ADJOURN City of Stillwater Heritage Preservation Commission May 3, 2010 Present: Howard Lieberman, Chair, John Brach, Micky Cook, Robert Goodman, Jeff Johnson, Jerry Krakowski, Roger Tomten and Scott Zahren Staff present: Planner Mike Pogge Approval of minutes: Mr. Brach pointed out he was not officially a member as of the April 5 meeting; he was in attendance as a visitor. Mr. Brach also noted a misspelling of his name, Brach, not Bracht. Mr. Lieberman, seconded by Mr. Johnson, moved approval of the April 5, 2010, minutes as corrected. OPEN FORUM No comments were received. PUBLIC HEARINGS Case No. DEM/DR/2010-09 Demolition request for a 1-1/2 story duplex and to consider a request for review of a new residence to be moved onto the property in compliance with the Neighborhood Conservation District (RB, Two Family Residential District) requirements at 415 Sherburne St. S. in the RB, Two Family Residential District. Stephen Schaffer, applicant. Scott Wille, owner of STW Construction Services, was present representing the applicant. Mr. Lieberman briefly reviewed the request and some information regarding the condition of the existing structure. Mr. Johnson noted for the record that the existing structure is a duplex, not a single-family home, as indicated in one portion of the agenda material. Mr. Wille noted that the existing garage will remain, not be demolished, as indicated in the agenda material. Mr. Johnson said the information submitted in support of the demolition request does cover the nine required points for issuance of a demolition permit. Mr. Johnson said he thought one of the big elements in considering a demolition request is how much a structure contributes to an historic neighborhood, as well as the architecture of the structure. Mr. Johnson pointed out that much of this neighborhood was on the fringe of Stillwater's development at the time it was built with many of the neighboring homes from the 1950s and that vintage. Mr. Johnson said, unfortunately, this home is in poor condition and is a reminder of what poor maintenance over the years and lack of attention to maintenance can do; he said that is demonstrated in the letter from the insurance carrier. Ms. Cook asked how long the current owner has owned the property; Mr. Wille responded that the applicant has lived there for the 20 years he has owned the house. Mr. Zahren wondered whether the applicant would take any better care of the home he proposes to move to the property. Mr. Wille said there are medical conditions involved with the maintenance of the house. Ms. Cook said in her view each of these old homes are stand-alone homes, with historical significance based on age alone; she said she was concerned about the precedent of tearing down a building that looks better than a number of others in the City. Mr. Johnson agreed with the concern regarding demolition by neglect and some people's notion that because it is an old house it doesn't warrant the maintenance and care to preserve it or the effort to rehab it when the house gets to this condition. Mr. Brach said he would not like to see a home of this vintage demolished, but he said he thought the letter from the Semple Building Movers talking about the conditions of the sills and joists is pretty significant problem when it gets into rehabbing a home like this. Mr. Goodman said if the house had kept its original look, without the numerous alterations over the years, it might have been a modest addition to the neighborhood, but after what has been done to it through the years, it appears as an "unfortunate example" of domestic 1 City of Stillwater Heritage Preservation Commission May 3, 2010 architecture. Mr. Goodman said he didn't see what could be done with the structure to make it look any better or make it any more livable. Mr. Johnson noted the packet addresses all the nine items required for the issuance of a demolition permit and said as the owner wants to stay at this location and there's no reason to think the owner will make an effort to rehab the house, he said he did not see a change in direction in this project by holding out for other opportunities. Mr. Johnson moved to approve the demolition permit as submitted. Mr. Brach seconded the motion. Mr. Lieberman opened the public hearing. The resident of 1125 Pine St. spoke in favor of approval of the request for demolition. He spoke of the many additions to the original structure. He said residents in the neighborhood would appreciate the approval. Mr. Lieberman noted that included in the documentation are a number of letters from nearby residents all in support of the plans, along with several other letters that were received the day of the meeting. Mr. Lieberman said he was troubled by this request and noted that it is not often that a request for demolition of an entire house comes before the Commission. While not a pristine example of 1875 architecture, Mr. Lieberman suggested that history is an evolving concept and as the City begins to lose an historic property here and an historic outbuilding elsewhere, it begins to lose the fabric of Stillwater. He also said he was troubled by demolition by neglect over a period of 20 years, for whatever the reason. He agreed that the cost of rehabbing a house is expensive and economic need is a consideration. However, Mr. Lieberman noted there are a lot of historic house in Stillwater that are simple workers' houses, not homes of B&B quality, and as they are "shrugged off' one at a time, there will be nothing left over a period of years. He said he didn't