MUSIC IN LOWELL PARK
A Proposal from the Downtown Council
The Downtown Council proposes to host five concerts in Lowell Park this
summer.
Objective: By providing high quality entertainment for residents and visitors, the
Downtown Council hopes to create a sense of an attractive and
inviting downtown community.
Dates:
Wednesdays, August 1,8,15.22.29
7-10 P,M.
Artists: The intent is to schedule a different kind of music each evening,
The programmers are considering jazz, classical, big band,
light rock, reggae, and country western depending on artist
availability,
Funding: We hope to fund the concert series with a mix of sponsorships,
donations, and the sale of 3.2 beer, soda, ice cream, and
light refreshments,
Insurance: Liability insurance would be provided through a rider on the
Chamber of Commerce's policy, Dram shop insurance is
not required with the sale of 3.2 beer.
The Downtown Council requests of the Parks and Recreation Board and the
City Council:
1. Their support of the concept of concerts in Lowell Park
2. The use of the park for the dates listed above
3. A license to sell 3.2 beer and permission to sell refreshments
for the dates listed above
4. Financial support from the City's special events fund
5. The closing of Levy Road during the concerts

Property Owners of historic commercial buildings in Downtown Stillwater are
challenged with maintenance and rehabilitation of their structures. They are
often faced with questions of incorporating new functional patterns and
current technologies, while restoring the historic fabric and character of
their buildings. This workshop will address restoration and rehabilitation
questions as they relate to specific historic buildings, historic districts,
and as they relate to design review.

NATIONAL REGISTER PLAQUE FOR LOWELL PARK.
DISCUSS ION :

The Heritage Preservation Commission made a recommendation
to the Park and Recreation Board and City Council at their
April 4, 1990 meeting to place the National Register Plaque
for the Stillwater Bridge in Lowell Park. The plaque is
proposed for placement at the Chestnut Street entrance next
to the IILowell Parkll sign. The plaque will be mounted on a
free-standing post at a 90 degree position.
The Park and Recreation Board reviewed the request at their
April 24, 1990 meeting. They were pleased with the idea and
stated that this proposed location would be appropriate.
RECOMMENDATION:
Approval to place a National Register Plaque for the
Stillwater Bridge in Lowell Park off the Chestnut Street
entrance.

Dear Mayor and Council Members:
Rivertown Restoration of Stillwater is aware that the City is recommending that the
former church at the comer of S. 4th and W. Pine Streets be razed as a consequence of a
fire there some time ago. Because razing a structure is an irrevocable finality, and the
building's exterior architecture is historically significant and aesthetic to its immediate
location, and it is very unlikely that the replacement structure's exterior architecture
woiuld be historically compatible, we would, therefore, urge that the City ask the
owner(s) to investigate whether the exterior structure is sufficiently adequate to permit
renovation to any use allowable within, or with a reasonable variance, the zoning
regulations there.
It might be that there is so much structural damage that the building is not salvageable,
and razing is the only option. However, we would greatly appreciate that at least some
effort be made to determine whether there is a salvageable use for the structure that
would be acceptable to its neighbors. This approach might also relieve some of the
present burden of the owner(s). If we can be of help in this matter, please feel free to
contact us, and we thank the City for its consideration of this matter.

COMMUNITY FOOD SHELF COMPETITION, May 7 - 11, 1990
The second annual Food Shelf Competition is being held this year from Monday,
May 7 to Friday, May 11, and something new has been added -- there are
prizes. Anyone contributing 40 pounds of food or $20 (each $ is worth 2
pounds of food) will be eligible to be in a drawing for one night plus $50
spending money at the FantaSuite Hotel or a Hot Air Balloon Ride for two
(courtesy of Press On). Also, a traveling tropny will be awarded to the
organization that donates the most "pounds per employee".

The other community participants are School District 834, Allen King
Plant-NSP, IncStar, Inc., First State Bank of Bayport, Lakeview ~emorial
Hospital, and Press On, Inc.
Items to bring: Non-perishable food items -- any canned goods, peanut butter,
jams, soup, tuna, spam, etc. Nonfood items -- toiletry articles, deodorant,
soap, shampoo, laundry detergent, toilet paper, disposable diapers -- and,
Money.
Please bring your donation to City Hall to be recorded and food to be weighed.
As stated above, if the donation equals 40 pounds or $20, you will be eligible
to be entered in a drawing for a prize. Of course, all donations are welcome,
whether large or small. And, let's not forget, that the most important point
of the Foodshelf drive is to help share with our less fortunate neighbors.

CONTRACT
THIS AGREEMENT, made this day of , 1990,
between Junker Sanitation, Inc., a Minnesota Corporation ("Junker"), and the
City of Stillwater, Washington County, Minnesota ("City"):
1. WHEREAS, the City has operated a site on City property for the
drop-off of brush, sticks, trees and pruning refuse; and
2. WHEREAS, in order to facilitate the handling of this material, the
City has purchased a chipper machine to be operated from the site;
THEREFORE, it is hereby agreed as follows:
1. Junker agrees to operate the chipper at the site during the
Saturdays that the City authorizes the site to be open for the drop-off of
material by the public.
2. Junker is authorized to use the chipper to chip appropriate
material that it has collected as part of the City contract, and this use
shall be scheduled by the City Public Works Director.
3. Neither party shall receive any compensation from the other party
as part of this Contract or for use or operation of the chipper.

City of cancellation of the same by the issuing agency.

Informal discussion was held with David Paradeau regarding
enlargement of the Minnesota Zephyr Depot to approximately
three times the original proposed size. The enlargement would
incorporate a log~ing and rail museum as an attraction. Cost
of the building was estimated at $600,000.

The proposed building would require more parking than would be
available at the present site. The estimated time of
completion would be approximately two years. Members agreed
that the City property to the South would be best used as a
shared parking facility with the downtown businesses in the
at~ea.
Council suggested that Mr. Paradeau work with Mr. Russell,
Community Development Director, for the purchase and
development of the depot and the City Attorney, David
Magnuson, was directed to prepare a development agreement for
the pt~r:lject.
Mr. Paradeau requested a first right of refusal if the City
should decide to sell adjacent property in the future.
Council directed the City Attorney to include this in the
development agreement for further consideration.

Holders of parking permits have requested refunds for permits
which were issued prior to the removal of the meters, when the
fee covered the subsequent period.

