HomeMy WebLinkAbout2002-09-09 CPC MINCITY OF STILLWATER PLANNING COMMISSION SEPTEMBER 9, 2002 Chairperson Hultman called the meeting to order at 7:00 p.m. Present: Commissioners Bealka, Gag, Middleton, Peroceshi, Ranum, Teske, Wald and Council Representative Zoller Others: Steve Russell, Community Development Director APPROVAL OF MINUTES Motion made by Commissioner Wald, seconded by Commissioner Middleton to approve the August 12, 2002 commission minutes. Motion carried unanimously. Case No. V102-55. A variance to the front yard setback (30 feet required, 14 feet requested) for the construction of a garage at 322 West Sycamore Street in the RB, Two Family Residential District. Monica McClellan, applicant. (Continued from August 12, 2002 meeting.) This item was continued from the August 12, 2002 meeting so the Ms. McClellan could produce a site plan with the correct location of the garage. is The site plan that was submitted for this meeting had the incorrect dimensions of the garage. Ms. McClellan would like a 16 foot by 24 foot garage, which would require a 11 ft. variance. Ms. McClellan will provide correct information at the next meeting. Motion made by Commissioner Middleton, seconded by Commissioner Wald to table item until the next meeting. Motion passed unanimously. Case No. V/02-59. A variance to the front yard setback (30 feet required, 18 feet requested) to add a basement/new foundation to an existing residence located at 309 E Willow Street in the RA, Single Family Residential District. Daniel Kalmon and Stephanie LeGros, applicants. Ms. LeGros requested a variance to the front yard setback to construct a new foundation to a house that was built in the 1860's. It was built 6 feet below street level and there are constant drainage problems. The new foundation would raise the house about 6'5" from its current location. The change in elevation would put the first floor near street level, providing better drainage around the house. The house is currently sitting 18 feet from the front property line. The septic tank is located directly behind the house, which prevents the applicants from moving the building to meet the setback requirements. CITY OF STILLWATER PLANNING COMMISSION SEPTEMBER 9, 2002 Motion made by Council Representative Zoller, seconded by Commissioner Bealka to approve the variance to the front yard setback to add a new basement/foundation to the existing residence at 309 E. Willow Street with the following conditions: 1. All revisions to the approved plan shall be reviewed by the Community Development Director. Motion passed unanimously. Case No. V/02-60. A variance to the rear yard setback (25 feet required, 22 feet requested) for the construction of a porch with an addition located at 1006 Abbott Street West in the RA, Single Family Residential District. Jim and Pat Segelstrom, applicants. Mr. and Mrs. Segelstrom requested a variance to the rear yard setback to construct an addition and a porch. There is an existing 9 foot by 12 foot porch in poor condition. Mr. and Mrs. Segelstrom want to replace the existing porch with a 12 foot by 22 foot porch. • Motion made by Commissioner Ranum, seconded by Commissioner Teske to approve the variance to the rear yard setback for the construction of a porch with an addition at 1006 Abbott Street W. with the following conditions: 1. The materials, color and architecture shall be similar to the existing house. Motion passed unanimously. Case No. SUB102-61. A subdivision of a 15,000 square foot lot into two lots of 7,500 square feet each at 221 West Cherry Street in the RB, Two Family Residential District. Hans and Susan Halpren, applicants. Mr. and Mrs. Halpren requested a subdivision of a 15,000 square foot lot into two lots, each 7,500 square feet (50' by 150'). Mr. and Mrs. Halpren would like to build a home and a garage on the vacant lot that will be similar to the existing house. Jean Hamm, 213 W. Cherry Street requested that the Commission require Mr. and Mrs. Halpren to have the lot surveyed before the subdivision is approved. Ms. Hamm is concerned about the location of the property line. Council Representative Zoller also thought a survey should be required before subdivision. 2 CITY OF STILLWATER PLANNING COMMISSION SEPTEMBER 9, 2002 Motion made by Commissioner Gag, seconded by Council Representative Zoller to approve subdivision of a 15,000 square foot into two lots of 7,5000 square feet each at 221 West Cherry Street with the following conditions: Lot is to be surveyed Motion passed. 