Chairman Fontaine called the meeting to order at 7 p.m.
Mr. Wald, seconded by Mr. Roetman, moved approval of the minutes of July
8, 1996; all in favor.
Case No.--SUP/96-46 A special use permit for the placement of two signs
located at Orleans Street and Cottage Drive in the RA, One Family
Residential District. Ed Bieging, applicant.
Mr. Bieging was present regarding the request. He said there is no other
signage on the site.
Mrs. Bealka, seconded by Mr. Wiedner, moved approval as conditioned; all in
favor.
Case No. V/96-47 A variance to the sign ordinance to replace an existing
sign face at 2289 Croixwood Blvd. in the CA, General Commercial District.

Jim Nelson represented the applicant.
Mr. Russell noted the Fina gas sign in in conformance with the ordinance.
What is not in conformance with the ordinance is the existing wall sign
and free-standing sign. Mr. Fontaine pointed out when there is a change in
ownership, the new owners must conform to the ordinance. Mr. Roetman
noted that the owners could use the free-standing sign if the lettering is
removed from the building.
Mr. Roetman, seconded by Mr. Wiedner, moved to deny the requested
variance; all in favor.
Case No. V/96-48 A variance to the front yard setback (15 feet required, 3
• feet requested) to install a sign at 13147 McKusick Road N. in the RA, One-
Family Residential District. Beltram Van Tassel, applicant.
On a motion by Mr. Wald and Mr. Roetman the case was tabled until later in
the meeting. When the case come up again, Mr. Van Tassel explained the
request is to place the sign on his boundary line so he won't have to
removed so many trees. The existing post has to be moved three feet in
order to accommodate the county's 15-foot right-of-way.
Mr. Roetman, seconded by Mrs. Bealka, moved approval as conditioned; all
in favor.
Case No. V/96-49 A variance for the extension of the canopy at Food-n-
Fuel located at 1101 N. Owens St. in the CA, General Commercial District.
Bruce Madsen, applicant.
Scott Klindell appeared representing Food-n-Fuel.
Linda Thueson, 1104 N. Owens St., asked whether there would be any
additional lighting.
Mr. Klindell explained there would be no additional lighting on the
perimeter; additional lighting will be under the canopy and downlit. He
also said the intent is to enclose the trash area and perhaps do some
landscaping.
Mr. Roetman asked about the condition of approval regarding bringing
existing signage up to code. Mr. Russell explained the lettering on the
building may be too large.
Mr. Zoller, seconded by Mr. Roetman, moved approval as conditioned. Mr.
Wiedner spoke against approval, saying approval would extend a non-
conforming use and there is no hardship involved. Mr. Wald said he thought
adding an extra pump might create additional confusion for traffic
circulation. Motion passed 4-2, with Mr. Wald and Mr. Wiedner voting
against.
Case No. V/96-50 A variance to the sign ordinance to place a sign on the
property located at 614 W. Mulberry St. in the RB, Two Family Residential
District. Richard Houde, applicant.
Mr. Houde was not present. Mr. Roetman, seconded by Mr. Wald, moved to
• table the case; all in favor.
Case No. SUP/96-51 A special use permit for a graphic design sign for the
building located at 301 S. Second St. in the CBD, Central Business District.
Mark Balay, applicant.
Ed Hocksford represented the applicant.
Mr. Roetman asked why a special use permit is needed. Mr. Russell said the
question is whether the graphic amounts to off-site advertising for the
Andiamo; off-site advertising is not allowable.
Mr. Hocksford said the graphic is intended to complete the mural theme on
the exterior of the building; also Andiamo is the name of the banquet hall.
Mr. Wiedner, seconded by Mr. Roetman, moved approval as conditioned; all
in favor.
Case No. SUP/96-52 A special use permit for a building addition to house
therapy services for facility residents located at 313 S. Greeley St. in the
RB, Two Family Residential District. James Forberg, applicant.