Abrahamson was ap ointed to the Metro Waste Control
Commission's Gene'al Advisory Committee, and Mr. Kriesel also
informed the coun il that the dump site would be open on
Saturdays between 8:00 A.M. and 12:00 noon. Jim Junker will
have someone avai able at these times to control the volume of
dumping and verif residency.
Mr. Kriesel also "nformed the Council about a meeting
scheduled by the ashington County Board for Wednesday, April
18, 1990 to discu s the Law Enforcement Facilities annexation

Variance to the Parking Ordinance for expansion of a restaurant/takeout
business at 826 So. 4th St. in the CA, General Comm. Dist. Donald Istel,
Applicant, Case No. V/90-15
Notice of the hearing was published in The Courier on March 22, 1990
and copies were mailed to affected property owners.
Mr. Russell addressed the project description and the parking demands for
the proposed restaurant. The neighbors to the north of the facility were
concerned about the exhaust fan noise. It was recommended that the
employees park in the rear and the fan be relocated to the roof of the
building. Mayor Abrahamson closed the public hearing.
Motion by Councilmember Farrell, seconded by Councilmember Bodlovick, to

making of an improvement consisting of sanitary sewer repair, water
services, drainage, street construction and appurtenances located on W.
Mulberry St., between the easterly line of No. Owens St. & the westerly
line of No. Fourth St.; No. Sherburne St., between the northerly line of
W. MYrtle St.. and the southerly line of Linden St.; and No. William St.,
between the northerly line of W. Myrtle St. and the southerly line of
Mulberry St.
Notice of the hearing was published in The Courier on April 5 and
April 12, 1990 and mailed to affected property owners.
Mr. Moore presented a summary of the project, stating th~ total cost is
estimated at $1,062,688, with a total assessable cost of $489,063.14 after
MSA and Water Board participation. The estimated street assessment is
$73.53/assessable foot. He stated the sewers have been televised and they
indicate some damage which needs repair. Construction could begin
approximately the middle of June and be completed in October of this year.
Rodney Nord, 235 No. William St., stated concerns about the amount of
heavy traffic, such as school buses and semi-trailers visiting the Valley
Co-op on William St., thus destroying the street. Mr. Moore stated the
street will be constructed to bear this load.

Donald Martin, 718 W. Myrtle St., stated William St. was reconstructed
less than 20 years a 0, but seal coated only once. All that needs to be
done is to replace t e damaged sewer.
Don Madsen, 202 No. herburne St., stated there is only one block on
Sherburne that is ba and that part is the curb. The projected cost is
too high.
Allen Olsen, 118 No. Sherburne, stated the street is basically in good
shape -- there are 0 ly two or three curb areas that need repair.
Doug Lacher, 106 No. Sherburne, agreed with his neighbors. They have had
no trouble through r instorms, no flooding, etc. All that is needed is
some patchwork.
Steve Solomonsen, 80 W. Mulberry, stated they just received a stop sign
to slow traffic and ow it is proposed to widen the street and make it a
speedway. They cann t afford the cost.
Sara Schmidt, 114 No. Sherburne, stated she is paying taxes for schools,
even though she does not have children, and will need a second job to pay
the assessments. Th street is fine, wt~ mess with it?
Mike Dalkey, 303 No. Sherburne, stated he only has one source of income
and cannot afford th assessments. He feels the problems are not as
extensive as stated - take care of the minor problems.

Judith Hilbur, 214 N . William St., also stated she cannot afford the
assessments; also No. William St. is a bus line and carries excessive
loads which make the street deteriorate.
Barney Brown, 303 No. Greeley St., stated the majority of people are not
in favor of the proj ct, the streets are the best in town -- there is
nothing about this p oject that sounds right and it is a ripoff.
Jack Johnson, owner f property at 123 No. William St., stated he has
income property whic is non-homesteaded. He added he cannot afford all
the taxes that are c ming -- school, county~ etc. He does not think the
project should be this extensive. Also, he questioned why the people on
Third St. paid only alf the cost of this proposed project. Thirty-five
dollars a foot may b more palatable to the residents affected and there
should be a city fun to take care of these excessive costs.
Mr. Nord, stated a c mplaint regarding snowplowing.

Mr. Lacher stated his property value will go up and he will have to sell
it at a higher price to offset the assessments.
Ron Johnson, 728 W. Mulberry St., asked whether any nice shade trees will
be taken down. Mr. Moore replied there are no plans to remove trees.
Charley Brown, 303 No. Greeley St., asked if it would help their cause to
start a petition.
Ralph Nagel, 229 No. William St., expressed concern about the proposed
width of William St., saying it is difficult to back out of his driveway
and not hit another car.

Nora Mariana, 804 W. Myrtle St., representing Gary Mariana, asked who pays
for the 100 ft. of sewer that needs repair and the Council informed her
that those persons benefiting from the sewer would pay.
A man, 219 Sherburne St., inquired what the assessment rate would be and
how many years they would have to pay. Mr. Kriesel replied this has not
been established yet, but in the past it has been ten years at 8%.
Jeff Meyer, 513 Mulberry St., inquired about repair of the existing sewer
lines. He stated he can hear the neighbor's toilet flushing in his house.
Rodney Nord asked if this improvement will raise the tax base of his house.
In addition to paying the assessment, his taxes would also go up.
Art Noot, 817 W. Mulberry said it sounds like a bad plan to him and will
do damage to many people.
Toni Magee, 1127 W. Mulberry St., asked why she is being assessed if her
end of the street is not being reconstructed.
A man at 115 No. William St. asked what would happen to his new sidewalk.
Mr. Moore replied that possibly this sidewalk could be left in.
Polly Webster, 233 No. Harriet, asked if it was possible to reconstruct
only Mulberry St.
Mayor Abrahamson closed the public hearing.
Council and Staff discussion followed, including such items such as how
long the project could be delayed before big problems would occur, how MSA
stipulations and monies are allotted, and delaying the project until after
study of the pavement management program and development of an assessment
policy.

We , living on the west side of the seven and eight hundred block of
South Third street, are writing you to express our dissatisfaction with
the sidewalk and curb construction of our block last summer. We brought
the matter to the attention of David Junker and Nile Kriesel, last
October, after receiving no satisfaction from Dick Herold, the Wash-
ington County Engineer.
David and Nile visited the site and informed us that it had to be
taken up with the county. We brought the matter to the attention of
Don Wisniewski and he also visited the site. We discussed the construc-
tion over the phone and Don indicated he would revisit the job after
we expressed that the sidewalk angled out toward the curb eighteen
inches from one side of the property to the others ide at 808 South Third
Street. The walk then angles back, approximately six inches, toward
the lawn of the property at 712 South Third Street.

Due to the arrival of winter, we did not pursue the matter again until
this month. We contacted Mr. Wisniewski and were informed that he had
sent a letter to Mr. Kriesel recommending that nothing be done to correct
the irregularities in the sidewalk. He stated that he felt the curved
sidewalk did not have an "awkward appearance". We disagree: We feel
it is an eyesore and effects the property value of the entire block.
In addition to the problems with the sidewalk, the sod that was in-
stalled was poorly done. Some of us chose to add dirt of our own to
level the surface before the sod was layed. Those that did not, have
a surface that could be dangerous to mow, i.e. it is so rough there is
a danger of turning an ankle walking through the grass.
We find it unbelievable that anyone would ever consider paying a
contractor for the poor workmanship we are being assessed to pay. We
need your assistance in this matter: We feel that the only fair
solution is to replace the sidewalk and sod for the entire block.

