Mr. Fontaine called the meeting to order at 7 p.m.
_Approval of minutes: Mr. Wald, seconded by Mr. Rheinberger, moved to approve the minutes of
Nov. 9, 1998; all in favor.
Case No. SUP/98-68 A special use permit to construct a three-slip dock, landing and parking
area at 1513 N. Main St. in the RB, Two Family Residential/Bluffland Shoreland District. Randy
Boller, applicant.
Jan Paquette, 601 Wildwood Lane, represented the applicant.
There was discussion regarding conditional of approval No. 3 - that the site be enlarged to
maintain the 20 percent impervious surface maximum... Ms. Paquette said the applicant is
requesting to use only 5 percent of the total site for parking; the area won't be blacktopped, it
will be gravel or some other surface. Mr. Russell noted that if the property is subdivided at some
point in the future, the 20 percent surface maximum could become an issue. Mr. Russell
suggested that a condition could be added that if gravel does not work, the applicant would be
required to come back before the Commission. Mr. Weidner suggested requiring that the lot be
paved to be in conformance with the other downtown lots. Ms. Paquette said the applicant does
not want to pave the area for aesthetic reasons - to be in keeping with the rest of the property;
also, the parking area will not be maintained (plowed) in the winter. It was decided to amend
condition of approval No. 3 to state that the site shall not exceed 20 percent impervious surface,
and that the surface material be acceptable to the city engineer.
Mr. Roetman asked about the number of slips, and which agency determines the number of
allowable slips. Ms. Paquette said the applicant does desire three slips. Mr. Russell stated the
City is responsible for considering requests for less than five slips. Ms. Paquette said the
requested third slip is for the applicant's hot tub; the hot tub is not a structure, it floats in the slip.
Mr. Rheinberger said he did not think the hot tub was an issue. Mr. Fontaine said the issue is that
that the applicant can't run two commercial boat operations. Mr. Rheinberger, seconded for
discussion by Mr. Zoller, moved to change condition of approval No. 4 to allow three slips.
Motion passed 7-2, with Mr. Zoller and Mr. Weidner voting no.
Mr. Rheinberger, seconded by Mr. Zoller, moved approval of the request as conditioned,
40 amending the wording of condition of approval No. 3 and allowing three slips; motion passed
unanimously.

Case No. V/98-71 A variance request for an attached one-car garage (294 square feet) and new
detached 936 square foot garage (one garage of 1,000 square feet maximum allowed) at 123
Birchwood Dr. in the RA, Single Family Residential District. Gary Midbrod, applicant.
Mr. Midbrod was present. He pointed out that the City apparently never obtained an easement to
construct the cul-de-sac; the street is situated on a portion of his property. He said neighbors
have no objections to his plans. Pat Viers, 124 Birchwood, spoke in favor of the proposal. Mr.
Midbrod said he is not planning to put a bath in the garage, and he is planning to do landscaping.
Mr. Zoller, seconded by Mr. Rheinberger, moved approval as conditioned; all in favor.
Case No. SUP/98-72 A special use permit request for use of a residence for office space with no
patient care or evening or overnight use at 1104 S. Everett St. in the RA, Single Family
Residential District. Lakeview Hospital applicant.
Richard Weinhandl was present representing the applicant. Mr. Roetman questioned a request for
a commercial use in a residentially zoned area. Mr. Russell noted that hospital use is a permitted
use in residential zoning with a conditional use permit.
• Mr. Zoller asked which departments would be housed in the building. Mr. Weinhandl said
possibly quality assurance and perhaps the chaplaincy services; the use would not involve
frequent coming and going of employees at that location, he said.
Mr. Rheinberger, seconded by Mr. Valsvik, moved approval as conditioned.
Case No. SUP/98-73 A special use permit for a Type III home business at 217 W. Churchill St.
in the RB, Two Family Residential District. Stephanie Bish, applicant.
Mr. Fontaine pointed out that according to the ordinance, one employee is allowed for a Type III
home business, therefore, conditional of approval No. 3 should be eliminated.
Mr. Roetman, seconded by Mrs. Bealka, moved approval as conditioned, eliminating condition
No. 3; all in favor.
Case No. SUP/V/98-74 A special use permit for expansion of health space with a variance to
front and rear yard setback requirements for renovation of existing residence at 112 S. Greeley
St. in the RB, Two Family Residential District. Heidi Rosebud, applicant.
Ms. Rosebud was present and provided drawings of the plans. She said she had talked with all
the neighbors and none objected to the proposal. Mr. Fontaine asked about lighting. Ms. Rosebud
said sofit lighting is needed for the handicap access ramp; lighting will be soft. She also stated
she will be coming back with a sign plan.

Mr. Weidner abstained from the discussion. Mr. Zoller, seconded by Mr. Rheinberger, moved
approval of the requested variances; vote was 8-0, with Mr. Weidner abstaining. Mr. Zoller,
seconded by Mr. Hultman, moved approval of the Special Use Permit; vote was 8-0, with Mr.
Weidner abstaining.
Discussion regarding cluster development at the Bergmann/Gadient properties
Mr. Russell opened the discussion by noting there is no specific plan to review at this time. It is a
concept, which was presented to the Open Space Committee earlier, to possibly allow higher
density housing in order to preserve the Gadient woods and provide for park use in the area west
of the Legends housing development.
Present for the discussion were Dan Herbst of Pemton, Wayne Soojian of Ryland Homes and
Dwight Jelle of Westwood Professional Services.
Mr. Herbst told the Commission his company has a purchase agreement for the Bergmann
property and a right of first refusal on the Gadient property. He said Pemton/Ryland Homes
would like to move forward with development of the Bergmann property. If Pemton eventually
controls both properties, he said plans would be for an active park on the Bergmann property and
passive park use for the Gadient property. There would be a trail system connecting to both 62nd
40 Street and Manning Avenue as well as an internal trail system.
Mr. Herbst briefly reviewed two concept plans for the Bergmann property. One plan provides for
2.99 acres of park use, 140 attached units and "generous open space" between the units. A
second plan would provide for a 7-acre park, plus 1.7 acres of ponding by clustering the housing
units.
Members were generally in favor of the second concept plan. Mr. Weidner noted that the
Gadient property and preservation of the woods would be a key to the development. Mr.
Roetman asked about the increase in density. Mr. Herbst said the Comprehensive Plan indicates
a density of 100 units; the concept plans is for 46-50 units more than indicated in the
Comprehensive Plan. Mr. Roetman noted that the proposal might generate some opposition as
indicated by discussions during the Comprehensive Plan update where there was concern
regarding density and its impact on residents. Mr. Fontaine also expressed some concern
regarding the design of the housing units.
