HomeMy WebLinkAbout2002-06-10 CPC MINCity of Stillwater Planning Commission June 10, 2002 Chairperson Hultman called the meeting to order at 7:00 p.m. Present: Commissioners Bealka, Middleton, Ranum, Peroceshi, Teske and Council Representative Zoller Others: Steve Russell, Planner Absent: Commissioners Gag and Wald APPROVAL OF MINUTES Motion made by Commissioner Ranum, seconded by Commissioner Bealka to approve the May 13, 2002 commission minutes. Motion passed unanimously. AGENDA Case No. SUPN/02-25. A special use permit and variance to lot size to construct a duplex on a 34,359 square feet lot (35,000 square feet required) with an exiting 5- unit apartment building at 516 West Myrtle Street in the RB, Two Family • Residential District. Steve Throne, applicant. Mr. Throne requested a special use permit and variance to construct a duplex at 516 W. Myrtle Street. There are six existing rental units on the property. Mr. Throne would like to reduce the existing units to five, but if it is required he will reduce the existing units to four. There were several residents in the audience that opposed the addition of another rental unit on the property: Dave Johnson, 104 N. Harriet Street, opposed the construction because of safety reasons and the addition of rental property in the neighborhood would affect the value of the surrounding properties. Dave Walquist, 121 N. Martha Street opposed variance and special use permit because of safety issues and the proposed building is 2/3 the size of the existing building and doesn't belong in a neighborhood with historic single family homes. Requested that the Planning Commission deny variance and special use permit. Pat Weed, 202 N. Martha opposed because of safety issues, historic flavor in area, there is no need for additional rental units because there is always a for rent sign. 1 City of Stillwater Planning Commission June 10, 2002 John Humphreys, 209 N. Martha opposed for all reason previously listed. Kyle Weed, 202 N. Martha, opposed because it does not fit the Victorian flavor of Stillwater. Requested not to allow a structure to be built. Beth Clendenen, 207 N. Martha, opposed because it will not enhance neighborhood in any way. Motion made by Council Representative Zoller, seconded by Commissioner Ranum to deny variance request to allow 7 units on a 34,359 square foot lot. Motion carried unanimously. Motion made by Commissioner Teske, seconded by Commissioner Ranum to deny special use permit to allow two structures to be on one lot. Motion carried unanimously. Case No. V/02-29. A variance to the accessory building (120 square feet allowed, 240 square feet requested) for the construction of a 12' x 20' x14'6" high storage shed at 2307 Hidden Valley Lane in the RA, Single Family Residential District. Steven E. De Mars, applicant. Mr. De Mars requested a variance to build a 240 square foot accessory building. Mr. De Mars review information he provided for the Commission. The accessory building would meet all setback requirements. One pine tree will be removed. Commissioner Middleton expressed his concern about granting a variance for an accessory building because it may set a precedent for other neighbors. Commissioner Ranum does not believe that a hardship exists in this situation. Motion made by Commissioner Peroceshi, seconded by Commissioner Bealka to approve variance request to allow construction of 240 square foot accessory building. 5 fore, 2 against. Motion carried. Case No. V/02-30. A variance to the rear yard setback (25 feet required, 20 feet proposed) for the construction of a deck at 201 Boutwell Road in the RA, Single Family Residential District. Chris Arnez representing ACR Homes applicant. Mr. Arnez requested a variance for 20 foot rear yard setback for construction of a deck. There is a walk-out two stories up and without the variance it would only allow a four foot deck. The size of the deck would be kept to a minimum. Bill Laquer, Developer for Wildwood Pines, informed Mr. Arnez that there are covenants on the lots and requires a plan to be reviewed by Agriculture Review Committee for approval. • 2 City of Stillwater • Planning Commission June 10, 2002 Diane Axdahl, lives on Mallard Court, opposed construction of deck because of drainage issues. Ms. Axdahl is concerned about increased flooding on her property. Council Representative Zoller recommended tabling item until issues with covenants are resolved. Motion made by Commissioner Teske, seconded by Commissioner Bealka to table variance request for the construction of a deck until issues regarding covenants on the lot are resolved. 6 fore, 1 against. Motion carried. Case No. V/02-31. A variance to the side yard setback (30 feet required, 20 feet requested) for the construction of a residence at 703 Green Twig Way in the RA, Single Family Residential District. Bob Miller, Real Estate Lawyer and Steven A. Chestnut, applicant. Mr. Chestnut requested that a variance be granted for a 20 foot front yard set on Kallie Court because of the irregular shape of the lot. There are no houses on Kallie Court that would be impacted by the variance. Position of the structure and drive way was discussed. Structure would be consisted with the homes to the north. Charlie Corcoran, 2221 Kallie Court opposed because of aesthetic reasons. Mr. Corcoran is concerned about aspen and oak trees that would be removed during construction. Commissioner Teske is concerned because there is no plan for the structure and did not feel comfortable granting a variance without seeing a design. Motion made by Commissioner Middleton, seconded by Commissioner Bealka to approve variance request for 20 foot front yard set back on Kallie Court. 