Project Description:
A Design Review Permit for the renovation of a storefront at 210 South Main
Street.
DISCUSSION:
The request is to make alterations to the facade at 210 South Main Street,
Sherburne Jewelry Store. The changes to the building are minor but will change
the character of the storefront. One alteration is to move the existing South
column tow to three feet north in order to void an existing doorway thereby
creating a window area.
e
Another change will be to raise the bottom sill height from approximately
eighteen inches to forty inches. The store owner feels that the raised sill
height will help define the window space for the presentation of jewelry. The
forty inch bulkhead will then be overlayed in brick which will match the
existing brick on the building. The owner feels Main Street is dirty from the
traffic and this will be easy to maintain. No other changes to the building
wi 11 be made.
DESIGN REVIEW RECOMMENDATION:
The Design Review Committee reviewed the request on April 2, 1990. There were
two recommendations on this proposal which include:
1. Moving the existing South column two to three feet North is a resonable
solution. The existing columns will remain.
2. The Committee does not recommend raising the sill height. Lower sill
heights and large windows are historically correct on this facade.
Smaller windows are not in proportion with the original intent of this
storefront. Design Review recommendation is to leave the eighteen inch
sill definition, then fill in that additional space with dark colored
glass to the forty inch sill level. This would correctly define the
window and still allow the presentation area for jewelry to remain at
eye level. From a distance, the large window would be defined. Also a
brick bulkhead is not consistent with the historic integrity of the
building.

The Design Review Committee reviewed the plans for Sherburne Jewelry for a
second time after recommendation by the Planning Commission to review and
comment on the window height. The following is the recommendation:
The Design Review Committee does not recommend that
the changes to window sill height be made. The
historic integrity of the structure is threatened by
the placement of smaller windows and a large
bulkhead. Design Guidelines were established in
Downtown Stillwater in order to preserve the
existing fabric of Main Street and to review
alterations to existing and new structures in
relation to the existing historic buildings. This
facade is original and should not be altered.

Discussion:
The request is to conduct small group house tours, small business meetings,
and small weddings at the William Sauntry Bed and Breakfast. The Hubbs were
granted a Special Use Permit on November 13, 1989 to conduct a five bedroom
Bed and Breakfast at this location. This request is to allow additional uses
of this large, historically restored structure. The first level of this home
contains over 2,000 square feet of usable floor space for group gatherings.
This area can accommodate a 75 person occupant load.
The applicants have stated that their 3/4 acre lot can accommodate
approximately 20 vehicles. This would not provide enough space for larger
functions at the home. However, Maple Street could accommodate overflow
on-street parking.
CONDITIONS FOR SPECIAL EVENTS
1. A maximum of six special events (large functions defined as business
meetings, bus tours, bridal and wedding showers, anniversaries, weddings
and wedding receptions, and church functions) over twenty persons allowed
per month.
2. All special event visitors shall park on site or on the residence side of
the street.
3. Limit of groups: 50 capacity as approved unless special approval is
obtained from the City Council.
4. Food must be served by a licensed caterer.
5. All special events shall be over by 9:00 P.M.

This coming Tuesday, May 1st, the City Council will hear a request to expand the
commercial use of the Wm. Sauntry Bed and Breakfast house at 626 North Fourth
Street. After learning more about the expanded guidelines permitting
considerably more traffic and the obvious negative impact that would have upon
our neighborhood, including our property values, many of us are understandably
upset at such a commercialization of the residential neighbnrhood.
I trust you will consider carefully changing the nature of our residential area .
which is just now stabilizing with new families, many of whom have young
children who should be protected from the risk of increased traffic.

A variance to the front yard setback requirements (twenty five feet requested,
thirty feet required) for the construction of a garage addition.
DISCUSSION:
The request is to construct a twelve foot by twenty foot garage addition to
the front of a home. A thirty foot setback is required, a twenty five foot
setback is requested. The applicant1s would then convert the back half of the
existing garage (12Ix20') into a family room. Due to the existing setback,
(all are at the minimum setback allowed), this addition is the most feasible.
The applicant's also believe that the stated location for a family room will
function very well with the existing living space of the home.
CONDITIONS OF APPROVAL:
1. The roof drainage from the garage shall remain on the site.
2. As much as nine foot variance to front yard setback allowed (twenty one
foot setback).
RECOMMENDATION: Approval.
FINDINGS:
For reasons stated, the granting of the variance is reasonable use of the home
and this is the minimum variance that will accomplish this.

The request is to vacate a portion of South Holcombe Street.
DISCUSSION:
The request is to vacate a 100'x30' portion of South Holcombe Street, North of
Ramsey Street. (See attached map.) Holcombe Street is improved to
approximately the South line of Lot #5. A house is located on Lot #5, 122
South Holcombe Street. Access to the 'residence is provided off of Holcombe. If
the street were vacated as proposed, the residence would be without access.
A portion of the area requested to be vacated (to the South boundary of Lot
#5) could be vacated. This would not address the garage encroachment
situation.
RECOMMENDATION:
Vacation of Holcombe Street from the South boundary of APN 11221-5050 to the
North boundary of APN 11221-5200.

1. Petitioners hereby request vacation of that certain
unopened public street in the City of Stillwater, Washington
County, Minnesota, known as Holcombe Street, described as
follows:

Addition extended eastward to the East line of Holcombe

REVIEW OF SPECIAL USE PERMIT AND REPORT ON 1989 RIVERTOWN TROLLEY

BACKGROUND:
The Trolley use permit was approved last year with a condition of approval
that the owner return to the City with a report on 1989 activities, including
any changes for 1990. Also, in 1989 Downtown Capital Improvement Plans were up
in the air and a condition required that the use of Water Street for Trolley
parking be reviewed when the improvement plans are available.
Mr. Raleigh has submitted the attached letter report. The report indicates the
Trolley Tour Service was met with enthusiasm by the public. The operator
intends to add two new tours of historic Stillwater and is considering
operating a route car. Staff has discussed the route car idea with MTC and
there may be some technical assistance and possible monetary assistance MTC
can provide in developing a route car circulator service to help ease the
parking situation Downtown. This idea could be explored further this coming
year.
The Freighthouse owner has submitted a letter allowing the Trolley ticket
booth on this property for the 1990-1991 season.
RECOMMENDATION:
Approval of Special Use Permit SUP/89-26 with original conditions of approval
as listed below.
1. The ticket booth shall be located on Freighthouse property, setback
five feet from the South and East property boundaries.
2. The temporary booth shall be removed by December 1, 1990 unless special
approval is given by the City Council. (This is necessary because of
the flood plain section.)
3. The area between the ticket window and Nelson Street shall be approved
by the Community Development Director.
4. A use permit is granted for one year, at the end of the season (October
15, 1990) the applicant shall prepare a written report describing the
tour activity and suggesting improvements to the business regarding
booth location and bus loading area. This will be considered along with
City improvement plans for the South Main Street area in considering
the application for the 1991 season.
5. The ticket booth sign shall be a maximum of four square feet.
6. The trolley booth may be four by twelve feet.