7 fore, 2 against. Case No. SUP/02-62. A special use permit for a Type II home occupation request for an esthetician's business out a residence at 209 West Laurel Street in the RB, Two Family Residential District. Lori McNally, applicant. Ms. McNally requested approval of a Special Use Permit to operate a Type II home occupation for an estheticians business. Because the operation changed the applicant needs to meet new regulations. The hours of operation will not change. The amount of traffic per hour will not change since there is only one session room. The number of cars on site at one time will not be more than two. Motion made by Commissioner Ranum, seconded by Commissioner Bealka to approve the Special Use Permit for a Type II home occupation for an estheticians business at 209 West Laurel Street with the following conditions: 1. No outside storage or display of products, equipment, or merchandise is permitted. 2. Any retail sales must be accessory or incidental to the primary residential use. 3. Infrequent hobby, craft or art sales are permitted twice per year for not more than six days per calendar year. 4. Any sign must be unlighted and smaller than two square feet. 5. Customers are permitted by appointment only. 6. Not more than 20 percent of the total gross floor area of the dwelling unit may be used for the home occupation, or 400 square feet, whichever is less. 7. No activity or equipment may be used that creates noise, vibration, glare, fumes, odor, or electric or television interference is permitted if it is detectable by adjacent neighbors. 8. Business hours are limited from 7:00 a.m. to 8:00 p.m. 9. Off street parking must be provided for customers. 10. No more traffic, which is allowed other than in a normal residential area. 11. No more than one nonresident employee is allowed. Type II home occupations are subject to review upon complaints from the neighborhood. If in the opinion of the zoning administrator the complaints are substantial, a public hearing must be held at which time additional conditions CITY OF STILLWATER PLANNING COMMISSION SEPTEMBER 9, 2002 may be added to this special use permit or in the alternative, the Type II home occupation permit may be revoked. Motion passed unanimously. Case No. V/02-64. A variance to the front yard setback (30 feet required, 26 feet requested) for the construction of a ramp located at 415 West Wilkins Street in the RB, Two Family Residential District. Nancy Rowe representing applicant. Ms. Rowe represented her mother, Lucille Crowley. Ms. Rowe requested a variance to the front yard setback for the construction of a wheelchair ramp. Motion made by Commissioner Peroceshi, seconded by Commissioner Teske to approve the variance to the front yard setback for the construction of a wheelchair ramp at 415 West Wilkins Street with the following conditions: 1. All revisions to the approved plan shall be reviewed by the Community Development Director. Motion passed unanimously. Case No. V/02-65. A variance to the rear yard setback (5 feet required, 2 feet requested) for the construction of a two-car garage located at 604 Laurel Street West in the RB, Two Family Residential District. Steve and Kate Constant, applicants. Mr. and Mrs. Constant want to amend the variance request and will return for the next meeting. Motion made by Commissioner Ranum, seconded by Council representative Zoller to table item until the next meeting. Motion passed unanimously. Case No. V/02-66. A variance to the rear yard setback (5 feet required, 3 feet requested) for the construction on a garage at 720 1St Street South in the RB, Two Family Residential District. Elena and Brett MacDonald, applicant. Motion made by Council Representative Zoller, seconded by Commissioner Wald to table item until the next meeting. Motion passed unanimously. 4 CITY OF STILLWATER PLANNING COMMISSION SEPTEMBER 9, 2002 OTHER ITEMS Future Use of Old Public Works Site, 215 North 5t" Street The city was approached by a realtor to sell the old Public Works site for 8 units of assisted housing. The City Council requested the Commissions input. Michael O'Brien inquired about the possibility of purchasing some of the land the Public Works Building is on for housing for social agencies. The Commission would like a public land use study done before land is sold. Motion made by Commissioner Ranum, seconded by Commissioner Teske to recommend that Council direct city staff to prepare a city facility master plan. Motion passed unanimously. Gary Wind, a Stillwater resident, inquired about the progress of the South Boutwell Area Plan. The Commission did not have any new information for Mr. Wind. ADJOURNMENT Motion made by Commissioner Wald, seconded by Commissioner Bealka to adjourn the meeting at 9:45 p.m. Motion passed unanimously.