know if the Commission should automatically approve a demolition because a house needs some work that will cost more than it would cost to demolish and put another structure on the lot. Ms. Cook noted this is the Heritage Preservation Commission and identifying and protecting historic structures is the Commission's overriding responsibility. The resident of 1125 Pine St. said he would like to see something newer or something done to the existing structure because of problems that have occurred there, including a recent drug overdose. Mr. Zahren noted that tearing the house down and replacing with a 1960s home isn't going to solve any drug problem; Mr. Wille clarified the drug problem involved a renter, not the homeowner, and that renter is gone. Mr. Wille said he has been working with the applicant ever since the applicant received the first letter from his insurance company looking at various options from re -roofing to jacking up the basement, and explained how they got to the proposal to move a new house onto the property. Mr. Lieberman suggested that the money proposed to be spent on buying and moving the new structure onto the property would go a long way to improving the existing house. Ms. Cook wondered whether the structural engineer who provided an opinion in this matter has expertise in older structures. Mr. Brach said according to the materials submitted, there is no doubt the existing structure can be renovated and said he thought the numbers provided were very realistic cost estimates. Mr. Wille noted that the costs could go much higher than estimated depending on the conditions of the joists. Mr. Johnson, who noted he is a structural engineer by trade, talked of the problems that can be observed just by looking at the exterior of the structure; he expressed his concern that it is neglect that gets a structure, such as this, to the condition where it is not economical to continue to maintain/rehabilitate the structure — it becomes an economic decision rather than one of historic preservation. Mr. Johnson said he would like to see the existing home stay, but said his motion still stands based on the ordinance, suggesting that perhaps the HPC needs to have some additional discussion regarding the current ordinance. Ms. Cook wondered how much economic considerations have impacted HPC 2 City of Stillwater Heritage Preservation Commission May 3, 2010 decisions in the past; Mr. Johnson stated economic considerations are included in the ordinance to have the homeowner think about other options, but is not a consideration for the HPC in making its decisions. Mr. Tomten asked how long the owner has had a renter; Mr. Wille said for at least 15 years. Mr. Tomten asked about the estimate for a new structure; Mr. Wille said that was based on square footage. Mr. Krakowski asked if the cost for jacking up the house included the addition; Mr. Wille said the cost was based on removing the addition. Mr. Wille said when he got involved in this process, he did not expect to be at this point, noting that he contacted four firms regarding jacking up the house and only one responded, the others wouldn't touch the house due to its condition. Mr. Wille also stated both an architect and structural engineer believe there have been at least four additions to the original structure. Ms. Cook asked if there are any unique features to the interior of the house; Mr. Pogge said it is primarily modern inside. Mr. Lieberman suggested that any action be based on the fact that the house has gone through such substantial renovation since initially constructed that little of the integrity of the house dating back to 1875 is still intact. Mr. Lieberman also suggested that the action reflect the fact that the house is in such a state of deterioration that if left the way it is, it could become a hazard. Mr. Johnson said while not part of his formal motion, his motion was based not only on the fact that the request meets the requirements of the ordinance but, as stated in his preface to the motion, also on the fact that the house proper has had significant modifications over the years where the original historic integrity has been diminished by those additions, along with the fact that the condition, unfortunately by neglect, has gotten to the point where many of the historic elements of the house are lost or would be difficult to maintain or replace. Mr. Brach seconded the amendment to the motion. Ms. Cook wondered about trees on the lot that might be removed during the process of moving a new structure onto the lot; Mr. Pogge said by ordinance that is limited to 20% of the trees on the lot, removal of any more would require the property owner to submit a replacement plan for trees of similar size. Motion to grant the demolition permit passed 6-1, with Mr. Lieberman voting no. Regarding the infill design review, Mr. Lieberman noted there are infill design guidelines that must be followed. Mr. Tomten and Mr. Johnson noted the mass of the proposed replacement structure is very similar to the rest of the neighborhood and of the same vintage as neighboring houses. Mr. Brach said he appreciated the porch addition. Mr. Wille said they want to do something to the front of the house. Mr. Johnson noted there are two views to the house and what appears to be the front may have been a side door, which is why it appears somewhat awkward compared to neighboring houses; Mr. Wille explained how the house would sit on the property. Mr. Johnson suggested that the porch helps make cover up the lack of window symmetry and make