HomeMy WebLinkAbout1998-09-14 CPC MIN• Planning Commission Sept. 14, 1998 Present: Chairman Jerry Fontaine Glenna Bealka, Russ Hultman, John Rheinberger, Darwin Wald, Tom Weidner, and Terry Zoller Others: Planner Sue Fitzgerald Absent: Kirk Roetman and Don Valsvik Chairman Fontaine called the meeting to order at 7 p.m. Approval of minutes: Mr. Rheinberger, seconded by Mrs. Bealka, moved approval of the minutes of Aug. 10, 1998; all in favor. Case No. V/98-54 A variance to the side yard setback (30 feet required, 17.5 feet requested) for construction of a third stall garage plus storage behind an existing garage at 600 Northland Ave. in the RA, Single Family Residential District. Jeffrey and Laurie Hill, applicants. Mr. and Mrs. Hill were present. Mr. Hill explained that the garage will be 25 feet from the street, 18 feet from the property line. An existing fence will not be moved. When questioned, he said they would like the garage addition because they plan to purchase a boat. Mrs. Bealka, seconded by Mr. Zoller, moved approval as conditioned. Mr. Zoller noted that while there is no proven hardship involved, this is government of the people. Also, the addition will be within the existing fence line. Motion passed 6-1, with Mr. Weidner voting no, stating there is no legal hardship. Case No. V/98-55 A variance to the side yard setback (10 feet required, 6 feet requested) for construction of a deck attached to a three-season porch at 1410 Riverside Dr. in the RA, Single Family Residential District. John and Ann Kraemer, applicants. Mr. Kraemer was present and explained the request. Access to the deck is limited by the slope of the property, he said. The adjacent neighbor's house is 14 feet from the property line, and there are trees alone the property line. Side yards are not used in the neighborhood, he said, and the addition will not impact anyone's view. Mr. Rheinberger, seconded by Mrs. Bealka, moved approval of the variance as requested by the Kraemers. Motion passed 5-2, with Mr. Wald and Mr. Weidner voting no. Case No. V/98-56 was withdrawn. Case No. V/98-57 A variance to the side yard setback (5 feet required, 2 feet requested) for construction of a garage at 104 No. Owens St. in the RB, Two Family Residential District. • William Swartz, applicant. Planning Commission • Sept. 14, 1998 Mr. Swartz was present. He said his neighbors do not object to the proposal. There is adequate room from the front of the garage to the sidewalk for one car. Mr. Rheinberger, seconded by Mr. Wald, moved approval as conditioned. Motion passed 6-1, with Mr. Weidner voting no. Case No. V/DR/98-58 A variance to the bed and breakfast ordinance to increase the number of bedrooms from five to six at 319 W. Pine St. (The Ann Bean House) in the RB, Two Family Residential District. Ken and Kim Jadwin, applicants. Mr. and Mrs. Jadwin presented a petition signed by a number of neighbors indicating they were not opposed to the request. Patricia Jewell-Peterson, 320 W. Pine St., read a letter of opposition for the record. There was some discussion as to the reason for the five-bedroom limit in the city's ordinance. Ms. Fitzgerald pointed out that the Ann Bean B&B is larger than most B&Bs in the city. Mr. Wald said he recalled that fire protection was one of the reasons for the restriction; Mr. Hultman said if there are over five bedrooms, code requires sprinkling the structure. . Mr. Jadwin said he had looked at the request for a sixth room at the Sauntry Mansion and there was no mention of requiring sprinkling; meeting fire code is a separate issue, he said. Mr. Jadwin noted that they could use the sixth room as an apartment, but would prefer to use it as a B&B guest room. Mr. Rheinberger, seconded by Mr. Wald, moved to deny the request. Mr. Weidner suggested that if square footage is an issue, it would be more appropriate for the City Council to change the ordinance than grant a variance. Motion to deny passed 6-1, with Mrs. Bealka voting no. Case No. SUB/V/98-59 was postponed due to an issue with an easement. Case No. V/98-41 A variance to the front yard setback (30 feet required, 10 requested) for construction of a two-story garage at 300 E. Willow St. in the RA, Single Family Residential District. Margaret Zoltai, applicant. Continued from the August meeting. Ms. Zoltai said the new proposed location is back 12 feet farther than initially proposed, but it has since been discovered that the property line is also back 12 feet farther than thought. It was noted that a neighbor, Joseph Raduenz, who had objected earlier, has withdrawn his objection. Mr. Rheinberger, seconded by Mrs. Bealka, moved approval as conditioned. Mr. Fontaine noted that here are few houses on the street that meet the setback requirement. Motion passed 6-1, with Mr. Weidner voting no. • 2 . Planning Commission Sept. 14, 1998 Other business: • Letter regarding new lights at the Oasis Market on Croixwood Boulevard/Highway 5 - Ms. Fitzgerald said the owners have been informed of the need to shield the lighting. • 62"d Street Plan - Sherri Buss of Bonestroo, Rosene, Anderlik & Associates reviewed the revisions to the plan made subsequent to the Planning Commission workshop on Aug. 31. Mr. Fontaine asked that a statement be added to the plan regarding working with the Browns Creek Watershed District on long-term and inter-community water management issues. Members were in consensus to proceed to public hearing with the revised plan as presented. It was agreed to hold the public hearing at the regular October Planning Commission meeting, unless the regular agenda is too lengthy; Mr. Fontaine will make that decision. • Bridge corridors - There was a brief discussion regarding the impact of the alternative bridge corridors being proposed by Mr. Braun. Mr. Fontaine said he felt the Planning Commission should take a formal position on the issue. Mr. Zoller agreed that was appropriate for the Commission to make a statement. Mr. Zoller moved that the Planning Commission go on record recommending selection of the original corridor and that the chairman write a letter to Mr. Braun outlining the Planning Commission's concerns regarding the impact the alternative corridors would have on downtown, the Aiple property and Lowell Park. Mr. Rheinberger seconded the motion; motion passed unanimously. Mrs. Bealka, seconded by Mr. Weidner, moved to adjourn at 8:40; all in favor. Respectfully submitted, Sharon Baker Recording Secretary 3