Reports Regarding 1989 Tour Activity
After operating the trolley for one season, I am very pleased
with the public enthusiasm for a historic Stillwater. tour. The
Rivertown Trolley booth and location worked well for us and our
customers. We really became an information center for the city.
Through our marketing efforts during the past few months and the
good track record we established last season, we are pleased with
the many groups already booked for this spring and early summer.
These efforts will be bringing many new tourists into Stillwater
to shop and eat at the many restaurants.
We are in the process of developing two new tours of Stillwater
to ensure repeat business and to allow us to alternate our routes.
We had intended to do this report s00ner-;~.but with all..the .
controversy over parking meters and free parking, we wanted to wait
and see if any patterns would have developed early that would affect
a regular route trolley. There seems to be more interest in the
downtown area in having a route car, but most people that we have
talked to want to wait until spring to see what kind of problems
may arise with the new parking ordinances.
We look fODvard to a continuing good relationship with the city of
Stillwater, and we will do our best to become one of the best
attractions in the city.

As I stated at our meeting. the Regional Transtt Board (RTB) wants to increase its
communications with local units of government. At the same time. we strongly
encourage local initiatives in proposing possible new or enhanced transit services that
will best meet the needs of your citizens.
At our meeting. you requested that the park-and-ride lot located in your municipal
parking lot in the downtown area be relocated to an alternative location. possibly at a
church parking lot along existing transit routes. Very shortly you should be contacted by
MTC officials to examine the options with you. Ukewise. please contact me when you V
would like to meet with our staff to discuss the idea of bringing possible circulator service
to out of downtown parking sites.
To further promote good communication. our RTB board member representing your

for tours around the Stillwater area.

DISCUSSION:
The request is to temporarily locate a four by eight foot ticket booth along
the North side of Nelson Street just East of the Freighthouse parking lot. The
booth would be located on Freighthouse property on an old railroad bed.
Tickets for tours of the Stillwater area would be sold from the booth. The
tours, as proposed, would leave from Lowell Park next to Nelson Street as
described in the letter of application.
The visitor tour use is complimentary to the Downtown. The ticket booth design
replicates the design of the tour vehicle. The bootn must be removed during
the off-season because of flood plain requirements. A sign is proposed but riot
shown. A maximum sign size of four square feet is recommended.
It is recommended that the structure be setback five feet from the front and
side property lines and the area between the booth and street paved with a
hard surface for easy customer access.
It is suggested the temporary structure be allowed for the summer season, then
reevaluated regarding booth location, site improvements, and trolley loading
area as part of the Downtown Plan improvements. A bus loading area is proposed
for the South end area and could provide a loading location for tour buses.
RECOMMENDATION: Approval as conditioned.

The City Council of the City of Stillwater, Minnesota, does

The request is to locate an on-site sewer system within two feet of the side
property line and a well two feet from the front and side property line if
proposed well site next to the home is too difficult to access for the
drilling rig.
Application, including perk test information, has been submitted and reviewed
by the Building Inspector (attached memo).
The setback variance would not impact the developability of the adjacent lot
#7 because a house is already located on the back site. However, lot #9 is not
developed and is constrained for development due to topography. Septic system
drainfield must be located fifty feet from a well so by granting the variance
for the well, the lot would be further restricted.
RECOMMENDATION:
Approval of drainfield setback variance but not well setback variance.
CONDITIONS OF APPROVAL:
1. The house constructed on the site shall have a maximum of three
bedrooms.
2. The final house plans and septic system plans shall be reviewed by the
Building Department for conformance with this approval.
3. The variance for the alternative well system is not approved.

The site plan submitted is a true representation of the lot
configuration and topography. From my site observation and
the soils report, this plan appears to be the most logically
and probably the only way that this lot can be developed
into a home site.

The proposed two foot drainfield setback from the side
property line appears to have no affect on the adjacent
property and it will create enough area for future expansion
of the sewer system.
The well site does meet the required separation to sewer and
to the building but appears to be a very difficult
installation site. If Mr. Locey can get a written
certification from a water well installer that the site can
be used for well installation, I would recommend approval of
the application.

Parking Agreement to use Cub employee parking
during non-use times.
The idea for shared use of parking Downtown was first
discussed in the Downtown Plan. Some of the larger offices
and service uses, including banks along Second Street and
Cub Foods Headquarters just north of Chestnut, provide
parking for their employees usually Monday-Friday, 8:00 A.M.
to 6:00 P.M.

City Staff has discussed the possible use of the CUB
employee parking spaces, 90-100 spaces, after 6:00 P.M. on
weekdays, weekends and holidays. This is when the peak
parking demand occurs in the Downtown.
CUB has offered to lease the 90 spaces to the City on a year
to year basis for $3,000 per year. The City would also be
responsible for signage changes, insurance during public
use, and trash pickup after weekend use.
The $3,000 or $33.00 per space is a good rate for 90 parking
spaces. It is possible that some of this cost could be
passed on to benefiting downtown activities, such as special
events in Lowell Park or the MTM train rides, should the
City want to defer the cost. A Downtown Parki ng Di strict to
pay parking costs could also be considered when the report
on the Parking Management Program is reviewed later this
year.
RECOMMENDATION:
Direct Staff to prepare a lease agreement with CUB Foods for
the use of 90-100 parking spaces for $3,000 per year~

HERITAGE PRESERVATION COMMISSION AND DESIGN REVIEW
COMMITTEE.
The Heritage Preservation Commission and Design Review Committee
have combined efforts for Design Review. Both Ordinances establish-
ing these Committees have been amended in order to reflect this
change. Subsequently, there are eight members on the Design Review
Committee/Heritage Preservation Commission. The Ordinances establish
a seven member Commission. Maureen Lodge has resigned due to the
fact she moved to Afton. Her resignation is attached.
Two Design Review Committee members are additional to the Heritage
Preservation Commission at this point. These two appointees are
Shawn Draper and Linda Smith. They have shown strong interest in
Preservation issues at the last few meetings. Design review and
preservation issues do go hand-in-hand in Downtown Stillwater.
RECOMMENDATION:
Appoint Shawn Draper as an official member of the Heritage
Preservation Commission.
Appoint Linda Smith as an ex-official member of the Heritage
Preservation Commission. Official appointment will be made as
openings occur on the Heritage Preservation Commission.