it appear more of a front. Mr. Tomten agreed that the porch helps and noted that one of the characteristics of the older architecture of the town is the focus of the living space on the street either using porches or bigger windows facing the street. Mr. Tomten asked about the possibility of adding a window to the kitchen space to enhance the impression of being the front of the house; Mr. Wille explained the interior of the house and placement of the electrical services which would make that difficult. Mr. Tomten moved to approve the infill design review permit, with the added condition that the contractor has expressed an interest in preserving the existing trees at the front of the property. Mr. Lieberman seconded the motion. Mr. Zahren asked about the front porch, whether it would or would not be included. Mr. Tomten said his motion includes a front porch as indicated in the submitted plans. Mr. Wille clarified the condition regarding the trees -- that any tree removed outside of 6' from the house must remain. Motion passed 6-0, with Mr. Lieberman abstaining. Mr. Tomten wondered whether if the City 3 City of Stillwater Heritage Preservation Commission May 3, 2010 had a low interest loan program available, which, he said, might have made a difference in this case. Mr. Wille responded that the owner likely would have made application to such a program. DESIGN REVIEWS Case No. DR/2010-08 Design review of proposed renovation of building exterior at 201 Main St. S. in the CBD, Central Business District. Brian Larson, Larson Brenner Architects, applicant. Continued from April 5, 2010, meeting. Brian Larson was present, along with a representative from Gartner. Mr. Johnson clarified that the project was proceeding with the plans approved last month, with the existing side windows filled in and the awning treatment as discussed and approved; Mr. Larson responded in the affirmative. Mr. Larson provided color samples, a gray for the painted metal — sunscreens and steel channels above the windows and metal panels that form the cornice. A scale model of the proposed signage, two-sided projecting sign, was also provided. The Gartner representative explained some of the details of the proposed sign, including mounting and edging. Mr. Larson said they would propose the signage to be down lighted with a linear fluorescent fixture or a smaller LED linear version. Mr. Tomten asked about the sheen of the color, noting that if the paint is as reflective as the sample, the lighting of the sign will be very difficult. Mr. Larson said the paint would not be a high gloss. Mr. Johnson noted there are street lights and signal pole nearby and wanted to be sure that the proposed signage and sun shield do not obstruct the view of the signal light and that the signal pole/street lights don't result in too much competition for the building signage. Mr. Larson said he has viewed the angles and the signage doesn't come close to the street lights; the signage projects 3'4" from the face of the building so it won't come close to having the impact that the larger overhang previously did. Mr. Johnson suggested perhaps moving the signage to the other side of the canopy; Mr. Larson said the Gartner group liked the proposed location but said he could bring that issue to their attention. Mr. Tomten said he thought a gooseneck fixture, rather than a linear fixture, works better on a wall application at controlling the light; he suggested a linear fixture might result in glare issues that might reduce the effectiveness of the signage. Mr. Tomten suggested using several steel channels to recess the light fixture in the channels and hang the sign down between the channels. Mr. Larson said the fixtures they are looking at are adjustable at the one access; Mr. Larson said they would look at that suggestion. Ms. Cook asked about the flags; the Gartner representative stated they are proposed to add a graphic, color element and would not contain any verbiage. Mr. Lieberman said he liked the banners and color addition. Mr. Larson stated there is a possibility the owner would like to add some accent lighting to the exterior of the building; he provided a drawing and possible fixtures of some proposed exterior lighting, which he said is not a definite proposal at this point. The exterior lighting would be behind the sunscreens so they would not be visible, with perhaps one centered by the main window and on the north side under the main panels of brick to provide a pool of light; he said they would have to look at the building at night after it is opened to see if that might make sense. Mr. Johnson clarified that at this point there is nothing proposed for the east elevation other than the continuation of the cornice. Mr. Krakowski spoke in favor of the more modern look of the lineal fixtures as opposed to the gooseneck fixtures. Mr. Johnson said he thought the proposed accent lighting helps fill in the extra space and provides more "windows" to the building at night, but said he was a little concerned with the light that projects off the end and said he agreed with Mr. Tomten's suggestion to bring the sign in to hide the fixture within the framing. Mr. Larson said they could look at that suggestion to see if it works but said a concern might be from the straight on 4 City of Stillwater Heritage Preservation Commission May 3, 2010 elevation that if the sign is set in, it would sit somewhere in the void instead of the brick. Mr. Tomten said he liked the idea of accent lights but said his concern would be that the fixture not