James Forberg, architect, and Cheryl La Follette, representing Beverly
Enterprises, appeared regarding the request.
Frank Rheinberger, representing his mother, Margaret, 818 W. Olive St.;
Greg Lawrence, 814 W. Olive St.; and Lori Bjorkman, 819 W. Olive St.,
spoke against the request. Concerns centered on existing traffic problems
and existing on-street parking by staff/visitors; the potential for
creating additional traffic problems by adding new beds or more staff in
the future.
Mr. Forberg and Ms. La Follette explained the request would not create the
need for any additional parking -- there are no plans for new staff and the
patient population would remain the same as mandated the state's
moratorium on additional nursing home beds Two parking spaces would be
lost, but two spaces would be added to the south parking area. Mr. Forberg
said there is the potential for perhaps five or six additional spaces to the
west and along the building.
Ms. La Follette explained the addition is needed to house therapy services
• for residents required by state and federal mandates; services previously
provided in hospitals, are now provided by nursing homes, she explained.
• Currently there is not adequate space to provide the required services; day
room areas and hallways often have to be used, she said. Several staff
members also described the space problem.
There was some discussion about the required parking spaces based on
staff and visitors.
Mr. Wiedner suggested the facility had outgrown the physical structure
and a move might be more appropriate. Mr. Zoller asked about the
possibility of purchasing the building on the corner (of Greeley and Olive);
the architect said that is not an option as it is a wooden structure and
would not meet fire code.
Mr. Wiedner, seconded by Mr. Zoller, voted to deny the request. Vote was 3-
3, with Mrs. Bealka, Mr. Fontaine and Mr. Roetman voting against denial.
Mr. Russell noted the 3-3 vote amounts to a denial. The applicant can
appeal to the City Council within 10 days, Mr. Fontained explained.
Case No. SUP/96-53 A special use permit for construction of an
elementary school located 1 /4 mile east of Highway 15 on Highway 12.
• Independent School District 834, applicant.
Representing School District 834 were Dan Parker, business manager; Greg
Hollings, engineer; and Rick Dahl of BWBR Architects.
Mr. Parker said the hope is to break ground for the new school sometime
this fall. The Stillwater Township Town Board approved the SUP the week
prior to the Planning Commission meeting.
Mr. Fontaine pointed out that the SEH report defines several traffic issues
and expressed his personal concern about having just one access to the
site. Mr. Parker said the original request was for two access points, but
the county allowed just one. Mr. Hollings said he believed adjustments can
be made to address the issues raised in the SEH report.
Mr. Dahl described the building and site design plans.
Mr. Zoller expressed his concern about the absence of sewer and water on
site and questioned whether the drainage is to Long Lake. Mr. Russell said
the drainage flows under County Road 12 and to the north. Mr. Russell also
• pointed out that one of Stillwater Township's conditions of approval is
that there be no on-site septic; the township's conditions of approval are
included in the Planning Commission's conditions by reference.
Mr. Zoller, seconded by Mr. Wald, moved approval as conditioned; all in
favor.
Case No. ZAT/96-2. A zoning text amendment to Chapter 31, Zoning, of the
Stillwater City Code adding a new Village Commercial District, V-C. City
of Stillwater, applicant.
Present for the discussion were Paula and Robert Kroening; Marc Putnam
of Charles Cudd; and Dave Johnson, Stillwater Township Supervisor.
Mr. Putnam expressed his concern about the front and rear yard setback
requirements which, he said, could create a planning "barrier" in the
context of a Planned Unit Development (PUD). He also asked that the
surface coverage requirement be changed from 60 to 70 percent; 60
percent coverage could make the site unusable, he said. He also asked that
the right-of-way issue be clarified. He also provided written comments
responding to the regulations as proposed.
There was considerable discussion regarding adding language "except when
in a PUD" to the setback requirements and lot coverage.
Mr. Johnson and Mr. Fontaine spoke in favor of allowing flexibility to
provide for PUDs. Mr. Russell said uses in the district could not be
changed; language could be added indicating elements that could be
modified for a PUD.
Mr. Johnson suggested adding the "when not in a PUD" to the setback and
minimum lot area requirements and adding a provision regarding lot
coverage and landscaping unless in a PUD.
Mr. Roetman, seconded by Mr. Zoller, moved approval with the added
language regarding exceptions for PUDs and several language changes
recommended by the Stillwater Township Planning Commission. Motion
passed unanimously.
Case No. ZAT/96-3. A zoning text amendment to Chapter 31, Zoning, of the
Stillwater City Code adding a new Agricultural Preservation District, A-P.
City of Stillwater, applicant.