1990 - 1991 LABOR AGREEMENTS
AFSCME Agreement
Accompanying this memo is a copy of the labor agreement for the
AFSCME unit. The agreement contains the following changes:
1. Changed Article 4.1 to read:
The normal work week shall be five (5) consecutive eight (8)
hour days or with supervisory approval four (4) ten (10) hour
days.
2. Changed Article 4.2 to read:
Schedules. Work schedules showing work shifts, workdays and
hours and employee assignment shall be posted on a personnel
board at each work site.
The normal schedule for employees of the City will be 8 a.m.
to 4:30 p.m., Monday through Friday.
Service to the public may require the establishment of
regular shifts for some employees on a daily, weekly,
seasonal or annual basis other than the normal work schedule.
The EMPLOYER will give seven (7) days advance notice to the
employees affected by the establishment of work days
different from the employee's normal work schedule.
3. Changed Article 6.4 to read:
During the first calendar year of employment, any new
employee must be hired before June 30th to be eligible to
receive the floating holiday.
Any new employee hired after June 30th shall be eligible to
receive one-half (1/2) of a floating holiday.
4. Changed Article 7.2b to read:
Any days used by an employee must be replaced at the
following earning rate:
Employees shall earn sickness disability at the rate of
sixteen (16) hours for each month worked.

5. Changed Article 8.1 vacation schedule to read:
From 0 thru 12 months of employment
From 1 year thru 4 years of employment
After 4 years thru 10 years of employment
After 10 years thru 15 years of employment
After 15 years of employment
5/6 days per month
10 days per year
15 days per year
20 days per year
One additional day
for each year up to
20 years for a
maximum of 25 days.
A day is equal to eight (8) hours.
6. Changed Article 8.6 to read:
Vacation time can be accumulated up to eighty (80) hours and
used in the following year. Vacation in excess of eighty
(80) hours at the end of the year shall be paid on the second
(2nd) pay day in January at the rate of pay in effect at the
end of the previous year.
7. Changed Article 11.4 to read:
All permanent employees shall receive monthly longevity pay
according to Appendix B.

8. Changed Article 12.1 to read:
Time and one-half the employee's regular hourly rate of pay,
shall be paid for work performed in excess of the normal work
week of forty (40) hours. Compensated leave shall be
considered worked hours for the purpose of determining
eligibility for overtime compensation.
9. Changed Article 12.4 to read:
Employees who elect to take compensatory time off in lieu of
overtime pay, shall earn compensatory time at the rate of
time and one-half. Compensatory time off shall be scheduled
at the mutual convenience of the employer and employee.
Employees shall not be allowed to accrue more than forty (40)
hours of compensatory time or carryover more than forty (40)
hours of compensatory time into the next calendar year
without permission of employees supervisor.
10. Changed Article 16.1 to read:

The Employer will contribute up to $205 per month per
Employee toward group health insurance including dependent
cover age from January 1, 1990 through December 31, 1990. The
Employer contribution for 1991 will be negotiated based on
settlements with other employee bargaining units but in no
event be less than the amount contributed by the Employer
during 1990.

questions or concerns regarding the Agreement. The AFSCME members

Tuesday night along with the other agreements discussed below.

ARTICLE I. PREAMBLE.
1.1 This Agreement entered into by the City of Stillwater hereinafter referred
to as the Employer, and Local 517, affiliated with Council No. 14 and the
American Federation of state, County and Municipal Employees, AFL-CIO,
hereinafter referred to as the Union, has as its purpose, the promotion of
harmonious relations between the Employer and the Union; the establishment
of an equitable and peaceful procedure for the resolution of differences;
and the establishment of rates of pay, hours of work and other conditions
of employment.
1.2 All personnel policies unless otherwise stated, shall be applied uniformly
across the entire bargaining unit.
ARTICLE II. RECOGNITION.
2.1 The Employer recognizes the Union as the exclusive representative in a
unit defined as:
All employees of the Ci ty of Stillwater who are public
employees within the meaning of Minnesota Statutes 179A.03,
Subd. 14 excluding supervisory and confidential employees,
essential employees, employees of the Stillwater Public
Library Board and all employees of the Public Works Department
and Parks and Recreation Department.
e ARTICLE III. UNION SECURITY.
3.1 The Employer agrees to deduct the Union dues from the pay of those
employees who individually request in writing that such deductions be
made. The amounts to be deducted shall be certified to the Employer by a
designated representative of the Union, and the aggregate deductions of
all employees shall be remitted together with an itemized statement, to
the designated representative by the first of the succeeding month, after
such deductions are made. Any fair share fee collected shall be processed
in accordance with Minnesota Statutes 179.65, Subd. 2.
3.2 The Union agrees to indemnify and hold the Employer harmless against any
and all claims, suits, orders or judgments brought or issued against the
Employer as a result of any action taken or not taken by the Employer
under the provisions of this article.
ARTICLE IV. HOURS OF WORK
4.1 The normal work week shall be five (5) consecutive eight (8) hour days or
if employee requests and with supervisory approval, four (4) consecutive
ten (10) hour days.
4.2 Schedules. Work schedules showing the work shifts, workdays and hours and
employee assignment shall be posted on a personnel board at each work
site.

4.3 All employees shal be scheduled a one-half (1/2) hour unpaid lunch break,

period during each one-half shift. The rest period shall be scheduled at
the middle of eac one-half shift, whenever possible. Employees who are
authorized to work beyond their regular quitting time shall receive a rest
period if one is ecessary due to length of overtime authorization.
ARTICLE V. PART TIME
5.1 Part-time employe s shall be eligible to earn all employee benefits on a
pro rata basis pro ided that such employees work regularly scheduled hours
in each pay perio , as opposed to being subject to call or to work when
available.
5.2
Part-time employe s shall be paid an hourly rate computed by dividing the
full-time annual ate for which they would be eligible by 2,080 hours.

5.3
Part-time employe s who become full-time employees shall be given credit
for a forty (40) our work week for determining the salary step based on
the length of ser ice.

When a holiday falls on Saturday, the preceding Friday shall be observed
as the holiday. When a holiday falls on Sunday, the following Monday
shall be observed as the holiday.
6.2
6.3 Christmas Eve or New Year's Eve will be a split work force. The schedule
for these two (2) holidays to be approved by the Department Head.
6.4 During the first calendar year of employment any new employee must be
hired before June 30th to be eligible to receive the floating holiday.
Any new employee hired after June 30th shall be eligible to receive one-
half (1/2) floating holiday.
ARTICLE VII. SICK LEAVE.
7.1 Sick leave shall be earned by full-time employees at the following rates:

From ten (10) to fifteen (15) years, thirteen (13) weeks at full
pay; thirty-nine (39) weeks half pay.
From fifteen (15) to twenty years, twenty-six (26) weeks at full
pay; twenty-six (26) weeks at half pay.
From twenty (20) to twenty-five (25) years, thirty-nine (39) weeks
at full pay; thirteen (13) weeks at half pay.
Over twenty-five (25) years, 52 weeks full pay.
A week shall be considered to be five (5) working days. Sick leave
benefits shall accrue on the January 1st immediately preceding the
anniversary date of employment.
7.2 Sickness disabili ty benefits usage shall be subj ect to the following
conditions:
a. An employee may use the full entitlement only once annually.
b. Any days used by an employee must be replaced at the following
earning rate: employees shall earn sickness disability leave at the
rate of sixteen (16) hours for each month worked.
c. Sickness disability leave time cannot be earned during the time an
employee is on sick leave.
d. Sickness disability leave time shall be earned as a replacement for
used leave time by only those employees who have utilized the
benefit.
7.3 Sick leave may be authorized for the following reasons with the
limitations as specified:

