Chairperson Hultman called the meeting to order at 7:00 p.m.
Present: Commissioners Bealka, Gag, Middleton, Peroceshi, Teske, Wald and
Council Representative Zoller
Others: Steve Russell, Community Development Director
Absent: Commissioner Ranum
APPROVAL OF MINUTES
Motion made by Commissioner Middleton, seconded by Commissioner Teske to
approve the June 10, 2002 commission minutes. Motion carried unanimously.
Case No. V/02-42 A variance to the accessory building size requirement (120
square feet allowed, 353 square feet proposed) for the construction of a 16' x 22'
second garage at 415 North Center Street in the RB, Two Family Residential
District. Douglas and Mary Christenson, applicant.
Mr. and Mrs. Christenson are proposing to build a 16' by 22' garage in their back
yard. It would be approximately 13' high at he peak. They do have an existing
two car attached garage that they are unable to add on to on the north side due
to the property line and in the rear they have an above ground swimming pool.
The garage would have garage doors but no driveway.
Motion made by Council Representative Zoller, seconded by Commissioner Middleton
to approve variance to the accessory building size requirement at 415 North Center
Street with the following conditions:
1. The architectural style, materials, and color match the main structure.
2. All plans be reviewed and approved by the City Engineer.
3. No driveway is allowed for the accessory building.
Motion passed. 7 fore, 1 against.
Case No. V/02-43 A variance to the front yard and street side setback (30 feet
required, 18' and 2' 1" requested) for the construction of a garage with living
space above located at 901 6th Avenue South in the RB, Two Family Residential
District. Todd and Audrey Hansen, applicant.
Mr. and Mrs. Hanson were originally granted a variance for a front yard setback
at the April 8, 2002 meeting. Since the meeting the applicant has had a survey

completed. The survey revealed that the property lines were different than the
applicant believed. Instead of seeking a 5'6" setback, the amended setback is
2'11 ". The existing storm sewer is close to the area and the applicant will have to
have it re-routed if the variance is granted. They are also requesting a variance
to the front yard setback on Sixth Street (163" requested) to allow for a new
entry added to the original plan.
John Prosser of 906 5t" Avenue South, was concerned about the effect the
construction will have on the catch basin. Mr. Prosser inquired if the neighbors
would have an assessment for the re-routing of the storm sewer. Mr. Prosser
also inquired about having the utility easement on his property vacated.
The Commission informed Mr. Prosser that it is the responsibility of the
homeowners doing the construction to pay for the utility work. If Mr. Prosser
wants to have his easement vacated he would need to go through the steps
himself.
Motion made by Commissioner Middleton, seconded by Commissioner Wald to approve
variance to the front and and street setback for the construction of a garage with living
• space above at 9016 Avenue South with the following conditions:
1. The architectural style, materials, and color match the main structure.
2. All plans be reviewed and approved by the City Engineer.
Motion passed unanimously.
Case No. SUP/02-44 A special use permit for live music on the patio at 410 South
Main Street in the CBD, Central Business District. Steve Bremer, Grumpy Steve's
Coffee, applicant.
Mr. Bremer requested a Special Use Permit for live music on the coffee shop's
patio, and to have an outdoor speaker that will play music that is being played
inside the shop. The music would be played from 11:00 a.m. to 10:00 p.m. Hours
are fixed and days they would play music would vary. They would play blues,
jazz and acoustics. The music would be background music.
Alan Rose of 312 S. Main Street, was concerned about the extra noise
downtown. Mr. Rose is also concerned about the precedent it sets for other
business.

