HomeMy WebLinkAbout2002-08-12 CPC MINCITY OF STILLWATER PLANNING COMMISSION AUGUST 12, 2002 Chairperson Hultman called the meeting to order at 7:00 p.m. Present: Commissioners Bealka, Gag, Middleton, Teske, Wald Others: Steve Russell, Community Development Director Absent: Commissioners Ranum, Peroceshi and Council Representative Zoller APPROVAL OF MINUTES Motion made by Commissioner Wald, seconded by Commissioner Middleton to approve the July 8, 2002 commission minutes. Motion carried unanimously. Case No. SUP/02-49. A special use permit for a Bed and Breakfast (Aurora Staples Inn) located at 303 North Street in the RB, Two Family Residential District. Kathy and Jerry Helmberger, applicant. Continued from July 8, 2002 meeting. Mr. and Mrs. Helmberger requested a special use permit to operate a five- guestroom bed and breakfast, the Aurora Staples Inn. Mr. and Mrs. Helmberger • purchased the property and moved in on July 31, 2002. The exterior of the building, signage and everything else will remain the same. Motion made by Commissioner Middleton, seconded by Commissioner Wald to approve a special use permit for a bed and breakfast (Aurora Staples Inn) with the following conditions: 1. The Manager of the residence shall live on-site. 2. One parking space for each guest room shall be set aside and marked "FOR GUEST ONLY". Two spaces available on site for manager. 3. If provided, dining facilities for breakfast shall be available o registered guests only (not available to the public). 4. No liquor shall be sold on premises. If wine is served, a wine license must be obtained from the City. (Ord. #768 Adopted 10-22-92) 5. One four square foot sign is allowed on-site consistent with the architectural character of the building (maximum height four feet). 6. Adequate pedestrian scale lighting shall be provided between the bed and breakfast and parking. 7. No general external lighting of the site that may impact the surrounding residential area is allowed. 8. The special use permit is not transferable. New property owners or managers shall require a new special use permit. CITY OF STILLWATER PLANNING COMMISSION AUGUST 12, 2002 9. The bed and breakfast use permit shall be reviewed before the Planning Commission and City Council for revocation if the Community Development Director receives complaints regarding the bed and breakfast use. 10. No additional bedrooms can be used for the bed and breakfast. Five bedrooms is the maximum allowed under the Ordinance. 11. The Heritage Preservation Commission shall determine the maximum number of guestrooms. Special Use Permit for Special Events 1. A maximum of six special events (large functions defined as business meetings, bus tours, bridal and wedding showers, anniversaries, weddings and wedding receptions, and church functions over twenty persons allowed per month. 2. All special event visitors shall park on site or a controlled remote location. 3. Limit of groups: 40 capacity as approved unless special approval is obtained from the City Council. 4. Food must be served by a licensed caterer. 5. All special events shall be over by 9:00 p.m. 6. No open bar on premises for special events. Champagne is allowed on a two- is person/one bottle limit. 7. No outside entertainment or lighting for special events. 8. This permit shall be reviewed upon complaint. 9. Kathy and/or Jerry Helmberger, owners of the property, shall be on site during all special events. This use is not transferable. Motion passed unanimously. Case No. V/02-30. A variance to the rear yard setback (25 feet required, 20 feet proposed) for the construction of a deck at 201 Boutwell Road in the RA, Single Family Residential District. Clay Kippers and Arnez Construction, representing ACR Homes, applicant. Continued from July 8, 2002 meeting. Mr. Kippers of requested a variance to the rear yard setback for the construction of a deck. Mr. Kippers received a faxed letter for ACR Homes to sign as a condition of approval. ACR Homes has not yet signed the letter. Community Development Director Russell inquired about drainage issues that were brought to his attention by a neighbor. Community Development Director Russell stated since a variance is being requested for the property, the drainage issue should be looked at. 2 CITY OF STILLWATER PLANNING COMMISSION AUGUST 12, 2002 341 Boutwell Place was not concerned about the construction of the deck. He was concerned about getting approval from the association because of covenants that were place the land. Motion made by Commissioner Middleton, seconded by Commissioner Bealka to approve a variance to the rear yard setback for the construction of a deck with following conditions: 1. A building permit shall not be issued until the Community Development Director has received deck approval from the Wildwood Pines 5 n Addition Architectural Association. 2. The deck shall be compatible in style and materials to the house. 3. Plans shall be reviewed and approved by the Building Official. 4. Drainage should be looked at by the City Engineer. Motion passed unanimously. Case No. V/02-51. A variance to the front yard setback (30 feet required, 13 feet requested) for the construction of an attached garage with an addition above • located at 1402 Ramsey Street West in the RA, Single Family Residential District. Joe and Jennifer Flock, applicants. Mr. and Mrs. Flock requested a variance to the front yard setback for the construction of an attached garage with an addition located above. There is an existing one car tuck under garage. Mr. and Mrs. Flock feel the only way to build a suitable garage is to build out towards the front yard. Commissioner Teske felt that the setback is not such an issue since of the elevation of the property. Commissioner Middleton felt that this is a true definition of a hardship and it will improve the home. Motion made by Commissioner Gag, seconded by Commissioner Teske to a variance to the front yard setback for the construction of an attached garage with the following conditions: 1. The garage and addition shall be similar in style and materials as the house. 2. Drainage from the roof shall remain on site. 3. Building plans shall be approved by the City Engineer and Building Official. 0 Motion passed unanimously. 