Background
According to the bylaws of the Parking Commission (attached), a Chairman and Vice Chairman
are to be elected annually by a majority vote of Commissioners present at the first meeting of
the calendar year.
Discussion
The Chairman should request nominations for both positions. If only one nomination is
received for a position, a simple hand vote is all that is necessary. I f two or more nominations
are received for a position, then a secret ballot on folded slips of paper should be conducted.

ESTABLISHING DOWNTOWN PARKING COMMISSION
AND BYLAWS
PURPOSE
The Downtown Parking Commission is established to oversee the development and
implementation of the Downtown parking plan. This includes planning for long-range parking
lot improvements and day-to-day regulation of public parking spaces.
COMPOSITION AND SIZE OF COMMISSION •
(1) Members. There is established a city downtown parking commission, the "commission,"
which shall consist of seven (7) voting members that includes a Council representative, six
members shall be either downtown business owners or downtown property owners or
residents of the City, to be appointed by the city council. The Police Chief of the city shall be ex
officio, nonvoting member of the commission. All voting members shall serve without
compensation. Any Commissioner that misses two consecutive meetings without notice to the
Chairman shall be removed from the Commission.
(2) Term. All appointments shall be for staggered terms of 3 years. however, terms may be
extended if there is a shortage of suitable applicants. All terms end on the first day of May in
the year in which they expire. Members shall serve without compensation and shall continue to
hold office until their successors have been appointed and qualified.
(3) Appointment Process. All applicants for appointment or reappointment shall be
interviewed by the Council representative to the commission and the chair of the commission
("interview panel"). If the chair's term limit is fulfilled or due for reappointment; the interview will
be held by two (2) members of Council. A recommendation from the "interview panel" will be
given to the City Clerk for placement on the Council agenda for consideration.
ORGANIZATION
A Chairman and Vice Chairman shall be elected annually by a majority vote of Commissioners
present at the first meeting of the calendar year. During the absence of the Chairman, the Vice
Chairman shall exercise and perform the duties of the Chairman.
DUTIES AND POWERS
The Downtown. Parking Commission is advisory to the City Council. It shall have have no
authority other than that expressly given to it by this resolution,
The Commission shall make recommendations to the City Council regarding the development
of a long term Downtown Parking Plan and day-to-day management of Downtown public
parking.
Commission shall seek and obtain public comments on parking improvement projects and
changes to parking regulations that may affect businesses, property owners, customers and
residents of the community at large.
The Commission shall explore options for making Downtown parking financially self sufficient
by setting permit fees and fine rates and exploring methods of financing the construction of
new and maintenance of existing parking facilities.
The Commission shall exercise such other functions with respect to Downtown parking
improvements as requested by the City Council.
The Commission shall present to the City Council a yearly report of Commission
accomplishments and activities.
DUTIES OF CHAIRMAN
The Chairman shall set the agenda for Commission meetings, with assistance of Police Chief,
appoint special subcommittees of the full Commission and represent the full Commission when
recommendations are made to the City Council.
STAFFING
The Police Department, with the assistance of the Community Development and
Engineering/Public Works Department, shall provide technical and administrative assistance to
the Commission.
MEETING
All meetings of the Commission shall be open meetings to which the public and press shall be
admitted.
Notice of the meeting shall be given as determined by the Commission.
The Parking Commission shall meet as needed as determined by the Commission.

Special work sessions or subcommittee meetings shall be scheduled by the full Commission at
regular meetings to study and prepare recommendations regarding Commission parking
matters.
QUORUM
A quorum shall consist of four (4) members of the seven (7) Commission members. The
Commission without a quorum shall take no action.
VOTE
All action shall be taken by voice vote. Tie votes with one or more Committee members absent
shall continue the item to the next regular meeting. Tie votes with all members present shall
defeat the motion.
REVISION OF BYLAWS
The Bylaws may be recommended by the Commission for approval of the City Council.
Note: All approvals are by majority unless none is required by State Statute.

RE: Rearrangement of Rivertown Commons Parking Spaces in Ramp
BACKGROUND
Rivertown Commons has eight permanently reserved spaces on Level 2 of the parking
ramp. (See attachment) They are there as a replacement for eight spaces lost to
construction of the ramp.
The location of the eight spaces was chosen because it is the shortest distance between
the parking spaces and the apartment building.
Two of the spaces along the north wall are sub -compact spots. Experience shows us that
these are not good spaces for the residents of Rivertown Commons, many of whom are
elderly or have physical handicaps. For example, one of the residents has had body
damage done to her car on several different occasions due to another resident trying to
maneuver (unsuccessfully) into a sub -compact spot.
REQUEST
The poor soul whose car has been hit a number of times has asked if it would be possible
for the City to consider re -arranging the parking spaces reserved for Rivertown Commons.
RECOMMENDATION
In order to keep all the reserved spaces together, staff recommends moving all eight to the
east wall of Level 2. The location of the re -arranged spots can be seen in the attached
layout.