For illness or injury, dental or medical treatment for the employee.
Sick leave usage by the employee may be subject to approval by the

Department H ad. The Employer may require verification for an
absence of tree days or more, from a recognized medical authority
attesting to the necessity of the leave, ability to return to duty
or other inf rmation deemed necessary.
In the event a pregnant employee elects to resign her employment
because of p egnancy, such employee will be paid for accumulated
sick leave u to but not exceeding 15 work days.
b.
c. Sick leave u e for serious illness of the employee's spouse, minor
children or mployee's parents living in the household shall be as
established n the City's personnel policy.
7.4 Should illness oc ur while an employee is on vacation the period of
illness may be cha ged to sick leave and the charge to vacation reduced
accordingly. An mployee requesting such a change may be required to
submit a written s atement from a physician attesting to illness and the
period of disabili y.
Any permanent or robationary employee who is injured while performing
work within the sc pe of his employment, and by reason thereof is rendered
incapable of perfo ing his duties shall, on his request to the department
Head accompanied b a physician's certificate be eligible to receive not
exceeding 90 days ick leave, said sick leave not be charged against his
normal sick leave heretofore accumulated by him, so as to receive full
compensation for at period, and in addition shall be entitled to the
medical and hospit 1 expenses provided by the Workmen's Compensation Act,

such Act.
7.5

If recovery is not complete, an additional recovery period not in excess
of 90 days may be g anted, during which time the injured employee shall be
paid a sum of mon y which with Workmen's Compensation will be equal to
one-half (1/2) of his compensation, and during such additional recovery
period the injured employee may also receive a sum of money chargeable on
a pro rata basis 0 this accumulated sick leave equal to the remaining
one-half (1/2) of is compensation.
The monthly payme ts under this section shall not exceed an employee's
normal monthly com ensation. During either of said recovery periods the
employee may also request pay for accumulated vacation, to an amount
totaling his usua monthly pay, otherwise no vacation credits shall be
forfeited during h's incapacity.

8.2 Vacations shall be granted at the time requested by the employee upon
approval of Department Head. If the nature of the work makes it necessary
to limit the number of employees on vacation at the same time, the
employee with the greater departmental seniority shall be given his choice
of vacation period.
8.3 If a holiday occurs during the calendar week in which a vacation is taken
by an employee, the employee's vacation used shall be reduced by one work
day.
8.4 Any employee who is laid off, discharged, retired or separated from the
service of the Employer for any reason, prior to taking his vacation,
shall be compensated in cash for the unused vacation he has accumulated at
the time of separation.
8.5 Vacation may be taken in increments of less than a day with the approval
of the Department Head.
8.6
Vacation time can be accumulated up to eighty (80) hours and used in the
following year. Vacation in excess of eighty (80) hours at the end of the
year shall be paid on the second (2nd) payday in January at the rate of
pay in effect at the end of the previous year.
8.7 Vacation shall accrue on January 1st immediately preceding the anniversary
date of employment.
ARTICLE IX. SEVERANCE PAY.
9.1 Permanent employees shall be eligible for severance compensation upon
retirement, death or disability in accordance with the following
conditions:
a. Employee shall have been employed by the City for ten (10) years or
more except in cases of death or layoff;
b. Compensation shall be one-half (1/2) of the employees unused sick
leave;
c. Death benefits shall be paid to the surviving spouse or the
employee's estate.
ARTICLE X. LEAVES.

10.2 Employees shall be granted a leave of absence with pay any time they are
required to repor to jury duty or jury service. All fees shall be
returned to the loyer except those paid for duty on the Employee's
normal day off and those for meals and mileage. Any hours not on jury
duty shall be work d.
10.3 Notice. An employe using jury duty or funeral leave shall notify the
Employer of such i tent as soon as the necessity or such leave is known.
10.4 Unpaid leaves for a limited period, not to exceed six months, may be
granted for any re sonable purpose, and such leaves may be extended or
renewed for any r asonable period. Employees shall submit a written
request for person 1 leave to the City Council. All personal leaves shall

10.5 Union Business. E ployees elected to a Local Union office or selected by

granted at the re est of the Employee.

ARTICLE XI. WAGES.
11.1 Employees shall be paid in accordance with the attached salary schedules e

marked Appendix A-1 (1990) and Appendix A-2 (1991).
11.2
Incumbent employees will move into the salary schedule in accordance with
their length of service.
11.3
Call Back. Any full-time employee called to return to work after his
regularly scheduled shift shall be paid a minimum of two (2) hours.
11.4
All permanent, full-time employees shall receive monthly longevity pay
according to Appendix B.
ARTICLE XII. OVERTIME.
12.1 Time and one-half the employee's regular hourly rate of pay, shall be paid
for work performed in excess of the normal work week of forty (40) hours.
Compensated leave shall be considered worked hours for the purpose of
determining eligibility for overtime compensation.
12.2 Distribution. Overtime work shall be distributed as equally as practical
to qualified employees.
12.3 Overtime shall be calculated to the nearest fifteen (15) minutes.
12.4 Employees who elect to take compensatory time off in lieu of overtime pay,
shall earn compensatory time at the rate of time and one-half.
Compensatory time off shall be schedules at the mutual convenience of the
employer and employee. Employees shall not be allowed to accrue more than
forty (40) hours of compensatory time or carry over more than forty (40)
hours of compensatory time into the next calendar year without permission
of employees supervisor.
ARTICLE XIII. GRIEVANCE PROCEDURES.
13.1 Definition of Grievance. A grievance is defined as a dispute or
disagreement as to the interpretation or application of specific terms and
conditions of this agreement. An employee has the right to have Union
representation.
13.2 Organization Representatives. The City will recognize representatives
designated by the Union as the grievance representative of the bargaining
unit having the duties and responsibilities established by this article.
13.3 Processing of Grievance. The aggrieved employee I s representative shall be
allowed a reasonable amount of time without loss in pay, if an employee,
when a grievance is investigated and presented to the City during normal
working hours provided the employee and employee representative has
notified the designated supervisor.
13.4 Grievance Procedure.

writin to the City Councilor their designee within ten (10)

Union shall be held at a time mutually agreeable to the

meetin , the settlement shall be reduced to writing and signed
by the City Councilor their designee and the Union. If no

with he foregoing procedure, either party may refer the
grieva ce to arbitration within ten (10) working days after
the Un'on's receipt of the Employer's written answer in step
3, as provided in Minnesota statutes, Section 179.70. The

the "ules Governing the Arbitration of Grievances" as
establ'shed by the Public Employment Relations Board.

arbitrator shall be without power to make decisions

in any way, the application of laws, ordinances or rules
and regulations having the force and effect of law. The
decision shall be based solely on the arbitrator's
interpretation of application of the express terms of
the Agreement and to the facts of the grievance
presented. The parties may, by mutual written agreement
agree to submit more than one grievance to the
arbitrator provided that each grievance will be
considered as a separate issue and each on its own
mer it.
c.
The fees and expenses for the arbitrator's services and
proceedings shall be borne equally by the City and the
Union, provided that each party shall be responsible for
compensating its own representative and witnesses. If
either party desires a verbatim record of the
proceedings, it may cause such a record to be made,
provided it pays for such a record. If both parties
desire a verbatim record of the proceedings, the costs
shall be shared equally.