provide a hot spot or bright bulb look at the bottom. Mr. Larson said the accent light is quite small and should not be an issue as viewed from across the street. Mr. Johnson noted for the record that the staff report does not indicate whether the signage is lighted. Mr. Tomten moved to approve the signage with the four conditions listed in the staff report, with a fifth condition that a linear light fixture is proposed for the projecting sign or some other recessed or fully concealed lighting method, and a sixth condition approving the accent lights as described in the handout dated May 3, 2010, with the condition that the accent lights be fully shielded. In was noted that it is location of the lens, not the Tight source, that is of importance. Mr. Johnson seconded the motion. Ms. Cook asked if there are any restrictions from MnDOT regarding projections from the north side of the building; Mr. Pogge said staff and applicant are having conversations with MnDOT. Motion passed unanimously. Case No. DR/2010-10 Design review of signage for Dollar Tree at 2070 Market Drive in the BP- C, Business Park Commercial District. Anchor Sign, LLC, applicant. Mr. Pogge stated the applicant was unable to be present. Mr. Pogge stated the business is expanding into an adjacent location. Mr. Johnson said while not an issue with this sign, he thought there were sign criteria specific to this location; Mr. Pogge said he would look into that. Mr. Zahren moved to approve as conditioned. Mr. Goodman seconded the motion; motion passed unanimously. NEW BUSINESS Extension request for Design Review Permit No. 2008-35 at 1221 Broadway St. N., new construction in the Neighborhood Conservation District. Mr. Lieberman moved to approve the requested extension. Mr. Zahren seconded the motion. Mr. Johnson noted the permit was approved July 7, 2008, not 2007 as indicated in the agenda information and the extension should be to July 7, 2011, not 2010 as indicated. Mr. Lieberman accepted the scrivener corrections as a friendly amendment to the motion. Amended motion passed unanimously. OTHER BUSINESS Mr. Pogge stated he had met with Mike Koop at SHPO and would be meeting with him again. The Preservation Awards will be presented at the May 18 Council meeting, he said. It was noted the next retreat session will be at Teddy Bear Park on Wednesday, May 30, at 6 p.m. Mr. Lieberman expressed his concern about the demolition process that occurred during this meeting and suggested that some "tinkering" should be done with the demolition ordinance as it stands. There was discussion about the possibility of a City low -interest loan program or other incentive program to assist with rehabilitation of homes. Mr. Pogge suggested that language needs to be added to the demolition ordinance that makes it more of a delaying ordinance — currently the ordinance is primarily a "make application" ordinance. Mr. Pogge also suggested that the ordinance has to have some rational basis for denial — a local designation district or denial of properties on the National Register or a combination of the two. Mr. Johnson noted that the current ordinance doesn't provide a strong position for denial if an applicant covers all the nine points required by the demolition permit. There was additional discussion about the demolition permit issued previously in the meeting and alternatives to demolition. 5 City of Stillwater Heritage Preservation Commission May 3, 2010 Meeting was adjourned at 9:25 p.m. on a motion by Mr. Lieberman. LOCATION: 1117 Broadway St N HPC PUBLIC HEARING DATE: June 7, 2010 REVIEWED BY: Community Development Director PREPARED BY: Michel Pogge, City Planne ' BACKGROUND George Middleton, property owner of 1117 Broadway St N, is requesting a demolition permit in order to demolish a portion of an existing single family home. The current structure was built in 1952 according to the Washington County Assessor's office. Since the home is over 50 years old, it is by definition considered to have potential historic significance. Consequently, the Heritage Preservation Commission is required to review the demolition request. This site is in the Conservation Design District; however, since the main structure is not being TOTALLY removed a new addition is not subject to the infill design criteria. 1117 Broadway St N Demolition Page 2 SPECIFIC REQUEST The applicant requests approval of a permit to demolish a portion of the primary dwelling unit. EVALUATION OF REQUEST Chapter 34, Section 34-4 of the City Code states that "if buildings or structures are determined by the community development director to be historic or potentially historic, the application must be sent to the [heritage preservation] commission for review... Buildings or structures determined nonhistoric must be referred to the building official for issuance of a demolition permit." A "nonhistoric structure or building" is defined by Chapter 34, Section 34-2 as a structure or building less than 50 years old... Since the home was built in 1952 it is of potential historic significance and requires review by the Heritage Preservation Commission. Section 34-5 of the City Code lists nine items which must be considered prior to approval of a demolition permit by the Commission. (1) A map showing the location of the building or structure to be demolished on its property and with reference to neighborhood properties; This information is included in the attached application. (2) A legal description of property and owner of record; The legal description of the property is Lots 11, 12, 31, 