Background
Brine's is planning its annual Bocce Ball Tournament. As in past years they are requesting
permission to close the City parking lot north of The Freighthouse and that portion of Water
Street just west of the parking lot.
Discussion
The Parking Commission has recommended a fee schedule for reserving public parking spaces
for private use. The Council agrees with the recommended fees, though they will not be
officially adopted until January 18, 2011. Assuming the fees are adopted as recommended, they
will be as follows:
Off Season Rates

On -street parking (except on Main Street)

There are 17 full usable spaces that would be reserved for this event. A number of spaces are
lost to snow storage and a construction dumpster. Each of the lost spaces is noted with an
asterisk on the attached map. At $3 per space (off season rate), the total cost of the 17 spaces
would be $51. Staff suggests recommending to City Council that this fee be charged for the
event.

This letter is to request permission from the city of Stillwater for
Brine's upcoming 18t. Annual Frozen Bocce Ball Tournament. The date is
set for Sat. Feb. 20th, from 10:00 a.m.-10:00 p.m. This year we would like to
use parking spaces on both the east and west side of Water St. from
Chestnut St. to just behind Brine's building, this would include closing
Water St. in that area (see plan). The area in use will be completely enclosed
by snow fencing with two controlled entry points. Brine's will be providing
are own security for the entry points and enclosed area. We will contact
affected business to see if there are any conflicts. A port -a -pot will be on
sight and all clean up will be done on Sun. Feb. 21th. If there are any
question please contact Gerry Brine at 439-7556. I would like to thank the
city of Stillwater for past and future co-operation on this event.

RE: Trolley Tour LLC request for Permanent On -Street Parking Space
BACKGROUND
Mr. Tom McGlynn (dba Trolley Tour LLC) is planning to operate a trolley shuttle service and
historic tour business in Stillwater. The Downtown Parking Commission heard a request
from Mr. McGlynn in December for use of a permanently reserved parking space and a
signed drop-off/pickup spot for use by the business. On a vote of 3-2 the commission
recommended approval of the request.
The City Council considered the McGlynn request and Parking Commission
recommendation at their January 4th meeting. Though the Council was generally
supportive of the request, there was confusion over the number of spaces needed to
accommodate the 27 foot long tour trolley. Therefore, the Council referred the request
back to the Parking Commission to look specifically at the number of spaces needed for
the tour trolley.
Subsequently, staff met on site with Mr. McGlynn, and abutting businessmen. The effect
of the meeting and further discussions with the businessmen was a revision to the
proposal. Trolley Tour LLC is now requesting to reserve 27 feet of parking space on Water
Street North of Myrtle Street directly behind the gas station. This is instead of 27 feet on
Water Street behind Leo's Malt Shop.
COMMENTS
Number of spaces required
In Trolley Tours' preferred location behind Leo's Malt Shop, the yellow no parking zone
was considerably longer than the 30 feet minimally required. So, some of the no parking
zone could have been converted into the parking space for the trolley. Consequently, only
one space would have been needed for the 27 foot long trolley. (See attached map.)
However, the yellow no parking zone behind the gas station just meets the 30 foot
minimum requirement. No space can be given up to lengthen a 20 foot parking space.

Therefore, both parking spaces behind the gas station will need to be reserved. (See
attached map.)
Fee
The cost of the reserved parking space needs to be determined by the City Council.
Though, the Parking Commission should make a recommendation on the amount. Factors
to be considered in setting the fee include: 1) the fee paid by Stillwater Trolley Company;
2) the Parking Commission's recently recommended fees for private use of public parking
spaces; and 3) the effect of moving the trolley to a spot favored by the City and local
businessmen.
Stillwater Trolley Company has two reserved parking spaces on Nelson Street. They are
paying $500 apiece for the spaces; a total of $1,000 a year. The price has not been
increased since 2003.
If the Parking Commission's recently recommended fees were applied, the fee for one
reserved spot on Water Street (between April 1st and October 315t) would be $1,7491. The
cost for two spaces would be $3,498. However, it was recognized by the Parking
Commission that for certain uses such as a trolley, the recommended fee represents the
beginning point of a discussion by the Council to determine the actual cost.
Since Stillwater Trolley Company is paying $500 for each of the two trolleys being parked
on Nelson Street, staff believes that $1,749 for each parking space is too high. Instead,
staff would recommend charging $645 for a space, which represents $3 per day. It may
then also be appropriate to consider increasing the cost per space for Stillwater Trolley
Company to $645 per space when their agreement is reapproved for 2011.
Finally, the Commission should deliberate whether Trolley Tours LLC should be charged for
one space or two spaces. In Trolley Tours' preferred location behind Leo's Malt Shop only
one space is necessary because of the excess yellow no parking zone. To accommodate
local businessmen, and to locate in a spot preferred by City staff, Mr. McGlynn has agreed
to relocate. But in the relocated space there is no excess yellow zone. Consequently, the
trolley must take two parking spaces. Perhaps in recognition of the Trolley Tours
concession, the City could consider charging for only one spot.
ALTERNATIVES
The Parking Commission has the following alternatives.
1. Recommend approval of the relocated reserved parking for Trolley Tours and
recommend a charge of $645 (or whatever fee the Commission finds to be
appropriate) for the reserved parking.

