HomeMy WebLinkAbout1996-12-09 CPC MIN 10 0 PLANNING COMMISSION Dec. 9, 1996 Present: Jerry Fontaine, chairman Glenna Bealka, Dave Charpentier, Kirk Roetman, Don Valsvik, Tom Wiedner and Terry Zoller Others: Steve Russell, Community Development Director Absent: Darwin Wald Chairman Fontaine called the meeting to order at 7 p.m. Mr. Valsvik, seconded by Mr. Zoller, moved approval of the minutes of Nov. 18, 1996; all in favor. Case No. SV/96-74 A petition for a street vacation for a portion of Sycamore Street between the west side of William and County Road 5 and a portion of Carnelian Street from 50 feet north of Sycamore Street to 210 feet north of Sycamore. Elizabeth Whitbeck, applicant. Ms. Whitbeck was present. She explained that adjacent property owners are interested in seeing the vacation granted so they can take care of the property -- plant trees, landscape, etc. Richard Edstrom representing Stillwater Golf Club questioned the impact the requested vacation might have for providing future access to a five+ acre parcel of property the golf club owns and might want to develop in the future. Mr. Russell said access would probably have to be provided by extending Moore Street to the west. Later in the discussion, it was also noted the Minnesota Street is platted for right-of-way and could be used for future access to the parcel. Mr. Valsvik asked whether there would be an easement for future sewer and water on Carnelian Street. Mr. Russell said the city didn't believe that such an easement is needed. Mr. Wiedner questioned the advisability of granting the vacation given the potential for future access problems for the golf course. He moved to deny the petition; motion died for lack of a second. 10 Mr. Roetman, seconded by Mrs. Bealka, moved approval as conditioned based on the land use in the Comprehensive Plan and the fact that Minnesota Street is platted for right-of-way and is available for future access. Motion passed 6-1, with Mr. Wiedner voting no. Case No. SUB/96-75 A subdivision of the territorial prison site into two parcels located at 608 N. Main St. in the CBD, Central Business District. City of Stillwater, applicant. Mr. Russell explained the request is to subdivide the property into two parcels -- the development site and the city-owned property along the perimeter of the property -- in keeping with the development agreement. Mr. Zoller, seconded by Mr. Roetman, moved approval as conditioned; motion passed unanimously. Case No. SUP/96-76 A special use permit for a four-guest room bed and breakfast located at 651 S. Broadway St. in the RB, Two Family Residential District. Katherine Francis, applicant. Ms. Francis was present and pointed out she is the listing agent, not the applicant, The applicant is Aldine West, who was present for the discussion. Mr. Wiedner and Mr. Zoller abstained from the discussion and vote. Mr. Wiedner's firm represents Ms. West; Mr. Zoller is a neighboring property owner. Ms. West explained that she wished to operate a 2-bedroom, seasonal (May through October) bed and breakfast and had plans to restore the home. She said she wasn't aware the house was within 900 feet of another B&B. Mr. Fontaine asked about off-street parking. Ms. West said there was space next to the garage to allow the garage to be enlarged by two spaces. Nick Chaves, 704 S. First St., owner of the Lady Goodwood B&B, said his only concern was with the city's ordinance; his establishment is within 500 feet of Ms. West's proposed B&B. Bruce Brillhart, owner of the Ann Bean B&B, also spoke of the city's ordinance prohibiting B&Bs to be located within 900 feet of each other. The following neighboring property owners spoke in opposition to the proposal: Phil Flodin, 623 S. Broadway; Joel Moline, 300 E. Locust St.; Phyllis and Myron Reubendale, 609 S. Broadway; Paula McHugh, 620 S. Broadway. Concerns centered on parking, traffic and safety problems. Mr. Valsvik noted the city allows B&Bs as a way of restoring historic homes and worked hard to put together an ordinance regulating such operations. He moved to deny the request as it does not meet the ordinance requirements; Mr. Roetman seconded the motion. Vote was 5-0, with Mr. Zoller and Mr. Wiedner abstaining. Case No. Sip/DRia -77 q special use permit and design review for a 14'8" x 10' addition to the Freighthouse caboose. Richard F. Van Doeren, applicant. Mr. Van Doeren and assistant manager John Daley were present for the discussion. Mr. Van Doeren briefly outlined the proposal. Mr. Zoller said he had two problems with the Freighthouse's operation -- the use of satellite toilet facilities and garbage disposal. Mr. Van Doeren said he was not aware of a concern about the satellites but was aware 0 f the garbage problem. He said the owners in addressing the garbage issue and had compacting system before the summer t would also guarantee that port-a-potties if that was a condition of approval. were attempting to be proactive plans to install a self-contained season. Mr. Van Doeren said he would not be used this summer Mr. Roetman, seconded by Mrs. Bealka, moved approval with the two additional conditions that a self-contained garbage unit be installed and that the use of port-a-potties be discontinued. Motion passed unanimously. Mr. Russell noted that the City Council had referred the issue of surface water use on Long Lake back to the Planning Commission and Park and Recreation Board. He suggested that a special joint public meeting be held in January or February. Mr. Roetman suggested that representatives of the DNR be asked to attend the public meeting.