Thomas Kalinoff of 428 S. Broadway, was also concerned about the extra noise
downtown. Mr. Kalinoff requested that no electronic amplification be used and
limit the hours the music plays to 8:00 p.m.
Motion made by Commissioner Middleton, seconded by Commissioner Wald to approve
special use permit for live music on the patio at 410 South Main Street with the following
conditions:
1. The Special Use Permit shall be reviewed upon complaint.
2. The music noise shall be unobtrusive to the downtown area.
3. The music would need to end by 8:00 p.m. Sunday through Thursday and by
10:00 p.m. on Friday and Saturday.
Motion passed. 7 fore, 1 against.
Case No. V/02-45 A variance to the side yard setback (5 feet required, 15" and
27.5" requested) for the reconstruction of a garage roof with storage space above
located at 202 North Martha Street in the RB, Two Family Residential District.
Kyle Weed, applicant.
• Mr. Weed requested a variance to remove an existing garage roof and replace it
with a trussed roof. The proposed roof pitch would be similar to the existing
house. The existing structure of the garage will remain the same. The walls will
be reinforced to meet code for additional weight. The revised roof will not exceed
the 20 foot requirement.
Jim Mathiowetz of 210 North Martha Street, is opposed to the reconstruction
garage. Mr. Mathiowetz feels that the reconstruction of the roof will block his view
and limit the light that goes into his house.
Judy Gulden of 218 North Martha Street, is concerned about the negative impact
the height of the garage will have on her back yard.
Motion made by Council Representative Zoller, seconded by Commissioner Middleton
to deny variance to the side yard setback for the reconstruction of a garage roof with
storage space above at 202 north Martha Street. Motion passed. 6 fore denial, 2
against.
Case No. V/02-47. A variance to the front yard setback (30 feet required, 10 feet
requested) for the remodeling of an exiting residence at 502 Quarry Lane in the
RB, Two Family Residential District. James Lammers, of Eckberg, Lammers,
Briggs, Wolff & Vierling, representing David A. Smith, applicant.

Mr. Lammers requested a variance to remodel an existing structure that is
located 3 feet from the bluff line. The remodel results in portions of the old
structure being removed and the new structure being setback 9 feet from the
bluff line with a slope greater than 24%. Mr. Smith is trying to bring the home into
compliance with the ordinance.
Council Representative Zoller inquired about the existing patio. Mr. Lammers
stated the existing patio would stay.
Motion made by Commissioner Peroceshi, seconded by Commissioner Bealka to
approve variance to the front yard setback for the remodeling of an existing residence at
502 Quarry Lane. Motion passed unanimously.
Case No. V/02-48. A variance to the rear yard setback (25 feet required, 21 feet
requested) for the construction of a deck at 2185 Interlachen Drive in the RA,
Single Family Residential District. Erich Hoefferle, applicant.
Mr. Hoefferle requested a variance to construct a deck. The house is setback 34
feet from the rear property line. The deck would be 13 feet by 22 feet long,
leaving a setback of 21 feet. Mr. Hoefferle requested a variance because the
bay windows and patio doors stick out. Mr. Hoefferle is unable to use his patio
furniture.
Motion made by Commissioner Bealka, seconded by Commissioner Teske to approve
variance to the rear yard setback for the construction of a deck at 2185 Interlachen
Drive. Motion passed unanimously.
Case No. SUP/02-49 A special use permit for a Bed and Breakfast (Aurora Staples
Inn) located at 303 Fourth Street South in the RB, Two Family Residential District.

Motion made by Commissioner Middleton, seconded by Commissioner Wald to table
item until next meet because applicants were not present. Motion passed unanimously.
Case No. V/02-30 A variance to the rear yard setback (25 feet required, 20 feet
proposed) for the construction of a deck at 201 Boutwell Road in the RA, Single
Family Residential District. Arnez Construction, representing ACR Homes,
applicant. Continued from June 10, 2002 meeting.
Motion made by Commissioner Middleton, seconded by Commissioner Wald to table
item until next meet because applicants were not present. Motion passed unanimously.

