HomeMy WebLinkAbout2002-11-13 CPC MINCITY OF STILLWATER PLANNING COMMISSION NOVEMBER 13, 2002 Chairperson Hultman called the meeting to order at 7:00 p.m. Present: Commissioners Bealka, Gag, Middleton, Peroceshi, Ranum, Teske, Wald, Council Representative Zoller Others: Community Development Director Russell APPROVAL OF MINUTES CASE NO. V/02-70. A variance to the front yard setback (30 feet required, 11.7 feet proposed) for the construction of a new single family residence on lot north of 721 South Martha Street in the RB, Two Family Residential District. Bahr Construction, applicant (continued from October 14, 2002 meeting). The design for the home is not yet complete. Motion made by Commissioner Wald, seconded by Commissioner Middleton to table item until the next meeting. Motion passed unanimously. CASE NO. V/02-73. A variance to the front and rear yard setbacks (Front yard: 30 feet required, 23 feet requested. Rear yard: 25 feet required, 6 feet requested ) for an addition located at 333 West Aspen Street in the RB, Two Family Residential District. Mark and Alice Walker, applicants. Mr. Walker requested a variance for an addition that is in the process of being constructed. The addition is a one level 6 foot by 20 foot infill between the main structure and the garage. This would connect the garage to the house creating more impervious surface coverage. Impervious coverage is already over the 30% coverage permitted by the zoning ordinance. The current amount of impervious coverage would not change. Ted , 921 Martha Street was concerned about the Planning Commission dealing with this matter after the fact. Motion made by Commissioner Middleton, seconded by Council Representative Zoller to approve the variance to the front and rear yard setback for an addition located at 333 West Aspen Street with the following conditions: The addition shall be similar in architectural style, color and materials to the main structure. Motion passed. 6 fore, 3 against. • CITY OF STILLWATER PLANNING COMMISSION NOVEMBER 13, 2002 CASE NO. V102-74. A variance to the street side yard setback (30 feet required, 12 feet requested) for the construction of a deck addition located at 302 South Third Street in the RB, Two Family Residential District. Fred Kallinoff, applicant. Mr. Kallinoff requested a variance to the street side (north) yard setback to construct a deck. The north side of the existing house sits on the property line and is not in compliance with the 30 foot setback requirement. The house is older than the regulation. There are very limited areas of the site that can be used due to the topography of the land. Commissioner Middleton inspected the property and stated the deck will not be closer to the street than the house. Council Representative Zoller believes there is not other place to build the deck. Commissioner Teske felt the addition of a deck would be an improvement. Motion made by Council Representative Zoller, seconded by Commissioner Wald to approve the variance to the street side (north) yard setback for the construction of a deck located at 302 South Third Street. Motion passed. 8 fore, 1 against. CASE NO. V/02-75. A variance to the rear yard setback (25 feet required, 10 feet requested) for the construction of a gazebo located at 504 South Owens Street in the RB, Two Family Residential District. Patrick O'Neal, representing Marcella Thorene, applicant. Mr. O'Neal requested a variance to the rear yard setback for the construction of a 10 foot attached gazebo, located on the southwest corner of the existing deck. The house is situated on a corner lot. The Commission felt that there are other possible locations for the gazebo to be built that would not require a variance. Motion made by Commissioner Middleton, seconded by Commissioner Ranum to deny the variance to the rear yard setback for the construction of a gazebo located at 504 South Owens Street. Motion failed. 4 fore, 5 against. Motion made by Commissioner Peroceshi, seconded by Commissioner Teske to approve the variance to the rear yard setback for the construction of a gazebo located at 504 South Owens Street. Motion failed. 2 fore, 7 against. • 2 CITY OF STILLWATER PLANNING COMMISSION NOVEMBER 13, 2002 The Commission would like the applicant to return to next months meeting to with different plans for discussion. Motion made by Commissioner Ranum, seconded by Commissioner Wald to table the item until the next meeting. Motion passed. 8 fore, 1 against. CASE NO. SUB/02-76. A resubdivision of Lots 1 and 2 into one lot of .33 acres located at 2103 Schulenberg Alley in the RB, Two Family Residential District. Dan Challeen, applicant. The Commission requested that Mr. Challeen come to the next meeting with revised plans. The garage would be located too close to the street. Motion made by Commissioner Teske, seconded by Commissioner Bealka to table item until the next meeting for further discussion. Motion passed unanimously. CASE NO. V/02-77. A variance to construct a 24' x 30' garage with a 3 foot setback (30 feet required) at 2103 Schulenberg Alley in the RB, Two Family Residential District. Dan Challeen, applicant. i Motion made by Commissioner Teske, seconded by Commissioner Ranum to table item until the next meeting for further discussion. Motion passed unanimously. OTHER ITEMS Commissioner Teske was concerned with the Planning Commission assisting the applicants with the design of projects if what the applicant presents is not feasible. It is not the job of the Planning Commission to offer suggestions.