32 and 33, Block 7 of Carli & Schulenberg's Addition to Stillwater. (3) Photographs of all building elevations; Photos from various angles are included in the packet. (4) A description of the building or structure or portion of building or structure to be demolished; The applicant has indicated they wish to demolish the southern portion of the home as indicated on the enclosed site plan. (5) The reason for the proposed demolition and data supporting the reason, including, where applicable, data sufficient to establish any economic justification for demolition; The applicant indicated in their letter that they would like to reduce the size of the home to build a "performance based" house and decrease their carbon footprint. Additionally, they indicated by reducing the footprint of the home they would be in a position to sell a portion of the existing home site for an additional home site. No information on the cost to renovate the exiting home was submitted with the application. J 1117 Broadway St N Demolition Page 3 (6) Proposed plans and schedule for reuse of the property on which the building or structure to be demolished is located; No plans for the exiting home were submitted with the plan. If a new home site would be created, the new home would be submitted to design review by the HPC. (7) Relation of demolition and future site use to the comprehensive plan and zoning requirements; The current comprehensive plan land use designation for the property is Lozv/Medium Density Residential and is zoned RB, two-family residential. This site is in the Conservation Design District; however, since the main structure is not totally being removed a new addition would not be subject to the infill design criteria. The new home site would be subject to the infill design criteria. (8) A description of alternatives to the demolition; The applicant indicates that an alternative would be to keep the exiting footprint and renovate the interior of the home. (9) Evidence that the building or structure has been advertised for sale for restoration or reuse and that sale for restoration or reuse is not economically feasible. The applicant did not advertise the structure for sale since it involves only a portion of the structure that cannot be reasonable relocated. ALTERNATIVES The Heritage Preservation Commission has the following options: 1. Approve the demolition permit as presented. 2. Deny the demolition permit if the applicant has not proved the necessity for demolishing the garage or if the Commission believes, there are alternates to demolition. 3. Continue the public hearing until the July 7, 2010 Commission meeting. The 60-day decision deadline for the request is June 24, 2010; however, staff can extended it for an additional 60 days. RECOMMENDATION Review and take action on the request. attachment: Application and supporting documents from the applicant 27 April, 2010 City of Stillwater Heritage Preservation Commission 216 Fourth Street North Stillwater, MN 55082 Dear Members, I own a piece of property located at 1117 North Broadway. The house was built in 1951. The house is a single story, wood frame ranch style house. The house was designed and built by a gentleman named Steinmetz. My wife and I are the second owners of this property. The property, Lots 31, 32, 33, 11 & 12, Bock 7 of Carli & Schulenberg's Addition to Stillwater is owned by George & Kathleen Middleton. Please see attached drawing. It is our desire to demolish the Southern part of the building which currently comprises the garage, laundry room, mechanical room, a half bath, and the kitchen (see attached Proposed Demolition Plan). There are two primary reasons for this demolition request. First is lifestyle. It is our intention to remodel the remaining portion of the house into what I term a "Performance Based" house. We are committed to decreasing our carbon footprint, and as such, our housing must reflect and address that choice. Our new home will incorporate new technologies and materials that will help us reduce power usage, and hopefully generate electricity with some type of solar PV installation. In addition, the new house massing will open our East West orientation to take advantage of our passive solar potential. The second reason is financial. The existing house spans 4 of the 5 existing lots. By reducing the footprint, we would potentially be able to sell a buildable lot at some point in the future. Maybe we could use the money to pay our health insurance. The alternative to our proposed partial demolition would be to keep our existing footprint and massing, and remodel the interior of the home to fit our lifestyle. And, of course, perhaps not have money to pay for health insurance. We thank the Commission and Committee Members for their time in reviewing this proposal, and apologize for venting about health insurance. The applicant is requesting wall signs facing Myrtle St, Water St, and Chestnut St. Additionally, the applicant is requesting a projecting sign on Chestnut St. the proposed of these new signs is to replace and discontinue using the temporary signs that are currently used on the site, other than during special events and with 30-day temporary signs permit as authorized by the City Code. All of the wall signs are proposed to be aluminum with a wood frame painted gold on a green background. The letters are proposed to be gold color injected formed plastic letters to add definition. The wall sign along Myrtle is proposed above the side entrance and will be illuminated with goose neck lights. The size of