Mr. Russell explained the district would be something of a "holding zone"
for properties seeking annexation. Mr. Putnam questioned whether there
should be a requirement regarding ghost platting.
Mr. Roetman, seconded by Mr. Zoller, moved approval adding language
regarding ghost platting. The motion was amended to include schools in
the permitted uses. Motion passed unanimously.
Case No. ZAT 96-1. A zoning text amendment to Chapter 31, Zoning, of the
Stillwater City Code adding a new Campus Research and Development
District, CRD, City of Stillwater, applicant.
Jim Bradshaw of Bradshaw Funeral Homes has purchased the entire 29
acre parcel in the proposed Campus Research and Development District. He
outlined his plans for a funeral home and memorial gardens on a large
portion of the parcel. Mr. Bradshaw expressed his concern whether his
proposal would be an allowable use in the new district. William Spangler,
12811 N. 62nd St., spoke in favor of Mr. Bradshaw's plans as meeting the
intent of the new district.

Mr. Wiedner spoke in favor of providing Mr. Bradshaw with some assurance
that the proposal will be a permitted use.
Mr. Johnson also spoke in favor of giving reasonable assurances for Mr.
Bradshaw to proceed. He also questioned the five acre minimum parcel
requirement for the district, suggesting that smaller sites might work.
Mr. Russell said the five acre requirement is aimed at uses that are job-
producing.
Mrs. Bealka, seconded by Mr. Wald, moved approval adding funeral home and
related services to the permitted uses. Mr. Wiedner said he would not like
to see a traditional cemetery as an implied use. Mr. Zoller suggested
removing "related services" from the language. The amended motion passed
unanimously.
Sidney White, 6286 Stillwater Blvd., expressed his concern about the cost
of providing access to the parcel and the potential cost to him.

Case No. ZAM/96-1. A zoning map amendment to Chapter 31, Zoning, of the
Stillwater City Code to designate 20+ acres of land located west of
County Road 5 and north of Trunk Highway 36 a Campus Research and
Development (CRD) District. City of Stillwater, applicant.
Mr. Roetman, seconded by Mr. Wald, moved approval; motion passed
unanimously.
Case No. CPA/96-1. Amendment to City of Stillwater Comprehensive Plan
incorporating the orderly annexation agreement as part of that document.
Mrs. Bealka, seconded by Mr. Roetman, moved approval; motion passed
unanimously.
Review and approval of amendment to existing nark dedication policy,
Mr. Putnam expressed his concern about the requirement for commercial
use, and he urged the Commission to change the required percentages
"dramatically." He also handed out written comments regarding the policy.
Mr. Russell noted a change in the commercial use requirement from 7.5 to
7 percent. He also suggested that the required residential park dedication
be reduced one percentage point to be more in line with other Twin Cities
communities. Mr. Wiedner said he agreed with Mr. Putnam's comments
regarding commercial use, but spoke in favor of the higher dedication
requirements for residential developments.
Mr. Russell said City Attorney David Magnuson has reviewed the proposed
policy and will be asked to review the dedication requirement for
commercial development.
Mr. Roetman moved approval reducing the residential requirement by one
percentage point (9-10-11-12 percent), changing the commercial
requirement to 7 percent and eliminating the second sentence in the
residential trail requirements as recommended, subject to Mr. Magnuson's
review of the revised policy. Mrs. Bealka seconded the motion; all in favor.
Mr. Roetman, seconded by Mr. Wald, moved to adjourn the meeting at 11:30
p.m.; all in favor.
