PLANNING COMMISSION
April 14, 1997
Present: Jerry Fontaine, chairman

Chairman Fontaine called the meeting to order at 7:05 p.m.
Mr. Wald, seconded by Mr. Valsvik, moved approval of the minutes of March
10, 1997; all in favor.
Case No. SUP/97-12 A special use permit request for a home-based
business at 2266 Eagle Ridge Trail in the RA, One Family Residential
District. Gilbert and Ellen Damsgard, applicant.
Mr. Damsgard was present for the discussion. He said there would be very
few deliveries made to the home.
Tom Henderson, 1206 Eagle Ridge Trail, spoke in opposition to the request.
He stated that having such a business is against the covenants of that
development. He questioned whether the city is responsible for enforcing
the covenants.
There was some discussion as to how the covenants might affect the
request. Mr. Rheinberger suggested that it would be up to the homeowners
to pursue the matter in court, if they so choose.
Mr. Roetman, seconded by Mrs. Bealka, moved approval as conditioned.
Motioned passed 6-2, with Mr. Wiedner and Mr. Valsvik voting no.
Case No. PUD/97-13 A planned unit development request for four twin
homes located at 1321 S. Fifth St. in the RB, Two Family Residential
District. James Blichfeldt, applicant.
Present for the discussion were Mr. Blichfeldt and his engineer/surveyor
Mark Kemper. Mr. Blichfeldt gave a brief presentation outlining his plans.

Speaking in opposition were: Al Ehnert, 1324 S. Fifth St.; Ron and Sandy
Anderson, 216 W. Orleans; the resident of 1222 S. Fourth St.; and two
residents who did not identify themselves or their address.
Concerns centered on the size of the project and number of units placed on
that property; the proximity of the units to neighboring properties; the
potential for increases in property taxes due to the probable cost of the
units; the potential for additional assessments, such as sidewalks.
Carol Anderson, 1312 S. Fourth St., spoke in favor of the project. Larry and
Richard Rose, owners of the property, said it is not economically feasible
to build single-family homes on the site considering the cost of removing
the greenhouse; they also stated that even if Mr. Blichfeldt does not
purchase the property, the greenhouse will not be operating next year and
will be vacant.
Mr. Kemper noted the proposed twin-homes would have less of a building
"footprint" on the property than the existing structures.
Planning Commission members' concerns centered on the compatibility of
the design with the neighborhood, as well as the proposed number of units.
• Mr. Rheinberger, seconded by Mrs. Bealka, moved to deny the request as not
being compatible with the neighborhood; motion passed unanimously.
Mr. Rheinberger, seconded by Mr. Roetman, moved to deny the accompanying
subdivision request, Case No. SUB/97-14. Motion passed unanimously.
Case No. SUP/97-15 A special use permit for a popcorn wagon at 401 S.
Main St. in the CBD, Central Business District. Mike Bastian, applicant.
Mr. Bastian was present for the discussion and noted the applicant was
incorrectly listed as John Shinn in the agenda packet. Mr. Bastian said the
operation would be the same as last year when he operated the business.
Mr. Wald, seconded by Mr. Roetman, moved approval as conditioned. Mr.
Roetman suggested adding a condition that the SUP is non-transferable.
Motion as amended passed unanimously.
Case No. V/97-16 A variance to the side yard setback (two feet requested,
five feet required) to extend a garage at 318 W. Sycamore St. in the RB,
Two Family Residential District. Sally Studtman, applicant.

Ms. Studtman explained that she will be keeping the existing garage and
would like to extend it three feet forward to the lattice work on the
house. The existing garage is already out of compliance. No neighbors have
objected to the proposal.
Mr. Valsvik, seconded by Mr. Wald, moved approval as conditioned; motion
passed unanimously.
Case No. V/97-17 A variance to the accessory building size requirement
(120 square feet allowed, 320 feet requested) for construction of a pool
house at 1907 N. Fourth St. in the RB, Two Family Residential District.
George and Kathleen Middleton, applicant.
The Middletons were present for the discussion.
Mr. Russell noted that the size of the lot and the fact that the pool and
pool house are concealed from neighboring properties might be a
consideration.
Mr. Wiedner suggested there would be little to gain by reducing the size of
the requested structure, other than to have a smaller structure that is
less attractive and less useful.
10 Mr. Valsvik, seconded by Mr. Roetman, moved approval of the requested
variance; motion passed unanimously.
Case No. V/97-18 A variance to the garage size requirements (1,000
square feet allowed, 1,125 requested) for construction of a three-car
garage with half bath to be used as a hobby room and home office at 500
W. Poplar St. in the RB, Two Family Residential District. Randall and
Margaret Callies, applicant.
Mr. Callies was present and agreed with the condition that a deed
restriction be recorded on the property limiting use of the garage to a
hobby room or non-commercial home office.
Mr. Roetman expressed his concern that allowing the half bath might
expand the future use of the structure. Mr. Russell noted that is why the
deed restriction will be recorded.
Mr. Rheinberger, seconded by Mrs. Bealka, moved approval as conditioned.
Motion passed 7-1, with Mr. Roetman voting no.

Other business
• Mr. Fontaine said Mr. Junker, chairman of the Parks and Recreation Board,
• had communicated with him that the Park Board wishes to have the Long
Lake water surface use issue be part of the Planning Commission's agenda,
rather than having a separate meeting.
It was agreed to have Mr. Fontaine review next month's agenda. If there is
a light agenda, the discussion will be held at the regular meeting. If Mr.
Fontaine thinks the agenda looks too heavy, the discussion will be held on
May 19.
• Mr. Russell said he had attended a workshop on neo-traditional
development. He suggested that after the AUAR is completed, the
Commission should start meeting with the developers on a PUD for the
annexation area.
• Mrs. Bealka said she enjoyed a planning workshop she attended and will
get a copy of the video of the workshop for interested members.
• There was a brief discussion as to the status of Mr. Charpentier's
membership.
Mr. Wald, seconded by Mr. Valsvik, moved to adjourn at 8:45 p.m.