13.5 Waiver. If a grievance is not presented within the time limits set forth
above, it shall be considered "waived". If a grievance is not appealed to
the next step within the specified time limit or any agreed extension
thereof, it shall be considered settled on the basis of the Employer's
last answer. If the Employer does not answer a grievance or an appeal
therefore within the specified time limits or any agreed to extension, the
employee and the Union may elect to treat the grievance as denied at that
step and appeal the grievance to the next step. The time limit in each
step may be extended by mutual written agreement of the City and the Union
in each step. The term "working days" as used in this Article shall mean
the days Monday through Friday, inclusive, exclusive of holidays.
13.6 Grievance Representative. Employees presenting a grievance under step 2
shall be represented by a representative of the Union.
13.7 Record. All documents, communications and records dealing with a
grievance shall be filed separately from the personnel files of the
involved employee(s).
13.8 Discipline in the form of a written reprimand, withholding a salary
increase, suspens ion or discharge shall be in writing. An employee
receiving such discipline may submit the disciplinary action to the
grievance procedure beginning at step 2.
ARTICLE XIV. SENIORITY .
e
14.1 Seniority means an employee's length of continuous service with the City
and by job classification.

14.2 On January 1 and uly 1, the Employer shall establish seniority lists
showing the contin ous service of each employee. A copy of the seniority
lists shall be fur ished to the Union when it is posted.
e
14.3 Breaks in Continuo s Service: An employee's continuous service record
shall be broken b voluntary resignation, discharge for just cause and
retirement.
14.4 New employees shal be subject to all provisions of this contract limited
only by the follow ng:
1. New employee may be subject to a six-month probationary period.
Probationary period will be the time needed to determine the new
employee's ility to perform the work.
2. New employe s may be assigned duties on such basis as deemed
necessary fo them to be properly trained for the work they are
hired to per orm.
ARTICLE XV. WORK FORCE.
15.1 Any vacancy or new y created position in a department will be posted in a
conspicuous place . n all departments where employees within the bargaining
unit work. Such n tice shall be posted for at least five (5) work days
prior to filling such vacancy or newly created position. Whenever
practicable, vacan ies shall be filled from among the present employees in
the department, gi ing first consideration to seniority and qualification.
If it becomes nee ssary in filling a vacancy to bypass an employee's
seniority, reasons for said denial shall be given in writing to such
employee. No vaca cy shall be reduced in classification by the Employer
without first bein offered in the bidding process.

15.2 A reduction of t e work force will be accomplished on the basis of
seniority and job lassification provided all probationary and temporary
employees in the c assification(s) where the layoff occurs are laid off
first. In the e ent of layoffs or a reduction of the work force,
employees may exer ise their seniority rights to a job classification of
a higher, the same or lower pay within the bargaining unit provided that
all job relevant alifications between employees are equal.
15.3 Employees shall b recalled from layoff according to seniority and job
classification. N new employee shall be hired for a job classification
which a layoff has occurred until all employees on layoff status within
that job classifi ation have been given ample opportunity to return to
work within twenty four (24) months of said layoff. The City will notify
employees on layof to return to work by registered mail at the employee's
last recorded addr ss. The employee must return to work within three (3)
weeks of receipt 0 this notice in order to be eligible for reemployment.
ARTICLE XVI. INSURANCE.
16.1 The Employer will contribute up to $205 per month per Employee toward e

group health insurance including dependent coverage from January 1, 1990
through December 31, 1990. The Employer contribution for 1991 will be
negotiated based on settlements with other employee bargaining units but
in no event be less than the amount contributed by the Employer during
1990.
16.2
The City shall provide a $15,000 life insurance policy for all permanent
employees.
16.3
Employees hired prior to January 1, 1985 and who retire after 15
continuous years of City service and who are eligible for PERA benefits
shall be allowed to continue their medical insurance coverage at City
expense until their death. If said employee provided dependent coverage
for his/her spouse prior to his/her retirement, the City shall pay said
dependent's coverage until death.
16.4
Dental. If a plan is available within the Stillwater City Government
Structure, that it will be offered to the City employees of AFSCME Local
517 to be negotiated.
ARTICLE XVII. GENERAL PROVISIONS.
17.1 Neither the Union nor the Employer shall discriminate against any employee
because of Union membership or nonmembership, nor because of age, race,
creed, gender, color, religious belief, sexual or affectional preference.
e 17.2 Union Use of Bulletin Boards. The Employer agrees to furnish and maintain
suitable bulletin boards in convenient places. The Union shall limit its
posting to official notices and bulletins of the Union to such bulletin
boards.
17.3 The Employer agrees to recognize stewards and alternates as certified by
the Union subject to the following stipulations:
1. Employee Union officers shall be granted a reasonable amount of time
off without pay during work hours for union business, provided they
notify their designated supervisor.
2. Nonemployee representatives of the Union shall be permitted to come
on the premises of the Employer for the purpose of investigating and
discussing grievances if they first notify the Employer's designee
and provided the Union representative does not interfere with the
works of the employees.
3. The Union will notify the Employer in writing of the designated
steward and alternate and of the other designated representative of
the Union. The Union will notify the Employer of any change in
designation within ten (10) working days of the change.

17.4 Work Rules. The Employer shall have the right to establish work rules and
personnel policies which shall be equitably and uniformly applied. Prior
to the effective date, any work rule or policy shall be posed on all

17.5 City will provide 11 training required by the City at City expense.
17.6 Any subject matter placed in the Employee's personnel file which could be
detrimental to th Employee's future promotion, transfer, present or
future employment, shall be served upon the Employee in writing. Such
matter shall be proper subject for the grievance procedure. All
materials in any mployee's file shall be available for the Employee's
inspection.
17 .7 Mileage. The Ci y will reimburse Employees for the use of personal
automobiles for au horized City business at the rate of 25 cents per mile.
17.8 The Employer shal provide required uniform articles and equipment to
SecretaryjDispatc ers and Community Service Officers.
Should any articl , section or portion thereof, of the Agreement be held
unlawful and unen orceable by any court of competent jurisdiction, such
decision of the curt shall apply only to the specified article, section
or portion thereo directly specified in the decision; upon the issuance
of such a decis'on, the parties agree immediately to negotiate a
substitute for th invalidated article, section or portion thereof.
ARTICLE XVIII.