6 fore, 1 against. Motion carried. Case No. V102-32. A variance to expand a nonconforming residence by adding a 240 square foot bedroom at 216 West Wilkins Street in the RB, Two Family Residential District. Marcia Kilbourne, applicant. Ms. Kilbourne requested a variance for expansion of existing nonconforming building for medical reasons. Ms. Kilbourne was willing to keep the total number of bedrooms at 3, if she would add a bedroom on the main floor. Ms. Kilbourne would knock down a wall between two of the bedrooms upstairs. • 3 City of Stillwater Planning Commission June 10, 2002 John Shimota lives directly across the street from 216 W. Wilkins St., opposed any kind of additions. There have been a number of additions over the years and it never seems to end. Mr. Shimota is concerned about the number of occupants. Motion made by Commissioner Ranum, seconded by Commissioner Teske to deny variance request to expand nonconforming residence. 6 fore, 1 against. Motion carried. Case No. SUB/02-34. A subdivision of Lot 12, Blk 1, Liberty on the Lake, The Woodlands, into two lots. Lot A being 5,501.93 square feet to be combined with adjacent lot. David Hempel representing CPDC, applicant. Mr. Hempel requested a subdivision of Lot 12 to be combined with the adjacent lot. Subdividing the lot would reduce tree removal and grading. Parcel A would be shaved of and combined with lot 3. No set backs would be affected. The Commission was concerned about Lot 12 becoming nonconforming in the future. There will be no need for a variance for Lot 12 in the future to make it buildable. Motion made by Commissioner Middleton, seconded by Commissioner Ranum to approve subdivision of Lot 12 and combine with the adjacent lot. Motion carried unanimously. Case No. V/02-35. A variance to the parking requirements (31 parking spaces required, 12 requested) at 220 East Myrtle Street in the CBD, Central Business District. Mark Balay representing David Hurley, applicant. Mr. Balay requested a variance to parking requirements to allow 12 parking spaces. The Commission did not have any concerns with the variance. Motion made by Council Representative Zoller, seconded by Commissioner Middleton to approve variance request for 12 parking spaces. Motion carried unanimously. Case No. SUP/02-36. A special use permit for the construction of a 14,500 square foot classroom and community life center assembly addition to an existing 16,350 square foot building and expansion of parking to 209 spaces at 1616 Olive Street West in the RA, Single Family Residential District. Tom Peterson with Station 19 Architects representing Our Savior's Lutheran Church, applicant. 4 City of Stillwater Planning Commission June 10, 2002 Mr. Peterson requested a special use permit for expansion of the church. No variance is needed. Mr. Peterson and applicant is concerned with bituminous trail to be constructed along west property line and the width of the driveway off of Olive Street. City is requesting a public access easement from the church so the City can install a trail. The Commission expressed their concerns about two lanes of traffic turning onto Olive St. County would like to have one in-bound drive and one out-bound drive. Mr. Peterson is going to contact the County for clarification. There was also concern about emergency access into the parking lot. The Fire Department has reviewed plans and did not have any negative comments. There were also concerns about the parking lot and neighborhood exposure. There were will be landscaping to hide the parking lot. Richard Miller, 801 Autumn Way, is concerned about the expense about the trail. Mr. Miller attended at neighborhood meeting and the neighbors were not informed about the trail. Mr. Miller is also concerned about safety issues because the trail will empty on to a busy street. Cara Torseth, 100 Myrtlewood Court, requested clarification on the building plans and traffic emptying onto County Road 12. Donna Moritz, 1719 W. Olive, is concerned about the additional traffic on Olive St. Ms. Moritz is concerned about the entrance to the parking lot and landscaping to camouflage the parking lot. Motion made by Commissioner Middleton, seconded by Commissioner Ranum to approve with the following conditions: 1. The driveway connecting the east and west parking lots shall be removed. 2. The driveway off of Olive St. shall be reconfigured to reduce driveway width to accommodate one way traffic with the approval from Washington County, city staff and fire department. 3. An 8 foot easement for trail to connect Olive to Myrtle. 8 foot easement would be in the 30 foot set back. 4. The drainage plan shall be reviewed by the City Engineer and coordinate with the city areas drainage improvements if feasible. 5. A detailed landscape plan and tree preservation plan shall be submitted before 40 building permits are issued. 5 City of Stillwater Planning Commission June 10, 2002 6. The east parking lot shall be signed and restripped to accommodate proposed parking. Motion carried unanimously. Case No. SUP/-02-37. A special use permit for the construction of a 28,572 square foot, two-story office and professional building located on Curve Crest Blvd and TH 36 in the CRD, Campus Research and Development District. Dick Zahring, Welsh Co., and Lynn Sloat representing MSP Development Co., LLC, applicant and James Bradshaw also present. Mr. Bradshaw gave a brief overview of landscaping and parking lots. Roofing materials and siding are congruent with funeral home. Signage will be uniform for overall project. Mr. Zahring reviewed background information with Commission. Hey would like to start construction on the building towards the end of July. Occupancy would be near the end of the year, at the latest February. The building is a prairie style structure. Mr. Zahring does not believe that there will be any problems meeting conditions. Mr. Sloat gave an overview of lighting and equipment on the roof. The slant of the roof would prevent equipment form being seen from the ground. The