the sign is 33" by 96" for a total of 22 square feet. The wall signs along Chestnut St and Water St are proposed to be 16" wide by 96" tall for a total 4 101 Water St S Page 2 of 10.6 square feet. The applicant is requesting that the signs be placed at above the main entrance at the corner of Chestnut St and Water St. The top of the sign will be approximately 31 feet above the sidewalk and would require a variance from the Planning Commission since it exceeded to allowable 15 foot height limitation for wall signs. The sizes of the proposed wall signs meet the requirements of the code. The proposed projecting sign is for Charlie's Irish Pub and is in the southeast corner of the building. The proposed sign is 30" by 30" for a total of 6.25 square feet. The maximum allowable size for a projecting sign is 6 square feet therefore the proposed sign will needed to be slightly reduced in size or a variance will need to be obtained from the Planning Commission. Attached are drawings that detail the proposed signs. Lighting To improve lighting on the outdoor patio, the applicant is proposing to add lights to improve the night lighting condition. The applicant is proposing to use fixtures similar to those that currently exist on the patio and add up to nine additional fixtures. Enclosing an outdoor storage area Currently a number of conference tables are stored under the outdoor stairs. To meet the code requirement that outdoor storage be screened, the applicant is proposing to add a door and correct the condition of the exiting lattice that will fully enclose the table storage area. Outdoor Pergola A wood pergola is proposed to be installed in the northwest corner of the deck. The enclosed drawing details the look of the pergola. Other Issues at Water Street Inn • Trash Dumpsters Per the approved Special Use Permit (SUP) as agreed to by the original owner and architect and recorded in the chain of title all trash receptacles are required to be located inside the building. At some point, the trash was moved outside without the approval of the City and in violation of the approved SUP. The current enclosure is in disrepair and needs to be replaced. To that end, the City sent a letter to Mr. Dougherty on April 23, 2010 stating that the enclosure needed to be replaced. In conversations with Mr. Dougherty that resulted due to the letter, it became clear the City may have an interest in land where the enclosure sits as part of various improvements the City may complete in Lowell Park in the near term. The City Staff has agreed to postpone action on the enclosures for 90 days until August 6th to allow time for the City to develop plans that would help the city decide if it is appropriate for the City to acquire this property. After August 6th Staff plans to work with Mr. Dougherty to quickly resolve this issue. Any plans for a new trash enclosure will be submitted to the HPC for review and consideration. 101 Water St S Page 3 • Outdoor string lights Mr. Dougherty has agreed to remove the outdoor string lights as part of the light improvements he is making on the patio. • Accessory Structure/Outdoor Bar Chapter 31-209 (c) 2.i outlines the when a design permit for a structure in the downtown area is required and states: Sec 31-209 Design Permits. Design permits shall require the following: (c) Required when. A design review permit is required for the following: (2) Type of projects and uses with the downtown plan district and the west business park plan district: i. New commercial structures. Chapter 31-101.156 defines a structure as: Structure means anything constructed or erected by humans except for fences or walls or decks 18 inches or less in height. The outdoor bar that is currently on the Water Street Inn patio was constructed and occupied without the required design review by the City. With that said, according to City liquor control records, it is staff's best estimate that the bar was occupied in the fall of 2003. Since this was constructed without proper approvals, a property owner can never receive grandfather rights for the structure without some action on the City's part. However, taking into account that the structure has been in place for over 6 years Staff has been advised by City Attorney Magnuson that we would have a tough time pursuing a formal enforcement action at this late date. With that said, prior to any maintenance or replacement of the structure, formal design review process will need to be followed. The current structure as it exists today has been formally documented and the City will enforce the requirement that a design review permit be obtained in the future if the structure is altered. • Exterior Fire Exit/ stairway During the original construction of the building, an exterior fire escape was installed along the north side of the Water Street Inn building. During a review of the design review files, staff was not able to find where the escape was to be temporary. Additionally, I have consulted with City Building Official Cindy Shilts about this issue. The Minnesota Building Code permits outdoor fire escapes as a second means of egress. 