ARTICLE XIX. EMPLOYER
19.1 The Employer reta'ns the full and unrestricted right to operate and manage
all manpower, f cilities and equipment; to establish functions and
programs; to set and amend budgets; to determine the utilization of
technology; to e tablish and modify the organizational structure; to
select, direct an determine the number of personnel; to establish work
schedules; and 0 perform any inherent managerial functions not
specifically limi ed by this Agreement.
19.2 Any term and co dition of employment not specifically established or
modified by this greement shall remain solely within the discretion of
the Employer to m dify, establish or eliminate.
19.3 Prior to contract ng out or subcontracting any work performed by Employees
covered by the A reement, the City agrees to meet and confer with the
Union to discuss ossible ways and means to minimize the elimination of
positions covered by this Agreement.
20.1 Employees shall

ARTICLE XX. EMPLOYEE

20.2 Employees choosing to participate in the internal affairs of the Union as
an officer, steward or other capacity, may do so without fear of reprisal
by the Employer for such participation consistent with the Employee's job
duties and responsibilities and the provisions of this contract.
ARTICLE XXI. WAIVER.
This Agreement shall represent the complete Agreement between the Union
and the Employer.
The parties acknowledge that during the negotiations which resulted in the
Agreement, each had the unlimited right and opportunity to make requests
and proposals with respect to any subject or matter not removed by law
from the area of collective bargaining, and that the complete
understandings and agreements arrived at by the parties after the exercise
of that right and opportunity are set forth in this Agreement. Therefore,
the Employer and the Union, for the life of this Agreement, each
voluntarily and unqualifiedly waives the right, and each agrees that the
other shall not be obligated to bargain collectively with respect to any
subject or matter referred to or covered by this Agreement or with respect
to any subject or matter not specifically referred to or covered by this
Agreement, even though such subject or matter may not have been within the
knowledge or contemplation of either or both parties at the time that they
negotiated or signed this Agreement.
ARTICLE XXII. TERMINATION.
This Agreement shall be effective as of the first day of January 1990 and
remain in full force and effect through the 31st day of December 1991. It
shall be automatically renewed from year to year thereafter unless either
party shall notify the other in writing by November 1st that it desire to
modify this Agreement. This Agreement shall remain in full force and be
effective during the period of negotiations or until notice of termination
of the Agreement is provided to the other party in the manner set forth in
the following paragraph.
In the event that either party desires to terminate this Agreement,
written notice must be given to the other party not less than ten (10)
days prior to the desired termination date. The termination date shall
not be before the anniversary date set forth in the preceding paragraph.

SPECIAL ASSESSMENT POLICY CONSIDERATIONS
RE:
Enclosed are various schedules that attempt to describe the impact
that a $45 front foot (ff) assessment would have on property owners
and taxpayers. The $45 ff assessment was used because it appears
that this would be a reasonable assessment and one that would be
sustainable if an assessment was appealed to District Court. The
$45 ff assessment is also comparable to what was assessed to
property owners for the Pine/Churchill Street and Third/Orleans
Street improvements.

The assumptions that I used are listed in Schedule A. Basically,
I assumed that the City would need to reconstruct all of its
streets (70 miles) at least once every 35 - 40 years. This means
that we would have to reconstruct 1.75 to 2 miles of streets every
year at a cost of $1,795,000 to $2,051,000 per year. Using
available MSA funding and assessing $45 ff would create a bonding
requirement of $936,000 to $1,072,000 per year (see Schedule B).
Based on my assumptions, the City would have to levy a tax of
$1,344,840 to $1,543,780 per year in the 10th and succeeding years
to support the debt service associated with bonding for the City's
share of the improvements.
The tax impact of the levies on properties of various market values
is shown in Schedule D. It appears that a $45 ff assessment policy
would be favorable to properties with a market value of $125,000 or
lower and unfavorable to properties over $125,000. For example,
Schedule E shows that a property valued at $75,000 with 75 ff would
pay about $20,000 over a 40-year period for a 100% assessment but
only about $14,000 if assessed at $45 per ff. Whereas a property
valued at $150,000 with the same front footage would pay about
$26,000 as opposed to $20,000 over the same 40 year period.
Commercial/Industrial properties would also have to pickup a
significant portion of the tax.

Another consideration to keep in mind is the impact that a $45 ff
assessment policy would have on the overall debt that is supported
by tax levies. Schedule F shows the levies that would have to be
made each year if this policy was to continue into the future. I
included estimated future levies for G.O. Corporate Bonds that will
probably be issued for future Capital Outlay purchases including
facility expansion and payment for a new armory facility.

The tax levies would "max" out at $2,160,030 per year in about 14 _
years (2003). In ot er words, a levy of $2,160,030 would have to ~
be made each and eve year to sustain the policy.
The estimated future tax levies are substantial compared to past
levies ($676,844 in 990 vs. $1,971,090 to $2,160,030 in 2003).
However, our Street Maintenance Budget should decrease thereby
decreasing our Gener 1 Fund Levy. There are some other factors
such as tax deducti ili ty of tax levies (vs . no deduction for
assessments) that will lessen the impact of the tax levy that need
to be discussed and c nsidered. I will explain the proposed policy
in more detail at th meeting Tuesday and we can look at some of
the other considerat'ons.

Dear Honorable Body:
This is written to express our concern for the completion of the
improvements that were begun in the vicinity of our properties as
referenced above. Since we have been assessed for the project
and are ready for development although the work does not appear
to be completed, we need to know:
1) Is the sanitary sewer and water main ready for our use?
If not, when can connections be made for service? When can the
utilities be put into use?
2) Is the curb and street paving for Tuenge Drive a part of
an overall contract and when will it be paved? If it is not part
of the present contract, when will the contract be let and when
will the work be done?

We are writing on behalf of the land Stewardship Project and the
Stillwater Public library to personally invite you to a public discussion
on the problem of urban sprawl and farmland loss to development in
Washington County.
The event will take place on Wednesday, May 9, 1990 at 7 p.m. at the
Stillwater Public library. A showing of the recently produced video "Turn
Here Sweet Cornu (see attached info.) will be followed by a discussion of
what is happening to farmland in the Stillwater area. Representatives of
the Metropolitan Council's Ag Preserves program will be there and we'd
like to have you there to share your perspectives on the issue.
Our purpose in sponsoring this meeting fs to generate a dialogue
between' development and environmental interests, between government
agencies and non-profit organizations and between farmers and suburban
residents. We do not pretend to have the answers, but we hope that such
discussions will lead to creative solutions that serve the Stillwater
area's long-term future.

Turn Here Sweet orn is the latest work by Minneapolis-based
video artist Helen De Michie!. The work, which recently premiered
at the Intermedia rts Gallery in Minneapolis, is a "video essay" about
urban sprawl in t e Twin Cities area and about the consuming nature
of our society in general. Turn Here Sweet Corn chronicles the re-
lationship betwee producers and consumers of food, and the receding
of a vibrant rural ulture into the realm of memory.