Case No. PUD/02-50 A planned unit development for a 3.67 acre mixed use
residential/office development concept located on Stillwater Blvd between Curve
Crest and Wildpines and east of Parkwood Lane. Tim Nolde and Roger Tomten,
applicant.
Mr. Nolde and Mr. Tomten were back in front of the Planning Commission
because of concerns the residents and the Commission had. Mr. Tomten went
over information to address the concerns about trails, traffic and circulation,
compatibility of design, utility improvements and cost to the adjacent property
owners.
Community Development Director Russell reviewed letter from Assistant City
Engineer Sanders addressing issues that were brought forth at the April 8, 2002
meeting.
Motion made by Council Representative Zoller, seconded by Commissioner Teske to
keep #8 as a condition of approval. Motion passed unanimously.
Motion made by Commissioner Gag, seconded by Commissioner Wald to approve
Planning unit Development for 3.67 acres of mixed commercial/residential development
• located west of CR between Curve Crest Boulevard and Wildpines Lane with the
following conditions:
1. The park dedication requirement for the townhouse subdivision shall be provided
with subdivision approval.
2. A CR 5 access permit shall be obtained from Washington County for the
proposed driveways.
3. Fencing or shrubs, berming, retaining wall shall be constructed along the
perimeter of the drive through driveway to screen headlights from adjacent
residential areas.
4. The final design for the bank building shall be reviewed based on the
architectural and site design guidelines.
5. The City Engineer shall review the drainage plan to ensure ponding requirements
are met.
6. Drainage, utility and trail easements shall be provided with the subdivision on
final PUD approval.
7. The detailed townhouse plans shall be reviewed by the fire department for
access requirements regarding road width.
8. A monument type sign made of materials consistent with the bank building shall
be allowed rather than the 20' pylon sign. A building sign indicating the name of
the bank over the main entry may also be allowed.
9. Heritage Preservation Commission conditions of approval are added as
conditions of this approval.

10. No vehicle connection between Parkwood Lane and CR 5.
Motion passed unanimously.
Case No. CPA/02-02 A Comprehensive Plan Amendment changing land use
designation of Outlot B, Long Lake Estates, located on Stillwater Blvd from
Attached Single Family to Business Park Commercial (BP-C). Mike O'Brien, Real
Estate Masters, representing Jennings State Bank, applicant.
Community Development Director Russell gave an overview of the
Comprehensive Plan Amendment.
Art Junker of 1164 Parkwood Lane, requested clarification on hours of operation
and the land use.
Motion made by Commissioner Middleton, seconded by Commissioner Gag to approve
Comprehensive Plan Amendment changing land use designation of Outlot B, Long Lake
estates. Located on Stillwater Boulevard from Attached Single Family to Business Park
Commercial. Motion passed unanimously.
Case No. ZAM/02-02 A Zoning Map Amendment to rezone Outlot B Long Lake
Estates, from Town House (TH) to Business Park Commercial (BP-C). Mike
O'Brien, Real Estate Masters, representing Jennings State Bank, applicant.
Community Development Director Russell gave an overview of the Zoning Map
Amendment.
Motion made by Commissioner Middleton, seconded by Commissioner Bealka to
approve Zoning Map Amendment to rezone Outlot B, Long Lake Estates, from
Townhouse to Business Park Commercial. Motion passed unanimously.
Consideration of South of Boutwell Area Plan (continued from 6/17/02 public
hearing).
Additional traffic information was presented to the Commission in order to make
a decision about South of Boutwell Area Plan.
Sherri Buss reviewed traffic information that was gathered by Engineer Sheldon
Johnson. Sheldon Johnson believes that the Neal Extension will disperse the
traffic amount evenly.

Motion made by Commissioner Middleton, seconded by Commissioner Wald to direct
Sherri Buss and Community Development Director Russell to approve all aspects of the
South of Boutwell Area Plan and to direct the Neal Extension between Northland and
Maryknoll, with a secondary option to improve Boutwell. Motion passed unanimously.
Motion made by Commissioner Middleton, seconded by Commissioner Peroceshi to
adjourn the meeting at 10:35 p.m.