101 Water St S Page 4 • Outdoor Table Canopies The Commission in the past has raised concerns with the use of outdoor table canopies that carry advertising. On July 11, 2006 the Council made a policy decision that allows umbrellas with logo/verbiage signage. RECOMMENDATION Consider/ review the request and take an action. Initially the applicant was looking to remove the paint; however, upon inspection and consultation with various parties they have elected to simply clean up the existing surface and repaint the brick a similar color. The building is located in the core Stillwater Commercial Historic District as listed on the National Registry of Historic Districts. The building itself is a contributing building to the Historic District and was built sometime prior to 1884. The Downtown Design Manual Guidelines provides direction for storefront facades including requirements for transom windows, display windows, entry doors, and kick plates. The bottom of the second floor is currently at the top of the display windows which prohibits the introduction of transom windows. The applicant indicated in their letter that the storefront will use wood trimming with aluminum framing for the glass and an aluminum door. Since this is a contributing building, some consideration should be given to requiring the use of an all wood frame and wood door. This would be similar to what was recently completed at the Stillwater Olive Oil Company store i 226 Chestnut St E Page 2 front which was also a contributing building. Several products are available from various vendors that could accomplish the same storefront look with all wood products. The applicant noted that a recessed light would be installed above the front entry door. Specific details on the lights were not submitted. The light fixtures would appear to be recessed can style lights. Detailed lighting specifications should be submitted and shielded light fixtures should be used with the appropriate wattage of light bulbs. Finally, the applicant notes that an awning will be used and some text/signage for the tenant will be applied to the awning. Since this was not included in the application package they will need to resubmit for design review on the awning. Members of the Commission: Gartner Properties, owners of the property located at 226 Chestnut Street in Stillwater, Minnesota intend to replace the existing entrance door and glazing of the building's storefront. The existing storefront has a deteriorating tile base and single -glazed aluminum storefront windows, with a wooden signage panel spanning the facade above the window. The remaining building facade is painted brick up to a second story cornice. The proposed changes to the existing building exterior follow the existing style and detailing of similar building storefronts, including details and features that are compatible with the adjacent buildings. 1. The wooden signage panel will be removed. The facade behind the panel is rough stucco over wood, and exposed wood and steel structure. This will be covered by painted MDF/wood/Miratec trim and flat panel system as indicated on the attached drawing. A simple black fabric awning on a metal frame (not shown on drawing) will also cover this panelized area, extending full width of • the building and height from the storefront window to underside of the second story window sill, with the business name on the 8" to 12" high front valence. 2. The existing brick will be painted a similar -to -existing warm/offwhite color. 3.' The building itself is a contributing building to the Historic District and was built in 1910. Front Facade and Canopy The front facade improvements include the installation of a new store front including kick panels, transom windows, display windows, and door. Additionally they are proposing a fabric canopy. The Downtown Design Manual Guidelines provides direction for storefront facades including requirements for transom windows, display windows, entry doors, and kick plates. The applicant proposed to remove the lower portion of the storefront, sign area, and brick under the storefront and replace it with an all wood storefront and door. Transom windows are proposed to be installed in the current sign location. The existing brick above the current sign area appears to be the only original brick on the building. The lower portion and storefront kickplate areas appear to be new to the current structure. Staff continues to look for an older photo to confirm this. If the brick 229 Main St S Page 2 is not original to the building, their proposal seems appropriate. Natural gas lights are proposed on the front and side of the building. The front facade will also have a fabric awning. The fabric will be black with gold pin stripes. The Lucky's Pub logo will also be placed on the center of the awning. The size of the logo meets the requirements of the sign code. Details on the exact style (traditional crank or aluminum framed) was not clear in the drawings. Walkway Today, south of proposed restaurant is a pedestrian walkway that connects Main St and Water St. Originally, this area was part of a building that was located on the site and burned down. For a number of years the area remained vacant and later was improved to become a pedestrian walkway. The walkway/open space is part of the property containing Autumn Cottage and the proposed restaurant. A temporary easement was conveyed to the City for a pedestrian walkway and allows the property owner to cancel the easement after a 30-day notice. As part of this plan, the applicant is proposing to maintain a five-foot pedestrian walkway along their south property line and construct a patio/outdoor dining in the northern section of the corridor. Today the walkway is approximately 23 feet wide. Patio As part of this, the applicant is proposing to install a ground level patio in the northern 18 feet of the open space corridor. The area will include 8 - four chair tables, eight seats around a fire pit feature, and