lighting on the property would be down-lit. A lighting plan will be brought back to the Heritage Preservation Committee for approval. Harry Furgala, 12525 62nd Street, and friend Dave Ness are concerned about amount of traffic on trails and water following onto his property. Mr. Furgala is concerned about traffic because any one who uses the trail can look directly in to his home. Mr. Bradshaw is willing to work with Mr. Furgala and city staff to resolve this issue. Council Representative Zoller complimented the design of the building and layout. He believes it will be a nice addition to the area. Motion made by Commissioner Middleton, seconded by Commissioner Ranum to approve special use permit for construction of 28,572 square foot, two story professional building with the following conditions: All utilities shall be completely screened from public view. 6 City of Stillwater Planning Commission June 10, 2002 2. A lighting plan showing the fixture type, height, location and exterior lighting intensity shall be submitted with building permit plans for Planning Director approval. 3. All landscaping shall be installed before utility release or final project inspection; no project shall be phase unless the Planning Commission grants approval. 4. Continuous concrete curbing shall be installed to separate parking areas from landscape areas. 5. Handicapped parking spaces and signage, incompliance with state requirements, shall be shown on building permit plan and installed before final inspection of the project. 6. The street address of the building shall be displayed in a location conspicuous from the public street. 7. The trash enclosure shall be made of a sturdy opaque masonry material, with trash receptacles screened from view and compatible with the color and materials of the project. 8. Fencing, as indicated on the plans, shall protect all trees required to remain on site, or other necessary measures shall be taken to prevent damage during construction activity. 9. No roof equipment shall be visible to the general public. 10. All gutters, downspouts, flashings etc. shall be painted to match the color of the adjacent surface. 11. Construction projects shall conform to the City's noise ordinance; construction during the dry season shall mitigate excess dust problems. 12. Grading and drainage plan to be approved by City Engineer before building permits are issued. 13. Sign package to be approved by the Heritage Preservation Commission including directional signs. 14. Exterior lighting plan to be reviewed and approved by city staff before building permit is issued. 15. All security lights on building shall be downlit. 16. A sign permit is required for signage. 17. All exterior modifications to the approved plan are to be reviewed by Community Development Director. Motion carried unanimously. Case No. V/02-38. A variance to the sign regulations for the placement height of a sign (15 feet allowed, 30 feet requested) at 102 South Second Street in the CBD, Central Business District. Mark Balay, representing Harvey Woodruff, applicant. Mr. Balay requested a variance to the sign regulations to place a 30 foot sign at 102 South Second Street. Mr. Balay believes that it would be serious 7 City of Stillwater Planning Commission June 10, 2002 architectural mistake to place the sign at a lower level due to the slope of Myrtle Street. Motion made by Commissioner Teske, seconded by Commissioner Ranum to approve variance to sign regulations for placement height of sign to be 30 feet at 102 South Second St. Motion carried unanimously. Case No. V/02-39. A variance to the sign regulations for the placement height of a sign (15 feet allowed, 30 feet requested) at 221 North Main Street in the CBD, Central Business District. Dan Schulte, Kagan Binder Attorneys. Mr. Schulte requested a variance to place sign above second story windows. Kagan Binder Attorneys would like the sign for name recognition. Heritage Preservation Committee approved design of a 3 foot sign contingent upon Planning Commission approval of variance. The Commission believes that it may be confusing for customers. Customers may not go through the correct doors. Commissioner Teske believes that a sign could be placed that is within the sign regulations. Motion made by Council Representative Zoller, seconded to Commissioner Bealka to approve variance with the following conditions: 1. The architectural style, materials and color match the existing structure. 2. All plans shall be reviewed and approve by the Building Official and a building permit shall be obtained. 3. The sign shall be not larger than 3 feet in height, with no lighting. 2 fore, 5 against. Variance is denied. Motion carried. Case No. SUP/02-40. A special use permit for residential use in an existing building at 207 Nelson Street East in the CBD, Central Business District. Steve Bremer, applicant. Mr. Bremer requested a special use permit for residential use at 207 Nelson Street. Commission does not have any issues with this request. 8 City of Stillwater Planning Commission June 10, 2002 Motion made by Commissioner Peroceshi, seconded by Commissioner Teske to approve the special use permit. Motion carried unanimously. Case No. V/02-41. A variance to the front yard setback (30 feet required, 8.8 feet requested) for the replacement of an existing porch at 1213 South Fifth Street in the RB, Two Family Residential District. Bruce and Teresa Jacobsen, applicant. Ms. Jacobsen requested a variance to the front yard setback to replace existing porch. They would like to remove the existing porch and build a new porch. The existing deck is difficult to use. The new porch would not encroach in the front yard set back more than the existing porch does. Motion made by Commissioner Ranum, seconded by Commissioner Bealka to approve variance to front yard setback. Motion carried unanimously.
