RESOLUTION NO. 2011 -182
A RESOLUTION APPROVING A
RESUBDIVISION OF PROPERTY LOCATED AT
215 ST. CROIX AVENUE WEST
CASE NO. 2011-26
WHEREAS, Paul Nickerson, owner of the subject property, made application for approval of
a resubdivision of his property located at 215 St. Croix Avenue West; and
WHEREAS, the subject property consists of four platted lots that are currently combined
into a single home site and the requested resubdivision would create two home sites from the platted
lots; one for the existing home and a site for a new home; and
WHEREAS, the legal descriptions of the two resulting parcels are:
See Exhibit A; and
WHEREAS, on November 14, 2011 the Planning Commission held a public hearing on the
resubdivision, received no comments from the public, and unanimously recommended approval of the
resubdivision; and
WHEREAS, the requested resubdivision is consistent with the City's Comprehensive Plan,
Zoning Ordinance and Subdivision Ordinance.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Stillwater
hereby approves the requested resubdivision of property with the following conditions:
1. The utility hook -up fees shall be paid to the City prior to staff approval of the deeds for
the resubdivided property, or prior to issuing a building permit for the new site,
whichever event occurs first.
2. The plans for providing sanitary sewer to the new building site shall be reviewed and
approved by the City Engineer prior to approval of the deeds for the new building site, or
prior to issuing a building permit for the new site, whichever event occurs first.

Lots 5 and 6 and all that part of Lot 7 that lies east of the west 16.50 feet thereof; all in Block
5, Willken's Addition to Stillwater, Washington County. Minnesota, together with all
hereditaments and appurtenances belonging thereto, subject to the following exceptions:
conditions, restrictions and covenants of record, if any.

Lot 8 and the west 16.50 feet of Lot 7, all in Block 5, Willken's Addition to Stillwater,
Washington County. Minnesota, together with all hereditaments and appurtenances