a ten seat bar. Through the side of the existing building three sets of raised steal storefronts are proposed to be installed that when operated will rotate open to a 90 degree angle. Two sets of entry doors are also proposed along the patio. A wood fireplace is also proposed for the patio. Two steel beams are proposed to extend from the fireplace and connect back to the building. The perimeter of the patio will be enclosed with a decorative fence with landscaping installed between the patio and walkway. Building addition Attached to the building is a proposed two-story addition with a full basement. The main material is brick that will match the exiting brick on the front of the building. The second floor will have both an enclosed area and outdoor patio. The basement will be used for storage and cooler space. Access to the deck will be available from both stairways inside the building and outside the building. The Minnesota building code requires two means of egress from the second floor. In discussions with the applicant, requiring the second set of stair to be internal to the building would require the addition to be wider than the main part of the building. Per the State building code the second set of stairs are allowed to be external. 229 Main St S Page 3 This alternative seems reasonable and would appear to allow the addition to keep the same profile as the existing building. Additionally, no elevator is required to the second floor since it provides less than 30 seats and provides the same services as the first floor. Trash Enclosure The applicant is also proposing to install a trash enclosure in the southeast corner of the site. The enclosure will be constructed of material similar to the new building addition and be totally enclosed with a roof. ALTERNATIVES The Heritage Preservation Commission has the following options: 1. Approve the requests in whole or in part. 2. Deny the requests. 3. Continue the request for more information. The 60 day decision deadline for the request is July 16, 2010 and the next Heritage Preservation Commission meeting is scheduled for July 7, 2010. STAFF RECOMMENDATION Approve the request as conditioned. CONDITIONS FOR APPROVAL 1. Project shall follow the plans dated May 21, 2010 and date stamped June 3, 2010 as on file in the Stillwater Community Development Department. 2. No rooftop venting or other penetrations are allowed except those specifically shown on Sheet A2 of the plan set dated May 21, 2010 and date stamped June 3, 2010. 3. Prior to the issuance of a building permit an exterior lighting plan shall be submitted, reviewed, and approved by the City Planner. The lighting plan shall show the fixture type, wattage, height, location and exterior lighting intensity. All lighting shall be directed away from the street and adjacent properties. Light sources shall be shielded from direct view and protected from damage by vehicles and pedestrians. 4. Prior to the issuance of a building permit, a drainage plan must be submitted to, reviewed by and approved by the City Engineer. 5. Prior to the issuance of a building permit, the plan shall be submitted to the Middle St. Croix WMO for review and any changes to the plan required by Middle St. Croix WMO and found reasonable by the City Engineer shall be incorporated into the plans. 6. Prior to the issuance of a building permit the applicant shall submit all required permits for building in the flood fringe and evidence from a licensed professional 229 Main St S Page 4 engineer or architect that all local, regional, state and federal flood fringe development regulations are being followed. 7. All gutters, downspouts, flashings, etc. shall be of a color that matches the adjacent surface. 8. The street address of the building shall be displayed in a location conspicuous from Main Street. 9. All required landscaping shall be installed prior to final project inspection. 10. All trash dumpsters, grease dumpsters and other refuse containers shall be stored in the trash enclosure. 11. All construction activity shall conform to the City's noise ordinance. Construction during dry periods shall mitigate dust problems. 12. All minor modifications to the final design review permit shall be approved in advance by the Community Development Director. All major modifications shall be approved in advance by the HPC. Determination of the distinction between "major" and "minor" shall rest with the City Administrator. 13. Continuous concrete curbing shall be installed to separate street parking areas from pedestrian walkways. 14. Any of the brick pavers that are disrupted along Main Street shall be salvaged and reinstalled before final inspection of the project. 15. The signage on the canopy identifying Gulf Oil. The location of the site is at 103 Main St N. The applicant has not submitted any proposal for the pylon sign at this time. The proposed building signage will be applied to the existing building parapet and calls for the Lucky's Station logo in orange, white and black with the words "Lucky's Station" in white. The application calls for a white and orange striping along the upper portion of the sign all on a black background. It seems reasonable to limit the logo and words on the Main Street and Water Street side to one Lucky's Station logo. The applicant is also proposing to reface the gas pump canopy for Gulf Gas. After a number of conversations with representatives from Gulf, they have agreed to go away from their current logo and canopy design and proposed a vintage gulf logo and pin stripping design.