RECOMMENDATION
Since Trolley Tours LLC is making a concession to use a location Tess desirable to them in
order to satisfy the wishes of local businessmen and City staff, and their preferred location
would have only required one reserved parking space, staff recommends Alternative 1.

RE: Request by Rivertown Commons Resident for 24/7 pass in Ramp
BACKGROUND
Mr. Allen Okerman requested a residential parking permit for the municipal ramp this
winter. Though the Council agrees with the Parking Commission's recommendation not to
allow residential permits in the ramp, they found that during the winter it made sense to
allow handicapped residents to buy parking ramp permits this year on a trial basis.
The Parking Commission's policy, agreed to by the Council, is that the City will not sell
residential permits for the ramp. There are four reasons for this policy:
1. Economic Development Project - The parking ramp was constructed with
Tax Increment Financing (TIF) funds to encourage economic development and to
support downtown businesses. It is not a residential parking facility and the more
residential parking that is permitted in the ramp, the less it can fulfill its primary
purpose as an economic development tool.
2. TIF Funding - Since TIF funds were used for this public project, only 10% of
the facility can be used for private purposes such as residential parking.
3. Development Agreement - As assembly of the land for the parking ramp
was negotiated, Trinity Lutheran Church agreed to give land to the City in return for
free parking on Sunday mornings. The intent of this was to create more parking
spaces for the churches in the area. Each space that is permanently occupied by a
residential vehicle reduces the number of spaces available on Sunday mornings.
4. Event Parking Revenue - Each space that is permanently occupied by a
residential vehicle eliminates event parking revenue for that space. Event parking
revenue is critical to generating operational and maintenance funds for the facility.
Given the concerns of the Parking Commission, the City Council has adopted a policy that
the process for receiving such a residential permit should be demanding. Therefore,
neither City Staff nor the Parking Commission issues these permits. It is something that
only the City Council can do.

COUNCIL ACTION
The Council approved the sale of seasonal residential passes in the ramp on a trial basis with the
following conditions:
1. A total of 17 seasonal residential passes may be sold by the City this winter season. Sale of
the 17 seasonal passes will be on a first come, first served basis. Together with the 8
reserved spaces for Rivertown Commons residents, the total number of residential passes
would be 10% of the parking spaces in the ramp.
2. A seasonal residential pass may be sold by the City only if the vehicle has been issued a
handicapped parking permit by the State of Minnesota.
3. The seasonal permit will only be valid between October 1st and April 30`h
4. Prior to offering seasonal residential passes next winter season, the program will be re-
evaluated by the Parking Commission and City Council.
5. The permit is not transferable.
6. The cost of manufacturing and installing a reserved parking sign shall be borne by the
permit holder.
REQUEST
The City Council has requested the Parking Commission to recommend a fee amount for the
seasonal residential pass.
FEE CONSIDERATIONS
1. The cost of the seasonal permit should not be less than the pro -rated cost of the $300 per
year paid by Rivertown Commons for each of their 8 reserved spaces. That would be a pro-
rated cost of $25 per month. This amount covers ramp operational costs.
2. The 8 parking spaces for Rivertown Commons exist because of the 8 surface spaces they
had prior to constructing the ramp. Consequently, the cost of the 8 spaces was subsidized
by the City. They were not charged for facility construction costs, only operation costs.
3. It would be reasonable to consider charging more for the additional 17 seasonal residential
permits, because it is hard to justify subsidizing those spaces.
4. At a construction cost of $22,000 a space, with an expected life of 50 years, the annualized
construction cost of a space would be $440. This is about $37 a month.
5. Since the parking space would likely sit vacant throughout the entire winter, it may not be
justifiable to charge $62 per month for the permit ($25 operation cost + $37 construction
cost). Perhaps it could be discounted by one third to $40 per month.