3 CITY OF STILLWATER PLANNING COMMISSION AUGUST 12, 2002 Case No. V/02-52. A variance to the front yard setback (30 feet required, 18 feet requested) for the construction of a porch at 504 West Olive Street in the RB, Two Family Residential District. Eric and Amy Thole, applicant. Mr. and Mrs. Thole requested a variance to the front yard setback for the construction of a 7-foot deep wrap around porch. Mr. Thole stated that in the future he would like to add pillars to the porch. Motion made by Commissioner Teske, seconded by Commissioner Wald to approve a variance to the front yard setback for the construction of a 7-foot deep wrap around porch with the following conditions: 1. Building plans shall be approve by the Building Official. 2. Materials and architectural style shall be compatible with the existing structure. Motion passed unanimously. Case No. V/02-53. A variance to the front yard setback (30 feet required, 23 feet requested) for construction of an addition at 919 North Martha Street in the RB, • Two Family Residential District. Mariah Remodeling, representing Roberta Heimerl, applicant. A representative for Mariah Remodeling requested a variance to the front yard setback for construction of an 8 foot by 24 foot addition. The existing master bedroom is in front next to the garage and the existing bathroom is at the other end of the home. The variance request is for a bathroom to be constructed next to the master bedroom and also for an entryway into the house. Motion made by Commissioner Gag, seconded by Commissioner Wald to approve a variance to the front yard setback for the construction of an 8 foot by 24 foot addition with the following conditions: 1. Building plans shall be approved by the Building Official. 2. Materials and architectural style shall be compatible with the existing structure. Motion passed unanimously. Case No. V/02-54. A variance to the rear yard setback (25 feet required, 19.1 feet requested) for the construction of a four-season porch at 136 Myrtlewood Court in the RA, Single Family Residential District. James and Jean Hoy, applicant. 4 CITY OF STILLWATER PLANNING COMMISSION AUGUST 12, 2002 Mr. and Mrs. Hoy requested a variance to the rear yard setback for the construction of a 14 foot by 16 foot four season porch. Daniel C. Parker, Assistant to the Superintendent for Finance and Operations of Stillwater Area Schools sent a letter to city hall in stating the district will not raise any objections to the variance request. Motion made by Commissioner Middleton, seconded by Commissioner Bealka to approve a variance to the rear yard setback for the construction of a 14 foot by 16 foot four season porch with the following conditions: 1. Building plans shall be approve by the Building Official. 2. Materials and architectural style shall be compatible with the existing structure. Motion passed unanimously. Case No. V/02-55. A variance to the front yard setback (30 feet required, 20 feet requested) for the construction of a garage at 322 West Sycamore Street in the RB, Two Family Residential District. Monica McClellan, applicant. Ms. McClellan informed the Commission that the wrong set of plans had been submitted to the Planning Commission. She would like to bring the correct plans to the next Planning Commission meeting. Motion made by Commissioner Teske, seconded by Commissioner Wald to table item until the next meeting. Motion passed unanimously. Case No. V/02-56. A variance to the rear yard setback (25 feet required, 14 feet requested) for the construction of a deck at 150 East St. Croix Avenue in the RB, Two Family Residential District. Barbara Quade, applicant. Ms. Quade requested a variance to the rear yard setback for the construction of a 10 foot by 11 foot deck in the rear yard. The deck will have a stairway to it and a hand railing around it. Motion made by Commissioner Middleton, seconded by Commissioner Wald to approve a variance to the rear yard setback for the construction of a 10 foot by 11 foot deck with the following conditions: Plans shall be approved by the Building Official. i Motion passed unanimously. 5 CITY OF STILLWATER PLANNING COMMISSION AUGUST 12, 2002 Case No. V/02-57. A variance to the rear yard setback (25 feet required, 22 feet requested) for the construction on a deck at 1300 Surrey Lane in the RA, Single Family Residential District. Lawrence and Allison Munch, applicant. Mr. and Mrs. Munch requested a variance to the rear yard setback for the construction of a 14 foot by 34 foot deck. The Commission was concerned about the size of the deck. The option was given to Mr. and Mrs. Munch to get a 3 foot variance by the bay window with a maximum length of 14 feet. Motion made by Commissioner Middleton, seconded by Commissioner Bealka to approve a 3 foot variance to the rear setback by the bay window for the construction of a deck not to exceed 14 feet in length with the following conditions: Plan shall be approved by the Building Official. Motion passed unanimously. Case No. V/02-58. A variance to the rear yard setback (25 feet required, 5 feet requested) for the construction garage at 220 4th Street South in the RB, Two Family Residential District. Gregg and Kathy Carlson, applicants. Mr. and Mrs. Carlson requested a variance to the rear yard setback for the construction of a 23 foot by 33 foot garage. There is not an existing garage on the property. The lot that the house is on drops off sharply on the Olive Street side and on the Fourth Street side making access to the lot impossible. The only access is a 165 foot easement and driveway from 5th Street on the north side of the property shard with 208 Fourth Street. Mr. and Mrs. Carlson proposed to construct an attached double car garage to the west side of the property. The design would incorporate the Greek Revival details of the existing house. Craig and Sue Martin, 208 Fourth Street submitted a letter in favor of the variance. The Commission is not have any concerns about the variance. Motion made by Commissioner Middleton, seconded by Commissioner Teske to approve a variance to the rear yard setback for the construction of a 23 foot by 33 foot attached garage with the following conditions: 0 1. Materials and architectural style shall be compatible with the existing structure. Motion passed unanimously. OTHER ITEMS Use of vacant sites for affordable housing Staples Field - The Commission felt if the land is sold for market value that money should be used for other parks. If the Park Board could come up with other alternatives such as possibly closing Aspen and Martha to create a larger park space. Lily Lake - Look into expansion of the park. Possibility of a clubhouse. Brown's Creek Park Shelter - FYI Motion made by Commissioner Wald, seconded by Commissioner Bealka to adjourn the meeting at 8:55 pm. Motion passed unanimously.
