not the name "Lens ". A special use permit from the
Planning Commission is required for murals.
The sign proposed for the west side (front) of the building will replace an existing
internally lit sign. Three "gooseneck" fixtures will light the 2' 1 /2" by 16'4" wooden
sign.
Kris Rumpsa, Kenya Designs, was present on behalf of Len's Foods to discuss the mural
project. She presented a rough sketch with colors.
Ms. Fitzgerald indicated that Len's can have a sign on Myrtle Street and Owens Street
but not on the back.

The new sign would be wood illuminated by gooseneck lighting and would replace the
existing back lit sign that faces Owens Street.
Motion by Commissioner Lieberman, seconded by Commissioner
Johnson to approve the wall murals on the south side of the building and no sign
following conditions. All in favor.
Conditions of Approval:
1. All revisions to the approved plan shall be reviewed and approved by the Heritage
Preservation Commission.
Case No. DR/03 -46. Design review of signage for The Art of Healing Touch located
at 1380 Frontage Road. Donna McDonald, applicant.
The applicant is requesting design review for signage at the new Valley Ridge Mall,
formerly River Heights Mall. The sign is 12" high, it consists of red channel letters on a
raceway. It will say "'Massage Therapy.
Ms. McDonnell, The Art of Healing Touch, made a correction in the spelling of her name
and the address as 1330 Frontage Road not 1380.
The sign will be 12 inches and it will have a painted border and the signs will go above
the border a minimum of 12 inches.
Ms. Fitzgerald said that there are guidelines for the signage and that all businesses will
have to go through design review. Ms. Fitzgerald will get a copy of the guidelines
presented to the businesses and bring to the next HPC meeting.
Motion by Commissioner Eastwood, seconded by Commissioner
Peterson to approve the design for signage as presented with the
following conditions. All in favor.
Conditions of Approval:
1. All revisions to the approved plan shall be reviewed and approved by the Heritage
Preservation Commission.

Ms. McDonnell said that in the case of the banner that was now up and was asked to
have down in 30 days (which was the 4" of August), that it would be down in two
weeks. Ms. Fitzgerald asked the commissioner to give an extension of two weeks.
Motion by Commissioner Lieberman, seconded by Commissioner
Eastwood to grant a two week extension on the removal of the banner.
All in favor.
Case No. DR/O3 -47. Design review of signage for Custom Framing & Art Supply
located at 1250 Frontage Road. Lee Emberley, applicant.
The applicant is requesting design approval of new signage for Custom Farming & Art
Supplies located at the former River Heights Mall, now Valley Ridge Mall. The proposed
sign is red channel letters on a raceway. The upper case letters are 18" high and the
lower case letters are 13" high.
Mr. Emberley presented the request for signage at Custom Framing & Art Supplies.
Commissioner Lieberman commented that commission's goal is to have some level of
consistency and sense of harmony in the design package of the new Valley Ridge Mall.
Motion by Commissioner Peterson, seconded by Commissioner Hark to
approve the signage as presented with the following conditions. All in
favor.
Conditions of Approval:
1. All revisions to the approved plan shall be reviewed and approved by the Heritage
Preservation Commission.
2. No additional signage.
Case No. DR/O3 -49. Design review for signage for Espresso on Third Coffee Shop
located at 150 South Third Street. Mike Rice and Di Hark, applicants.
Diane Hark stepped down as and abstained from voting.
Mike Rice, Espresso on Third Coffee Shop, was present to discuss the design review of
a 3' 1h °by 5" wooden sign for the coffee shop. The sign will have a cream background
with medium green and red lettering. It will not be lit.

Mr. Rice stated that improvements have been made to the property. They removed the
dumpsters located outside and the debris has been cleaned up. The parking lot has
been redone. There is soffit lighting around the building.
Motion by Commissioner Johnson, seconded by Commissioner
Eastwood to approve the signage as presented with the following
conditions. All in favor.
Conditions of Approval:
1. All revisions to the approved plan shall be reviewed and approved by the Heritage
Preservation Commission.
2. No additional signage.
Other Business
Discussion regarding the possibility of a parking structure on Water Street.
Discussion regarding East Half of Churchill Nelson Slaughter Addition Architectural
Survey was tabled until the next meeting.
Ms. Fitzgerald brought up a couple changes on the Kwik Trip project. First, there is less
signage then originally proposed and they are turning the cupulas.
Petco is expanding their grooming area. They are only changing the door location.
The footprint won't change.
The River Heights Plaza is now officially the Valley Ridge.
Motion by Commissioner Lieberman, seconded by Commissioner
Peterson to adjourn the meeting at 9:34 p.m. All in favor.

4. If provided, dining facilities for breakfast shall be available to registered guests
only (not available to the public).
5. No liquor shall be sold on premises. If wine is served, a wine license must be
obtained from the City. (Ord. #768 Adopted 10- 22 -92)
6. One four square foot sign is allowed on -site consistent with the architectural
character of the building (maximum height four feet).
7. Adequate pedestrian scale lighting shall be provided between the bed and
breakfast and parking.
8. No general external lighting of the site that may impact the surrounding
residential area is allowed.
9. The special use permit is not transferable. New property owners shall require a
new special use permit.
10. The bed and breakfast use permit shall be reviewed before the Planning
Commission and City Council for revocation if the Community Development
Director receives complaints regarding the bed and breakfast use.
11. No additional bedrooms can be used for the bed and breakfast. Five bedrooms is
the maximum allowed under the Ordinance.
Special Use Permit for Special Events
1. A maximum of six special events (large functions defined as business meetings,
bus tours, bridal and wedding showers, anniversaries, weddings and wedding
receptions, and church functions over twenty persons allowed per month.
2. All special event visitors shall park on site or a controlled remote location.
3. Limit of groups: 40 capacity as approved unless special approval is obtained
from the City Council.
4. Food must be served by a licensed caterer.
5. All special events shall be over by 9:00 p.m.
6. No open bar on premises for special events. Champagne is allowed on a two -
person /one bottle limit.
7. No outside entertainment or lighting for special events.
8. This permit shall be reviewed upon complaint.
9. Kathy and /or Jerry Helmberger, owners of the property, shall be on site during all
special events. This use is not transferable.
Motion passed unanimously.
Case No. DR/02 -38 Design review of a planned unit development for a 3.67 acre
mixed use residential /office development concept located on Stillwater Blvd
between Curve Crest and Wildpines and east of Parkwood Lane. Tim Nolde,
applicant.
Applicant not present. Consultant of the project gave a brief overview of the
project. Consultant was not sure why this was in front of the Commission tonight
since the land is not in Stillwater. Community Development Director Russell
wanted the Commission to be aware of the project.
